Foreign Affairs / Malawi Suspends Anti-gay Laws. Would Nigerian lawmakers Follow Suit? by Devonian(m): 5:32am On Nov 06, 2012
Malawi suspends anti-gay laws as MPs debate repeal
Moratorium follows arrest of gay couple in 2009 as Amnesty and rights groups urge permanent solution

Malawi has suspended anti-gay laws and ordered police not to arrest people who commit homosexual acts pending a debate on whether to repeal the legislation. President Joyce Banda's government announced on Monday that it had imposed a moratorium on the laws until the 193-member parliament could decide on the highly contentious issue. The move was welcomed by Amnesty International as "a historic step forward", but local activists urged caution. Sections 153 and 156 of Malawi's penal code criminalise sexual conduct between men and anyone convicted faces up to 14 years' imprisonment, with or without corporal punishment. Section 137A of the penal code criminalises "indecent practices between females", with anyone found guilty liable to five years in prison. Ralph Kasambara, the justice minister, said: "There is a moratorium on all such laws, meaning that police will not arrest or prosecute anyone based on these laws."

The laws that criminalise homosexuality in the deeply conservative country will not be "enforced until the time that parliament makes a decision", added Kasambara, who is also attorney general. If the laws are found to be unconstitutional, he said, it would be an embarrassment to the government, but if they are found to be valid, police will be able to act. "It is better to let one criminal get away with it rather than throw a lot of innocent people in jail," said Kasambara.

In 2009, two men were arrested and charged with public indecency after becoming the first gay couple to marry in the former British protectorate. The prosecution drew condemnation from around the world including from Amnesty. Noel Kututwa, its southern Africa director, said: "Amnesty International welcomes Minister Kasambara's statement and hopes it serves as the first step towards ending discrimination and persecution based on real or perceived sexual orientation and gender identity in Malawi. "We urge the government not to lose momentum on this basic human rights issue and to ensure the full repeal of these discriminatory and hate-filled laws." Gay rights campaigners in Malawi called for the government to go further. Gift Trapence, director of the Centre for the Development of People (CEDEP), which now openly operates in the country, said: "This is a good stepping stone but we want a total repeal of the sodomy laws for Malawi to align itself with international human rights standards. "Suspending is something else and repealing is another thing. We want the government to repeal these archaic laws." Trapence said CEDEP regarded the sodomy laws as "still intact until they are repealed" and said Malawians, who generally favour prohibition, should debate the issue with "sober minds and remove all prejudices". Chrispin Sibande, a rights lawyer, said the moratorium was "very shaky" because it was not supported by a clear legal order. He called the government move "political goodwill" that could change at any time.

Michael Kaiyatsa, a programme officer with another leading rights group, the Centre for Human Rights and Rehabilitation, said the suspension was "a welcome development and a step in the right direction". But he said rights groups wanted a "permanent solution – the complete repeal of sodomy laws". Banda, who came to office in April following the death of President Bingu wa Mutharika, initially said her government would decriminalise homosexuality but later made a U-turn and said parliament was better placed to solve the controversial issue. A recent report presented to Banda recommended decriminalisation of same-sex marriages as a way of fighting the spread of HIV and Aids.

I seriously doubt if any PhD holders would apply to drive trucks. Even if her/his PhD is in Igbo Linguistic, s/he should be able to secure job(s) in one of the Nigerian Colleges of Education if s/he can't get a job in a Uni. It's also often the case that whenever PhD holders apply for jobs which potentially demean their doctorates, they remove all references to the PhD in their CVs. In other words, they don't disclose their PhD credentials which is what I expect these PhD holders to do.

We shall all see!

hardbody: his kinsmen are being wiped out by the North that he worked so hard to align with.

Gowon's call of duty was to protect the corporate and territorial integrity of Nigeria from both internal and external forces/agression. Can you really blame him for wanting to keep Nigeria one?

hardbody: The Hausas and Kanuris are not through with with the Tivs yet, it's payback time. I am a good student of history, trust me

Are the Hausas and Kanuris through with other tribes in Nigeria yet? We all need to think through how to tackle the menace truncating Nigeria's peace and growth. What Nigeria needs is REVOLUTION. Something akin to Rawling's revolution in Ghana. In a famous interview with Dennis Ejindu in May 1967 (just before the start of the civil war), Major Chukwuma Kaduna Nzeogwu noted, '[w]e had a short list of people who were either undesirable for the future progress of the country or who by their positions at the time had to be sacrificed for peace and stability. Tribal considerations were completely out of our minds at this stage.' This assertion is still apt today. Without tribal sentiments, as I've said earlier on, and to borrow Nzeogwus words, we need "a short list of people who are either undesirable for the future progress of the country" (mainly politicians and military juntas who brought Nigeria on its knees) "or who by their positions at [this] time had to be sacrificed for peace and stability" of Nigeria.

