So it can said that u don't have inalienable to land.. Govt cab relocate and compensate, but u can't say this land was given to me by my great great grand father, therefore I shall stay.. An Act of 1978 , overrides what was given to u in 1900..

Your submissions relates to a situation where the said land is needed by the Government for a particular purpose and has no effect on the legality of land ownership by individuals, families and respective communities. Even Tompolo facilitated the sale of community land to FG which is a debate for another day.

Moreover, the argument above is just secondary.

Is Lagos State a Yoruba land according to extant laws of Nigeria?
Land Use Act only recognises States not tribes and therefore grants governors sole authority over land..
Are u saying that community or family rights trump that of a governor in relation to land acquisition?
Also, section 1 of Land Use Act, stipulates that individuals cannot own freehold interest in Land in Nigeria.

There is nothing like Yoruba land in Nigeria and can never be until the constitution is amended to accommodate such obnoxious definition.
You are getting it twisted .. Land Use Act of 1978 only conveys rights of occupancy. The Act vests all land in the hands of governors with the exception of federal govt land. Governors are vested with the power to grant " statutory rights of occupancy" in urban areas while LGAs are granted "customary rights of occupancy " in rural areas.. So even though your village/family/community doesn't have C of O, it's the govt that grants right of occupancy and has the right to appropriate such land for its use.. Abuja was once a community/village/family land but FG took over it and sold it to individuals and assigned C of O..

When you sell your inheritance, it's gone. Individuals and communities issue buyers with "Power of Attorney" and not necessarily C of O because they are not the State.


There is nothing like tribal/ethnic land recognized anywhere in Nigerian constitution and laws.
Even ur family land technically belongs to the govt.. So just ASO Rock land was once owned by a community/family, town, but the govt has right of way and can pay compensation to the affected family..
BTW, it's the govt that issues C of O and recognses deed of assignment or power of attorney.. C of O or power of attorney doesn't convey ownership in its entirety, but occupancy with rights and privileges.
So govt is the landlord that gives u right of occupancy -C of O

This is not a well thought out question because you are making the wrong assumption that there is any equivalence between a piece of land, its surface structures and the natural resources under that same land. In other words, it is possible for one person to own the land and another person to own what is underneath the land. For example, according to Nigerian law, a person can buy a piece of land today and have a valid C of O or legal title deed. But if oil is found in that land tomorrow that oil automatically belongs to the federal govt, the owner of the land cannot legally lay claim to the oil even though they are the rightful owners of the land.

As a general rule, in the US the owner of a piece of land whether private or government also owns whatever resources lie underneath that land. So one person can own anything found up to 500 ft below ground and another person can lay claim to what is found between 500 ft and 1,000 ft below ground and so on.
Point of correction: no one owns land out rightly in Naija. U r given a C of O( certificate of occupancy not certificate of ownership) C of O lasts for 99 yrs

You are bereft of how budget works.. Those projects are part of his 30% capital expenditure.. If he's borrowing N2.5tn to fund capital projects, that would mean that capital projects are over 40% whereas govt id proposing 30% on capital projects.. Your numbers don't add up.
Btw, dollar to Naira conversion is N197 and it has no effect on the budget.. A reminder that Naira has lost value againt $ by 40% since last May.

Keep yapping and being selective in ur responses. It was around 40% under Obj without borrowing and increasing national debt.
It was 31% in 2013; 24% in 2014; 18% in 2015-all without borrowing and doubling national.
But GMB is borrowing to fund recurrent expenditure. He's increasing the already bloated FG expenditure by 70%..

GMB increased the size of budget to 64% from 3.9tn in 2015 to 6.0tn in 2016 by borrowing ie N2.5tn. Capital budget is restored to 30%, really?? It was around 37% during OBJ time when National budget was around N2tn. So GMB is borrowing to fund recurrent expenditure??
Another profligate budget... 30% capital budget is peanut compared to 2013 when it was about 31%; it was 24% in 2014 ; 2015 is about 18% -- all these when the national budget was less than 4tn. Only 30% of 2.5tn borrowed funds would be used for capital projects which means for every N100 borrowed, N70 is for "chopping" money for politicians and their cronies while N30 would be for capital projects. -N750bn would be used for capital projects while N1.75tn will be "chopped" by politicians, mind u neither federal minimum wage nor workforce has increased to warrant FG to add 1.7tn to already bloated FG's recurrent expenditure.
