Politics › Telling Someone To Commit Suicide Might Be A Crime by blank(op): 3:02am On Jun 07, 2017

Taunton, Massachusetts (CNN) -

On the last day of Conrad Roy III's young life, the text messages popped up on his phone, one after another.

"You need to do it, Conrad."
"You can't think about it, you just have to do it."
"Are you going to do it today?"
The sender of the messages, authorities say, was his 17-year-old girlfriend, Michelle Carter. The "it" was suicide.
Prosecutors argue that the texts are overwhelming evidence that while Carter played the role of a loving girlfriend, she was secretly urging Roy to kill himself. The next day, in June 2014, Roy's body was found slumped in his black Ford F-150, dead from carbon monoxide poisoning. He was 18.

Carter, now 20, is on trial this week on involuntary manslaughter charges.

When Roy had second thoughts, she told him to get back in the truck and listened on the phone while he cried out in pain and took his last breaths as his pickup truck filled with the deadly gas, Assistant District Attorney Maryclare Flynn said Tuesday.
"She mocked him when he chose to delay his death," Flynn said in her opening statement before Bristol County Juvenile Court Judge Lawrence Moniz, who will decide the case. "She put him in the car that night."
Attorney Joseph Cataldo talks to his client, Michelle Carter, on Monday.
Attorney Joseph Cataldo talks to his client, Michelle Carter, on Monday.

But Carter's attorney, Joseph Cataldo, painted a starkly different version of events, describing Roy as deeply depressed over the divorce of his parents and a victim of physical and emotional abuse who was on a "path to take his own life for years."
"This is a suicide case," he said, "not a homicide."
Cataldo noted the young's man extensive online searches about suicide methods, Carter's attempts to get him to seek help and her own bouts with mental issues.
"It was his choice," Cataldo told the judge in his opening statement.
"She didn't cause his death."

Is it a crime to tell someone to commit suicide?
Boston defense attorney Peter Elikann told CNN affiliate WFXT that lawyers and legal scholars are watching the trial closely because it could set a legal precedent.
"At the moment, there's really no law on the books in Massachusetts about whether somebody can encourage somebody to commit suicide or not," he said.
Carter, now 20, is being tried as a youthful offender because she was a minor when her alleged crime took place. She waived her right to a jury trial, meaning her case will be decided by Judge Moniz, who will render a verdict after testimony is over.
Asked whether Carter will testify, Cataldo said "no comment."

Roy was found dead July 13, 2014, in his truck in a Kmart parking lot in Fairhaven, nearly 40 miles from his home.
He was wearing a blue T-shirt, shorts and sunglasses, a since-retired Fairhaven police officer testified Tuesday as Roy's relatives wept softly in the courtroom.
A cell phone was found in the waistband of his shorts. A gasoline engine was in the back seat. It was no longer running.
The day before, authorities say, Carter had urged him to go through with his plan to commit suicide.
"You're ready and prepared. All you have to do is turn the generator on and you will be free and happy," she wrote, according to a document disseminated by the Bristol County District Attorney's Office.
"No more pushing it off," she allegedly wrote. "No more waiting."

Conrad was a troubled youth who had tried to kill himself in 2012 by overdosing on Tylenol, his mother testified.
But after he began taking medication and went to counseling, he seemed much better, Lynn Roy said. He graduated from high school in 2014 and was making plans for the future, she said.
Her son never talked about Carter and she rarely saw them together, she said.
On the day he died, she went to the beach with Conrad and his sisters, Roy testified. He was laughing and joking about other people on the beach.
"He seemed fine," she said, although under cross-examination she added that her son later seemed "preoccupied."

In the months following Roy's death, Carter posted tributes to him on Facebook, calling him her "angel." She also organized a charity softball tournament and raised $2,300 money for mental health awareness in his honor.
But Carter insisted on holding the event in another town miles from Roy's friends and family, said Tom Gammell, who described himself as Roy's best friend.
When he questioned her on the location of the tournament, she became upset and "wanted to make clear that she was getting credit" for organizing the event, Gammell testified Tuesday.
He said he had never heard Michelle Carter's name before Roy's death.

