Attahiru Jega is allegedly scheming to remain as Independent National Electoral Commission (INEC) Chairman, despite his claim of not wanting a second tenure of another five years, covering the next general election in 2019 and expiring in 2020, report TheNiche. The former Vice Chancellor of Bayero University, Kano was appointed in June 2010, and completes his five-year tenure on June 30 this year. By law, the tenure is renewable for another five years. Although he has at different fora, national and international, disclosed that he does not want to stay on, an impeccable source told TheNiche that “he desperately wants a re-appointment and the plot has been finalised.” It was learnt that he has perfected plans to sponsor groups and individuals beginning from the coming week to drum support for his re-appointment. The groups are expected to advocate for Jega’s retention, just as cronies and rented commentators are already drafted into the promotional exercise. Part of the game plan is to bandy the example in Ghana, where the Electoral Commission Chairman, Kwadwo Djan, has been in the post since Ghana returned to multiparty democracy in 1996. Djan has supervised five elections under the Fourth Republic Constitution. Hidden agenda “The plot for Jega to continue in office has been perfected. In the weeks ahead we will witness groups, cronies and rented commentators drumming support for him to stay on. “Their argument will be that, as in Ghana, his continuity will help the nation’s democracy to stabilise,” said our source, who preferred anonymity. The source disclosed that even though President Muhammadu Buhari may not know about the scripts he may not kick against it since Jega is in the good books of his party, the All Progressives Congress (APC), as well as the sympathy of some Nigerians. The suspicion behind Jega’s come back bid is his undisguised agenda to continue with the delineation exercise he started which received criticism from the public. “Unknown to many, Jega wants to ensure the delineation exercise is carried out and part of the hidden agenda is to give the North a good edge politically, with power moving permanently out of the South. “They will evoke emotion and many people will buy into the project, ignorant of the underlying secret,’’ the source disclosed. Appointment, removal of INEC boss Going by the Constitution, the president consults the Council of State in appointing an INEC chairman, but the appointment is subject to confirmation by the Senate. There was speculation that former President Goodluck Jonathan wanted to get rid of Jega before the presidential vote on March 28, but it would not have been an easy exercise except for political expediency. In this instance, the president could move against an INEC chairman relying on Part D Section 171, under Public Service Rules of the Constitution of the Federation. Section 171 (1) says, “…. Power to appoint persons to hold or act in the office to which this section applies and to remove persons so appointed from any such office shall vest in the president.” Breaking a jinx In Nigeria’s history, no indigenous electoral commission chairman has conducted two elections before the expiration of his term, except Jega, who did in 2011 and 2015. He is 11th indigenous electoral body chairman and the first Northerner to occupy the position. The first post-independence election was conducted in 1964 by Eyo Ita Esua (Cross River). Michael Ani (Cross River), headed the then Federal Electoral Commission (FEDECO) that conducted the 1979 election after which he stepped down. Victor Ovie-Whiskey (Delta State) conducted the 1983 election. Humphrey Nwosu (Anambra) supervised the election in 1993. Ephraim Akpata (Edo) conducted the one of 1999 which ushered in Olusegun Obasanjo as President. Akpata died in office in 2000 and was replaced by Abel Gobadia (Edo), who conducted the 2003 election. When Gobadia’s tenure ended in 2005, Maurice Iwu (Imo) succeeded him and conducted the 2007 election which produced the late President Umaru Yar’Adua. When Iwu’s tenure expired in 2010, Jega was appointed by Jonathan to succeed him. Jega conducted the 2011 election that brought in Jonathan. He also superintended the 2015 election that ushered in Buhari. His appointment came with fanfare and little dissention, being hailed as the activist and unionist who would level the electoral playing field. After the 2011 ballot, there was groundswell of approval for Jega, national and international, that the people’s votes counted. Some disagreed, though, arguing that the election was far from credible Buhari, who contested the result of the 2011 poll, insisted that the process was characterised by flaws. Jega’s Chief Press Secretary, Kayode Idowu, could not be reached on the telephone at press time to comment on the alleged interest of his boss in tenure renewal. Source: TheNiche Newspaper |

