The truth of the matter is that it is a cabal in the government of the State who are the brains behind this move to get out the Deputy Governor, Mr. Lucky Ayedatiwa to foster their continuous grip of the state in the event that Governor Rotimi Akeredolu is not able to survive his failing health.



Insiders' information has it that the calculation is to position Barrister Olusola Oke to succeed Akeredolu in office and in the event of failure the plan B is to support Mr. Wale Akintehinwa from Ile-oluji. It is very clear that the likelihood of Ayedatiwa as substantive Governor will put paid to any of these plans.

It was reported this same man who was the person that gave the first Bullet proof car to Akeredolu during his first shot at the governorship of the state in 2012, had been very supportive and loyal to the Governor up till this very moment even with all the provocations and campaign of calumny against him.

According to fresh information, the Deputy Governor-elect, Sen. Umar Abubakar, who has represented Kebbi North in the Senate and who was presented with a certificate of returns by the Resident Electoral Commissioner (REC) for Kebbi state, Alhaji Muhammad Mahmoud Bello in Birnin-Kebbi on April 19 forged his school certificates.








Insiders revealed to us that Senator Umar wrote a letter to the Permanent Secretary , Ministry of Basic Education and Secondary Education in Sokoto, Mr Lawal Saddiq Sanusi applying for the certified true copy of his testimonial’.




In the letter, he alleged that he was a student of Sultan Abubakar College between 1974 and 1979 with the admission number 958. He requested for the certified true copy of the testimonial and secondly, for a letter of attachment and confirmation that the testimonial bearing Umaru Abubakar belongs to him.

The principal of the school he claimed to have attended is under intense fire right now by the Permanent Secretary to produce attestation for the Deputy Governor.
“The name Umaru Abubakar is not on the list of students who graduated and were issued testimonials in 1979.
Neither the Examinations Records nor any of the school records listed the name of Umaru Abubakar as having sat for Teachers Grade ll examinations in 1982, or to be among students who were issued testimonials in 1982 as indicated in the testimonial attached by Senator Umaru Abubakar Argungu.
The attached copy of the testimonial of Umaru Abubakar does not carry the name of the issuing officer, which is not the tradition of the school.”
According to the story, the Deputy Governor was allegedly dismissed from the Sultan Abubakar College Sokoto which was then a Teachers Training College during a mock examination alongside 15 others.

Ladi Adebutu is on the run, trying to evade prosecution for vote buying, money laundering--Investigation





Contrary to his claim that he left the country because of alleged threats to his life, the
candidate of the Peoples Democratic Party (PDP) in the March 18 governorship election in Ogun State, Hon Ladi Adebutu, actually travelled abroad to evade the long arm of the law over alleged criminal activities, sources have revealed.

Checks revealed that Adebutu left the country following security agencies' uncovering of a vote buying plot linked to him during the March 18, 2023 governorship and House of Assembly polls in Ogun State and the invitation extended to him to clarify issues.

According to the sources, Adebutu was alleged to have perpetrated bribery, conspiracy and peddling undue influence contrary to sections 121 and 127 of the Electoral Act 2022; breach of electoral law prohibiting vote trading, deliberate facilitation of money laundering, and connivance to deliberately breach the monetary policy of the Federation.

Sources revealed that in a letter made available to security agencies investigating his criminal activities, Adebutu had indicated that he travelled abroad to seek medical care, and had given no indication of threat to life.

Sources within the security services indicated that
preliminary nvestigations showed that in the build-up to the election, Adebutu had contacted his bank and caused over 200,000 prepaid Verve bank cards preloaded with N10,000 each to be printed.

A credible security source confirmed, with clear-cut evidence that these Verve Bank Cards were delivered directly in two batches on the 16th and 17th of March 2023, respectively, by an accounts officer from Zenith bank.


This, it was maintained, is a violation of Section 121of the Electoral Act (2022), which prescribes 12 months' imprisonment for any “person who directly or indirectly, by his or herself or by any other person on his other behalf corruptly makes any gift, loan, offer, promise, procurement or agreement to or for any person, in order to induce such person to procure or to endeavour to procure the return of any person as a member of a legislative house or to an elective office or the vote of any voter at any election."

The Verve cards, which were supposedly printed to honour the lawmaker's late mother, were however uncovered as vote buying instruments going by
the confessions of party agents and POS operators arrested by security agencies during the polls, which indicted the PDP guber candidate.

Adebutu was said to have applied for the Verve cards from Zenith Bank on February 27, 3023 two days after the presidential election which the PDP lost by a wide margin in Ogun State, following which the cards were delivered to him by his relationship officer in the bank.

Investigation further revealed that contrary to Adebutu's claim that the cards were issued during his mother's burial, they were actually issued few days to the election, raising the obvious question of collusion by Zenith Bank with a politically exposed person to perpetrate electoral fraud.

Also, the statements by some of Adebutu's polling agents that were arrested confirmed that he gave them the cards to manipulate the March 18 polls.


The sources described Adebutu's actions , using game-betting platforms and POS operators, as well planned, carefully orchestrated and unprecedented electoral fraud made out of desperation after losing the February 25, 2023 Presidential and National Assembly elections.


Adebutu and his agents were said to have
distributed the cards throughout the over 5000 polling units and positioned POS operators at the same so each voter could convert the card to cash at the POS terminals.


The cards were said to have been funded on the 16th and 17th of March directly from Adebutu's account with Zenith Bank, with the lawmaker paying over N2.4bn directly from his account.


Said a source: "Checks at the Corporate Affairs Commission (CAC) showed that the foundation in whose name the PDP candidate carried out his criminal activities were fictitious.


"We have it on good authority that following a petition written to security agencies over the incident, it was observed that Adebutu expended huge sums to manipulate the March 18 2023. governorship election in Ogun State.



"Hon Adebutu caused prepaid Verve cards preloaded with N10,000 each and bearing such inscriptions as Dame Caroline Oladunni Adebutu Empowerment Scheme, Dame Caroline Scheme and “Dame Caroline Oladunni Adebutu Memorial Endowment Scheme, to be printed under the guise of honouring his late mother, but it was a vote buying gimmick, and these cards were used to buy votes on March 18.



