The detained leader of the proscribed Indigenous People of Biafra (IPOB), Nnamdi Kanu, has appealed against the decision of a Federal High Court (FHC), Abuja, dismissing his objection to his trial continuation.

Kanu, in a notice of appeal dated and filed March 28, through his team of lawyers led by Aloy Ejimakor, prayed the Court of Appeal, Abuja to allow the appeal and set aside the trial court’s decision.

The IPOB leader had filed a preliminary objection seeking an order for some conditions to be met by the Federal Government before his trial at FHC could proceed. He had alleged that the Department of State Service (DSS) personnel often seized documents of his lawyers during visitation, stopped his lawyers from taking notes, eavesdropped on his consultation with his lawyers on matters pertaining to his defence, among others. He alleged that he had not been given adequate time and facilities to defend himself in accordance with Section 36(6)(b) of the 1999 Constitution (as amended).

But Justice Binta Nyako of a FHC had, in a ruling on March 19, declined to grant the objection of the detained IPOB leader. The judge, who ordered accelerated hearing of the trial, also dismissed his application for bail. However, Kanu, in the notice of appeal, listed the Federal Republic of Nigeria as the sole respondent.

He argued that the trial court erred in law when the court assumed jurisdiction to proceed with the hearing of the criminal trial against him when he was glaringly denied the constitutional right to fair trial. He alleged that he was denied adequate facilities to prepare for the defence of the criminal allegations against him and his right to counsel of his own choice, thereby occasioning a grave miscarriage of justice.

“The denial of the appellant (Kanu) of the opportunity to interact and brief his counsel on what line of defences the appellant tends to agitate in the trial court and rely on was adequately brought to the attention of the trial court by motion. The trial court failed and neglected to make necessary orders that would protect the appellant’s aforesaid rights, but rather held that the court cannot dictate how the respondent carries out its work,” he said. He said the trial court had the power to order the respondent to cease and desist from interfering with his constitutional right. Besides, Kanu said the lower court had the power to order an alternative custodial arrangement or non-custodial arrangement for him, where it is impossible for the respondent to comply or where the respondent persists in the act.

He said: “Denial of the appellant’s right to adequate facilities to prepare defence as enshrined in Section 36 (6) (b) of the 1999 Constitution is a jurisdictional issues in the absence of which the trial court cannot assume or proceed with the jurisdiction over the case, unless and until such facilities are accorded to the appellant.”

Kanu argued that though he had prayed the court to stop the DSS alleged unconstitutional acts of forcibly seizing and photocopying confidential legal documents brought to him by his lawyers meant for his defence of the charges against him, the court declined to grant the plea. He said the trial judge erred in law when the court ordered accelerated hearing, despite the consistently refusal of the respondent to afford him the right to adequate facility to prepare for his defence of the charges levelled against him and his right to counsel.

He said the order for accelerated hearing of the case, in face of the constitutional breaches of fair hearing/trial rights of the appellant, was a credence to the respondent to proceed on the unconstitutional denial of the appellant his right to adequate facilities to prepare for his defence and his right to counsel of his choice.

“In the present case, where Sections 36 (6) (b) and (c) of the Constitution are violated by the respondent against the appellant, the trial court lacks the jurisdiction to hear and or proceed with the hearing of the case,” he added.

The IPOB leader, therefore, prayed the appellate court to allow the appeal, vacate the ruling of the lower court for the trial court to decline jurisdiction to proceed with the hearing of the case, unless and until he is granted his right to fair hearing under Section 36(6)(6)(b) and (c) of the constitution. Alternatively, he urged the Appeal Court for the trial court to order an alternative custodial or non-custodial arrangement free of interference with his said constitutional right to fair hearing. He equally sought an order setting aside the order for accelerated hearing of the case in the circumstances of the case where he is not allowed facilities to prepare for the defence of the charges against him and denied his right to counsel.