The crisis that has engulfed the All Progressives’ Congress (APC), even before President Muhammadu Buhari names his cabinet, may soon claim its first victims, pointblanknews.com has learnt. The predictable storm which has already fractured the party, at least at the National Assembly, may consume the party in no distant future if urgent moves are not made. Two prime targets are the national Chairman of the APC, Chief Odigie Oyegun and Party Spokesman, Alhaji Lai Mohammed, who are considered to have angered party chieftains. Even one of the party’s top brass , Asiwaju Bola Tinubu said it two weeks ago after the Bukola Saraki’s ‘coup’ at the NASS that embarrassed the party and gave Tinubu a black eye. He had said “Unless an urgent reconciliation is put in place, the anti-party activities which led to Saraki’s Senate Presidency might cause a prolong crisis in the party. And with plans by the APC leadership to enforce discipline, some leaders might call it quit with the party,” Political commentator, Levinus Nwabughiogu captured it thus “It is a baptism of fire. It is happening early. No one anticipated it. They tried to cover it but it leaked out. They also tried to manage it, but it is escalating. And now, there is palpable aggression and deep seated animosity within…The development has divided APC leaders. And the blame game continues. Was it really a marriage of convenience that bought the APC leaders together in the first place? These are questions popping up now amid the crisis rocking the APC. Make no mistakes about it, all is not well for the APC. Not at the moment. The reason is simple. The party lost the National Assembly leadership elections. Did I say the party? It is not really the party but some powerful persons in the party? How did this happen” Interestingly, some top members of the party are blaming two key actors for the mess in the party, and they appear to be the first victims, because they are calling for their sack. It is also on record that Tinubu had blamed Buhari for the crisis as well for what he called the President’s “ aloofness” before the National Assembly showdown. According to Tinubu “The President may need to assert himself by playing a fatherly role to reunite his political platform that is in tatters. When some leaders met with the President after the coup in the Senate, he was said to ‘be hollow’ without a solution to the crisis at hand. The time to act is now…Despite the choice of National Assembly leaders being a mixture of party politics and legislative duty, the aloofness, or the perceived neutrality of the President allowed the ‘fight’ within APC to fester until it went of hand.” The Deputy National Publicity Secretary, Timi Frank is leading the call for the sack of Oyegun and his boss Mohammed. But Oyegun and Mohammed are fighting back. Frank and his co travelers blame Oyegun for the mock election which cost the party the Deputy Senate President. He is being accused of not being man enough to resist overtures by powerful forces to conduct the mock election against the wish of the majority. Frank maintained that With this incident alone, the Chairman should resign from his position after taking a position ( mock election ) against the people and the people’s position has finally come to stay.” But Oyegun who admitted his party has disappointed the Nigerian people however kicked back saying “A lot of people felt anguish in different form, we made mistakes and there is no arguing about that. I take responsibility for what has happened, but I don’t take the blame.” He also indicted Mohammed. His argument is, it was wrong for the spokesman to go on national television and say the President is not the leader of the party. He said “Let’s go back and ask Lai Mohammed who the leader of the party is if he does not recognize the President as the leader. In my own view, If Lai Mohammed that is my direct boss could come up to tell Nigerians that the President is only a product of the party and not the national leader of the party, then he should have been able to tell us who the leader of the party is”. A rather bemused Mohammed simply responded to his subordinate “Just ignore him. I said it in the context that Buhari is the leader of the whole of Nigeria, not just of my party. That is why I said I don’t want to react to Timi Frank. I don’t even want to answer him” Frank insisted “Not just the National Chairman but also the entire leadership that took this decision of conducting mock election against the outcry of the larger members of the party. Against the bigger picture of Nigerians, a handful of the party leadership came to take a decision, and, by today, the people have shown that the voice of the people is the voice of God. You could see the way the party, including the National Chairman, was speaking before the NASS leadership elections. It showed clearly that the Chairman had totally taken sides which wasn’t meant to be. “ It seems Oyegun and Mohammed are still not sure of what to do next. Sources told Pointblanknews.com that both men are not sitting comfortably. Meanwhile At the moment, Oyegun and Mohammed are in a fix. They are torn between the camps of the majority party members controlled apparently by Atiku and the President Buhari, unsure of which camp to join. For instance, According to Sunday Vanguard, Oyegun, last weekend, had a meeting with Atiku where he pleaded that Gbajabimila should be made the Majority Leader of the House. But that request was a bitter pill to swallow by many northern elements in the APC who argued that the South West has got the Vice President and the Deputy Speaker. Tinubu too is not sitting pretty as the hawks around the President are insisting he is kept at a distance. Last week reports say his portrait at the party’s national secretariat had been taken down. It is still not clear who directed it. http://pointblanknews.com/pbn/exclusive/apc-crisis-oyegun-lai-mohammed-may-be-first-casualties/

