Saraki loses fundamental rights suit in court The Senate President, Bukola Saraki lost another legal battle Friday as a Federal High Court in Lagos, struck out a suit filed by him to seek the enforcement of his fundamental human rights. The presiding Judge, Justice Ibrahim Buba in a short ruling, declined jurisdiction to entertain the suit. Saraki had in his suit through his lawyer, Mr Ajibola Oluyede, on Sept. 30 asked for the protection of the court to guarantee his fundamental rights against “political victimization”. Joined as respondents in the suit are: The Attorney General of the Federation, the Economic and Financial Crimes Commission,EFCC and the Independent Corrupt Practices Commission, ICPC. Other respondents are: Inspector General of Police, Code of Conduct Bureau, Code of Conduct Tribunal and Justice Danladi Umar. Also joined are: Mr Ataedze Adza, Mr Sam Saba, Mr Mohammed Diri and Mr M.S Hassan. Before now, Oluyede had brought an ex-parte application before the court, but Justice Buba ordered that the respondents be put on notice. The Judge also raised the issue of jurisdiction and ordered counsel to address him on whether it had jurisdiction to hear the suit or not. When the matter came up, Counsel to Saraki informed the court that all parties to the suit had been respectively served with the court processes. eph12:Nope. Saraki's case is a criminal case filed by the Agency constitutional empowered to do that. In criminal cases, you have to take your plea yourself. This case filed against the CCT chairman 'in name' also seemed like a criminal case. The only issue is just that it was filed by a civil society and may be a Civil case except if security agencies takes over the case. But until security agencies takes over the case, it is still a civil suit and the CCT chairman may not necessarily make himself available in court but can be validly and legally represented by his counsel. ...you are welcome ![]() |

This is an exercise in futility. They are trying to fight the calm, wise, young and handsome judge. This is one thing I really like about well educated Northerners, they are usually very calm and exude confidence & wisdom. They tried same nonsense with Jega and he took them to the cleaners. Someone should pls remind this Ozeokome that the era of getting ambiguous and silly injunctions is over. Many thanks to the current CJN. The court will attend to the case properly and the CCT chairman will send a legal representative, while he continues his work diligently. Someone should also pls ask this Ozeokome (fake SAN) what happened to all the frivolous suits he filed in a feigned support for the PDP during GEJ's pathetic era?? Did he emerge successful in say just one of them?!! Unserious hungry attention-seeking lawyer. |

sunnyb0b0:When cases are filed in court, lawyers are very cunny. They usually seek for a plethora of reliefs. The court usually considers their request one at a time. This definitely must have been one of the reliefs sought by the APC in the case. Wike also tried to do that in the Rivers Tribunal but he was unable to substantially prove that. |

He relied on an updated Nigerian law which says such trial can go on! Just that if a judgement emanates from it, it will not be executed until the higher court dispense the issues before it. This from Administration of Criminal Justice Act 2015. How come you guys are overlooking this and heaping loads of criticisms on the Chairman. The defence of Saraki knows this! They are just trying to intimidate the CCT, appeal to the emotions of people not having deep knowledge of the law and entirely frustrating that case on technicalities and not the substantive issue. |
chukwudi44:Are u too partisan not to see that your line of argument has been overtaken by Administration of Criminal Justice Act of 2015 which says a criminal case can go on even despite the pedency of an issue before a superior court only that the judgement emanating from such case will not be executed until the issue at the supreme court is dispensed with.
