fammo:That is an unfair criticism of the DPR. They have been sanctioning erring stations via free fuel distribution and seal up. It's just that they don't have the manpower to be covering every inch of the country at everytime. It is our people that are just being greedy and wicked to their fellow citizens. Saraki's legal team has already boxed themselves by asking for a full panel of the supreme court. And it is most likely it is the CJN that will head the panel. |

The Government is actually trying to curtail the activities of these marketers. And all hands must be on deck to make this work. The DPR needs to deploy more of their staff for monitoring and enforcement. |

felalegend:By the virtue of being the running mate of Audu, the prerequisite of participating in primaries does not count. The constitution has mandated the person who won the primaries to nominate a running mate. There is a reason the constitution mandated the person to nominate a running mate before his candidacy can be deemed to be valid. A running mate is a spare per adventure anything happens to the principal. The Taraba case you are citing as an example is still before the Appeal Court and may even go to the supreme court for judicial pronouncement, so you cant use that as a justification just yet. Moreover, you are not looking at the core details of that judgment, but just picking the peripheral. One thing you supporters of the 1st runner up in the primaries fail to realize is the constitutional provision I stated above which will be very difficult for the Bello guy to meet. According to the 1999 constitution as amended, the candidacy of a party flagbearer to contest can ONLY be valid if the person nominates a running mate. There is no way the guy can nominate another person for that position, his hands are already tied by circumstances. Although, he may later claim in court that he nominated Faleke after he was pushed forward by the party, but that will be too cosmetic and cannot stand any legal scrutiny as Faleke was already constitutionally nominated by Audu and his nomination to contest as Deputy Governor still subsists and as such, another individual cannot claim he nominated HE whose nomination is still standing and very much valid! |

Hmmmm I thought u re a political analyst. Well from my own opinion, they had a relationship, a very steamy one that ended at the detriment of the girl. And she is still very bitter and angry. Sometimes some ladies especially those ones u took their virginity can be crazily in love with someone. They can also be obsessively in love, which I think is what happened in this case. The lady obviously was obsessively in love with the guy and threw everything at him. TonyeBarcanista she may be right that she was gang banged, but I can validly assume that she must have willingly participated in at least one o*rgy before the guy will be forcing her to participate in others. Youths having access to cool cash and liberty can be extremely wild. The guy and the lady obviously had a wild intimate relationship, which resulted in the lady being in emotional bondage to the guy. The guy, as usual with most spoilt brats then took advantage of her and started treating her like dirt. The lady being an obsessive lover, took the dirt thinking "if that pleases the man I love, then I can take it". At the end of the day, the guy jilted her in a way that left her emotionally devastated. Jilting an obsessive lover can be traumatic, infact they may kill in anger sef or commit suicide. She is angry and bitter and unable to get back at the Audus due to their influence in the society. This must have made her even more bitter. She now lives in the US, land of equity and justice. And her eyes are fully opened with realisations that she was abused! This is with respect to her age then, but had the guy not jilted her, this would never had come up. She wants her own pound of flesh and has fired the first shots. But I must let her know that this is Nigeria, except she has all her facts intact, Nigerian guys cannot be easily intimidated. When the Audus decide to fight back and open their own can of worms, I hope her family will not suffer greater embarrassments. Of course the show has just began, she fired the first shots at the Audus using their real name while she used an alias that sounds even somehow. The Audus are now prepared to take on her back and has revealed her real name. One thing is sure, the Audu guy may be guilty on some fronts, but this lady equally played along until the relationship was broken. Imagine a lady trying to describe sexual encounter with a guy to the public using a phrase like "he fvck.d me". Her usage of that word alone will make a lot of people in this our society to doubt the 'young innocent me personality' she is trying to sell to the public. I'm not a lawyer. Someone pls tell me if we have anything like 'statutory rape' in the Nigerian criminal laws. No bashing pls. Just want to know if for sure we also have it in our laws. |

After the plethora of court cases has been resolved by the supreme court, if the verdict is not in favour of the siting governor, it is then the person can step aside in accordance with the supreme court ruling. |