WHAT THE LAW SAYS In the third reading document, there is a column for clauses, for the provisions of the bill – what was initially proposed, a column for what the committee recommends and then, the remarks. If you change what was proposed and you say what you want, you will state the reason you change it. My thinking is that someone who was not familiar with the document came to clause six. The opening paragraph reads in Clause Six: Sub-section One: The person who commits an act that causes penetration with a child is guilty of an offense called Defilement. That is the definition of defilement. The punishments are: Sub-section Two: A person who commits an offense of Defilement with a child age 11 years or less shall upon conviction be sentenced to imprisonment for life – Sub-section Three: A person who commits an offense of Defilement with a child between ages of 12 and 15 is liable upon conviction to imprisonment for life. Sub-section Four: A person who commits an offense of Defilement with a child between the ages of 16 and 18 years of age is liable upon conviction to imprisonment for life. What the committee handling the bill said was that the punishment is the same – life imprisonment and as such, there was no need to stagger the ages because whether it is zero to 11 or 18, the punishment is for life. Therefore, you need just one sentence covering all the ages and when they lifted the first one, which deals with 11 years or less, they did it to cover the whole and we found out that if you leave it as “ a person who commits an offence of Defilement with a child of 11 years or less shall upon conviction, be sentenced to imprisonment for life”, it would be as if you are approving going to bed with children, 11 years. That was the reason, if you look at the line across that sentence – that is the law making process, what you do not like, you rule it out and we have ruled it out. Then, they stated clearly that sub-sections three and four were deleted because the punishment is the same irrespective of age difference. So, somebody looked at it, saw that it was ruled out and still went out to say I encourage defilement of minors, is it not a mischief? What was ruled out was “with a child age 11 years or less. Automatically, what is then approved in the Votes and Proceedings for that day is the definition of Defilement and then, “the person who commits an offence of defilement shall upon conviction be sentenced to imprisonment for life”. We have to know what we are doing in this country because people have the predisposition to condemn and attack anybody that is doing anything good. Nobody can do right in this society and if we continue this way, we will be killing the spirit of those who want to do good. After all, I would have gone through those eight years without proposing a bill. There were people who did that because the law-making process is so slow and the time is so short. About 591 bills were proposed by Senators in the last Senate but only 123 were passed. So, there are so many proposals struggling for space and when some people look at it, they do not even want to try because there is too much hassle. Yet, those of us who pleaded, lobbied, spent money and energy and pushed until the end are rather attacked than appreciated. I said, ‘please, do not leave me empty handed, let us not have this kind of world, where parents cannot leave home because they are afraid that something might happen to their children; they are afraid the teachers might abuse them, that pastors and Imams may abuse them or that Professors would go after them if they go to the university’. Even in politics; there is no where to hide. The only deterrent is a very strong and stringent law that curtails those conducts and this bill is a revolutionary bill. There is no aspect of sexual offence that it does not cover. It updates those colonial laws that are still applicable in our society today and brings them up to international practices . It also deals with crimes that are not already in Nigeria but which we know that because Nigeria is well hooked to the international high way, World Wide Webb, those crimes will eventually come here. http://www.vanguardngr.com/2015/06/what-they-misread-in-sexual-offences-bill-chris-anyanwu/ |
