dondaddycares: If a prosecution witness under cross examination admits no money was missing, that doesnt mean d prosecution itself has admitted money wasnt missing.
He wasn't just a prosecution witness, he's part of the EFCC, he's police officer and he was the investigative officer the EFCC charged to investigate and look for the missing money so he himself is EFCC and EFCC's case rests on his findings and his submission was no money was missing and every kobo was accounted for.

EFCC Witness Clears FFK Of Misappropriation Of Aviation Funds

A prosecution witness, Bashir Abdullahi, said investigations by the EFCC had showed that there was no missing fund during the former Aviation Minister, Femi Fani-Kayode's tenure.

The witness, testifying before a Federal High Court in Lagos gave the testimony at the resumed trial of Mr. Fani-Kayode, who is being tried for money laundering by the Economic and Financial Crimes Commission.

Mr. Abdullahi, who is an investigating police officer with the EFCC, told the court that the case file of the accused was assigned to him in 2008 for investigation.

^^^^^^^ The EFCC itself cleared FFK so what's the whole charade trial about? Based on the above, is their any reason why they shouldn't close and abandon their worthless case?

facts elicited from cross exam are simply matters for (final) address. Did i hear u say call witnesses? Sure d prosecution called 3 witnesses, they must not call all their witnesses as listed in the information. Suffice it to say dat even one witness alone is sufficient to prove a case upon which conviction may be based on.
Please show us what witness they presented and how their testimony worked against FFK.

D EFCC closed its case, not abandoning it,stop being a mischief maker. If you aint happy d way EFCC is prosecuting d case,if u are a lawyer apply for d AG's FIAT and také over d prosecution...better still,d law allows for private prosecutors
This is just senseless garbage.

StArusi: FFK's Case has not been TERMINATED. The prosecution has only concluded its own presentation.(That is What is meant by EFCC Closes Case)when a prosecution closes it's case.
Fani Kayode is on trial because the government is trying to put him in jail based on 40 counts corruption allegations leveled against him, but the same government did not make make that case, they failed to put up any convincing argument or evidence against him, they refused to produce their main witness and critical component needed to nail FFK.

Furthermore, the basic foundation of their case crumbled when the EFCC itself admitted to the courtroom that no money was missing under FFK when he was the aviation minister because every kobo was accounted for.

So please tell us why FFK was charged if according to the EFCC itself, no money was missing

Now, after the prosecution closed their case, the defense is filling a no case submission. You know the meaning of no case submission? It means the are telling the court that FFK has no case to answer based on the prosecution's inability to present any credible facts against FFK, due to their inability to present their main witness, after concluding that no money was stolen and ultimately closing their with nothing proven against FFK.

No case submission means no case to answer, it means the defense is closing their case too, no further argument, no witness and no cross extermination, it means the case is over.

When the court returns, the judge is throwing out the whole case against FFK. All because the prosecutor did not prove anything against FFK, because they closed and abandoned their case against FFK.

It doesn't mean the case has come to an end. It means it is now time for the Defence to present theirs! EFCC has not withdrawn charges against FFK but rather closed its case- a stage in trial. If EFCC wants to TERMINATE the case against FFK, AGF will file a NOLLE PROSEQUI. That is not what happened. I don't care whether u are PDP or APC, just don't b misinformed. Next!
The defence counsel, Mr Wale Akoni (SAN), did not object to the letter by the Prosecution.
He, however, informed the court of his intention to file a no-case submission to the charges against his client

You are wrong, go ahead and read the news article because you obviously haven't read anything. The defense is not presenting anything, they are not even questioning or objecting the prosecution packing up their case because this is the best outcome for them.

They are instead filling a no submission motion for the judge to terminate the whole case since the prosecution aborted their efforts before proving anything and also after admitting that no money was missing. The judge doesn't need anything from EFCC or the AG before trashing the case.

FFK has no case to answer simply because the prosecution abandoned their case against FFK before proving anything.. PERIOD.