"Luck, however, ran out on him when party agents and POS operators who were used to perpetrate the deliberate manipulation of the electoral process were arrested by the security agencies and made statements that indicted him.




"The financial institutions that collaborated with him have revealed that he contacted them to create the cards which were delivered to him two days to the governorship election.



"It was when he observed that all these things had come into the open that he suddenly disappeared into thin air in order to evade justice."



The security sources, which accused the PDP lawmaker of violating Sections 121 and 127 of the Electoral Act (2022) which expressly forbid vote buying, said that it was regrettable that Adebutu had flagrantly violated laws meant to sanitize Nigeria's electoral process.

What Buratai Cannot Do?

Nigeria is an interesting country. I love the country because today, you are a hero. The next day, you are hanged in the court of public opinion by some mischief makers whose stock in trade is to propagate and spread half-truths and figments of their imaginations.






Some online news platforms are notorious for such. I laughed when I read its recent diatribe against the former Chief of Army Staff and Ambassador of Nigeria to the Republic of Benin, Lt.Gen. TY Buratai.




The story is such that the unsuspecting general public would be tempted to believe it. But some of us privileged to have understudied the TY Buratai era in the Nigerian Army would not agree with the mischief. We would linger around thoughts such as “Could this be the same TY Buratai? Or another?





Half-truths, outright insinuations, and illogical conclusions are the hallmarks of the story by the news platform linking the former army chief to the trial of a Major General facing court martial for the sale of Nigerian Army properties while he was the managing director of the Nigerian Army Properties Limited.




Wonders shall never seize. I almost puked after reading the story; it was more of a brutal attempt to give a dog a bad name to hang it. Interestingly, in the online platform, the blind pursuit to nail Lt.Gen. TY Buratai at all costs ensured that things that could happen only in dreamland were ascribed to his personality.





According to the gospel of the news platform, the former army chief used his office to siphon public funds and bought houses for government appointees.


Hear this “The officer who controls army properties all over Nigeria said in his court-marshal hearing, being secretly held since September 2022, that Buratai asked him to pay $730,000 to obtain Saudi Arabia citizenship to avoid being sent to the International Criminal Court upon expiration of his ambassadorial posting to the Benin Republic.”




If this isn’t a daft statement, what else to call it? the online news platform reminds one of the famous Molue buses in Oshodi Lagos in those days when it was usually a bumpy ride till you got to your destination.




There you find all sorts. The good, the bad, and the ugly. It is usually a congregational setting where various interest struggle for passengers’ attention.



Please permit me to say this free of charge. What the news platform attempted in their story remains a figment of imagination.
I know what Lt. Gen. TY Buratai can do, and one such is not to use his office to enrich himself or appease friends and cronies.
He is an enigma. This much was recognized during his stint as Chief of Army Staff. He calls a spade a spade, so he was christened a legend. In the annals of the Nigerian Army, the Buratai era was adjudged as one of the most productive in several spheres. It was a combination of strategy and robust intellectualism.




He prosecuted wars. He has been in the theatre of operations for God knows how long before his appointment as chief of Army staff. His antecedent are there for perusal.




And what Sahara Reporters concocted is not one of them. Again, success is not measured by what you accomplish but by the opposition you have encountered and the courage you have maintained in the struggle against overwhelming odds. That is the quintessential TY Buratai.
The platform missed an important point about the man they and their paymasters have laboured in vain to vilify.
He cannot compromise national security; he won’t dip his hands in public coffers or divert public property. That would have conflicted with his personality and philosophy about life.




TY Buratai is an introspective individual. That part of him may not have been identified.
He self-examines his actions and in-actions. And the chances that he would engage in uncharitable acts are very slim. From his interactions and mien, a discerning mind could tell easily.





In all of these, you won’t rule out the dynamics of politics. Maybe some persons are out to destroy his legacies. Perhaps some persons are out to force an outburst from him. But the Buratai that I know would always give a loud laugh.
Most times, he is unperturbed. I wonder how he does it. If we recall that the platform tirade against the former army chief didn’t start today. As a fact, Sahara Reporters have been on his constant trail since he was appointed as Chief of Army Staff.
I would not have been surprised if TY Buratai was accused of charitable ventures; he would go out to solve people’s problems, even in great discomfort. There are many examples of such benevolent acts.


He is never tired of such. These are some of the things we could believe he could do and not what the online platform and their paymasters want unsuspecting members of the public to believe.
Siphoned government funds and gave out government properties to cronies and associates who are alien to the TY Buratai personality and philosophy.



He doesn’t suffer fools gladly. So associating him with the trial of Major General UM Mohammed is, at best uncharitable and a smear campaign taken too far.
The news platform has been notoriously leading the smear campaign against TY Buratai. But how long it intends to sustain the diatribe is left to be imagined.




The beauty is that even the blind can see through the platform’s mischief. It should change its focus as this strategy is not working. TY Buratai can be accused and found guilty of selfless service to the country.
He remains a patriot and a dedicated one whose selfless service to man and humanity is noteworthy. That is the TY Buratai we know and not what the news platform wants us to believe.

It is no longer news that Mr Ogbuku who ascended the position of the MD have had a frosty relationship with Onochie and had sort whatever means to reduce her to a mere ceremonial chairman and undermine her constitutional role as the supervising and approving authority as demanded by law.

He had obtained a phantom judgement from Justice Okon Abange who could not see beyond his nose by delivering a skewed judgement which can only be a product of 'Ghana-must-go' bag exchanging hands.

From all indications, Ogbuku is on a kill mission whose intent is to finally nail the coffin of the commission that had hitherto been on a life support. He had embarked on a spending spree at the detriment of the region to the extent of renegotiating a 15 Billion dollar rail project without recourse to the supervising authority, (The board). and operating over 300 bank accounts against the Treasury Single Account (TSA) of the Buhari administration.

Whoever and whatever is propelling Samuel Ogbuku should know that the raw facts are now bare and that the days of reckoning has finally come.

With the matter finally before the senate committee the peoples representatives who enacted the act, Egbuku should be ready to swallow the bitter pills of his inordinate actions of trying to subvert the will of the Niger Delta people.

The Yusuf committee on their part should be vigilant as Egbuku and his cohorts may not be resting on their oars at perpetually keeping the NDDC down.

