Penguin2: That the law supports cancellation of votes if over voting is established is not in contention but I still maintain that what happened in Osun is rape of justice.
. Can somebody help us reach out to Kolaoo Alimi in Osun Central and Top people with thier topless leader Aregbesola yo know how they are faring now? Did they even sleep last night?
fergie001: Their lawyers will do a better job in that.
It is in the written statement of Anababa that overvoting was in over 1 500 polling units. Results INEC issued were fraught with overvoting. INEC data were used against it..What difference will it make at AC?
Penguin2: Agreed that TB acted on behalf of INEC but after cancellation of votes from over 700 polling units, do you think the provision of subsection 4 was met?
Are 700 polling units so small and insignificant that a winner can be declared without votes from there?
. In Aregbesola vrs Oyinlola. 2011 votes in entire 10 local governments were cancelled. Votes cancelled across ten local governments not the entire local governments. The law supports cancellation of votes if there are overvoting and non compliance of electoral laws. Neither of the two judgements is in support of rerun because there is no provision for that in the law. Elections took place in the contested polling units but irregularities were there.Cancellation is in order
yarimo: Your attention or salute is drawn or not. The governor should hand over immediately without wasting tax payers money in any appeal court. This is victory for democracy and welcome development to the people of osun state
Arutan: Are you saying Adeleke had F9result all round in his o/level? If this is true then it’s a shame for anyone to support such a person to assume leadership of a state. F9 all round That is very terrible.
Yes that was why in 2018 he registered for NECO. exam at Aisu Ede only to be impersonated by a boy. They were all arrested and it became a serious case then.. That was why he went abroad to undartake a road side degree within 12 days.
Penguin2: What we are trying to find out is where the Tribunal derived the power to cancel votes in over 700 polling units without ordering a rerun but going ahead to declare a winner with the exclusion of votes from over 700 polling units.
Is that justice?
INEC shirked in its responsibility to cancel votes cast where accreditation was compromised. The Tribunal is empowered by the law to handle cases relating to the election and decide on the matters. Cancellation is in the constitution on the controversial poling units The TB followed what is in the constitution as long as cancellation took place where there were cases of overvoting as presented and argued by the petitioner!TB acted on behalf of INEC as enshrined in the constitution.
INEC is the first defendant and is infact very interested because BVAS is on the line.
. We await whether INEC will appeal or not.My question from what he said is: Is it a must for the second judge in the majority judgement to read the judgement too? Answer is No .Since he was supporting all he needed was to sign the. judgement as he did.
fergie001: I am not been emotional. This has been my stance from when the suit started. Ejimatic & garfield1 know that.
Yes you are right ! IIt may interest us that NEC has even reportedly decided not to appeal the case. Anaba SAN refused to come for the judgement today .INEC knows that their genuine data have been used against them
fergie001: Have you read the minority judgement, No? You based your assertion on the majority....hmm.
. The minority judgement claimed Adeleke results should be used not the the results issued to Oyetola by INEC with CTC written on it.How would the decision be to Nigerians? INEC issued a result and ratified it. The body represented by Anaba SAN even agreed that there were overvoting in 1539 polling units. Who would reject the CTC results from INEC? Can syncronization fill in the vacuum? Is syncronization in our electoral laws? The majority judgement is in order. My opinion anyway!
Penguin2: The lead judgment of the Osun Tribunal was hinged on over voting.
But what did the 2022 Electoral Act say about over voting?
Read the provision of the Electoral Act on over voting as captured in section 51 and decide for yourself if justice was truly served in Osun or not.

. The TB reserves the right to adjudicate on an election matter, cancel result. and return winner on behalf of INEC especially where there is no possiblity of rerun after manipulated results have been cancelled.
fergie001: See, the Tribunal Chairman based his evidence on the BVAS report which is a secomdary evidence rather than the primary evidence, the machine itself.
What about the voter's register.... Useless to Justice Kume.