You are free to cry and worry over semantics, but when you set out to do something or accomplish a goal but instead stopped before attaining that objective, it means abandonment hence a no case submission by the defense.

Mogidi: How come the Yanks couldn't find the girls if indeed they are missing?
Your president and his investigative committee agreed that the were kidnapped.

Your president and his military just few days ago claimed that they know where the girls are located.

So, who is lying? You, your president or his military?

Also, your president didn't ask the Americans to rescue the girls and the Americans didn't promise to rescue your girls. Your president invited them to provide tools and intelligence and just today, they gave your country Intel and communication trucks and troops protection equipment.

Their job is to provide intelligence and it's up to your weak and incompetent president to act on it and rescue the girls, but as expected, the lazy and clueless man refused to negotiate and his military refused to use force so in effect, both the military and the useless president are not on the same page at the expense of the missing girls, their parents and Nigerians.

Btw, going by your usual unintelligent logic, Buhari and his rag tag BH are more powerful than the president of Nigeria, the commander in chief and the $6 billion/year budget military? You mean your weak and incompetent president can not even protect and defend 3 out of 36 states?

eldoradoxx: The impression an overwhelming comments on this page generates is that Nigerians don't understand simple English sentence construction. The report above says that Festus Keyamo of the prosecution team wrote the court informing it of "Close" of prosecution's case and the court consequently gave the Defence (Fani Kayode) 21 days to file its "No case submission". Nairalanders read the closing the prosecution's case to mean that termination of the prosecution of Fani Kayode , yet the same people are following Oscar Pistorious trial and knew when prosecution "closed" their case for Oscar to enter his defence. Its unfortunate that we have unnecessary hatred for our president (I dont like his style either) and very quick to criticize and insult him without any valid justifications 99 percent of time.
You need to work on your own English and spelling too.

Now, When you close your case before or without making your case and when you close your case because you can not prove your case, because you can not locate your main witness and lastly when because you yourself admitted that the accused didn't commit any crime because no money was missing, it means you have no option but to close and abandon your case.

And please, the Pistorious trial is very very irrelevant here simply because the prosecutor in SA presented their case against Pistorious with live witnesses and tons of other valid and accepted evidences in that court of law and the prosecutor in SA didn't admit to the world that Pistorious didn't commit any crime like the the EFCC did in Nigeria.

by Roger Boyes

After Syria, Iraq and Libya, trouble for the West could be brewing in corrupt Nigeria too Goodluck Jonathan is a Bad News president.
Three months after the abduction of more than 200 schoolgirls there is still no sign of them. Slowly, too slowly for the teenagers who made the perhaps fatal mistake of wanting to sit their exams, it is becoming clear that the president is largely indifferent to their fate. As he is no longer in the Western spotlight, President BadNews Jonathan has lost any sense of urgency. One day he will wake up to find he has lost his country too.

It’s not just our flickering attention span that now makes the West complicit in this crime, or its tardy solution. It is part of a broader betrayal, a sense of hopelessness that makes us too quick to wash our hands off problems too difficult to solve. You could call it PontiusPilatePolitik.
Remember how we demanded that Bashar Assad step down as Syrian leader? We don’t do that any more; apparently we may need him to defeat Islamist terror. Apparently we may need Iran too. As for the Western hard line on Vladimir Putin’s encroachment on Ukraine, you may notice we don’t mention Crimea much any more.

And so it is with President Jonathan. Forget the dizzying desertion of his responsibilities to his citizens — they are after all his citizens, not ours. Let’s move on, cry the apologists. Look where gun-toting sheriffing of the world got us in the past decade. Syria, Iran, Russia: they are not measures of our retreat from the world but just a recognition of the limits of our power, a new realism. One day soon an EU or State Department official will let it be known — strictly off the record, mind — that the West needs President Jonathan in a rebranded war against terror.
Tell that though to the girls wrenched from their boarding school in Chibok. The social media campaign ‪#‎bringbackourgirls‬ picked up momentum because the education of girls was such an obviously universal cause; its denial by force so obviously a crime that affected more than the northern Nigerian province of Borno. A state worthy of its name had a duty to shield them. Its continuing failure to do so is not comparable to the president’s other failings: his patchy record on bringing electric power to the country, the terrible roads. That is up to Nigerian voters to decide in next year’s election. When a government abandons its children though, it is time to step in. The locals are calling for an intervention by the United Nations. It is easy to understand their plea.

