The Judge says Lagos is wrong to refer to itself in that way when it is just one of the states in the Nigerian federation
The trial of a teenager and three persons accused of robbing a church during a vigil was stalled on Tuesday as the judge, Ebenezer Adebajo, questioned the prosecutorial power of Lagos State after it referred to itself as “The State of Lagos”.
Justice Adebajo of a Lagos High Court ruled that “The State of Lagos” was not the same thing as Lagos state, because Lagos state exists as a part of the Nigerian federation and that using the name “The State of Lagos” suggested that the state belongs to Lagos.
The defendants, Jamiu Saka, 16; Yusuf Lateef, 19; Chukwudi Onwuharanye, 18 and David Onokpise, 19, were alleged to have on May 19, 2012, invaded Sowers Ministry International during a vigil, armed with guns and cutlasses, and robbed the General Overseer of said church, Nelson Opara, of his mobile phone and money.
The defendants were arraigned on a three-count charge, offences that are contrary to Section 295(2) (b) of the Criminal Law of Lagos State 2011, and they pleaded not guilty.
When the court proceedings commenced on Tuesday, the state counsel, Olaitan Soetan, argued with Justice Adebajo that the matter could not go on as “The State of Lagos” was used as prosecution.
The judge however countered the argument stating that “Section 3 of the Constitution is headed States of the Federation. It is by virtue of this section that a State belonging to the Federation, note the use of the word ‘of,’ is named as Lagos. Thus we have Lagos State.”
He further argued that “this application is brought against The State of Lagos. It is a State belonging to Lagos” and then asked “does Lagos own a State? Who is Lagos or what is Lagos?”
“Lagos exists by virtue of Section 3 of the Constitution and it comprises of named local government areas. To say “The State of Lagos” is to refer in my opinion to a State that belongs to Lagos.
“It is not the same thing as Lagos State. It is for this reason that I do not accept that the party against whom the application is brought exists.”
Justice Adebajo subsequently adjourned the matter to December 19 for ruling to be delivered on the prosecutorial power of Lagos State using “The State of Lagos”.
Lagos state led a host of states in the southwestern part of Nigeria by developing its own flag and coat of arms in 2011 as rights of federating states.
Bayela and Kwara states also have their own flags and anthems.

bishopjoe02: It is a usual practice by recruiting organizations to specify age requirements as part of their eligibility criteria. In most vacancies the maximum age for entry level applicants is usually pegged at 27/28 and in some ridiculous circumstances 24/25. After consulting the 1999 Constitution I discovered that this practice is unconstitutional as it is a form of discrimination.
Section 42 subsection 2 states that “No citizen of Nigeria shall be subjected to any disability or deprivation merely by reason of the circumstances of his birth”. Ladies and gentlemen your date of birth and hence your age is a circumstance of birth so also is your sex and ethnicity. Employers have been getting away with this constitutional violation because nobody has challenged the practice rather people go about doctoring their ages so as to meet up with these ridiculous age requirements.

The following are the only jobs that the constitution has placed age restrictions and these jobs are mostly electoral office positions;
1) President ; must be 40 years old...section 131 subsection 2b
2) Vice president; same as that of the president... section 142 subsection 2
3) Senator; must be 35 years old...section 65 subsection 1a
4) House of representative; must be 30 years old... section 65 subsection 1b
5) Governor ; must be 35 years old...section 177 subsection 1b
6) &nbspeputy Governor; ; same as that of the Governor... section 187 subsection 2
7) Members of the house of assembly; must be 30 years old... section 106 subsection 1b

Other jobs include state commissioners and special advisers to governors (which have the same requirements as those of members of the house of assemble) and ministers and special advisers to the president of the federation (which have the same requirements as those of the House of Representatives).

Ladies and gentlemen, taking into account our erratic educational system with its numerous strikes, most students especially those in federal and state higher institutions end up graduating in their mid twenties and when you then factor in the one year NYSC and the waiting period of prospecting for jobs (which could range from months to years) you will notice that a significant number of graduates would have exceeded the maximum age limits placed by prospective employers.

Dear naija jobbers, the wind of change is blowing and we should not just sit and watch our rights been trampled upon and I think now is the time to act. In developed countries you will be prosecuted if you dare place age requirements for any job vacancy.

I do not want to lie about my age because it is not a crime and I shouldn’t be made to suffer for it.