One of two things will happen at the Appeal Court, either it is upturned or a retrial will be ordered but since there is no time, it should be upturned.
It is funny....just take a look at the majority judgement and tell me you wouldn't laugh.
. I have perused the judgement and the only thing that is funny there is "lo lo lo Buga win' Apart from that the judgement is in order. Oyetola went to court to prove overvoting and non compliance with electoral laws. The majority judges were fully convinced that he proved his case beyond the reasonable doubt. The electoral laws state that in a case there are overvoting and non compliance all the results in the affected polling units must be cancelled. In my opinion it was INEC that created issues in the Osun election by issuance of CTC results of the election that contained overvoting and irregularities. As for the forgery the TB confirmed forgery but claimed Adeleke still has o level result though it certicate is questionable for nobody will issue certificate for a result with F9 all round. APC will challenge this forgery conclusion at the AC and the entire minority judgement too.
Our attention has been drawn to Osun Judgement today which declared Oyetola as the winner of the July 16. 2022 election. Some people said the third judge did not say anything in the judgement.Gov Adeleke referred to this in his speech this afternoon. To set the record straight, It is not important for the last person to read the judgement. All he needed was to sign the judgement showing he agreed with it. Pls find attached the buttom of the judgment last page.
. Uneducated ilitrate CUPP! The body does understand how judiciary works. They should go back and learn government in secondary schools. If it is a sponsored judgement why having dissenting judgement? It is shocking that many voters don't know how Osun election was bedeviled by overvoting and irregularities. Cancellation of all the results in the contested local governments is justifiable. BEVAS don't guarantee free and fair elections. It is the masses that work towards fairness in our elections
. It is your right to do so but I forsaw loss for Adeleke today and it will repeat Itself in AC and SC. The BVAS exposed the rigging ,overvoting and manipulation of the election results! How would you explain the difference among BVA report EC8 forms and results posted online by compromised INEC officers especially the recruited officers?. I forsee the appeals of Adeleke will be struck out for lack of merit from AC to SC.
iwaeda: What Are the implications of Osun Election Tribunal on INEC use of BIVAS? With the nullification of 749 Polling Units, by the Tribunal means. INEC may not control the election.
1. BVAS cannot quaratee free and fair elections 2. BVAS can be manipulated to facilitate rigging ,overvoting and irregularities. 3 Results posted on the INEC servers can be manipulated by compromised INEC officers 4. BVAS do not have how people vote but how they are acccredited. 5 Free and fair elections are not quarateed in the next elections.6 Results can be manipulated even with BVAS. 7 All those things are factors that worked against Adelekes B Ede votes were manipulated on a grander scale so much so that twisted results were uploaded on INEC site. May we not experience that in February elections
counsels appearances for both parties being read to the judges.
Proper commencement of of business of the day being awaited.
Imole de Okunkun Parada ni gbogbo ipinle Osun. Senator Ademola Nurudeen Jackson Adeleke’s a goal . Victories on every side
BVAS was on trial today. It has been established that even with BVAS rigging and overvoting are possible. Can you imagine different results will be sent to INEC server by compromised presiding overseers and party agents in Osun. The majority judgement is on favour of Oyetola and it was read by Tribunal chairman seconded by the last member. Congrats to the winner!

CutieKing: This is strange.. Hardly winners of elections lose at the tribunal except at appeal or Supreme Court. This is rather strange. Pdp need to study the loopholes in the judgment and appeal.
Olowoeko11: people of Osun state won’t believe that
Oyinlola spent 8 years as the PDP governor.Does he have any legacies in Osun today? The years were spent on parties at Ada and dancing spree in Osun ...
fergie001: Not true. Forgery wasn't established. It was thrown out.
The main issue is over-voting, it's a split decision.
. I forsee Catch 22 in the judgement ochestrated by INEC and its lawyers.. The judgement continues but at the AC there will be appeals and counter appeals by both parties!