The novelist Ben Okri warns of a crisis “that if not contained could trigger something terrible in our country”. It has gone, he says, “beyond anything the government is equipped to deal with”. He’s right. Inaction, the washing of hands, is the worst possible response to what is going on in Nigeria. At the Berlin Conference, in 1885, Bismarck steered the European partition of Africa. Today the European Union, poised to integrate more closely, and reluctant to engage elsewhere in the world, has become a numbed spectator to a new era of partition — in Syria, Iraq, Libya and, if the centre collapses, in Nigeria too.

The malevolent power of Boko Haram may be exaggerated by President Jonathan in an effort to legitimise his rule; he is a leader in search of enemies. It thrives, though, on popular disdain for the corruption of the Jonathan government, and for the army of which he is commander in chief. Last February the president suspended the head of the central bank of Nigeria, Lamido Sanusi, who had pointed out that $20 billion was missing from the national oil accounts. Earlier he made enemies by sacking bankers, demanding the dismissal of thousands of civil servants and accusing a minister of leasing her own private planes to the government. Sanusi, now the emir of the northern fiefdom of Kano, is a man to whom we should be talking.

We napped in the years ahead of the Arab Spring, getting into bed with dictators who served our commercial interests and missing the rumble on the street. Now, as we flee any knotty international problem, we risk being on the wrong side of a brewing African Spring.

The corruption of African states has to be our concern in shaping aid and foreign policy. Crooked officialdom worries the new middle class of the continent’s fast-growing countries because it is beginning to destabilise governments rather than consolidate tribal loyalties; it must, therefore, become part of our calculations too. Nigeria could have been as rich and as self-confident as Indonesia. Instead it is teetering on the edge of chaos, its poverty of ambition exposed by the fate of 200 girls held, and perhaps brutalised, by fanatical Islamist hoodlums somewhere in the northern forests.

What do you suggest they do if after so many years of charade and deception, the same prosecution and EFFC admitted that no funds was missing during FFK's tenure at the aviation ministry and their so called imaginary main witness and the only critical component regarding their case against FFK remains lost and invisible and has been for almost a decade? Continue the case or toss in the towel. They tossed in the towel with zero dent or case against FFK.

Closing their case after admitting that no money was missing and their main witness is no where to be found remains their only option. Abandon or close their case against FFK either way you look at it makes no difference, they are done and FFK is practically off the hook, they just have to formalize it in a few months via the next court proceedings...

Engr. Rauf Adesoji Aregbesola was born in the month of May, 1957. He had his primary and secondary education in Ondo State, and later attended The Polytechnic, Ibadan, where he studied Mechanical Engineering and graduated in 1980. As a pupil in the primary school, Rauf was a centre-point around whom his mates hovered for guidance and direction. As a student, he was focused for remarkable performance which he made distinctively and seamlessly. In the Polytechnic, he positioned himself to conquer his environment by engaging in prolific studies.

Fellow of the Nigerian Institute of Management (FNIM), Fellow of Nigerian Society of Engineers (FNSE), Fellow of the Nigerian Association of Technological Engineers (FNATE) and Fellow of the Certified Marketing Communications Institute of Nigeria (FCMCIN), Rauf Aregbesola has a wealth of experience garnered through wide exposure in the private sector, such as the Nigerian External Telecommunications, now renamed Nigerian Telecommunications Ltd. and Lagos Airport Hotel, before establishing his own Engineering Services Company, Aurora Nigeria Limited, in 1986. The company had handled numerous major projects for both government and private organisations in most States of the Federation.

Ikengawo: most of the small towns in Nevada has prostitution has their highest revenue earner. If it was Nigeria you would be lamenting that so and so is a bad leader because so and so is a prostitute.

