mushystuff: And that makes it acceptable? So why was it necessary to vote out PDP if all APC does is validate the actions PDP was vilified for? There was palpable insecurity at the time fostered by idiotic northerners and the INEC then had the decency to review and postpone One (1) clear week to the time! Both situations are clearly worlds apart! Pele.... Every party had their excuses. So insecurity started a week to elections abi?? Those areas were secured b4 the postponement bah? |

Politics › Re: Agbakoba Makes Revelation About Tanko Muhammed, Acting CJN Appointed By Buhari by koboko69: 8:12pm On Jan 28, 2019 |
Newboss: There was no assumption there. Suspension in this context is clearly removal for some time. Everyone knows that. The law says removal. Temporary or permanent, it's still removal. That "type of" was an analogy to help you see things clearly. Ok na CBN case comes to mind. Did he win in court? Lol |
Politics › Re: Agbakoba Makes Revelation About Tanko Muhammed, Acting CJN Appointed By Buhari by koboko69: 5:21pm On Jan 28, 2019 |
Newboss: You don't need dictionary here. Just use the context. The context here is that the CJN was suspended until the case he has is settled (temporarily removed). That's clearly a type of removal. There are mainly two types of removal: temporary and permanent.
For example, if there's a law that says you should run when you see a goat. