Through his lead counsel, Ernest Obunadike, Danlami filed a petition against the declaration and return of Chindo. The petitioner accused the 1st respondent of presenting a forged primary school testimonial. (PDP & INEC were listed as 2nd & 3rd respondents respectively).

Labour Party has expressed confidence that tomorrow’s Supreme Court judgement would be in its favour.

The party disclosed this through its national legal officer, Kehinde Edun.

Edun noted that its presidential candidate in the February 25, 2023 election, Mr Peter Obi would be declared winner.

In his words: We are expecting victory because that is what justice demands; that is what Nigerians want. We will not lose hope. We have presented our case before the court.

Vanguard had reported how the Supreme Court had fixed tomorrow, Thursday, to deliver the judgment it reserved on the two appeals that are seeking to nullify the election of President Bola Tinubu.

Atiku and Obi are challenging the declaration by the Independent National Electoral Commission, INEC, that Tinubu of the ruling All Progressives Congress, APC, was the valid winner of the presidential election held on February 25.

AFTER the nomination, controversy, and the confirmation of a new Chairman of the Economic and Financial Crimes Commission, Ola Olukoyede, Nigerians should interrogate President Bola Tinubu over the continued detention of his predecessor, Abdulrasheed Bawa. Detained since mid-June, the former anti-graft czar has remained incommunicado, and without trial. Tinubu is displaying contempt for the law as exemplified by his predecessor, Muhammadu Buhari. He should chart a different course, and either release Bawa or prosecute him in court if he is found culpable of any crime.

Tinubu disappoints. Unlike Buhari who has a military background, he first came into public prominence as proponent of democracy. He was a leading operative in the struggle against military rule, including suffering persecution and exile. Besides, he constantly proclaims himself as a democrat and a “leader of democrats.”

But in office, he is assaulting the law. Instead of replacing the leadership of the Department of State Services that was Buhari’s chief instrument in violating civil rights, and ignoring court orders, Tinubu is backing its impunity.

The law is clear: the 1999 Constitution guarantees the right of every Nigerian to personal liberty. No one should be detained for more than a specified period without trial. Bawa has been held for weeks by the DSS, from which detention he reportedly resigned.


Tinubu had suspended Bawa over alleged abuse of office and “to allow for a proper investigation into his conduct while in office” on June 14, 2023. That is the proper procedure. The ex-EFCC chief was subsequently grilled by the DSS. But apart from recent leaked stories of alleged misdeeds, there has been no official word.

He is not the only one being denied freedom. The former Central Bank of Nigeria Governor, Godwin Emefiele, was also detained and later charged with illegal possession of firearms and granted bail. But DSS agents re-arrested him within the court premises before he could perfect the bail process. Like Bawa, he also resigned while in captivity.

Nnamdi Kanu, the ‘Biafran’ separatist agitator, has been granted bail, but is being denied freedom. Though Kanu’s case is a holdover from the previous government, Tinubu, the avowed democrat, and the Attorney-General, Lateef Fagbemi, have not moved to undo the lawlessness they inherited.


The rule of law is critical for the advancement of democracy, declares the Rule of Law Alliance, and is one of its cornerstones. Nigeria’s leaders should deepen democracy by respecting the law. Those who commit or are accused of crimes should be dealt with strictly in accordance with the law.

Bawa’s case is a cautionary tale for public office holders. Those who violate the rule of law today may also face tyranny when they are out of office and power. While he held sway as EFCC boss, he was cited several times for prolonged detention of suspects and multiple times for disobeying court orders. Emefiele treated a Supreme Court order with contempt, ignoring its ruling on the controversial naira note reissuance. Today, both men are at the receiving end. But multiple wrongs do not justify more of the same.

Allegations have been levelled; the responsibility of the state and its agencies is to investigate arrest and prosecute offenders, but always in accordance with the law.

Fagbemi should deliver on his promise to accord respect to the rule of law always. For him and Tinubu, Bawa and others being held in defiance of fealty to the law are test cases. They should arraign them in court immediately or release them.

A man identified as Sodirudeen Rufai has been arrested for attempting to set fire to the Guaranty Trust Bank building situated in the Oke-Ilewo Area of Abeokuta, Ogun State, on Tuesday.

PUNCH Metro gathered that the suspect claimed he decided to raze the bank after his several complaints that an unauthorised N500,000 was debited from his account fell on deaf ears.

