Online submission for tier 2 visa : my husband as the main applicant and I am a dependent 5th February
Biometrics : 7th Feb it's a standard visa
Decision concluded: 11th Feb,
Collection sms: 11th from vfs office in Riyadh Saudi Arabia
Decision : visa was Granted with vignette effective from 26th February till 28th March but it's a three years visa.
Lexusgs430, thanks so very much for your advices, I was very honest in all my explanations. Low and behold visa was Granted. May God bless nd grant ALL ur heart's desires ds yr in Jesus name.

Hello everyone. I have been a silent follower of this forum for a while now. I salute all the gurus here, doing a wonderful job. God bless you all.
I'm about to submit my application for spouse visa. Although I have gotten must of my answers from reading the pages of this forum, I still have questions. First, let me state that I have been on a ban since August 2008 when I applied for a study visa (unknown to me, my sponsor had provided a false tax document). Fast forward to 2017, I got married and my spouse is a British citizen. I have read here that a spouse visa/application over-rides any ban, and I desire to live with my spouse so we can build our family.
Now my questions, is it ok to apply now since our marriage is only 6-months old (my spouse has been visiting twice a year since 2015), and is there a specific bank balance which my sponsor should show as evidence (his annual salary is well over #18600), should we just show his salary account statement and payslips?

It's true that spousal visa overrides a ban. But the ban was caused by documents falsifications....

My advice/submission to you are - :

(1) Ensure all documentations submitted are 110% real and in date
(2) All required documents are submitted
(3) Is he self employed or PAYE (documents required are not the same)?
(4) You don't want to give them any reason to say NO
(5) Before you submit, ensure you mark all documents against a proper edited checklist
(6) Ensure tickets + boarding passes for all his visits, are also submitted and properly labelled......

Your original question and follow up response, is a bit confusing.....

Let me state what I understand so far - :

1- Your spousal visa was refused
2- You have a British Child
3 - You visited the UK as a child, but visiting status unknown



Your spousal visa application was filed from what country?
Are you presently in the UK?
How does your unknown historical visit affect your present spousal visa application?
How did you fill your spousal visa application?
What is your sponsors position in all this?


Child is British as my wife is British.

Am In Nigeria at the moment.
Came to the UK as a child with my dad. Didn't know what visa i came in with. And my dad past away.

Am waiting for appeal so am a bit scared

I was told to report at Croydon but I miss 2 session of reporting due to solicitor waiting for reply from Home office regarding reporting letter send to me them

The UK Decision Making Centre is currently assessing the application submitted by the above named. We are unable to conclude the application at this time.

From the evidence submitted it would seem that your sponsor is currently in the UK on a Tier 2 visa and has limited leave to remain. Given this you do not qualify for settlement.

Given this it is recommended that you withdraw your settlement application and that of your 2 children and re-apply for a Tier 2 dependent visas for all 3 of you.

Please check the www.gov.uk webiste for full details of how to apply.


I am very confused and don't understand the mail. I have gone back to check to see where (or if) I made a mistake in selecting the visa type.

Is it not a settlement visa? I was going to call them but want to take some time to do my research, possibly speak to am immigration lawyer.

And the fees! Have I lost over 5k pounds just like this?

Please how long does it take for these people to acknowledge the appeal thing. Am yet to get a mail from them concerning my online appeal though I recieved a mail when I uploaded my supporting docs to the email they provided.

The wait is now getting to me. *sad face *

Fully understood... You normally attended at set dates and times, but missed some reporting sessions and either after, before or during reporting sessions, you just kept filing all sorts and types of applications.

You went to the uk as a child, process of entry unknown.

You applied for spousal visa from Nigeria and application was refused. You now filled an appeal and awaiting your date with the adjudicator?

I seem to remember this case and the advice then was that since Home Office could not track your history of entry, the case seemed a little complicated.

I can see you applied eventually and was refused (not surprising)....

What new evidence have you submitted for appeal, to support your case?

You applied for a wrong visa, that email from the embassy is correct. You needed to apply for tier2 dependent visa and not settlement visa.

From appeal submission to decision making, the whole process takes between 18 - 24 months.

You have already received an acknowledgement of documents submitted.

What's the timeline on your appeal? What month did you file the appeal?

I am searching for the correct option. I cannot find "Tier 2 Dependent visa" on their website

Can't really submit any new evidence apart from child birth certificate. As I don't have any extra information as to when i came in coz I don't know have any information regarding it . What other information do you think I should send to them.

I have just read through your whole submission on this thread.....

You applied for the wrong visa as justwise stated.... Spousal visa is only meant for British citizens who are resident in the UK, and intending to bring their wife or husband.

You never stated originally that your husband had a tier 2 visa.

Best to speak to ECO nicely and see if they would refund fees paid or transfer for the right type of visa.

Yes. I miss 2 reporting session and due to advice from solicitor I just keep applying

I will send them a mail to see if they can change the category or refund fees.

I believe someone has had a similar issue and was able to send them a letter for them to change it?

If you don't have any new evidence to submit, I think you just have to hope it turns out well...

Like the adjudicator been in a good mood, and simply glosses over your case.....
