I don't see why the employer would be penalised by a tribunal if he has receipts e..g Teams records to back up his response.
The OP is talking about a situation where the employee is not given warnings in all these instances because according to him he'll only keep telling reference requesters, while keeping his 'joker' hidden to bring out in court.

In such an instance how will the OP show that the employee did not give valid explanations in the absence of documented warnings/queries? What will he use to establish that the explanations were not valid?

If he starts to write down verbal discussions and compile them, how will he prove that his version of events is correct if those are not presented to the employee to countersign as being accurate? It'll be his word against theirs in court, no? Or will he begin to make audio recordings - I can see the ICO having a field day with that one.

In all of these scenarios as well, it'll be incredibly easy to prove that the OP is being vindictive and unfair by keeping silent on performance issues while communicating that to the employee's potential employers.

P.S. There's also the separate data protection issue of whether it'll be appropriate to share an employee's meeting attendance records with other organizations down to the time when they joined and left meetings, but that's a separate issue I'd guess the ICO would be interested in.

Edit: see the government's guidance on references: https://www.gov.uk/work-reference It specifically cites warning letters as a way employers can back up their references. OP is proposing to deliberately avoid warnings. It'll be a walk in the park for that employee's lawyers to prove malice.

The information I have provided is true, not false. It is well documented, none discriminatory and has verifiable evidence. Whether the company was fair in it's policy of not disciplining every employee post every single or recurring err is another thing.

Just so you know, the company could also have brought these things to the employee's notice, give them fair hearing etc and still mention them in references because doing those things does not invalidate what happened.
You're missing the point.

Your first post talked about writing things that you've been silent about. In your own words: "You won't know you've committed certain blunders that I overlooked until you take me to court and I present evidence."

Obviously if the employee has breached policy and they have been queried or disciplinary measures (such as warnings) have been documented, then sure you can fairly and accurately include those in a reference.

Surely you can see how those are completely different scenarios.

Anyway, I tire of this debate, feel free to do what you've said sometime sha. It'll be clearer to you then why the vast majority of organizations in the UK choose to simply state when an employee worked and their JD, and only talk about negatives in the worst circumstances like fraud. Even minor queries are usually left out just to avoid ET risk.

For example, you can choose to comment or answer questions on the employee's sickness or absence record.
A sickness or absence record is one thing. It's a matter of fact and not disputable. The employee will be aware of what's on their record.

Formal disciplinary procedures can be notified as well.

But compiling 'things the employee did wrong' without ever putting them to the employee formally and making them aware/giving them fair hearing, but yet consistently detailing those allegations in references? I'd bet my bottom penny that no employment tribunal in this country will agree that that is fair.

I did not mean I will fabricate things against you. As an employer, I can easily pick up things I could ordinarily overlook and use it against you in referencing and it will be justifiable. You won't know you've committed certain blunders that I overlooked until you take me to court and I present evidence.

That aside, what do you mean by the bolded? Will the employee take over the company if he wins?
That's not the way it works.

No. I already told you how there are already systems in place to verify a person's need and to support them to the extent that they require. It's you who's making it seem as if people just wake up, stretch and declare 'I have a disability and I want benefits', and are then handed the keys to councils' vaults to take as much as they like.

I don't mean to sound like I'm attacking you (I really am not) but it's clear that you don't know much about how the system works, and you're basing your perception off articles like the one that started this conversation. Those articles are planted to rile people up against specific demographics, just like the constant attacks on immigrants.

Just FYI, the process of claiming disability payments takes a long time - usually several months, and typically requires assessment by a medical professional. It's also not usually permanent - it needs to be reviewed regularly.

On fraud - (DWP) has published annual statistics on benefit fraud and error which show that estimated disability benefits fraud was just 0.2 per cent of funds paid in 2022-23. Compare that to the funds lost to government cronyism at all levels from councils to Westminster and you'll see it for what it is - a distracting tactic.

So government should be the one running social care, right? Support workers, PAs etc - all of them should be hired by councils. And since you mention property investors, councils should be the ones building/managing care homes as well, right?

2.Families should be involved in care and not leave it 100% to government
What does this mean exactly? Do you think families are not involved in the status quo, and what does involvement mean to you? They should stay at home and be caregivers, right? So which family members should it be? Parents should retire and become carers when they birth children with disabilities? Elder siblings should do the same when they have younger siblings with disability?
What happens to those people's careers, life plans etc? Will they be paid at a rate commensurate with what they would be earning if they were, for instance, an investment banker in London before? Or would having a family member with a disability mean automatically that someone is doomed to the salary of a healthcare worker for life?


3.Disability should be dis-incentivized. Some people wear it as a badge of honor and it seems all these benefits encourage people to jump on the gravy train
How exactly should disability be disincentivized in your opinion? Again, you should check what people generally get paid, because it seems you're still letting your view be skewed by this one edge case.

4. Being disabled does not mean a person cant be productive, subject to the kind of disability they have and can be encouraged to contribute to the society rather than be a liability.
That's the status quo. Being disabled doesn't even automatically entitle people to benefits of any kind. There are thresholds and checks before a person begins to receive any kind of support.

You say this is an individual case, yes a few 10s or hundred people in a council but the impact that is having on council funds to effect its other functions. Besides I didnt say those not able to work shouldnt be supported, was responding to somone who said social care is helping the economy.
Robust economy?
I said robust economy in general terms. Whether any given economy is robust or not, supporting people with the ability to live properly must be a priority, or would you rather things be like they are in some countries where disabled people roll around on the street on wooden boards, half naked because they're too poor to buy clothes, holding plates in their hands and begging passerby for money to feed, because there's no support from the government to be had?