We're always ready to talk about how we so be like one society without bothering to know why that society is that way. Nevada's earnings come primarily from Las Vegas, a city what was found on a fraud committed against the mafia by mafian Bugsy Sigel.

If a Nigerian used fraud to do the same what will you say? soon after finding out they killed him. Again, if Nigeria what will you say? Then they used it as a spot to launder drug, prostitution, racketeering and armed robbery money by funneling them as casino earnings for decades until it used crime to become a viable economy which STILL makes most of it's earnings on gambling and prostitution. It has a exceptionally high murder rate and one of the worst unemployment and drug addiction situations in America.

Now I bring this up to show you the foolishness of asking a Nigerian state to copy Nevada as is Nevada is the fountain of great ideas. Nevada can make a policy to focus on e-learning because if you build a city on all of Nigeria's drug, prostitution, and fraud earnings it would probably make lofty expensive goals like this too. Don't tell me what Nevada is doing in education if you're not willing to tell me what Nevada did to fund the policy. What sense does it make to ask Nigerian states to do this if you're not willing to allow Nigerian states to copy the earning formula of Nevada as well? Let someone turn your village into a giant brothel and the tax earnings alone will fund all the Ipon Imo you can dream of.
What's the state's prostitution and mafia history got to do with the state's advancement and development in 2014? This means they are not advanced and a million times not developed than you or that their education system is not superior than yours or they don't have anything worth emulating?

felifeli: 1. Is the user of Opon Imo able to load new books by themselves ?
Does it really matter how the books are loaded? In fact the whole installation was done by IT techs volunteers right there in Osun so what's the big deal about loading books?

The same books loaded on one Flash Drive is enough to load up all the tablets in one school and more flash drives the better. They have trained staffs in all the schools to hand such basic functions.

They don't have to send one single tablet back to any manufacturer for basic installation.

And you are computer savvy? I don't think so.

Is Opon Imo the same thing as given in the other institutions ? Absolutely no. It is an educational toy and really at best a tool for indoctrination. It has no means to access internet , no bluetooth , no usb .
The idea is not for the students to get on the internet or surf the web, this is about replacing their school books and make reading and learning easy.

Do you get on the internet with the multiple published books you pack to school everyday? You are not making any sense..

2. Is the government able to change the books inside Opon Imo ? Absolutely no. The toy must be returned to the supplier for this. Possibly call for a fresh supply contract to Kabiru son of Aregbesola .The simple availability of bluetooth could have made it so easy to update thousands of tablets at once in a few minutes on site, but it seems more profitable (huh) for the supplier that they are returned .
Again, it's easy to load the tablets with ordinary flash drives and this could be done on site by the teachers or trained staffs on site which they have.

Again, you are not making any sense..

3. Are the books in the Opon imo free ?
Are the published books free? Do you work for free? Abo what's your free got to do with anything?

A handful of publishers were given the contract to load them.
What do you want them to do? Hire millions of publishers to load them? Abi what's your point?

Were all publishers contacted about the opportunity?

You already know the answer.
No, we don't k ow the answer so please tell us and back it with any credible proof that that they did not. You need to stop peddling your opinions as facts.

Osun State does not presently have a book from which schools can choose what they like.
Schools dictates what students read, not the other way around. Feel free to show us where students decides what they read in schools. Sounds like you're just rummaging through your assss looking for anything to throw in the and hopping something sticks..

4. Can other publishers also supply books fro putting in Opon ifa ? Absolutely no. The recommended book list is ignored. Only handpicked books.
You know this because you've tried and was rejected or making things up as usual? Of course making things up.

5. Can this system be called fair commerce ? Is there a level playing ground for all educational suppliers ? Was due diligence observed in the implementation of this educational SCAM ? Is there hope for other book suppliers to be included ? Absolutely NO.
Do you even know the meaning of fair commerce? The whole process wasn't free so what fair commerce are you talking about
? Fair commerce is goods and service changing hands unless your interpretation of fair commerce is hiring you and millions of other publishers to do less than ten people's job.