As police investigated the death, they found hundreds of text messages between Carter and Roy. In one, Carter allegedly counseled Roy on exactly how to commit suicide using carbon monoxide.
"If you emit 3200 ppm of (carbon monoxide) for five or ten minutes you will die within a half hour," she reportedly wrote. "You lose consciousness with no pain. You fall asleep and die."

Carter was indicted in February 2015. Her trial was delayed earlier this year at the request of the defense. Youthful offenders are tried in juvenile court, but the proceedings are public.

Politics › Breaking: Court Orders EFCC To Pay Nyako N12.5 Million Within 30 Days by blank(op): 2:47am On Jun 07, 2017
The Federal High Court, Abuja, has ordered the Economic and Financial Crimes Commission, EFCC, to deposit N12.5 million imposed on it for infringing on the fundamental human rights of Abdulaziz Nyako.

Justice Gabriel Kolawale, who made the order on Tuesday in Abuja, said the fine should be deposited with the Chief Registrar of the court.

The News Agency Nigeria reports that the N12.5 million was imposed on the anti-graft agency as a fine for arresting and detaining the senator for three days.

It was also imposed on the agency for freezing all of Mr. Nyako’s bank accounts for over two years without a court order, or charging him to court.

The fine was part of the judgment delivered by the court on June 22, 2016 in favour of Mr. Nyako, who is a serving senator and son of former Adamawa governor, Murtala Nyako.

Ruling on an application by the EFCC for stay of execution of the judgment, Justice Kolawale struck out the application saying it lacked in merit.

The judge said that no cogent reason was placed before the court to enable it use its discretion in favour of the anti-graft agency and stay the judgment.

He disagreed with the argument of the EFCC that it would not be able to function if it paid the fine, adding that the argument was based on sentiments and not on law.

The judge agreed with Mr. Nyako that the motion of appeal said to have been filed by the EFCC was a ploy to deny him the fruit of his success in his court case against the agency.

“More than a year after the judgment was entered against EFCC, the compilation of records by the agency for transmission to the Court of Appeal has not been done and the period allowed by law has expired,” he said.

Mr. Kolawale also agreed with the senator that his arrest and the freezing of his accounts for over two years was an abuse of his fundamental rights as a serving senator and a responsible citizen of the country.

He added that the claim by the EFCC that the fine would hamper its performance was not tenable, because EFCC was adequately funded by the Federal Government.

He ordered that the EFCC, should within 30 days, issue a bank draft in the sum of N12.5 million in the name of the Chief Registrar of the Federal High Court.

“The registrar shall open an interest yielding account in a reputable bank of his choice with the draft,” Mr. Kolawale said.

In the alternative, the court ordered the anti-graft agency to provide a bank guarantee of N12.5 million.

He said that in the event that the EFCC failed to deposit the bank draft within 30 days, the respondents shall have the right to apply for garnishee order nisi.

A garnishee order nisi is to allow Mr. Nyako withdraw directly from EFCC’s account with the Central Bank of Nigeria.

The EFCC had in an application praying for stay of execution of the judgment, complained that it would not be able to undertake its statutory functions if the N12.5 million fine was paid to the senator.

The anti-graft agency also informed the court that it had filed a notice of appeal in respect to the judgment of the Federal High Court.

The agency said it would be in the interest of justice to delay the payment, pending the decision of the Court of Appeal on the issue.

Earlier, the judge had berated the EFCC for claiming that the court issued a judicial fiat in respect to the judgment.

The judge said that the EFCC as an organisation established by law, should learn to conduct its statutory functions within the ambits of the law.

He decried the situation where security agencies rushed to magistrate courts to obtain detention warrants in matters where magistrate courts had no jurisdiction.