There is nothing like primaries in the statement issued by INEC. INEC is also very smart and deliberately remained silent on that. The total number of registered voters where the supplementary election is to take place is 49,000 while those with PVCs are just 25,000. while APC is already leading with 41,000 votes. So you see.... Stoical:Well you have some points. Relying on the opinion on the Attorney General is not as bad as you painted it. It is the fault inherent in our system that is making it seem so. The AGF is that of the federation and not of the APC and the legal opinion of that office on matters is quite very reliable. The major issue here is just that it is the government of the day that selects the Attorney General of the Federation. The last senate tried to separate the Attorney General of the Federation from the Minister of Justice but GEJ would have none of it, infact he filed a suit against the National Assembly before the supreme court on the matter. Now going to the supreme court as you said, INEC cannot just approach the apex court for interpretation on a matter. It is an abuse of court process. Parties to a matter cannot just jump at the Supreme court that they need an interpretation. The person that can approach the supreme court is the AGF and he stated that in his capacity as the AGF the issue is straight forward and does not require any special judicial interpretation. The next line of action for any dissenting opinion is to go to court. simple |
ShowYourCertificate:That is not my point and what I looked at. This issue has to be taken step by step in order to identify where there is lacuna of the law. As of now, there can not be a fresh poll according to the provisions of the constitution. There is no lacuna or ambiguity in that. INEC according to the constitution cannot cancel the result of a poll it has already announced. That is the position of the law. Death or no death, it stands! All the local government results announced so far stands! The constitution has already bound the hands of INEC in this regard. So for certain, INEC has to conclude the process. Otherwise any fresh poll conducted will be a nullity. This brings us to the 2nd issue on who now flies the APC card as it has been established that INEC has no option but to conclude the process. You may be right on your assertion that a fresh primary conducted at this time may be an illegality. That is why INEC in its wisdom did not tell the party how to go about substituting its candidate. INEC merely told the party that the right of substitution belongs to them as they MUST conclude the election process given the provisions of the law. The ball is now in APC's court on how to take an action that will be in tandem of the law. In your own opinion as you said, a fresh primary is an illegality, I lean my argument in your direction in this regard as well. My own opinion is that the Deputy should fly the flag while the party fields the person that emerged runner up in the election as the Deputy. This will be a win-win situation for the party. If the court later rules Faleke out of order, he will simply revert to his Deputy Position while the runner up who went in as Deputy takes over as Governor. |

The power to conduct election rest with INEC according to the constitution. The power to cancel an election result already released rest with the Election Petition Tribunal according to the constitution as well. |

The power to cancel any result released rest only with an election petition tribunal. Once INEC announces a result, INEC cannot do anything or take any action on such a result again. All the local government results announced so far by INEC stands. INEC cannot cancel them or even say they want to correct a mistake. INEC has no right whatsoever on those local government results. It is only an Election Petition Tribunal that can take action on those results earlier announced by INEC. |
ODUBEZE:Many may actually vote for the candidate as you said, but the law is not sentimental nor is it emotional. It has clearly stated that the party is the owner of the votes. This position of the constitution has been emphasized by the Supreme Court on many cases. You also fail to realise one point when you said a fresh poll should be conducted. The point is that INEC under the constitution does not have the right to cancel an election it has already released the result! It is only an Election Petition Tribunal that can cancel the result of an election that has been released by INEC. End of story |

adadadon:1. The mandate Audu got at the primaries has been handed both to him and the Deputy by the virtue of him selecting Faleke as his Deputy. Looking at it at another angle. After emerging the party's candidate, authority has been imposed on him by the party to make certain important decisions. One of such decision is the selection of who succeeds him per adventure he is unable to discharge the duties of the party's candidate (As a governor) and he selected Faleke. That decision is binding on the party. Take it to any court. It is not only through primaries that a party can present a candidate. A candidate can emerge by General consensus of the party as was the case in Benue state, which PDP challenged at the tribunal and lost, and even challenged at the appeal court and still lost. 2. There is no where it is written in all of our laws, that if anything happens to the flagbearer, that the person that emerged 2nd during the primaries should be handed the mandate. |
