Unmarried Ontario couple had no children and no house but man must still pay support, appeal court rules

TORONTO — A wealthy businessman will have to pay more than $50,000 a month in spousal support for 10 years to a woman with whom he had a long-term romantic relationship even though they kept separate homes and had no children together, Ontario’s top court has ruled.

Under Ontario law, an unmarried couple are considered common-law spouses if they have cohabited — lived together in a conjugal relationship — continuously for at least three years. But that doesn’t necessarily mean living in the same home, the court found.

“Lack of a shared residence is not determinative of the issue of cohabitation,” the Appeal Court said. “There are many cases in which courts have found cohabitation where the parties stayed together only intermittently.”

The decision comes in the case of Lisa Climans and Michael Latner, both of Toronto, who began a romantic relationship after meeting in October 2001. At the time, she was 38 and separated with two children, court records show. He was 46 and divorced with three children.

Although they maintained their separate homes, Latner and Climans behaved as a couple both privately and publicly. They vacationed together. He gave her a 7.5-carat diamond ring and other jewelry that she wore. She quit her job and would regularly sleep at his house. They travelled together and talked about living together.

Latner proposed several times and Climans accepted. He often referred to her by his last name. However, he insisted she sign a marriage contract and came up with several drafts. She refused.

Throughout their relationship, the two kept separate bank accounts and never owned property in common. Nevertheless, Latner gave Climans thousands of dollars every month, a credit card, paid off her mortgage and showered her with expensive gifts. He provided her and her children with a “lavish lifestyle,” the court found.

“Theirs was a committed relationship,” the Appeal Court said.

When their 14-year relationship finally broke down in May 2015, Climans asked the courts to recognize her as Latner’s spouse and order him to pay her support. He argued she had been a travel companion and girlfriend, nothing more. As such, he said, they were never legally spouses and he owed no support. An eight-day trial ensued.

In her decision in February 2019, Superior Court Justice Sharon Shore sided with Climans. She ruled they were in fact long-time spouses, finding that despite their separate home, they lived under one roof at Latner’s cottage for part of the summer, and during winter vacations in Florida. Shore ordered him to pay her $53,077 monthly indefinitely.

The higher court leaned heavily on Shore’s analysis, finding she was right to conclude cohabitation can occur even when the parties stay together intermittently.

The Appeal Court did find Shore had made an error in deciding how long Latner would have to pay Climans support based on when they first began cohabiting. While Shore had found that to be almost from the get-go, the higher court said it wasn’t earlier than their first stay together at his cottage, meaning they didn’t reach the threshold for indefinite payments.

Instead, it ordered him to pay her support for 10 years.

Climans and her lawyers declined comment. Lawyers for Latner did not immediately respond to a request for comment.

Hope you know AMAC means Abuja Municipal Area Council. Any city within AMAC is Abuja including the City Centre which is Asokoro, Maitama and the rest. I work with the FCTA so I know.
That is why I said anything outside AMAC is not abuja. We are saying the same thing. And you dont need to work with FCTA to know that.

Technically it's not. Abuja is Central area, Garki, Maitama, Wuse and Asokork. Others are FCT. Anything outside AMAC is FCT, not Abuja.
Abuja is in FCT.

I doubt there is a 2017 car that cost less than 3.5m especially with the current exchange rate. This seems more like a strategy to reduce the number of drivers on these apps.

I had a female friend that was doing well financially working with a top bank but refused to buy a car so that it wont drive away suitors. I never understood it and I still don't understand it. A guy that won't approach a lady because she has a car has self esteem issues and I'm sure as a lady that is the kind of guy you don't want approaching you.

I agree with you. I have lived in Abuja and Lagos, and Abuja is way more peaceful.
However, there is a reason people keep flocking to Lagos. Lagos has more opportunities than other cities. There are more jobs and businesses thrive more in Lagos. If other cities in Nigeria get their acts together, the burden on Lagos will reduce.
And also, Lagos has one the smallest landmass in the country, there is a limit to how much people it can sustain.

This is to tell you the type of people we have on Nairaland.

You see, some people went to school and they became graduates, but don't have that thinking faculty to profer a solution when the need arises.


I also came about a thread where a guy was kinda seeking for people opinions on how to curtail the spread of COVID-19, but still the moods keep feeding us with Abba k.

We ain't ready to progress in this country. The governments ain't to be blamed.
Mask stops people from spreading it, but doesn't protect the wearer. There were confusions initially about the use of mask. But it is still advisable that people wear it since one may be asymptomatic and still be able to spread it.

I remember predicting that the reign of the Coronavirus would come to an end when people started wearing face masks. It is gradually coming to pass. The reason the entire world is in this mess is that the Asians, who produce most face-masks and other personal protection equipment, blocked their manufacturers from exporting them to the rest of the world because they knew that they would be needed to protect their people.

