The Judge says Lagos is wrong to refer to itself in that way when it is just one of the states in the Nigerian federation The trial of a teenager and three persons accused of robbing a church during a vigil was stalled on Tuesday as the judge, Ebenezer Adebajo, questioned the prosecutorial power of Lagos State after it referred to itself as “The State of Lagos”. Justice Adebajo of a Lagos High Court ruled that “The State of Lagos” was not the same thing as Lagos state, because Lagos state exists as a part of the Nigerian federation and that using the name “The State of Lagos” suggested that the state belongs to Lagos. The defendants, Jamiu Saka, 16; Yusuf Lateef, 19; Chukwudi Onwuharanye, 18 and David Onokpise, 19, were alleged to have on May 19, 2012, invaded Sowers Ministry International during a vigil, armed with guns and cutlasses, and robbed the General Overseer of said church, Nelson Opara, of his mobile phone and money. The defendants were arraigned on a three-count charge, offences that are contrary to Section 295(2) (b) of the Criminal Law of Lagos State 2011, and they pleaded not guilty. When the court proceedings commenced on Tuesday, the state counsel, Olaitan Soetan, argued with Justice Adebajo that the matter could not go on as “The State of Lagos” was used as prosecution. The judge however countered the argument stating that “Section 3 of the Constitution is headed States of the Federation. It is by virtue of this section that a State belonging to the Federation, note the use of the word ‘of,’ is named as Lagos. Thus we have Lagos State.” He further argued that “this application is brought against The State of Lagos. It is a State belonging to Lagos” and then asked “does Lagos own a State? Who is Lagos or what is Lagos?” “Lagos exists by virtue of Section 3 of the Constitution and it comprises of named local government areas. To say “The State of Lagos” is to refer in my opinion to a State that belongs to Lagos. “It is not the same thing as Lagos State. It is for this reason that I do not accept that the party against whom the application is brought exists.” Justice Adebajo subsequently adjourned the matter to December 19 for ruling to be delivered on the prosecutorial power of Lagos State using “The State of Lagos”. Lagos state led a host of states in the southwestern part of Nigeria by developing its own flag and coat of arms in 2011 as rights of federating states. In most vacancies the maximum age for entry level applicants is usually pegged at 27/28 and in some ridiculous circumstances 24/25. A few days ago, news broke out that the Nigerian Senate was deliberating on making it legal for underage children to get married. At first, it seemed like a silly joke. But after I saw the videos and read the reports, especially on Senator Yerima, I was furious. I cannot believe that such a barbaric and extremely degrading issue will be discussed by the Senate in a country like Nigeria that is described as the Giant of Africa. Of all the issues facing this country: corruption, energy, unemployment, infrastructural deficiency, health, education, security, our senators have decided to waste tax payers’ money by sitting down to discuss how to enable these shameless, randy old men to marry under aged children legally. I cannot believe that a senator of Nigeria will push for child slavery to be made legal. I have read and I have studied all the stupid reasons that Senator Yerima and his colleagues have tabled; I will not even waste my time discussing it. No one should make this an Islamic issue. They should not take us all for fools. Now, I have absolutely nothing against Islam. In fact, I am a firm believer that every Nigerian has the liberty to practise whatever religion they like freely. But these shameless senators should not make Nigeria a Sharia state. Nigeria is not an Islamic country. Do not impose the evil desires of your heart on an entire nation using religion as a cover. There are no distinctions between child marriage and slavery. If anything, child marriage is worse. How can you subject a 13 year old child to that kind of life; a child who is yet to figure out her bearing in life. A child with hopes and dreams, a child that has a right to freedom, a right to education. Has Nigeria suddenly run out of mature girls who are fully developed and ripe enough for marriage that our shameless senators will actually resort to cradle snatching? I believe we are talking about marriage in Africa not in Europe or America.None of our matrimonial laws in Nigeria insists on traditional wedding before statutory. None insists on parents approval either. As long as you are not a minor (leSs than 21) you can get married with or without trad wedding or parental consent. However, some churches insist on both as a matter of 'church tradition.' The catholic church u mentioned insist on registry first cos they are not licensed (Catholic church does not believe in being subject to human authority in such matters) other orthodox churches like anglican, methodist and baptist conduct weddings without first going to registry. |

Traditional wedding is mere formalities if you will still go for 'court wedding' 2. Traditional wedding alone is not safe. Matters of custody, maintenance, inheritance, etc are uncertain (especially for the woman) 3. 'Court' wedding and 'Church' wedding are legally the same, as long as your church is licensed to conduct wedding. They are both Marriage under the Act. 4. If your church isn't licensed and you do 'church wedding' without going to the Registry, you're legally 'not married' Churches, like Catholic church and some new generation churches are not licensed to conduct wedding. The certificates they issue, in the eye of the law, are mere pieces of paper. Be warned!! |

Above all showing them love that will one day catch up with them to change.Legally, there is no provision for 'disowning' The only thing you can do is to write a will and exclude him from it. God help you if you die intestate (without a will), and the court appoints an administrator to distribute your property, he'll have as much right to it as your non-disowned children. Besides, you cannot compel him to drop your surname! Scripturally, if God loved us while we were yet sinners and released his only begotten son to die a shameful death, on no account should a parent disown a child.