In this interview, Senator Anyanwu says she was misquoted and puts everything in its right perspective while hoping that the President assents for the bill to become law. Excerpts The Sexual Offences Bill has recently generated a lot of controversy, can you throw more light on what it is all about? The Sexual Offenses Bill is one that has gone on a very long journey. It started in the 6th Senate, where half way, I did not go the whole hug and when I was re-elected in the 7th Senate, it was the first thing that I brought before the Senate. In fact, it was in 2011 that we did the first reading while the second reading was in 2012 and it has been sitting there ever since. But it went through a very thorough process and scrutiny because it went through a public hearing that was well attended by judges, Attorney-Generals from the states of the federation, Attorney-General of the federation office, the judiciary and all interest groups. This law was the result of three weeks of intensive work by about 20 young lawyers. They camped at the Law School in Abuja where they did the research and produced this document. The Senate Judiciary Committee, I believe, had some consultants who scrutinised this Bill. The arguments were made and there was nobody that was against the bill during the public hearing. Judges told us about their experiences, the kind of nightmarish stories they hear from victims and wanted the laws updated. In the Senate itself, on the two occasions we had debates on the bill, there was 100 per cent approval. There was nobody from the north, south, Christian or Muslim that was against the law. The only thing that they talked about was jurisdiction, which was the reason the law was passed in Abuja and to be adopted by all the states of the federation, bearing in mind their peculiar differences. When you now say that this law, which was primarily meant to protect children, adults, old people or those with disabilities, will turn against the people it is meant to protect, then, you should know that there is a problem somewhere. There is a lot happening in this country and I do not need to tell anybody living in Nigeria what is going on because we read them every day in the papers. I cannot recall any day that I picked up a paper in the past three years that I have not seen a horrible crime story relating to sexual offence. The one that threw me off balance was the story of a girl who was raped to death and then, set ablaze recently. This law became imperative because while we have a lot of laws covering different aspects of sexual offences, many of them were outdated, many were carried over from the colonial government. Imagine laws of 1948 and 1958 still being applied up till now. The result is that if somebody commits a crime , the punishment is like a slap in the wrist. If you penalise someone by asking him to pay N5,000 for raping a three-year old child, of course, before you bite your eyes, he has committed a more heinous crime ten times over. We have laws but they have encouraged crimes more than deterred them. I think it was a mixture of mischief and ignorance and could be a case of someone who did not know how to read legal documents. Many people, including those that work at the National Assembly may not have been preview to the documents and the way they are set out in the second reading and the third reading which is a general debate. Third reading is the real law making process where you take it clause by clause and when you read it, if you are not very familiar with it, you can make a serious mistake. |
Youths in the northern part of Nigeria under the aegis of Northern Youths Movement (NYM) have accused All Progressives Congress (APC) leader, Senator Bola Tinubu of being the brain behind the call for the resignation of President Mohammadu Buhari, saying Tinubu was gradually unfolding his actual agenda to hijack the presidency. A group, which called itself The PDP Media Watchdog, had reacted to the statement credited to President Muhammadu Buhari, declaring and admitting that his age will affect his performance rate as President of Nigeria by urging the president to resign from office. Already, the Peoples Democratic Party (PDP) had disowned the group, saying it was unknown to the party and had no connection whatsoever with the party at any level. In its reaction, the NYM in a statement signed by its Protem Chairman, Mallam Ishaya Jato alleged that the press statement credited to The PDP Media Watchdog actually emanated from Tinubu’s media office in Lagos. The northern youths said the statement was released to gauge the pulse of the public on Tinubu’s larger agenda of installing his crony, Prof Yemi Osinbajo (SAN) as the president of Nigeria. NYM disclosed that it was part of the agenda to cut short Buhari’s tenure that Tinubu desperately wanted to hijack the Senate and House of Representatives by installing his cronies as Senate President, Deputy Senate President, Speaker and Deputy Speaker of the House of Representatives. “The comment made in South Africa by President Buhari, regarding his age was deliberately hyped by Tinubu’s hatchet men in the media and the call for the president’s registration was aimed at gauging the reaction of Nigerians. “Also, we are aware that Tinubu’s camp is