Kanu sought a stay of proceedings pending when the respondent afforded him the constitutional safeguards of being afforded adequate facilities to prepare for his defence and his unfettered right to counsel.

Ohanaeze Ndigbo, the apex Igbo socio-cultural organisation, has expressed support for President Tinubu’s decision to consider releasing Nnamdi Kanu from detention.

According to a press release issued on Thursday and signed by Mazi Okechukwu Isiguzoro, Secretary General of the organisation, Ohanaeze Ndigbo disclosed that the anticipated date for Kanu’s release is December 2023.


The organisation said the president’s decision would have “significant implications for the political landscape in the Southeast.” The group also warned against any attempt by “mischievous Igbo political elites and deviant opportunists” to take credit for Kanu’s release.

“Ohanaeze Ndigbo urges President Tinubu not to entertain any visits or demands from these individuals,” the press release said. “The credit for Kanu’s release should solely be attributed to him.”


The group also said that Kanu’s release would “gradually diminish the rising popularity of both Peter Obi and Simon Ekpa in the Southeast.”

Nigeria has never been united. However, I think the military managed our diversity better than democratic government because elections divide countries all over the world.

The Biafran Nations League, BNL, are a group of armed militants who operate mainly in Cross River and Akwa Ibom States. They are made up of ethnic Ibibios, Efiks, and Orons. They are agitating that the two States be part of Biafra when it emerges.

Although the group is not associated with with other Biafran groups such as IPOB and MASSOB, they have demanded in the past that all Biafran agitators held by the Nigerian government, including IPOB leader, Nnamdi Kanu, be released. The group also does not recognize the authority of Cameroun over the Bakassi peninsula, part of which they control, and have had clashes with the Camerounian Army.

Another odd thing about BNL is that they like to hoist the Biafran flag sideways, rather than upright. Nobody is sure who leads the group

Basically, what Chukwuemeka does is to visit Igbo speaking areas outside the South East to relate and discuss their Igboness, and interview the indigenes

So far, he has been to Ika in Delta State, Igbanke in Edo, Oha-obu in Akwa Ibom, Obigbo, Ndoki, Etche, Ahoada, Ikwerre in Rivers and many more

However, Chukwuemeka has come under a barrage of online attacks, not from the people he visits, but from mainly Ijaw and Bini elements who are claiming that the places he is visiting are their territory. The Binis are claiming that all the Igbo speaking areas of Delta state, as well as Igbanke and Ikwerre, are their Descendants, and are thereforr Bini people, while the Ijaws are claiming that much of the Igbo speaking people of Rivers state such as Ndoki, Egbema, Etche, Omuma and even Oha-obu in Akwa-Ibom are their descendants.

They have threatened Chukwuemeka's life, reported his channel for hate speech when he never used hate, claimed that he was distorting history and forcing people to become Igbo

Chukwuemeka took to his YouTube channel in the video below to question why people are threatening his life just because he goes to interview people he shares language and cultural affinity with. He wondered how he is forcing people to be Igbo when he only has a microphone and Camera.

HUNDREDS of women from Ekakpamre community in Ughelli South local Government Area of Delta State, have called on the federal and state governments to rescue them from the incessant attacks and gang raping of women by suspected Fulani herdsmen.

The mostly aged women during the protest weilded fresh leaves and placards with inscriptions such as, “We do not want Cows in our bush” “They Graze on our land” “We are being raped and chased from our farms”, they accused security agencies of supporting the herdsmen against them.

The Leader, Mrs. Loveth Boyi while addressing newsmen said, “For over 3 years now, Fulani herdsmen have been troubling us, chasing us from our farmlands.

“Just last week, five women were raped in their farms and as a result, we can no longer access our cassava farms, either to plant or harvest.

“The herdsmen will harvest our cassava and other farm produce and give to their cattle, our husbands are not going to the bush, hence we are calling on the state and federal governments to rescue us from the shackle of herdsmen in the community.”

Mama Blacky Raymond, an Octogenarian who twisted her kneel due to the herdsmen attack stressed that she can no longer get access to her farm after she was chased from her farm.