Benefit the economy? When funds that should be used for other services, build infrastructure and other productive ventures are being cut reducing the general quality of life. In the council I live they released a list of services that they are planning to cut eg. School hours, roads that will be gritted during winter snow, frequency of garbage collection, closing down public buildings, reducing the hours street lights will be on for amongst other essentials services not to add councils going bankrupt, laying off of staff and increasing taxes. This and others with their wider implications.

I am not against social care, etc but the money will eventually run out someday and taxes will continue to go up etc. plus a lot of these providers and users are gaming the system, making loads of money.
So what's your solution? People unable to work or live normally due to their disability shouldn't be supported to have normal lives? Or you think they are paid too much so they should only be kept alive but not afforded any opportunity for leisure?

This individual's case is clearly very unique and that's why it's in the news. Beware of assuming that's the norm (unless you know many other people saving 50k from their disability payments).

Also, whether it benefits the economy or not is secondary. The core question is whether it benefits people to live a good life. What's the point of a robust economy if large swathes of people are living in lack due to not being able to work and earn an income and also not being supported by the government?

oh no. I didn't get a separate visa for Greece. It was the Germany own I got for 6 months I used . It elasped 31st Dec. So used it to enter multiple countries when I was on leave

Being on the shortage occupation list doesn’t mean you won’t pay IHS. Only means lower application fees.

The only time a cyber person won’t pay IHS is if they are of a sufficiently senior level that their occupation code is sufficiently high that their occupation code is ‘1181: health services and public health managers and directors’ which would bring them under the Health and Care Visa. Otherwise, it’ll be the standard skilled worker visa and IHS will be payable, although they can claim refunds in 6 month intervals afterward.

So if you want to get quicker dates using Greece as entry point and at the same time get multiple entries to visit as much Schengen countries as you want, you'll have to fully book and pay for holiday in three different Schengen countries (including Greece) which will be presented to the V.O to get a high chance of getting multiple entries.

Do these appointments need to be sequential? i.e. I have a holiday booked for May but if I want to add a couple others to it to apply for multiple entries can one be in say July and another in October?

Hi, thought to share my experience as a 1st time schengen visa applicant even though it is a while back.
My family and I applied for a schengen visa (for france) in the 1st week of Dec with a paid ticket with travel date in April 24. Took about 1 week of meticulous checking for appointment but we were able to get dates on a wedbesday at 11.30pm for the middle of dec.
We got our passports back 1 week after with visa stickers.

I'd say, keep checking for availabilities especially towards midnight. Also, they seem to release dates in small blocks (rather than availability 2 - 3 months ahead).

Oh I didn’t know it was possible at all to get multiple entries on one’s first shenghen application.

I have (not very wisely, in hindsight) booked a holiday in France and paid the fees in full but I simply can’t get an appointment date. I’ve just been checking but nothing comes up.

Again, planning is the key.

Yes. There's nothing special there - people do it all the time. If their circumstances change and they can't onboard you again they'll also tell you by email.

I've done it before when I got a more senior (and much better paying role) after having signed the offer letter, done ID check, met the team virtually was just waiting to resume. I didn't enjoy it but a man must do what a man must do, and it's a business thing after all...

The only risk is if you want to apply to them again in the future and they're still angry at you but there's nothing else. Since you didn't work with them, they won't ever be asked for a reference or even reflect in anything concerning you. The profile they've set up is internal, and they'll simply delete it along with other records relating to you.

Take out the payment reference number (it starts with X and will be at the top of your simple assessment letter) and then search for 'pay HMRC' simple assessment on Google, click the page and then select to pay without logging in. You'll enter your reference number and personal details and then be able to pay, although it's a bit finicky about which card you can pay with.

I had the same issue and had been postponing calling them until I saw your question and Tier4Dependant's reply to you. Paid within 3 minutes and got confirmation to my email immediately.

I don’t think this blanket assumption that every student facing financial difficulty failed to plan or somehow tried to cut corners is fair or logical.

I was going to say this but was hesitant so that the 'you are making people afraid' brigade will not stress me on a weekend.

How do you go to Youtube to copy answers for how to make your own insurance application? Are you and the YouTuber in the same circumstances?

I think people don't realise that there are people (claims adjusters) employed by insurance companies whose primary job is to avoid or minimise payouts, and while they'll let you enter whatever you like on the application, it's when it's time for a claim that they'll scrutinise it to see what they can use to void your cover.

This is not entirely correct, changing employer does require you to apply for a new visa. You simply need to apply to update your visa.

Changing employers requires applying for a new visa, so they will send you a new BRP as with any other visa. It usually arrives in 2 - 3 working days in my experience. Check the email with the visa approval - the details should be there.

Hello my people.
Please I have a question. My junior sister rented a shared apartment and sign a contract for 6 months. She has been staying there for 2 months plus and she found a better apartment close to her school. She called the landlord a Naija landlord that she wants to move out and she will get someone else to take over the room which the landlord agreed too. Now the problem is the person that took over the room has a cousin that they move in together. And other room mates are against that which they reported to the landlord in turn the landlord has asked the person to either tell the cousin to move out or they both move out. Now he called my sister and told her that she needs to move back in because he does not have the time to be looking for a new tenant which is not possible since she has gotten a new place and he also has been threatening her that she has to pay the next rent. My sister has messaged him that she informed him that she will be moving out and also forfeited her deposit on the house due to early move out. Please what can you guys advise as he is saying he will take legal action if he did not get the next rent payment on the 18th when the person that takes over the room moves out.
She should tell him to take the legal action he wants to take.

Insofar as the transfer to the new tenants was done with his knowledge and consent (and he even received consideration - the forfeited deposit), the contract between your sister and the landlord is terminated and she has no business talking with him about the house at all.