Eze Promoe: Our people says, 'Ogbu na mma ga-ala na mma' (He who kills by the sword shall die by the sword) . It remains Gowon, maybe why he isn't dead now is because God is preparing the most shameful death for him. Majority of the innocent blood are crying 'Gowon' 'Gowon' 'Gowon'

Leave Gowon alone. Let him be. The Leadership mantle of a highly polarised Nigeria fell on him when he was only 32 (an age when some people are yet to figure out what they want to do with their lives). Gowon did his best for Nigeria in and out of office. After the coup d'état that abruptly brought his regime to an end, he humbled himself, went back to the classroom and earned his BSc, MSc and PhD from the University of Warwick (my alma mater). He is such a humble and godly man whose humility and sincerity of purpose I strongly admire, in spite of (real or alleged) shortcomings which all mortals have.

Mine, unflinchingly, is Patrick Chukwuma Kaduna Nzeogwu (1937–1967) a man of principle, charisma, character, strong ideals, integrity, vision, purpose and undaunted courage. If, the coupists in charge of operations in the South had a quarter of Nzeogwu's courage and determination on the night of January 15 1966, the course of Nigeria’s (and possibly Africa’s) may have forever been altered for good. Sadly, however, what he sought, and fought, to change (corruption, vote rigging, nepotism and tribalism) remains the bane of Nigeria's polity.

tlops: A Nigerian student is languishing in Ukrainian jail for allegedly defending himself against six teenagers who attacked him in an entrance to his apartment block on November, 5 last year in Luhanski , Ukraine.

I'VE SUMMARISED THIS FOR THE BENEFITS OF THOSE SEEKING GREENER PASTURES IN EASTERN EUROPE OR THOSE WISHING TO ENROL IN EASTERN EUROPEAN UNIVERSITIES.

African Outlook gathered that...Olaolu Sunkanmi Femi and one of his friends:

1. Were physically attacked;
2. Charged with attempted murder of five people;
3. [Had] since been remanded in detention by the  Ukrainian police;
4. [Have] spent almost seven months in jail without trial; AND,
5. Appeared depressed when he showed up in court.

BESIDES:

1. Nigerian students...raised concern about the competence of the female lawyer: Ludmila Havrysh handling Olasunkanmi's case;
2. The Ukrainian lawyer...wanted to be paid $10,000 when she had not even been able to secure bail for her client;
3. One of the attackers's family...has a connection with the Ukrainian police [hence] the reason why the Nigerian student was being detained without trial;
4. One of the supposed victim (Ukrainian) has a police relative or parent, and so vowed to deal ruthlessly with Olasunkanmi";
5. The Nigerian embassy's representative came to visit Olasunkanmi in jail once but did not return again after the first visit;
6. The [Nigerian] embassy staff said...he was confident Olasunkanmi would be released soon. (Do you trust him/her? I don't!); AND,
7. When asked if the [Nigerian] embassy has been able to secure the service of an attorney for the Nigerian student, the embassy staff said: "It is not within our mandate to pay for attorney's fees for any Nigerian in distress..." (JUST IMAGINE THAT! THANK GOSH I'VE SWAPPED MY NIGERIAN CITIZENSHIP.)

MOREOVER:

1. A 28-year-old Nigerian student of Kharkiv National Radio Electronic University is in intensive care unit with knife injuries to his neck;
2. A 19-year-old Nigerian student from the Poltava Agrarian Academy is also lying critically ill in the Ukrainian hospital following knife injury inflicted on him;
3. Two Nigerian students were attacked late in the evenings [OF...] by assailants who fled the scene immediately after the attacks;
4. Many Africans including Nigerians have been killed in Ukraine by white supremacy gangs known as Skin heads in the past;
5. On January 18 2009, Shefiu Salawudeen, a Nigerian  was stabbed to death in Lviv, Ukraine around 8pm  while waiting at the bus stop to board a bus;
6. Same year, a Nigerian girl was also killed in Kharkiv, Ukraine;
7. A staff of the Nigerian consulate escaped death by a whisker when he was attacked in 2008 by the Ukrainians  gang;
8. No less than five racial killings of African were reported in 2008 alone; AND,
9. "Racially motivated attacks occur in Ukraine while police and courts do little to intervene" the Council of Europe said in a report made public February 2008 in Strasbourg.

meritdee: Listen or not... It has nothing to do with the AIM and OBJECTIVES some unseen powers has laid down.. There is more to BH bombings than what you guys are reading and seeing. There is nothing GEJ can do to stop it!(P.S. I'm no one's fan. GEJ or no GEJ). Forget what you know... There are some powers above GEJ.