We however trust that the Buhari administration will not hesitate to clamp down and remove bad eggs like Egbuku who is bent on feeding fat on the peoples common wealth.

Let it be known that Ms Onochie is a reformer, that has come to clean the rot that had bedeviled the commission and ultimately brought it to its knees.

It cannot be business as usual with a thoroughbred on the saddle.

The managing director of Lagos building investment company, Mr Tobi Lawal has been called out over allegations bothering on bribery, forceful acquisition of property, name dropping amongst other things.



In a message addressed to him which is made available to us, Bricktop Development and Advisory accused Mr Tobi Lawal of requesting bribes for an apartment which his company constructed under a JV with LBIC.



According to him, among the 16 buildings at Abike Court located at No 1, Rev. Ogunbiyi GRA, Ikeja Lagos, 11 apartments belong to him while the state agency owns five. Interestingly, Mr Tobi Lawal who is allegedly using one Lanre Obisesan as proxy demanded for one of Bricktop’s apartments as a bribe’. This was met with stiff opposition and sadly, Mr Tobi was alleged to have used his position to forcefully break into the apartment and damage it with an attempt to acquire it.


Mr Tobi and his proxy, Lanre Obisesan are alleged of name-dropping bragging with the governor's name to forcefully take people’s property, claiming it belongs to them while they didn't pay a dime.



“ Infact, he is extremely arrogant and proud and i am sure even the governor didn't know his worth. It's because of such characters like this that the performing governor of Lagos state almost lost his second term bid during the election. He is fond of using head of parastatal to perpetrate his acts and I advised them to get directives from the governor before listening to him. I also enjoined the IG and the CP to investigate the police he took along for his operations like this".

BURATAI: SUBJUDICE, SAHARA REPORTERS AND CONCERNS FOR PROFESSIONAL ABUSES

There are growing concerns about what appears to be persistent and flagrant abuses of the law and theory of subjudice within the media space by Sahara Reporters, an online media platform. In many climes, subjudice is tied to the right to freedom of expression and that of the press.

In Nigeria, for instance, Section 39 (1) of the constitution, as altered, provides that “Every person shall be entitled to freedom of expression including freedom to hold opinions and to receive and impart ideas, and information without interference. However, Section 39 (3) provides that nothing in this section shall invalidate any reasonably justifiable law in a democratic society, especially to maintain the authority and independence of courts.

In a simple explanation, Subjudice, as a legal principle, emphasises that to maintain the authority and independence of the Courts matters before the courts should be freed from comments likely to prejudice the determination of the case. Put differently. It means that when a legal matter has come under the jurisdiction of a court, nobody, including the press and other media, should interfere by either publication or public comment.

This legal caution is the reason democratic enthusiasts and media professionals have expressed concerns over Sahara Reporters’ penchants for consistent mention of former Chief of Army Staff, Lieutenant General Tukur Buratai, retd, in its reportage, especially in the mode of corruption and abuse of office allegations against the former Army boss. For instance, around the middle of 2022, General Tukur Buratai (retired) took publisher Omoyele Sowore before a High Court of the Federal Capital Territory over an allegation of false publication.

In his prayers, Buratai sought N10 billion damages because, according to him, Sowore, the publisher of Sahara Reporters, a United States-based online medium, linked him to a report that the anti-graft agency, Independent Corrupt Practices and other related OffencesCommission, found billions of currency notes in local and foreign denominations at an apartment in Abuja.

According to Buratai in suit number FCT/HC/CV/252/2022 filed through his lawyer, Dr Reuben Atabo, SAN, Sowore and his medium should be restrained from further publishing or caused to publish any defamatory publication against him. The senior advocate prayed the court for the following reliefs: A declaration that the defendant’s publication dated 23rd day of June 2022 with the caption “EXCLUSIVE: Anti-graft Agency, ICPC Uncovers Billions in Cash Meant for Arms, Ammunition To Fight Boko Haram In Abuja Home of the former Chief of Army Staff, Buratai amounts to defamation of the Claimant’s character, an order mandating the defendant to retract the said publication with a public apology which must be published in two national dailies and on the defendant’s online platform where the defamatory publication was made. An injunction restraining the defendant whether by themselves, servants, agents or otherwise, from further publishing or causing to be published the said or similar words defamatory of the claimant, damages in the sum of N10 billion being general and aggravated damages for libellous wordsfalsely, maliciously and recklessly published by the defendant of and concerning the claimant in the online publication. However, and curiously so, Sahara Reporters, in its recent publications, does not seem to have adhered to this noble professional principle nor respect for rule of law.

On Thursday, May 11, in an article titled Ex-Army Chief, Buratai Sues SaharaReporters for Exposing Recovery of Billions of Naira meant for Arms, Ammunition in Abuja House and on Monday, May 15, in an article titled “Amid Claims of Open Court Martial, Nigerian Army Bars Journalists from Covering Trial of Maj. Gen. Mohammed, Who Exposed How Buratai Used Army Property Firm to Obtain Saudi Citizenship, Fund Wives’ Trips.“ Obviously, these unfounded allegations and malicious reports, are directly aimed at the reputation of Buratai, stand within the bounds of unacceptable comments and reports given that the matter is before a court of competent jurisdiction.

Interestingly, emerging testimonies from stakeholders debunk these growing negative reports against Buratai. For instance, Brigadier General Onyeama Nwachukwu, Director Army Public Relation lambasted Sahara Reporters over the obvious false narratives. In an official release by the army spokesperson titled, “REPORT ON ONGOING COURT-MARTIAL TRIAL OF MAJOR GENERAL UM MOHAMMED BY SAHARA REPORTERS IS A CAMPAIGN OF CALUMNY” the reports stated: “The Army Headquarters has noted yet another ill-conceived report by Sahara Reporters on a sub-judice and ongoing Court Martial process of Major General UM Mohammed, the erstwhile Group Managing Director (GMD) Nigerian Army Properties Limited (NAPL), who was indicted by a military police investigation and recommended for trial. It is expedient to clear the air on the despicably false report and calculated attempt to cast aspersion on the ongoing Court Martial, which has already progressed to an advanced stage, as the prosecution has put forward the evidence against General Mohammed and closed its case. The accused senior officer has opened his defence and is testifying as Defence Witness One (DW1). For the avoidance of doubts, without being sub-judicial, the former GMD NAPL is facing trial in relation to alleged offences of theft of various sums of money belonging to NAPL and forgery. These are all acts declared as offences punishable under the provisions of various extant penal Laws in Nigeria.”

Also, only recently, the Minister of Defence, Major General Bashir Salihi Magashi, (retired)and Vice president- Elect, Senator Kashim Shettima, applauded former Chief of Army Staff, Lieutenant General Tukur Yusuff Buratai for putting his life on the line to ensure the indivisibility of Nigeria. Magashi stated this in a message at the public presentation and launch of three books in honour of Buratai. The books, titled: “Duty Call under Buratai’s Command,” “Walking the War Front with Lt Gen TY Buratai” and the “Lonely Grave,” were authored by Jibril Baba Ndace of the Blueprint Newspaper.

The Minister of Defence who was a special guest of honour represented by his Special Adviser, Technical, Major General AT Jibrin (rtd) commended the author for a job well accomplished. He further acknowledged the immense contributions of General Buratai, retd to the stability of the nation’s polity and his giant strides in repositioning the Nigerian Army, stressing that his positive chapter in Nigeria history nis assured.

The Vice president- Elect Senator Kashim Shettima represented by Senator Ibrahim Hassan Hadejia, the Chief of Defence Staff, General Lucky Leo Irabor and the Chairman and Chief Executive Officer of the Blueprint Newspapers Alhaji Mohammed Idris Malagi also acknowledged Buratai as a gallant defender of the indivisibility of Nigeria.

Similarly, fresh reports have disclosed that Major General UM Mohammed, a former Director, Nigerian Army Properties Limited, is facing a military court martial over allegations of collecting several billions of naira from serving and retired officers for post-retirement houses but which could not be found. This was reported in the Sunday edition of Vanguard newspaper.

According to the report, a senior officer who spoke to on the development said, “He is also being detained because he cannot account for the billions of Naira collected as proceeds from the sale of NA Properties and lands across the country. “To cover his evil machinations, he is claiming the funds were spent based on directives. But he had worked with several other Chiefs of Army Staff had committed other infractions before this final fraud and I can tell you authoritatively that he tried severally including recruiting many Emirs to beg the Army authorities to stop the court martial without success. This led to the present COAS decision to court martial him. All his mates have retired but since he is facing the court he cannot be retired until judgment is delivered.”

These insider revelations clinically debunk the sustained reports by Sahara Reporters which have been variously interpreted to be prejudicial and a glaring fact that the medium is pained and out on mischief…Therefore, it is about time those sponsoring these malicious reports stop and Sahara Reporters should thread the path of honour and rule of law by being forthright and honest in its reporting. They should eschew the camping of calumny against the former Army Chief.

SUBMISSION ON THE LINGERING CRISES OF USURPATION OF THE POWERS OF THE BOARD OF NIGER DELTA DEVELOPMENT COMMISSION BY IT'S MANAGEMENT




We are Legal Practitioners based in the above address with interests spanning constitutionalism, human rights, public interests advocacy and litigation. We have watched with keen interest the crises of leadership tussles at the NDDC which is a needless act of usurpation of powers of the board by it's management. The crisis has now extended to the process of budgeting by the commission and if proper understanding of the Act establishing the commission and the civil service rules are not adhered to and upheld by the relevant institutions and stakeholders, that will undermine the principles of good corporate governance that will hamper the Commission from its mandate.




We therefore welcome the Senate setting up an Ad-hoc Committee under your Chairmanship to investigate the 2021, 2022 and 2023 estimates of the Commission
We respectfully identified the following key areas for determination and proffer necessary advice:
THE ROLE OF THE CHAIRMAN OF THE GOVERNING BOARD OF NDDC
We submit that the NDDC's highest decision making organ is the Governing Board .This is amplified by section 1 sub-section 2 (1)(a) of the Niger Delta Development Commission (Establishment etc) Act 2000. This board headed by the Chairman in conjunction with the office of the Managing Director shall formulate necessary guidelines for the development of Niger Delta area.
Section 8 of the Act further provides that the Board shall have power to:
manage and supervise the affairs of the commission,
make rules and regulations to carry out the functions of the commission,
enter into such contracts as may be necessary or expedient for the discharge of its functions and
ensure the efficient performance of the functions of the commission.
With the above provisons of the Act, it becomes a settled matter of law that the Chairman of the Governing Board is the supervisory authority on all issues affecting the Commission. Without the approval of the Board, any action so taken will be a violation of the Act, and thus illegal.
The overarching responsibility of the Chairman is to protect the resources of the people and make sure that due process is followed in all administrative and financial activities. The Governing board is therefore superior to the Managing Director, because the Management must always seek approvals of the Board to make or take significant decisions.
It's therefore our considered view based on the extant law that the Commission can only effectively perform its roles with a substantive Governing Board headed by a Chairman. Any act done without the input and approval of the board is invalid and therefore remains voidable. The so called MoU signed by the management of NDDC with a United State based firm for the construction of railway in some parts of Niger Delta without the knowledge and approval of its governing board, is nothing but a gross usurpation of powers of the board as enshrined in the Act, and therefore null and void.
CAN THE MANAGEMENT TEAM UNILATERALLY PREPARE AND PRESENT NNDC'S BUDGET TO THE NATIONAL ASSEMBLY WITHOUT INPUTS AND APPROVAL OF SAME BY THE GOVERNING BOARD?
Section 18 (1) of the NDDC act clearly provides answers to this question. The said section is herein reproduced for ease of reference,
The board shall not, later than 30th September in each year submit to the National Assembly, through the President, Commander in Chief of the Armed Forces an estimate and expenditure of the income of the commission during the next succeeding year for approval.
It is clear from the above Section that the only person that can present the budget of the Commission to the National Assembly is its Chairman. Any budget presented to the National Assembly, including the Senate, by the Management of the Commission is a breach of the Act that established the Commission. We therefore urge Your respected Red Chamber to decline validating the illegal budget proposal before you as that will amount to giving a stamp of acceptance to an unlawful act. The Senate should not consider any budget estimates from the Commission that is not approved by it's board and presented for your consideration by the Chairman of the Commission.
May I, with respect also refer you to the Supplementary provisions regarding the Board in the NDDC Act, otherwise referred to as the Schedule. Section 1 (2)of the Schedule clearly provides that, the quorum of board shall be the Chairman and that the Board can only meet wherever it is convened by the Chairman and that under section 4 (1) the fixing of the seal of the commission shall be authenticated by the signatures by the chairman or any member of the board generally or specifically authorised by the board to act for that purpose and the managing director.
It is not in doubt that any decision made by the commission must be sanctioned by the Board. The management cannot act outside the province and authority of the Board.
The management team should be made to understand that it does not have unlimited authority and the principle of checks and balances under constitutional democracy has also been put in place by the NDDC Act so that the management team cannot confer unto itself emergency powers which will ultimately lead to abuse.
UNAUTHORISED AND FRUITLESS EXPENDITURES
We also respectfully urge your Ad-hoc Committee to examine if the Management of the Commission, especially the Managing Director, have observed the Public Service Rules, including that of seeking the approval of their supervising authority in this case, the Chairman of the board - before undertaking local and foreign trips; and also whether they travel within the airfare class so prescribed by the Public Service Rules.
We hope that you shall give the necessary considerations to the salient issues of law raised by our submission in this document and use them to resolve this unnecessary usurpation and abuse of power.

According to Banjoko, currently, petrol (which is the primary mover of people across the different strata of Nigeria) is being subsidized under the recovery process in two different and distinct phases…


1. On the costs of purchase


2. On the foreign exchange component of the importation and supply. The product herein is being delivered using the CBN exchange and not the parallel market for such importation….






As such, the advocacy and advice will be a consideration and push towards a phased-out deregulation of the sector…


"The first step is suggested to be on the purchase pricing option. Wherein the foreign component is retained while the product is imported and sold on the prevailing international pricing benchmark"




Furthermore, she states that the second phase will be to remove the foreign exchange component and allow importation and delivery to be at the parallel market (though the belief is that the incoming government must phase out the current regime of multiple exchange rates.





It would be recalled that the deregulation of economic activities which gathered momentum in this country in 1986 under the general programme of Structural Adjustment has been a matter of intense debate among economists, bankers, and members of the public at large.







The monopolistic tendency of NNPC to provide all the petroleum products created some features which have made justification for the deregulation of the sector. The features include a low level of competition, smuggling of petroleum products, monopolistic and sharp practices, the existence of petroleum subsidies, poor maintenance of infrastructural facilities, distortions in product supply and distribution, inappropriate pricing of products supply, and high level of fraud and corruption. According to the PPPRA, Reginald (2009) and Igbikiowubo (2011), the Federal Government of Nigeria wants to deregulate the downstream sector of Nigeria's oil industry in order to:


• Ensure that petroleum products are made available to consumers in an uninterrupted manner.


• Eradicate waste and corruption which are consequences of a tightly regulated economy. • Ensure that the supply and distribution of petroleum products are orderly and consumer friendly.


• Channel money realized from the exercise to development projects that will be beneficial to the majority of the people.



Notwithstanding the above, the office of the Chief Economic Adviser of the president in collaboration with the NNPC and the budget office of the Federation asserted that the rationale behind the Federal Government’s plan to deregulate the downstream petroleum sector includes:


• To improve the efficient use of scarce economic resources by subjecting decisions in the sector to the operations of the forces of demand and supply.



• Deregulation will further reduce economic waste and lightens social burdens caused by government control.



• To expand opportunities for economic growth, a competitive sector and help achieve greater cost-effectiveness. Furthermore, Allison Madueke (2011) harped on the imperatives for the deregulation of the downstream sector including:



• Saving of cost in petroleum subsidies.


• Job creation opportunities.


• Downtime record in the existing refineries.

• Investment opportunities or foreign direct investment in the sector.

NDDC Board Chairman disown 15 billion dollars MOU




1. My attention and the entire Board's have been drawn to a publication in some National dailies of the purported signing of a Memorandum of Understanding (MOU) between a US firm, "Atlanta Global Resources Inc." and the NDDC, whose Board I chair, for the "construction of a mega rail project across the Niger Delta, from Lagos to Calabar." This was done without my knowledge and without the authorization or consent of the Board.


2. Everything about this shady "MOU" is illegal due to the following reasons:
(a) By the act establishing the NDDC(Act No 6, of 2000), it is the Chairman of the board that is solely vested with the power to sign MOUs with any organization.


Part II of the NDDC Act, Section 8, sub-sections (a) and (e), among other provisions, specifically state inter Alia;
The Board shall have the power to:-
(a)manage and supervise affairs of the Commission,...
(e)enter into such contracts as may be necessary or expedient for the discharge of its functions and ensure the efficient performance of the functions of the Commission.
And the Supplementary provision of the Act as relating to the Board (Section 4, sub-section 1) clearly retains the Seal of the Commission in the Office of the Chairman.


(b) The "US company", Atlanta Global Resources Inc., has no expertise nor experience in any form of construction, let alone, Railway construction. This company is a Management and Export Consulting Firm is without known notable Directors.


Thus, the signing of an MOU to the tune of $15 billion(USD) with such an organization is not only suspect but dubious.


(c) The Federal Executive Council (FEC), having recognized the importance of infrastructure in the Niger Delta region had awarded the Contract for the same project in 2021 at the sum of $11.7 billion for the construction of a Mega railway from Lagos to Sagamu, Sagamu to Ijebu-Ode, Ijebu-Ode to Ore, Ore to Benin City, Benin-City to Sapele, Sapele to Warri, Warri to Yenogoa, Yenegoa to Port Harcourt, Port Harcourt to Aba, Aba to Uyo, Uyo to Calabar, Calabar to Akamkpa and to Ikom, Obudu Ranch with branch lines from Benin-City to Agbor, Ogwashi-Uku, Asaba, Onitsha and Onitsha Bridge and then Port Harcourt to Onne Deep Sea Port.


It is shocking that after the FEC, the highest ruling body in the country, had done this, that anyone would be signing an MOU on behalf of the NDDC and the Federal Government of Nigeria for the same project in 2023 without due process nor approval by the FEC in the twilight of the Muhammadu Buhari administration.


3. The same clumsy, shady and hazy transactions of the past in NDDC, that had bedevilled and stultified identifiable progress in the past, was rested with the "Forensic Audit" and the Inauguration of a New Board, with the Sanitisation of the Commission as its mantra. However, old habits die hard. And some individuals (within and without the Commission) still retain the retrogressive mindset that has held the Commission down for the past 22 years. We cannot remain in the old dubious path.


4. The Present Board is set on Transparency, Equity, Justice and Equality, and ready to midwife and embrace other policies and programmes that would uplift and improve the lives of the good people of the Niger Delta. With diligence, perseverance, persistence, and commitment, this Vision would come to pass.


We, therefore, call on all our partners in this quest - CBN (TSA), The National Assembly, Our nine States' Governors (Advisory Board), etc., to take note.


5. Epilogue: NDDC has not and could not have signed an MOU, worth $15 billion (USD) without the Board and FEC's approval.


The so-called MOU signed with Atlanta Global Resources Inc. "AGRI", is hereby disowned by the Board and declared null and void.

NDDC - WHAT WE MUST DO


1. The appointment and inauguration of the present board of the Niger Delta Development Commission, NDDC after a long hiatus had rekindled our hope for a new NDDC. However, if revelations emerging from the commission are anything to go by, our hopes have been dashed as we see the business continuing as usual.
The work environment right now in the commission is like that of a cult where files are carried under armpits and other provocative places of the human body all in a bid to do things secretly.


2. It is an open secret that tension enveloped the commission immediately after the board was inaugurated with the polarization of camps around particular interests in the board and the management.
The management team sees the governing board as meddlesome interlopers and staff have taken partisan positions around individuals on the board and management.


3. The commission has become adrift for too long and stakeholders can no longer stand aloof while the resources are being plundered with reckless abandon.


4. There have been cases of waivers issued to IOC's over payment of the statutory three percent contribution to as stipulated in the NDDC Act. We now understand that these waivers are now in millions of dollars which have reportedly been shared between personnel of the IOC's and top officials of the management team.


5. There are also reports of the management team back-dating and awarding unimpactful and unverifiable contracts for the clear purposes of siphoning scarce resources to private pockets. They have the habit of abusing due process with impunity and disregard for the input from the Governing Board.


6. To curb this incessant bickering between the governing board and the management, it is our candid consideration to urge the Federal government to take a critical look at reforming the governance structure of the NDDC for effective service delivery to meet the aspirations of our people.


7. It is on account of this that we are urging government to begin the process of curing this malignant cancer. This cure can begin by extracting the management composition structure (Section 3) (4) of the OMPADEC Decree of 1992, which stipulates that there shall be a Chief Executive of the Commission. This is without ambiguities.


8. Our idea of having an Executive Chairman, as increasingly voiced by stakeholders should be a top priority of the President Muhammadu Buhari administration in bequeathing a functional NDDC to the incoming administration of Asiwaju Bola Tinubu.


9. This envisages a single line management structure comprising of the Executive Chairman, the state representatives, Zonal representatives and an administrative Secretary to make up the board.

10. If Government fails to heed this advise as espoused by stakeholders, then we would have missed a golden opportunity to stop the decline and drift of the commission that is fast becoming comatose. We must do everything within and without to breathe a new life into the NDDC.


11. To all of these we have the implicit confidence that President Muhammadu Buhari will adopt a new approach by strengthening the role of the Chairman as the chief accounting officer and reposition the NDDC to serve the region and it's people without let.


12. This will be the only sure way to make the region attractive to investors who are now divesting fom the region. There are countless abandoned oilfields scattered in the region whose owners have refused to return to reactivate these fields due largely to apprehension of possible renewed violence in the region.


13. It is the belief of stakeholders that the NDDC should show capacity by putting policies in place to step in and work with government to proffer redeemable and actionable strategies to reverse the divestment that is ongoing.


14. If there are no new investments in the region that means a dearth of revenue for the country and the commission and no new projects would be embarked upon by the commission for the people.


15. Stakeholders call for this reform should not be misconstrued. The call is to strengthen the institution and reposition it to become a global institution that will provide a platform for the development of the region as originally encrypted at the establishment of the NDDC.


16. Once again we urge government to take a helicopter view of our suggestion and do the needful as soon as practicable.

N2 Billion: Binani Gives DSS 48hrs To Retract False/Defamatory Viral Video Allegation Against Her

Senator Aishatu Dahiru Ahmed ( Binani) has demanded an immediate retraction of a false and defamatory viral video alleging N2 billion bribery against her.

In a letter by her lawyer, Mr. Benbella Anachebe (SAN) to the DG of the Department of State Security Services and Mr. Halilu Sule, Deputy Director (operation), Binani threatened to take legal action against the Department if they failed to retract forthwith and the viral video was promptly withdrawn from circulation within 48 hours.


It would be recalled that the gubernatorial candidate of the All Progressives Congress (APC) governorship candidate in Adamawa State Senator Aishatu Dahiru Ahmed (Binani) denied offering an N2 billion bribe for her declaration as governor-elect on Sunday by the controversial Resident Electoral Commissioner, Hudu Yunusa-Ari.



She said a Department of State Services (DSS) officer was tortured by some thugs, state government agents, and the Government House police to make such unfounded allegations against her.


She described herself as a Democrat, who will never do anything to subvert the democratic process.


Binani, who made the clarifications in a statement in Abuja, said she had won elections into the House of Representatives and the Senate in a free and fair manner.
She said: “My attention has been drawn to very bizarre, unfounded wild allegations purportedly made by an officer of the Department of State Services to the effort that, I senator Aishatu Dahiru Ahmed ( Binani), gave out the sum of N2billion to procure a favourable declaration as governor-elect to some unnamed INEC staff. I never did; I would never do such.

“This statement was allegedly made when the officer was being tortured at gunpoint by the agents of the Adamawa State governor and the Government House police team alongside their political thugs.


“ I wish to reiterate that I am a Democrat. I have always been a committed Democrat and will never do anything to subvert the democratic process. I am not a do-or-die politician.



“In the past, I have won elections into the House of Representatives and the Senate in a free and fair manner. What happened in Adamawa was an unsuccessful attempt to subvert the people's will. The REC was illegally told to stand down by two INEC national commissioners from Abuja who were supposed to be in Adamawa in a supervisory capacity.
“ Even more curious is the nocturnal visit of some INEC national officers to Adamawa State Government House and bizarre declaration the same day after the visit that they have taken over the collation through the backdoor, with collation and returning officers selected by the governor of Adamawa.

About two and a half minutes after takeoff, the Super Heavy rocket booster was scheduled to expend most of its fuel and separate from the Starship spacecraft, leaving the booster to be discarded in the ocean. The Starship was meant to use its own engines, blazing for more than six minutes, to propel itself to nearly orbital speeds.
The flight reached its highest point 24.2 miles (39 kilometers) above the ground and the explosion occurred about four minutes after liftoff, according to SpaceX.
SpaceX said that “teams will continue to review data and work toward our next flight test.”

Why NAPIMS Boss, Bala Wunti, is Scared of His Own Shadow

...How he allegedly spent billions on the Atiku presidential campaign

...Abandons benefactor, late Abba Kyari's family



For now, peace seems to have eluded Bala Wunti, the Group General Manager of the National Petroleum Investment Management Services (NAPIMS), so much that even his shadow scares him. Instructively, as part of the restructuring and consolidation of the Nigerian National Petroleum Company (NNPC) Limited, NAPIMS is now known as the NNPC Upstream Investment Services (NUIS).




Until his elevation as GGM, one of the most influential roles in the Nigerian oil industry, Wunti was the Chief Upstream Investment Officer of the NNPC Upstream Management Services. It was reliably gathered that Wunti got the job through the influence of Malam Abba Kyari, the late Chief of Staff to President Buhari. He hails from the same Bauchi State as Mrs Kyari.




If fortune smiled on him generously in that post among others that he had occupied in the oil and gas industry where he had been a player for about three decades, the NAPIMS job ushered him into a higher level of mammoth wealth. Those close to him allege that between 2020 and now, he has acquired so much wealth that would make Forbes query their Richest List research team. Because of his sensitive position, he is not extravagant but is as financially solid as they come. He is reputed to, however, have a bias for acquiring luxury properties and has a mouthwatering property portfolio in Abuja.



Beyond his influence in the oil and gas industry, Wunti is a close ally of Alhaji Atiku Abubakar, the presidential candidate of the People's Democratic Party. With an Atiku presidency, Wunti was convinced he would retain his juicy portfolio or be elevated. Thus, as the 2023 electioneering approached, sources said that Wunti went all out, mobilising and mopping up funds for the PDP candidate. It was rumoured that his financial involvement in the Atiku campaign is in tens of millions of dollars. At his level, they don't transact in naira; it is either dollars or pounds!

Another impeccable source disclosed that Wunti never believed in Bola Ahmed Tinubu, the All Progressives Congress candidate, which further fuelled his investment in Atiku. Unfortunately for Wunti, Tinubu is now the president-elect and will be sworn in on May 29. And that is the crux of his problems.

Wunti is currently racing against time. He knows and has confided in close associates that the new administration will ease him out for his partisanship, among other infractions. Significantly, there is the overhanging allegation of his role in Nigeria's oil production decline. Last October, a group, the Concerned Citizens of Nigeria, accused Wunti of being involved in some contract fraud and engaging in multi-billion-dollar corruption.

In an open letter, the group alleged that Wunti is notorious for frustrating oil development operations for personal gains and using his position as a top official to exclusively give contracts to companies he favours in flagrant violation of the procurement procedures.

"A major concern is the country's participation in the Deepwater field development space, which is the major contributor to the nation's oil production. Despite the rise in the crude oil price in the past months, with countries all over the world taking advantage of this opportunity by aggressively embarking on reserve growth and field developments to ensure they derive maximum benefit (economy, job creation, etc.), this high prices currently present, Nigeria has only one (1) deep offshore drilling rig currently carrying out drilling operations, which is the SNEPco Bonga OML 118 drilling operation.

"Despite this challenge in the nation's oil development, Bala Wunti, due to his greed, personal interest, and inherent fraudulent character, is willing to frustrate this field (Bonga) development to the detriment of the sufferings and yelling of the nation and Nigerians in general."

The group highlighted Wunti's alleged involvement in contract irregularities, stating: "Investigations show that on the 18th March 2022, SNEPco wrote requesting for NAPIMS approval to exercise the two (2) years optional extension of the existing NNPC approved contract with OCEAN DEEP DRILLING (ODNEL)/VALARIS by extending the contract duration for another two years for the Provision of Deep Offshore Drilling Rig Services. The Valaris DS-10 drillship is currently carrying out drilling operations in the Bonga field of OML 118.

"This approval request will ensure an uninterrupted drilling activity in the field. Interesting to note is that to date (about seven (7) months delay), NAPIMS GGM has yet to and refuses to approve the contract extension. From our investigation with some SNEPco personnel, we understand that follow-up letters were sent to the GGM's office, and various phone calls were made but yielded no positive results.”

The group lamented that despite sending several whistle-blowing emails to the GMD of NNPC (Nigerian National Petroleum Company) for the past one year, “No action has been taken till date to address various concerns raised which could have resulted into NNPC being a better company for the over 200 million concerned Nigerians which the corporation is saddled with the responsibility of protecting their interest and the interest of our unborn children."

Curiously, despite the overwhelming evidence of his serial malfeasance, the Economic and Financial Crimes Commission, EFCC, has turned a blind eye to wunti. But, for how long?
On the home-front, there are insinuations that relations between him and the late Kyari family, which used to be very robust, has now broken down because of his alleged neglect of the Kyaris. Not even Kyari's wife who solidified the relationship between the two men or her kids are getting any form of support from the NAPIMS boss. The family source who disclosed this said that the Kyaris got frustrated and decided to keep him at arm's length when several attempts to get his attention for one thing or the other came to nought.

