Has hubby will be applying for settlemnt visa for us by january 2016...what are the chances of me getting a visa? Does settlent visa overrules a ban?

Yes it does..however, that does not mean that you will be given a visa at first application, chances are that you will be refused and given on appeal.

First you need to meet the requirements and be honest in your application.

On first attempt, expect rejection. And even on appeal, they would still flex their muscles, albeit they know their hands are tied, due to change in circumstance(s)

Hello House,
How do I know if they have my correct email address. My initial application was done directly by the lawyer and summited, so all the information from Home office go to the lawyer and they'll them forward the message to me. But the relationship between the lawyer and me had since ended. I am not too sure if Home office have my email address. So how do I make sure they have my correct email? Where do I need to write to?

Unfortunately, all correspondences would still be sent to the Lawyer.
The Home Office would not know you have severed relationship with your Lawyer.
Do you have your application reference number?

I have the application reference number.

Be honest with your immigration record with UK visa application, don't hid any previous refusal.

Getting a lawyer to write an appeal about what? That you were banned wrongly or what?

You are only going to make bad situation worst.

Please I have sent my supporting document since to UK Visa and Immigration POB 3468, Postcode S3 8WA, and since that time, I have not received any email regarding my document being received...Please do you have any idea?
Hoping to hear from you soon.

paparazzom:
Hey guys! hope you are all good.
As promised, here is my wife's UK spouse visa timeline.

After doing a lot of googling I came across this wonderful forum so I went through it from page 1 to 119 I think.
After gathering all the informations I needed, I decided to apply.

May 4th: I filled the online application for her here in the UK, paid the fees with my bank card, submitted it, then printed out the copy.
I sent the printed application along with supporting documents to my wife in Nigeria(I didn't realise I had to send it to
Sheffield myself)
I also booked her biometric day to may 18th at Ikeja.

May 18th: She did her biometric and was also interviewed on skype. she was also told that the supporting documents should be sent to
Sheffield.

May 19th: She received an email from UKVI stating that they have received her application and that they would send another email after
they have made a decision.

June 17th: I received a phone call from a guy asking me to attend an interview in Cardiff on June 22nd regarding my wife's spouse
visa.(I was so excited)
I went through my wife's application form, memorised where we got married and date, her parents names and date of birth,
where my wife was born, her address, and how we met.

Jun 22nd: I was interviewed on skype by one nice guy. He asked me a lot of questions e.g how I met my wife? how I met the financial
requirement? Accommodation and my job. (I was so relaxed) He told me after that, that was the quickest interview he has
ever done that a decision would be made as soon as possible

June 23rd: My wife got an email that a decision has been made and should expect the passport within 3-5 days.
Well she never received an email or text message from NonPerformace for collection so I asked my wife to go there and find
out what's going

July 07th: She went down to there office and showed them the email she got from UKVI.
Anyway she got her passport with visa on it. grin
Happyyyyyyyy grin grin grin grin grin

Congrats newbie,

Please I submitted the document to UK Visa and Immigration POBOX 3468 POSTCODE S2 8WA, I tracked it with royal mail and it's been signed by someone called McKenzie 2days after. However I have not received an email from the Homeoffice to say that they've received my documents. I only received email from ECO that Your online application has been received in Sheffield, UK. Your application is currently being prepared for consideration by an Entry Clearance Officer.

Please note that if you have lodged your Settlement application in the Caribbean region or Nigeria you must ensure that your UK sponsor has sent all relevant supporting documentation to the visa section in Sheffield. We will not start to assess your application until we are in receipt of these.

Please note that UKVI aims to complete all Visit Visa applications within 15 working days and all Settlement Visa applications within 12 weeks of the application date. If it is not possible to complete your application within this timeframe a member of our team will contact you to explain why.

If you have paid for Priority Service, your application will be placed in front of the queue and assessed ahead of other non-priority visa applications. As indicated in the terms of service, the amount paid for the priority service, as well as the visa fees, is not refundable if the visa application is refused or if the decision is delayed.

Please I need your help newbie, is it the right addy, if it is, how come I have not gotten any email?
newbie715:
Hello Everyone,

I really thank God. It's Yay time again grin The visa has come. grin I am really happy I discovered this forum‎. It guided me while I was putting documents together for submission and answered questions I had even after submission. I am particularly grateful to Justwise, Kazan and Girlfio cool for the suggestions then Karen (Portsmouth86) for crossing fingers and toes for me smiley.

Here is my timeline, it took more time than usual but that's because I had a setback so don't be discouraged.‎

March 23rd: I did the chest Xray for TB test then online submission‎

March 24th: ‎I was supposed to pick up the TB certificate and go for biometrics. Because I don't live in Lagos, I took 2 days off so that I could do the Xray, collect the certificate the next day then go on to submit passport and do biometrics but when I went to pick up the certificate, I was told that the Xray was abnormal, they said it was probably because I had pneumonia in 2013 and I had cough when I did the Xray, so I was told that I couldn't get a certificate as they don't work with maybes so they said they'd book me for sputum test, I had to come and cough and give them sample for 3 consecutive mornings and wait for 8 weeks atleast for the result (I couldn't believe my ears sad) but I had no choice so I did it, the result came out almost 9 weeks later so I picked it up and did biometrics on the 11th of June so I lost almost 3 months between online submission and biometrics, I had to keep going online to move my submission date so that my application will still be valid and because of the wait, I fell into the health surcharge period so I paid that as well.

