Politics › Disobeying The Constitution Or The Electoral Act Is NOT An Internal Party Affair by BluntCrazeMan(op):
A lot of people were referring to the judgement of the Abuja Federal High Court, and that of the Appeal Court to continue to hold that PDP was meddling into the internal affairs of the APC...

The most important thing to note here is that “the Judgement of the Supreme Court would be the final interpretation”...

Now, I am not pre-empting the supreme court judgement.
But we all need to know that, when someone is outrightly disobeying the Constitution or the Electoral Act, then, anybody anywhere can take it up in the court and demand that the court would declare that he disobeyed the laws of the land, and then, be properly sanctioned according to the law; (unless of course, the law in question specially stipulated the persons who must take up such cases.. for instance issues arising from primaries, and election tribunals.. Cases of improper documentations, and improper conducts do not have specified persons who must take them up.).

If the person (or persons) clearly violated the CONSTITUTION OF THE PARTY, but they did not violate the Constitution or the Electoral Act in any way,, then the offence can be called an Internal Party Affair..

We should know where the Boundary Lines are drawn in all of these..

Tor!

Nairaland why the misinformation?💁

It is the Supreme Court that will rule on the case on 26th May, and not Tribunal.

Why not tell your audience the truth for goodness sake?
Wrong Title I guess

Unfortunately he won't.even if they allow him, they will frustrate him from retrieving things
They just have to allow him..
They allowed Governorship Candidates..
So, why is it so difficult to allow a presidential candidate.??

(They actually have nothing to hide, so, let them even bring everything out for him inside a biigg hall.. And let the inspection go on in front of them..)

Obi had his time.
Lies..

Inspection of the BVAS is not time-bound.

And again, Obi applied for this early enough.

And finally..
Obi had to still inspect the BVAS the way it currently is.

Forensic will not take place.even if it does, you cannot cover all the bvas and with the bvas reconfigured, data recovered would not be reliable...if they were to do it,they would have done it since the guber polls finished.you have ran out of time
Meanwhile..

The Appeal Court gave the INEC only one condition for them to do the Reconfiguration of the BVAS Machines,, and that is, to do BACK-UP and then produce the CTC copies of all those items that were contained inside the BVAS Machines before wiping their data..

Abbegg Ooo...
Did the INEC do the BACK-UP.??

Or abi they totally flouted the court order.??

**(The INEC no go like wetin the judges go write for their “Pre-Hearing Report” tomorrow shaa ooo)

1. Tampering with evidence is a CRIMINAL Act..
(Am I correct on this.??)
(That is,, if such evidence is for a civil litigation, but it got badly tampered-with,, does the same “rules on evidence” which apply for criminal cases apply for such Civil litigations)

2. Now that INEC openly accepted that they tampered with the BVAS Machines,, (they supposedly backed-up ONLY the Accreditation Data in the BVAS Machines,, but they did not back-up the PHOTOS OF THE FORM-EC8A FROM THE VARIOUS POLLING-UNITS.. which were captured and stored inside the BVAS Machines..)
Can it be seen as a Fraudulent Act.??
And if it is established to be a fraudulent act on the side of INEC,, can it be a Ground for the Nullification of the Election.??

Let's look at it from that angle abbeggii..
I even later got to know that the INEC didn't even do any BACK-UP of any of the BVAS-Machines.
They just went straight and wiped off all the DATA inside all those BVAS-Machines..

Whereas the Court gave them the conditions for the configuration is to first do back-up..

Justice Tsammani: Televising the court cases is not provided for by the constitution and the powers are not resided hereon.

This panel sitting as Presidential Election Pettition Tribunal only has the power to listen to presidential cases.

The issue of televising is a policy… twitter.com/i/web/status/1…
Overtaken by events..

Not-Televising is also not in the constitution.
In case you missed my point.

So, INEC becomes the escape goat..
Well..

1. The forensic investigation of the wiped BVAS will still take place.

2. The extent of tampering of the BVAS would be established during the investigation..

3. The wiped “wharrever” can still be fully recovered in its totality...
It will just cost some more huge chunk of money..

2. Tampering with evidence is A CRIME on its own..