Beyond this, another problem for Wunti is that he does not have a cordial relationship with his boss, Mele Kyari, the chief executive officer of NNPC Limited. Whether or not Wunti's animosity borders on eyeing Kyari's post could not be independently verified, but he has been fingered as one of the brains behind the negative stories in the media against the NNPC boss. So frustrated is Kyari with Wunti's antics and campaigns of calumny that he overtly rues that he cannot sack him. Even if Wunti escapes Kyari's axe, he is confident that the evil he has done will not make him escape the new administration's.

The contents on VVF and Cervical Cancer are facts collated from research and interface with experts in the field. This approach places Nadama on the vantage of passing on a vital message while captivating the reader through entertainment (edutainment).
The choice of Hausa language as the medium of conveying this message is due to the low level of cervical cancer awareness among the Hausa-speaking community especially among those who dwell in the rural areas of Northern Nigeria. Many men and women from the target audience are not aware that cervical cancer is preventive.
Most are ignorant of the options available for the treatment of both cancer and the VVF for those unfortunately affected. This concern thus calls for continuous enlightenment campaigns through various forms of communication to apprise our people of this deadly disease and that it is preventable.
The book also illuminates the importance of community networking in confronting health challenges suffered by the vulnerable.
The intention of the writer is to send this message down to the grassroots level through the production of this drama as a first step. It will be followed by the production of an audiobook and ultimately production of a home video in the popular Hausa movie industry.
The latter two productions are particularly for the benefit of none literate Hausa speakers through entertainment. It is hoped that the book will be included in the curriculum of secondary and tertiary institutions to create this awareness from the teen ages upwards.

Sunday morning, the Independent National Electoral Commission, INEC declared Senator Aishatu Dahiru Binani the winner of the Adamawa governorship election.

The Resident Electoral Commissioner for the state, Barrister Hudu Yunusa made the declaration following the supplementary election held Saturday.

The REC in company with the police commissioner, Mohammed Barde, Director of the Department of State Services and Commandant of Nigeria Security and Civil Defense Corps, announced Binani as the winner.

Although the INEC HQ through its spokesperson paused the result and requested that all its officials to report to Abuja, the declaration remains intact unless declared void by the court,

This is not unconnected to the fact that section 149 of the Electoral Act of 2022 stated that:

Notwithstanding any other provisions of this Act, any defect or error arising from any actions taken by an official of the Commission in relation to any notice, form, or document made or given or other things done by the official in pursuance of the provisions of the Constitution or of this Act, or any rules made thereunder remain valid, unless otherwise challenged and declared invalid by a competent court of law or tribunal.
Thus, by this electoral act and action of the REC, Binani is the substantive governor-elect of Adamawa as only the court and not INEC head office can decide on this so-called controversy.

This informed the widespread jubilation across Adamawa by Binani and her massive supporters.

President Buhari, on his fifth day of the official visit to Saudi Arabia, met with some governors and other officials.
This was made known in a statement on Sunday by the Senior Special Assistant to the President on Media and Publicity, Garba Shehu.
At the Makkah Guest Palace, Buhari received Governors Mai Mala Buni of Yobe, Babagana Zulum of Borno, and Katsina Governor-elect Dikko Umar Radda.

Buhari said whatever Nigeria has achieved is due to the supremacy of its democracy and the power of the country’s institutions, which must continue to be strengthened.
The governors applauded the President for combating the threats of Boko Haram terrorists in their states and were happy that peace had been restored.
Speaking on efforts to conclude court cases and the plan to prosecute more offenders, the EFCC boss said that suspects arrested in connection with election fraud will be charged to court.
In his remarks, Katsina Governor-elect gave assurances of his commitment to an open and transparent government as promised during the campaign.

How Pro. Kingsley Predicted UK’s Placement of Nigeria Red List, Announces 3 Days Monthly Crusade



When God speaks through his servants, the wise listens. This is not unconnected to the fact that another of prophet Kingsley Aitafo’s prophetic warning is incoming to pass again.

The clergy warned against the backdrop of the United Kingdom placing Nigeria on the red list of countries .The prophetic wafrning was given early in March, 2023.




And to confirm his message, the United Kingdom has placed Nigeria and 53 other countries on the red list of countries that should not be actively targeted for recruitment by health and social care employers.
The announcement was contained in the revised code of practice for the international recruitment of health and social care personnel in England.
It is recommended that employers, recruitment organisations, agencies, collaborations, and contracting bodies check the red country list for updates before any recruitment drive.
It defined active international recruitment in the code as the process by which UK health and social care employers (including local authorities), contracting bodies, recruitment organisations, agencies, collaborations, and sub-contractors target individuals to market UK employment opportunities, with the intention of recruiting to a role in the UK health or social care sector. It includes both physical or virtual targeting, and whether or not these actions lead to substantive employment.
This was in response to the cry and move by the Nigerian government against brain drain of the health sector by the United Kingdom and proposition of bills against it.

During his prophetic release for 2023, he stated that there would be the threat of war in some foreign countries. Also, he predicted that two countries are planning to fight what is called war. And to confirm his prophetic warning, China has rolled out military gargets against Taiwan.

China launched military drills around Taiwan on Saturday, in what it called a “stern warning” to the self-ruled island’s government following a meeting between its president and the US House speaker.
Dubbed “United Sharp Sword”, the three-day operation — which state media said includes rehearsing an encirclement of Taiwan — will run until Monday, the People’s Liberation Army’s Eastern Theatre Command said in a statement.
Taiwanese President Tsai Ing-wen immediately denounced the drills, pledging to work with “the US and other like-minded countries” in the face of “continued authoritarian expansionism”.
China’s war games will send planes, ships, and personnel into “the maritime areas and air space of the Taiwan Strait, off the northern and southern coasts of the island, and to the island’s east”, said Shi Yin, a PLA spokesman.
A later report from state broadcaster CCTV said, “The task force will simultaneously organize patrols and advances around Taiwan island, shaping an all-round encirclement and deterrence posture.”
The report details the type of weaponry China was putting through its paces, including “long-range rocket artillery, naval destroyers, missile boats, air force fighters, bombers, jammers, and refuellers”.
Taiwan’s defence ministry released a video showing soldiers loading anti-aircraft missile launchers, fighter jets taking off, and other military preparedness exercises.
