CAN the result of an election be ready before it is conducted? The factual impossibility was the plank of a testimony yesterday by a witness called by former military ruler, Maj.-Gen. Muhammadu Buhari to buttress his claim that the last presidential election in Nigeria was a sham.

His witness, one Mr. Emmanuel Iwuamadi, tendered before the Presidential Election Petition Tribunal in Abuja the results of the April 21, 2007 polls in Rivers State, some of which bear dates that were before the exercise was even conducted.

The controversial results were duly certified by the Independent National Electoral Commission (INEC), which, however, mounted a strong opposition to their being tendered but failed.

Buhari was the candidate of the All Nigeria Peoples Party (ANPP) at the election which has produced Alhaji Umaru Musa Yar'Adua of the Peoples Democratic Party (PDP) as Nigeria's president.

Former Vice President Atiku Abubakar, who contested the election on the platform of the Action Congress (AC) is also challenging Yar'Adua's declared victory at the tribunal.

At the resumed hearing of the petition yesterday, Buhari's counsel, Chief Mike Ahamba (SAN) tendered result sheets from Rivers State, certified by INEC.

In his evidence-in chief, Buhari's first witness, Iwuamadi, who is a member of the ANPP candidate's team that inspected INEC's documents regarding the presidential poll, explained that the result sheets established a frightening discrepancy in dates.

"Whereas the election was conducted on April 21, several of the election result sheets duly certified by INEC were dated April 20, 2007", Iwuamadi claimed.

He said: "Some of the forms EC8 B From these states pre-date the elections, some of them are dated April 20, 2007, others were dated April 21, 2007 while others had dates like April 24 and 28 April, 2007."

Iwuamadi, who said that "there were instances where one agent signed all the result sheets," testified further: "What I want to say is that there are discrepancies in these documents, there were also letters from electoral officers stating that there was violence and that some relevant elections result were missing."

He further alleged that some of the collated results in Rivers State were signed by security men as party agents. He cited the Onwuma Local Government Council of the state where, according to him, there were two conflicting results.

In his petition, Buhari argues that votes were merely awarded to candidates at the polls even before the election date. The former Head of State has in fact constantly insisted that no election was conducted on April 21 contrary to the claims of the electoral body.

No wonder result are being cancelled by tribunal from states to states.