Our correspondent further learnt that he was said to have been advised by the Area Commander, Metro, Abeokuta, that he should allow the bank to follow its procedure in unraveling the circumstances behind the deduction when he reported the matter.

However, PUNCH Metro learnt that the matter took a turn for the worse after the bank told him that he had been defrauded.


After receiving the news from the bank official who attended to him, our correspondent learnt that Rufai was said to have gone back to the bank with petrol and began to sprinkle it on the banking hall.

While the drama was unfolding, some customers scampered for safety, while others, along with the bank security staff members, wrestled Rufai to the ground before he could use the lighter in his hand.

PUNCH Metro gathered that the bank’s Chief Security Officer, Godwin James, handed the suspect to the Ibara Police Division.


Meanwhile, during interrogation, the suspect was said to have claimed that he took the action to attract the attention of the necessary authorities about what the bank did with his money.

Speaking with our correspondent on Wednesday, the state police Public Relations Officer, Omolola Odutola, said Rufai would be charged with attempted suicide and murder.

Odutola said, “He was fighting a noble cause in an ignoble way. He has a right to make a complaint that his money is missing. But the way he went about it was wrong. We are going to hold him for an attempt to commit suicide with murder because if he had succeeded, he would have killed himself and every other person in the bank.”

Bayelsa Guber polls: INEC releases amended candidates’ lists, removes APC’s Sylva[b]
The Independent National Electoral Commission (INEC) has released amended lists of candidates for Bayelsa and Imo governorship elections.[/b]

According to the amended list uploaded on the commission’s website on Tuesday, the names of Timipre Sylva and his ruining mate, Joshua Maciver of the All Progressives Congress (APC) were not included for the Bayelsa election.


The list was signed by the Secretary to the Commission, Rose Oriaran-Anthony,


The News Agency of Nigeria reports (NAN) reports that the column for the names of APC candidate and his ruining mate was left blank with “court order” remarks on it.

Also for Imo, the commission included the names of Uchechukwu Ishiodu as the governorship candidate and Ahumbe Chiazor as the running mate, for Peoples Redemption Party (PRP) for the state election.

Oriaran-Anthony, in the amended document, explained that the action of the commission was in obedience to court orders on the lists, served on the commission.

She recalled that the commission published the final list of candidates for the 2023 Bayelsa State Governorship Election on June 9 in accordance with the provision of Section 32 of the Electoral Act, 2022 and the Timetable and Schedule of Activities for the Election.

She said that after the publication, the commission was served with an order of court in respect of the nomination of candidate of the APC for Bayelsa governorship election.

“By virtue of the provision of Section 287 of the Constitution of the Federal Republic of Nigeria, 1999 (as amended), the Commission is bound to enforce the orders of the court on the nomination of candidates by political parties in the state.

“The Amended list of candidates in respect of the 2023 Bayelsa State governorship election is hereby amended pursuant to the orders of court served on the commission,” Oriaran-Anthony said.


Also for Imo, Oriaran-Anthony also recalled that INEC published the final list of candidates for the state governorship election June 9 in accordance with the provision of Section 32 of the Electoral Act, 2022 and the Timetable and Schedule of Activities for the Election.

“After the said publication, the Commission was served with an Order of Court for the inclusion of the PRP and its candidate on the list of candidates for the 2023 Imo State governorship election.

“By virtue of the provision of Section 287 of the Constitution of the Federal Republic of Nigeria, 1999 (as amended), the commission is bound to enforce the orders of the court on the nomination of candidates by political parties in the State.



“The Amended list of candidates in respect of the 2023 Imo State Governorship election is hereby amended pursuant to the Orders of the Court served on the Commission,” Oriaran-Anthony said.

The Federal High Court, Abuja, on Oct. 10, disqualified Sylva from participating in the state governorship election.


Justice Donatus Okorowo, in the judgment, ruled that Sylva having been sworn in twice and ruled for five years as governor of Bayelsa would breach the 1999 constitution as amended if allowed to contest again.

The judge also declared that Sylva was not qualified to run in the November poll because if he won and was sworn in, he would spend more than eight years in office as governor of the state.

Also the Federal High Court, Owerri judicial division in Suit No. FHC/OW/CS/35/2023 – PRP & Anor v. INEC, amongst others, equally ordered INEC to include the name of the PRP governorship candidate in the list of nominated candidates already published on the INEC website