working on the possibility of President Buhari not completing his term, either due to failing health or death. “However, we youths in north are aware of his (Tinubu) plot against the north and we wish to tell him that we are watching. “He has failed in his attempt to hijack the National Assembly and use it to impeach President Buhari and we want to assure Tinubu and his cronies that President Buhari will not only complete his tenure, he will go for second term,” NYM said. The Chairman of the Independent National Electoral Commission (INEC), Prof. Attahiru Jega, has disclosed that allegations that the elections in Rivers State were manipulated and flawed was exaggerated. Jega said the elections in the state was credible and the commission did the right by announcing the winner. The INEC chairman, according to an online news medium, Per SecondNews, made this disclosure in Washington, DC during a conversation with US policy makers, think-tanks and members of the international community. The event, tagged: ‘Nigeria’s 2015 Elections: What Have We Learnt?,’ was hosted by the Center for Strategic and International Studies (CSIS) and anchored by Jenniffer Cooke, Director, African Programme at the institute. “We created a three man team to investigate the allegations of electoral malpractice, it was not true that elections didn’t take place in majority of the state, it was not true that results sheets was manipulated. There was no evidence of malpractice or photocopied result sheets, and no substantive evidence to establish alterations. “Rivers has become quite a big issue, and we did our best to be able to have enough evidence to make an informed decision before results were returned. We received reports of fake results sheets, use of photocopied result sheet, substitution of trend of INEC personnel and allegation of no election taking place in some polling units. “It came before we announced the results, so we immediately constituted a three-man team made up of national commissioners to go to Rivers State and investigate the allegations. “It was not true that elections did not take place in majority part of the state, in fact the evidence was that in the overwhelming majority election took place in most areas. “It wasn’t true that there was fake result sheets, there was no photocopied results sheets, there was no substantive evidence to support the wild allegations. “From our investigations we were satisfied that there was no substantive evidence to cancel the elections as agitated by some people, we also have people on ground and observers like TMG, and others who also gave us honest report about what happened. “I don’t think there was massive irregularities as reported in Rivers State, my advice is that they should go to the tribunal, if they have evidence, On our own part we have done our thorough investigation.” “We have scanned 95 percent of the results sheets from all the polling units and we will put them on our site once we get to 100 per cent.” “I am not saying their is no irregularities, but not to the magnitude that has been reported.” He said that the Orubebe incident was unfortunate and regrettable and advised statesmen to be statesmen and urged Nigerians to move on and forget about the incident. http://www.thisdaylive.com/articles/jega-allegations-of-electoral-fraud-in-rivers-greatly-exaggerated/212074/ |

Governor Samuel Ortom of Benue State has said that President Muham-madu Buhari would extend bailout to states to enable them offset backlog of salaries and liabilities crippling their economic activities across the country. He made this known yesterday in Makurdi, the state capital, during separate meetings with students and other union leaders from the Benue State University, BSU. Ortom further revealed that his predecessor, Gabriel Suswam left behind a debt burden of over N90 billion for his administration, contrary to the N9.2 billion debt as claimed by the former governor. Benue is among the distressed states in the country. Others include Osun, Enugu, Kaduna, Plateau and Imo. Most of the states or their local governments are said to be owing between four to six months salaries of workers amounting to several billions of Naira. However, according to Ortom, “the list of the debt (left behind by Suswam) include N50 billion incurred from ongoing contracts, N18 billion on certificated contracts, N12 billion on salary arrears and about N10 billion for bonds and bank facilities and loans.” He stated that the President had agreed to avail the states some lifeline but noted that Benue State government had concluded arrangements to borrow funds to pay one month of the backlog of salary arrears across board and to also ensure the take off of both the executive and legislative arms of government. He said the decision was prompted by the need to demonstrate to the state work force that he was determined to address their problems and to persuade striking tertiary institu-tion workers to call off their four-months-old strike. Earlier, President of the BSU Students’ Union Government, Bobby Taver-shima, had lamented that students of the university had been at home for four months but assured that they would not do anything to jeopardize the administration. Also, a representative of the National Associa-tion of Nigerian Students, NANS, Gideon Obande appealed to Ortom to clear arrears of bursary owed students in order to alleviate their sufferings. http://www.vanguardngr.com/2015/06/salary-crisis-buhari-to-bail-out-states/ |