June 11th: Submission, Biometrics and Skype interview‎

June ‎24th: Supporting documents sent to Sheffield

June 25th: We tracked the documents and we saw they had been delivered but I thought I was going to get an email confirming that they had received them. (it was at this point that Karen was crossing fingers and toes for me) It never came so I guess they don't acknowledge it‎

July 23rd: Hubby was called for interview

July 28th: Hubby had the interview‎ and when he asked the interviewer when we were likely to know the outcome, he told him 2 weeks that this is a busy period for them.

August 10th: I got ‎an email from Sheffield saying they had made a decision and that I'd get the passport within 3-5 work days

August 13th: I got 2 emails from Teleperformance, one in the morning saying a decision had been made that I will be contacted when they receive my passport. The second email came in the evening‎ stating that they had my passport so I should come and pick up.

August 17: I picked up the passport and it had Visa that had been issued on 31/07/2015. Yayyyy‎ grin grin

I am very happy and I am glad for all the feedback I got on this forum, what justwise has done here is highly commendable, not only did he create the thread but he constantly checks and assists people. Well done.

What I have to add is that everybody's ‎case is different. I didn't do the English test, we didn't have call log, o‎nly email history (lots of it) and BBM chat (just a few recent chats), because we had both changed phones severally we didn't have the old chats anymore. We are both busy at work during the day so we don't speak but we send loads of email then we Skype or do BBM call in the evening, we didn't print out the Skype but we had tickets and hotel reservations for holidays we took together, (3 holidays in total) so that and the email log was what we used as evidence of communication plus Hubby has been to Nigeria 4 times this year and about the same last year so we added the stamped pages of his passport showing the visits. Also a friend of mine was denied settlement Visa last month and one of the reasons is that she didn't state she knew her husband the 2 times she applied for visit visa but her records show that they had met as at that time. I fall into that category but they still gave me the visa...Thank God. Yaaay. The point is if you feel you are lacking in one area, do an overload of the one you have to prove that you have that area covered.

If anyone has any questions, I'd be more than happy to assist.

Thank you everyone once more, Nandos crew, are new members still welcome

Its not about you sponsoring the application. The shoulder of responsibility is on your wife, based on the type of visa you intend applying for.
Does your wife have all the relevant documentations to support your application?

Dear Ma,

Both postal addresses deliver post to the same post room within UK Visas and Immigration and the post is then sorted and forwarded to the relevant department.

Hi Newbie,

Since I sent the documents to S3 8WA, and I didn't send to Vulcan house, and the ECO has sent me an email saying my online application has been received, and they can't do anything until the supporting documents have been received, do you think it will still be reviewed? How about the two weeks deadline given? I have called the Embassy several times, when they check their system, they kept saying that there is nothing with the GWF reference number on their system. I am asking you because I think you've been in the same situation. Please come to my aid. I have not received any email about my documents, except email saying my online app has been received. Don't hesitate to contact me if you require some info.
Hoping to hear from you pretty soon.

Hello, don't work yourself up. If you read through my message when I got the visa, I stated that I never got an email confirming the delivery of my supporting documents, the postal address you sent to is the same one I used not the Vulcan House one and just like the email you said you received and posted here stated, mails from both addresses get delivered to the same office then they sort and I told you in my earlier post that it took almost a month after we mailed the documents before my hubby was contacted, I think it was just 2 days shy of a month. I'd advice you just hold on and tell your spouse to keep an eye out for the phone call. It seems like forever when you are waiting I know but it won't be long now anymore.

I don't quite get what you said about the two weeks deadline, can you explain?

All the best.

Unfortunately if your wife is not presently working, you cannot apply for a settlement visa. As she cannot satisfy the prerequisites to enable you apply for such.
Re: UK Spouse Visa/Appeal Process-part2 by Winso26: 7:44am On Oct 08, 2015
Hello everyone,
Urgent advise needed.
When I made my initial application we employed the services of a lawyer, but when the application was refused due to the mistake on the part of the lawyer, and that he was only interested in the fees. He initial charge us £900 which was fully paid. So when my wife and I decided to do the appeal on our own, surprisely we got another instruction to pay another £300, that he has logged an appeal for us. That's was when our problems started, we immediately told him to dis-logged whatever he has logged, he refused. My wife and I went ahead with our own well planned appeal as my wife the non-legal representative and to the glory of God, the appeal was allowed.
The problem is now, I've written to the Sheffield office to tell them of the severed relationship with the lawyer but surprisely we received an email from the lawyer yesterday the following messages:

''Please make arrangements to attend our Watford Office to collect the latest correspondence from the Home Office regarding your husband’s entry clearance.
Please contact me to arrange an appointment.''

I have been waiting for them to tell me to send in my passport because I got my promulgation since 31/07/2015. How do I handle this situation now. Do I have right to demand that message?
Please, good advice.