On his part, the President General of the Community, Edafe Kpohraror said, “The women are on this protest because herdsmen have continued to chase them from their farmlands.

“There is one Imam in the Community that is using the police and army to intimidate us, and as result, many people have fled the town because of possible arrest.

“We are appealing to the State Governor, Rt Hon Sheriff Oborevwori and President Bola Ahmed Tinubu to rescue our community from the attack of herdsmen.” Edafe pleaded

The day Igbo realizes they are the weakest link in Nigeria is the day they are delivered. Just like everyone has noticed, they have almost abandoned their region and focused on developing other regions. Why? Something is wrong with them.

We don't practice state of residence but state of origin in Nigeria. I can count up to 25 or more Igbos in my secondary school who are my mates out of 50 in Lagos State. The last time we got together, about 15 out of these people have been to their state of origin for a max of 3 days or did not bother to go. Yet, they comfortably fill their SE states as their origins in all their documents, but they know nothing about the place. And they go online shouting Igbo men should be president every time.

Many of them left Nigeria and did not return, but they go online causing wahala. They even make their children born abroad who have not visited Nigeria think every other person hates Igbo. But these people abandoned their places and they aren't still ready to return. Why?

To date, I do not understand the reason. They are the only region that thinks they must be the president because they deserve it. Did the other regions think they deserve it or contest? Lol. They want to be the president only during elections, but either want Biaf4a nation or a military takeover after losing elections. Tell me, who will want to put your kind of people in charge of the affairs of the nation?

It baffles me how those who claim to be Igbo that are not born in Nigeria support the useless ones at home.

The Igbo I know are good people, but when they refuse to fight bad people among them, do they expect others just give Igbo the presidency? Igbo caused war because of greediness and they are still. Who will ever allow such kind of people to rule over them?

Let Igbo think it through well. Let the good ones among them do something. I don't see any Igbo becoming the president of Nigeria in the next 20 years, and it can easily be extended to the next 100 years.

The best for Igbo is to find a way to create their nation if they are not ready to contest elections fairly, but they should do it without violence. Let them go and try it. This is my prayer for them, and let us see what will become of the Biafra nation. We will see how they will use the oil they always talk about when they aren't the majority of oil owners in Nigeria. They have forgotten about agriculture entirely.

I dont understand it....they abandoned their region, and live in other regions, and they are shouting that they want Biafra nation. Are they normal? So, if they create Biafra nation, do they still expect to live freely the way they live in other regions enjoying subsidies and other free supports? If their hosts chase them out of their places after having Biafra, what will they do?

Oh...I forgot...they always think they are entitled to everything. Oh....they will carry placards and go online saying they hate Igbos. Lol. Yes, they can have Biafra nation and still dominate other regions na.... Lol. Oh...they can even conquer other regions they occupy now since they thibk they are the ones building the regions. Very foolish way of acting. How can you leave your region and say you build other regions. Lol.

Seriously, the Igbo would drive themselves into extinction cos of their greediness. Greed is bad. How can they be too money conscious and abandon their states? It doesn't make sense.

They will soon attack me because of this post. The truth is very bitter.
This is to show you the fraud "one Nigeria" is. You are asking why Igbos left their Region develop other Regions? Really? What is "one Nigeria" then all about if all Nigerians dont make meaningful contribution wherever they reside in Nigeria?

Go about in Nigeria and tell me any Region that managed to develop anywhere in that Region that does not have federal or state capital status? But the Igbo man developed Nnewi, Onitsha and Aba without any of them needing to be capital of anywhere. Tell us that place you developed in your Region that did not need to be capital?

Igbos want to be President only during elections then talk about Biafra later? There are Yorubas agitating for Oduduwa Republic, did that stop a Yoruba man being President today?

This Presidency you people keep talking about all the time as if it is gold dust from heaven, how did it benefit those who held it in the past? Has the Presidency helped the common man?