1. They are brainwashing everyone, not only the suicide bombers but also trying to draw the attention of the masses towards the ungodly acts. Other examples are the happenings in other countries around the world. When people see breaking news on TV, listening to Radios and every other means, 90% percent of your mind is already drawn towards expecting a war related news.

2. They are reducing population.. Unruly killings everywhere. They've turned human beings to sacrificial lambs only for their hidden agenda.

3. They are causing confusions and fear.. They are trying to put fear in every living being, they want our soul to cry out for a messiah/saviour.

Try take your mind off Ethnic or religious ish for a while and think deep... I'm not trying to be too religious but I think its a warning call for everyone to prepare there mind for more evil to follow soon, when everyone will now cry out and seek that messiah to come put a stop to all these mess. And the much talked Anti-christ would take over power and peace would reign for a while.

Just a lil of my opinion tho.... If GEJ should mess up, he could end up like his other fellow African leaders that have passed.

I humbly beg to not only disagree with your messianic theory and propaganda, but also the twisted claim that there is nothing GEJ can do. Listen! In the developed world, let's cite two examples: UK and US, Mulsim terrorists keep making attempts geared twoards blowing up people, buildings, etc, whilst security agents M15 (in the UK) and FBI (in the US) keep trailing these terrorists and nibbling them before they carry out their dastardly acts. Only last week, an attempt by a 21-year-old Bangladeshi man studying in the US, to blow up the New York Federal Reserve Bank was uncovered by FBI agents (http://www.nytimes.com/2012/10/18/nyregion/arrest-in-plot-to-blow-up-federal-reserve-bank.html). In the same week, in the UK, plans by British Al-Qaeda gang to unleash 'another 9/11' in UK was uncovered by security agents (http://www.telegraph.co.uk/news/uknews/terrorism-in-the-uk/9625280/British-Al-Qaeda-gang-planned-another-911-in-UK.html#). There is a lot that Nigerian security agents can do if the government really wants them to go after these monsters including their patrons - whoever they may be! The government, through the security apparatuses, needs to fish out members and patrons of Boko Haram. Individually and collectively, they can't be bigger than the state. If Bin Laden was smoked out, killed and deposited in the Atlantic, so can the barons sponsoring Boko Haram.

It appears no one mentioned gossiping. May be Christians no longer consider gossiping a sin – which it is even if the subject line or subject matter remains true. Gossips have not only ruined relationships and marriages, but also maligned characters and destroyed careers (sacred/religious and secular). Some of the most chronic born-again lads and lasses as well as pastors, priests, elders, bishops, etc, I’ve met and interacted with gossiped. In the secular domain (especially in the social sciences), gossiping is positively considered. In the business world, it is considered a counter-productive phenomenon – especially in the work place. Biblically, however, it is an anathema to the Christian faith. Yet, most Christians, indulge and revel in it.

So, what I'm hoping to do is to take a 'leave of absence' from my current post and test drive in Naija. If I can't cope, then I simply return to my current post.

I certainly do not need you to tell me I needed to secure jobs before returning. Neither do I need you to tell me there are loads of jobless Nigerians seeking seimilar lectureships. Leave that to the faculty search committee who would consider individual candidate's educational qualifications, experience, publications in peer-review academic journals, etc. You’re surely one of the scumbags and hustlers I was referring to when I posted this message.

First of all shall I say that I posted this thread not with the intentions of being egoistic! Whilst acknowledging the fact that anyone who previously lived abroad and returned home (or people who haven’t travelled abroad, but knows the reality on ground) may have one or two things to say which would be quintessentially useful for my situation, I’m also aware that too many people derail threads on NL. For example, netotse, the first person to respond asked “what sector are you planning to go into” when this was already apparent in my post. This partly explains why I’m keen to hear from professionals and academics. Besides, I was hoping to hear from anyone in the same profession that left the West for Nigeria to give me feedback on their experiences back home in Nigerian universities. Consensus seems to be give it a test ride first (PapaBrowne "visit first for a month or two before making a final decision"; Kobojunkie "go down there for 3 to 6 month periods at first"; ftmom “set up a trial period during which you can decide what you want to do long term.”) I would certainly do this. Some also suggested business. I definitely wouldn’t go into business in Naija.

After over 10 years in the UK where I obtained my bachelor's, master's and doctorate degrees, in addition to teaching for a few years, I am planning to return to Nigeria and contribute my own quota to my fatherland. I intend taking up a teaching appointment in a University, preferably a Federal University.

Is there anybody on Nairaland who, as professionals or academics returned home from UK, USA, Canada or Australia, who can share their experiences with me here on:
(a) what to expect; and
(b) the pitfalls to avoid.
If you do not fall into this category please DO NOT respond to this posting. I need ONLY professionals or academics (not hustlers, no offence intended, please!) who have already experienced returning home after a long spell in European, North American and Australasia countries.