The judge said that such habits amounted to “nothing but corruption” on its own.

“In this extant case, EFCC cannot be said to be a diligent party having just filed a notice of appeal in a judgment delivered almost a year ago.

“The EFCC should wake up and realise that the law that established it is not a cosmetic law but designed to protect the Nigerian citizens from acts of recklessness in the name of performing statutory functions.

“It is a political slogan that a security agency cannot be subjected to court orders when it goes out of its way to infringe on the fundamental rights of the citizens.

“The act of arresting and detaining before investigation is unconstitutional and bizarre and must not be condoned by any law court.

“Remanding suspects through magistrate court orders in matters where magistrate courts have no jurisdiction is not only tragic but unfortunate.

“This trend must be stopped, the security agencies must realise that Nigeria is now being governed through a democratic process,” the judge said.

The Federal High Court had in 2016, ordered the EFCC to pay as damage the sum of N12.5 million to Mr. Nyako.

The court also ordered that the EFCC should tender a public apology to Nyako for freezing his bank accounts and unlawfully detaining him for days without obtaining a court order. (NAN)

dcutey:
The new application does not give room for blanks or words in spaces to be filled with numbers. I'm also in the same situation as daddysgal2015. At the end of the day, I don't think it will matter what is filled for an infant as long as they are aware the applicant is an infant.
What i do when filling in visa application for my family to break the expenses up into each person's contribution to costs. If i have booked accommodation and they say infant's stay is free, then they have zero amounts. If the cost of a room is 200 pounds for the week. I will share it based on if i was booking for 1 adult alone and then start apportioning (using the booking website as a simulant). Remember to work through your travel itinerary. Example.

Accommodation,
1 adult - #100
2 adults - #150
Children are free.

Thus, father has #100 as his accommodation cost, Mother has #50, Kids are zero.

Train,
1 Adult - #200
2 adults #400
Children above 6 - #100
Children 1-5 - #50
Infants free

Thus the father has #200, mother has #200, 1st child has #100, 2nd child has #50, Infant has zero.

At the end, you total each person's expense per category.

It won't be out of place to see #0 for accommodation for an infant, #15 for transportation, #100 for shopping etc.

To ensure everyone has a family application, on the Visa4Uk website, after filling your form, click on fill for another person until you have filled for everyone. Everyone includes father, mother, kids.

Hope it's clear.

I have watched the video and that woman is evil, pure evil. May her punishment not be shifted to her children, husband or siblings. May she bear it squarely on her head. Even if as you say, the campaign is useless, all people need to do is to google her name and see the kind of heartless animal that she is.

It's because of Nigeria's lax laws that she is still walking around freely.

These Turkish Airlines have mean and very wicked air hostesses. I flew with them only once and vowed never to repeat that mistake. I got on the plane with my baby and he started crying because he was hungry. I needed water to make his formula. They had collected my water before i got on the plane. I begged these people for water and they refused. The people around me begged them for water as well, they said until the plane takes off. My baby was wailing his head off.

One nice oyibo man stood up and tried to go meet the pilot to demand for water that it was abuse against a baby. That was when they gave me water. Horrible human beings. I cried plenty cry on that journey because i felt so dehumanised. How can they be so wicked?

I couldn't watch the video to the end. It was heartbreaking. How can someone treat a child that bad especially a special needs child. It is already hard enough without adding torture to it. 2 years of such abuse? That's cold.

How can we let her go with just a slap on her wrist? Nigeria still has a long way to go.

1004 is a joke. Such structures in the USA and other developed countries are built to accommodate the poor on a flexible mortgage scheme. But in Nigeria, it is home for the rich. That is why it is odd. Someone just coming into the country will laugh out loud to note that someone can live there and park exotic cars.

That is what Davido meant. Those who are wealthy, do not live in controlled environments, they leave far from the general populace. In secluded paradise.
I agree with you 100%. Can't stand those flats. My issue is just that it is in the heart of the town and land there is gold.