Instead of the West to respond by mobilizing their manufacturers to produce face-masks massively, so that they would be able to protect their people, they started a deceptive campaign to discourage people from using them. The campaign was so effective that people who wore face-masks were mocked and shamed by those who had been brainwashed. People who had face-masks were pressured into giving them away.

Now they grudgingly accept that face-masks are helpful but instead of producing adequate quantities of the quality face-masks that have been proven to be effective - the kind of masks that most Asians are wearing - they are asking people to use less effective home-made masks.
The use of face mask is a bit more complicated than that. As you said most countries do not have the supply chain to meet demand, and if everyone is wearing, there wont be enough for healthcare workers. I work in a pharmacy in canada and we have not had face mask in some weeks. Canada just started receiving recently and producing.

Let's take Lagos for example with a population of 20 million people and you have to use a mask a day. If 10 million people are using face mask, that is 300 million masks in a month. China has stopped selling, Aba cant produce that number. Remember that is just lagos.

As much as it will reduce the spread, it's a supply chain nightmare and that is why people have been asked to make theirs at home, it may not be so effective, but it's better than none. And for the business minded people, this is a perfect business opportunity, you are sure of a 300million demand in lagos alone for the next few months

If they should reduce it drastically, when the global price of oil increases again (as it will), it wont be easy to do a drastic increase. With a 20 naira reduction, they can increase it back to 145 without people rioting or even leave it at 125 without losing much. But people will certainly riot if they want to increase from 70 to 145naira.

Pros and cons for each:
US
Pros: easier to get funding than the other countries listed. if you get to stay, pay is higher in the US. US is more fun if that is a factor for you.
Cons: there is no easy path to residency, that's why most either marry a citizen or stay illegally. The other option is if you get an employer than can file for you, but then you are a slave because you cant resign without losing your status.

Canada
Pros: Easy to get PR after studying. Canada is more welcoming of skilled immigrants. I dont know much about your field but job prospect is dependent on what you study so you have to research your field well.
Cons: Not much funding available, high rate of student visa denial. I know some people that were denied in 2019. And Canada can be boring, if that matters to you

UK
Pros: Easiest to get Visa of the 3, with the change in rule, you can get to stay back for 2 years after your program which gives you opportunity to get UK experience.
Cons: UK schools are expensive. Immigration law seems to change often so you may get stocked. And if you stay back after study, I'm not sure what happens after the 2 years.
NB: i do not know much about UK generally.

I don't think his name should be released... but it is not an offense if it is.
I dont know why the doctor's name was published, but ideally it is wrong to give out medical information of a patient without their consent. In canada, not one single COVID-19 patient was identified by name, just age and where they traveled to.

Edit: I think most of the accounts in the screenshot are fake accounts. Most were opened in February and March, and with little or no following and followers. I had to check so I dont get triggered by trolls.

I was going to type the same thing. He only boast about his father, and he insults people with poor background. FFK has not achieved anything personally to boast of, everything he is, he was given because of his name.

I know, and the affordable services from tailors, to salon( In one salon at the East Coast, I was told plaiting fee is 250 USD, what I do for 10 dollars, I almost turned back except for the fact that I needed to).

This is weird but I just got tired of speaking fluent English without a mix of Swahili as I had no East African around.

Yes I also miss those affordable services. Tailor, cobblers etc. I have some shirts to adjust, and I'm weary of going to tailors around here.

The last paragraph got me laughing.
When I travelled abroad, I was impressed by how efficient the public offices were and the system. This was until I needed a driving licence that I realized how the lawlessness of my country could have easily got me that without even going for the driving test. Oh boy, I missed the corrupt system.

But now I am so strict to follow procedures and rules, and doing everything ethically. So that's a positive impact from the West .
Same here. I'm going for my driving test soon and the whole thing makes me miss Naija's lawlessness. In Nigeria we get used to getting around things by paying for it.

I had a similar thought recently.
I have an unpopular opinion about democracy. I do not believe it is the best way to elect rulers especially in developing countries. Election is more of a popularity contest than a means of choosing those best fit for the job. People choose their leaders based on charisma, popularity and sentiments like religion and tribe.
For democracy to work, you need well educated voters that can analyse the policies of the contestants and make a reasonable decision. Unfortunately we don't have that in Nigeria or most developing countries.
Until the people become better educated or we change our way of choosing our leaders, we will continue to elect misfits.

I don't think that it has anything to do with the protest. The reason is in the last paragraph. Almost 20% of Nigerians that visit the US end up stating illegally.

I once dated a lady for about 3 months, and in that 3 months I can't tell you how much I spent on her, up to paying for rent for her parents in Abuja. We broke up and she got married to someone else. Then she started bothering me for money that her husband isn't giving her cash, wanting to be my side chic, sending me nude pics, all because of money. I am saying this because I realised something from her- people like her can do anything for money.
My advice- don't lavish too much money on her, set up a business for her and she takes care of herself from the profit

The said husband should learn to control himself. I am a Christian and a fan of Adeboye, but this is very wrong. In countries with laws, the so called son will be sued.