Why northern APC senators voted Saraki …The ACN factor that upset APC nomination A ranking senator yesterday revealed how his Peoples Democratic Party (PDP) colleagues and those of the All Progressives Congress (APC) who supported the emergence of Senator Bukola Saraki as the Senate President were threatened the week preceding the inauguration of the National Assembly. He also revealed how senators-elect in APC from the North backed out of the Ahmed Lawan-for-Senate President project when they learnt that the intention was to cage President Muhammadu Buhari as plotted by some Action Congress of Nigeria (ACN) elements in APC, who nominated the vice president. The senator from the South-East, who doesn’t want to be named, told Daily Sun that elements who wanted Senator Lawan to emerge as Senate President, essentially from the ACN bloc of the APC did everything possible to ensure they arm-twisted the senators sympathetic to Saraki. He stated: “Sometime last week, it got so bad that their men stormed the Transcorp Hilton, Abuja, where most of us stayed and had our meeting to attack members. The attack came as the last effort after we resisted their inducement. “Yes, we were all approached to vote the people they wanted in the two chambers of the National Assembly, but we said no. We resisted them because we were on a mission to salvage our party, and we were bent on voting the person that would serve our interest. Now PDP is in the opposition and we have to teach APC a lesson in positive opposition.” He revealed that if the PDP National Assembly plot had been carried through to conclusion, there are indications that the APC would also have suffered another bad outing in the House of Representatives. Prior to the elections, there were plans already kept ready for the House of Representatives to also elect a PDP member as the deputy speaker from the South-South. Daily Sun gathered that the PDP caucus had got into a pact with the Yakubu Dogara camp for Hon. Leo Ogor, a PDP member from Delta State, to be the deputy speaker. But shortly after the election that returned Hon. Dogara as Speaker, the defeated contestant, Hon. Femi Gbajabiamila, acted fast and approached the new Speaker and pleaded with him that the South-West, with much membership of the House on the APC platform should not be left empty- handed. This point sounded valid to Dogara who immediately approached Ogor for his understanding, and the latter was said to have conceded, stating that if dropping his interest would foster smooth working in the House, he would not mind. The senator also noted that after they defied several efforts to woo them over, “the same people that had been persuading us resorted to force and had to get security agents to intimidate us and make us yield. It was at that point that we all vacated our suites in Hilton and relocated to the Sandralia Hotel in Abuja to conclude our plans and held to the decision we had taken.” The lawmaker said although they had facts of the plot as coming from the ACN arm of the APC, “it was the mild drama where some senators walked out of the chamber while in session on Wednesday, a day after the inauguration, that we got the message very clear. As those senators filed out of the chambers, we all noticed that the northern APC members who were among them, from the beginning, remained in chamber. All those that walked out were South-West APC senators.” However, from what he said, the other major factor that turned the table in favour Saraki was the notion that the plot to ensure that Lawan emerged Senate President was for the ACN bloc to cage Buhari. “There is this feeling that the ACN bloc had already taken the vice president’s slot, and allowing them determine who manages the National Assembly was like simply taking too much and making sure they manipulate the President with their men around the number one man. That is not politically sound and when the northern senators of the APC were aware of that plot, they had to beat a retreat and align with Saraki. Also, people who are very close to the President must have revealed to him why the agitation over the National Assembly leadership as targeting him, reason he changed his mind about attending the party’s caucus meeting in the morning, prior to the election of the National Assembly leaders, he explained. From the disclosure of the senator, the development in the APC over the outcome of the selection of the National Assembly leadership might have caused an early and major crack in the party. The fear, according to watchers, is that the party might experience early crack that might lead to a split along the lines of the blocs from which the ruling party was formed.
