Siga: my able MOD....u kuku have a valid point...its just the trend and reasons for refusal is becoming ridiculous....people get refused throughout the year, but the number of refusal has increased this month alone....now, the Canadian government may not be very specific about this, but I can tell u something...for instance here in Toronto, our Mayor(who was kicked out) complained about Toronto been congested last yr or so...not sure of the yr...and advised against new immigrants moving to Toronto....now, the new CEC program the government now have helps create a pathway to PR for international students and this has a quota...so, they have to control the number of students coming in to be able to maintain the quota for CEC....I may be wrong of right...again, guys need to reapply ....

Quota for working permit programs is not new, the UK has the same quota, colleges or universities will not give you admission and accept fees from you if they knew that they are not allowed to admit more foreign students because of quota. That will be fraudulent. If there is anything like quota then students will be refused admission, i don't believe that Canadian colleges and universities are collaborating with their embassy to rip-off foreign students even when they know that they don't stand any chance of getting a visa.

Lets not mislead people into thinking that they have done everything right and still get refused a visa.

Siga: Believe it or not....quota system do exist...even in a family...Papa and Mama dey agree say na only 2kids dem wan have....but at wat measure do that affect student applications, no one can really tell....Imagine some applicants saying their docs were returned same way they sent them...even with rubberbands and clips they used....they speaks volume....

Do you know any period of the year people don't get refused a visa? Do we assumed that from now on that nobody will be given a visa because the this year quota is full?

yes if you overstayed and get caught then you will be deported, that does not mean you have to lock yourself in the room.

Nobody stops you from moving around if you are an illegal immigrant, illegal immigrants sometimes get employed by employers who will pay them below minimum wage just because they got no paper, illegal immigrants can work with forged paper until they are caught.

If you are illegal and wants to go home you will not be stopped from going home. No illegal immigrant gets genuine permit or become a citizen unless their status changed through marriage....(another long story).....

iluminati: @ ALL WHOOSE APPLICATION ARE REALLY VERY HEAVY AND YET DENIED, THE INFORMATION I GOT FROM A RELIABLE SOURCE IS THAT CDHC QUOTA FOR THIS YEAR IS ALMOST FILLED UP. So the competition is very high now. A LOT OF QUALIFIED PEOPLE WITH ONE YR TUITION FEE AND ACCOMODATION WERE SEEN TODAY DENIED AND CRYING AT VAC. SO MY ADVICE IS ALWAYS TRY TO APPLY EARLY AROUND BEGINING OR MIDDLE OF THE YEAR WHEN THEIR QUOTA IS STILL MANY COS THOSE CDHC GETS TAGET TO FULFIL.

Stop spreading false news, there is no truth in all you said here. Let people know why they were refused a visa and work to correct it next time rather than believing that they were refused for just because of quota.

You will not be given a visa there, you will still go home and wait for further communication from they.

This is not an issue, British embassy started calling people at random for an interview couple of months ago, it could phone or face-face interview.

The questions will probably centred around your course and what you tend to do after graduation. These are questions anybody planning to travel to the UK to study should answer comfortably.

Appeal is time taken process !

That is a long time, it does take less time in some cases.

You're right, I believe the Embassy handle Administrative review, but the lawyer said he sent the appeal to the Tribunal that the Tribunal will send the paperwork to the Embassy for review, after reading a lot from this thread I disagree with him mail to me because I learnt the Tribunal will send the appellant acknowledgement letter, secondly they will send another letter regarding the hearing date, if I win the case then the Tribunal will contact UKBA, if the UKBA didn't challenge it then the Embassy will be contacted regarding the issue of my Visa. I've not received any letter yet, my husband signed the appeal form before the lawyer sent it off. I don't know if it is oral or paper hearing. What do I do now? Because the lawyer said there's no chasing up. Please help, will the Tribunal send me my own acknowledgement letter or to my husbands address in UK? Because I'm in Nigeria O.

Yes the tribunal will send you an acknowledgement letter within a month of your appeal, the letter will be sent in the address used for the appeal, and 2months before the hearing date you will be sent a letter detailing the date, time and the venue.
The appeal package does not go to the embassy or UKBA, a different body handles appeal.

Yes your husband can call the number at the back of the appeal document and quote your reference number, he will be told if they have received it or not

This was the mail my lawyer sent after putting in the appeal:

Appeal has been sent with all the documents provided (emails and western union receipts).
All the documents were posted to the Tribunal in the UK. 

The Tribunal will then send them to the Embassy.

Once the Embassy receives the documents they will review everything sent including our grounds for disagreeing with their decision. 

If they are convinced and satisfied with the documents then, they may withdraw their refusal and invite you to produce your passport in order to issue the visa.  This can take up to about 3months from now, although  it may take slightly longer or shorter. There is usually no chasing up.
In some cases they may agree with our reasons.  If this happens they may withdraw the refusal and reissue another refusal with other reasons.
However, if they are not convinced with the documents sent to them, then they will maintain their decision which means that the matter will proceed to Court hearing in about 6months.
If the matter is successful al at the hearing then it takes another 6 to 8 weeks after the hearing to have the visa issued.

I wanted to re apply the lawyer said the Embassy can be tricky that they may find another fault who knows the best bet is to appeal because the refusal is just evidence of contact which I have provided all emails and western Union, in which they can review. This is my predicament O. I sometimes can't sleep.

I disagree with that lawyer, embassy got nothing to do with your appeal, the immigration tribunal treats your appeal and its an independent body, they pass their judgement and notify the UKBA and you in writing about their decision, if its in your favour then the tribunal judge will give UKBA 15 working days to challenge the decision or issue you a visa. After the 15 working days, it takes about a month before your visa arrives.

When you are refused a visa and given the right to appeal, you are given two options, oral appeal or paper appeal, if you went for oral appeal then you will be invited by tribunal to defend yourself application or use a lawyer, it will be you, the judge and the UKBA immigration lawyer(if they bother to turn up), the judge will go through your case and ask you some questions then make his or her decision right there but you will not be given a visa or any written judgement, the written judgement will be sent to you and the UKBA after about 3weeks.

You or the UKBA will be given 15 working days to challenge that (depending on who the decision was in favour of)

The embassy do not treat your appeal, they will only be notify about the tribunal's decision and action will be taken depending on the outcome.

Now(starting from today) is the right time to pay your fees and get the CAS, you don't even have much time.

Only when you get your CAS that you will know if Sunderland state WAEC or not.

I can't tell you what your chances are because i don't know. Your faith lies with the review officer who will go through your case and decide if the ECO was right to refuse you a visa and the 10yrs ban.

All you can do now is to complete the review form and submit then hope for the best.