A few days ago, news broke out that the Nigerian Senate was deliberating on making it legal for underage children to get married. At first, it seemed like a silly joke. But after I saw the videos and read the reports, especially on Senator Yerima, I was furious. I cannot believe that such a barbaric and extremely degrading issue will be discussed by the Senate in a country like Nigeria that is described as the Giant of Africa. Of all the issues facing this country: corruption, energy, unemployment, infrastructural deficiency, health, education, security, our senators have decided to waste tax payers’ money by sitting down to discuss how to enable these shameless, randy old men to marry under aged children legally. I cannot believe that a senator of Nigeria will push for child slavery to be made legal. I have read and I have studied all the stupid reasons that Senator Yerima and his colleagues have tabled; I will not even waste my time discussing it. No one should make this an Islamic issue. They should not take us all for fools. Now, I have absolutely nothing against Islam. In fact, I am a firm believer that every Nigerian has the liberty to practise whatever religion they like freely. But these shameless senators should not make Nigeria a Sharia state. Nigeria is not an Islamic country. Do not impose the evil desires of your heart on an entire nation using religion as a cover. There are no distinctions between child marriage and slavery. If anything, child marriage is worse. How can you subject a 13 year old child to that kind of life; a child who is yet to figure out her bearing in life. A child with hopes and dreams, a child that has a right to freedom, a right to education. Has Nigeria suddenly run out of mature girls who are fully developed and ripe enough for marriage that our shameless senators will actually resort to cradle snatching? Are there no women in the senate? Where are all the so-called women in power? Are you all going to sit there and watch them do this to our children? Oh! Wait a minute! Where is the first lady of Nigeria, Patience Jonathan? Why haven’t we heard your voice? What is going on? Madam, if you do not get up and put a top to this madness, then I’m really sorry you’ve brought shame and shame on all the 35 senators who have voted to support this bill. bravolad: There has been a variety of views and opinions but we need to put things in perspective and context of our African identity and cultural heritage. I believe we are talking about marriage in Africa not in Europe or America.

To that extent, there are some laws regarding marriage rites in which case traditional or customary marriage is more important. This is because the the brides parents would need to sanction the union. It also involves the whole community of her Kinsmen witnessing and giving support to it. In Africa, after traditional marriage, a man is deemed married both by his kinsmen and in-laws. They could live without the white wedding. But you cannot just take a woman to the church for white wedding without fulfilling the traditional rites of marriage. Even if some church grants such wedding, the woman's family will challenge it. It also spells doom for the man if anything happens to the woman; the man must remarry the woman in death before her kinsmen.

Before, you are wedded in any church in Nigeria, you are required to prove that you have done the traditional marriage. This also implies that the groom has obtained the permission of the brides parents to marry their daughter. Much as I know, the Catholic Church will not wed you if you do not fulfill this requirement. More so, the church will equally require you to have done the registry aspect of marriage to fulfill the legal requirement of the law before the white wedding. When I wedded in the Catholic Church some years back, both were required before the church accepted the wedding.

While the registry gives a legal backing especially for women, the church/white wedding is merely for God's blessing. This so called white wedding was imposed on us by the British and they made it a requirement for the issuance of visas for a woman to travel to the UK with the husband and family. I personally feel it is discriminatory because married men are not required to provide it. (This is a discussion for another day). No sentiment please.

On the contrary, both forms of marriage can be relatively organized with a little budget and expenses, but this is a country where the majority of people follow the band wagon effect. I have seen families disintegrating because one family wants the society kind of ceremony while the other requires a low-key affair.
None of our matrimonial laws in Nigeria insists on traditional wedding before statutory. None insists on parents approval either. As long as you are not a minor (leSs than 21) you can get married with or without trad wedding or parental consent. However, some churches insist on both as a matter of 'church tradition.' The catholic church u mentioned insist on registry first cos they are not licensed (Catholic church does not believe in being subject to human authority in such matters) other orthodox churches like anglican, methodist and baptist conduct weddings without first going to registry.

You should be mindful of what you need, not just what you want.
My 2 cents:
1. Traditional wedding is mere formalities if you will still go for 'court wedding'
2. Traditional wedding alone is not safe. Matters of custody, maintenance, inheritance, etc are uncertain (especially for the woman)
3. 'Court' wedding and 'Church' wedding are legally the same, as long as your church is licensed to conduct wedding. They are both Marriage under the Act.
4. If your church isn't licensed and you do 'church wedding' without going to the Registry, you're legally 'not married' Churches, like Catholic church and some new generation churches are not licensed to conduct wedding. The certificates they issue, in the eye of the law, are mere pieces of paper. Be warned!!

However, lawyers should help answer the question if there is a legal provision for disowning an erring child.
Legally, there is no provision for 'disowning' The only thing you can do is to write a will and exclude him from it. God help you if you die intestate (without a will), and the court appoints an administrator to distribute your property, he'll have as much right to it as your non-disowned children. Besides, you cannot compel him to drop your surname!
Scripturally, if God loved us while we were yet sinners and released his only begotten son to die a shameful death, on no account should a parent disown a child.
PS: Prayerfully train a child the way he should go, and spare yourself a lifetime of pain and stress.

It is an open-secret that Sule Lamido is a presidential hopeful in the 2015 election. As if to confirm this assertion, former president Olusegun Obasanjo has lent his voice to the competence of Lamido to rule Nigeria.

The former president who was the chairman of an economic and investment summit held at the Sir Ahmadu Bello Conference lauded the achievements of the Jigawa state governor in office.

He said, 'You people of Jigawa, once again, I congratulate myself, because if you can say, yes, Obasanjo forced this one on us, it is a good forcing. You can help anybody to find a job, but you cannot help anybody to do the job. In this case, we found a job for Sule Lamido, he was ready, willing, able and competent to do the job.'

He did not mince word in describing Lamido as 'a person who exhibited good governance and one who is also competent to rule Nigeria.'

It is a malaise that has eaten deep into the fabrics of our public life- same thing with corruption. To curb it, stringent laws must be in place with vibrant law enforcement agents. The KAI-model should be adopted by all states.
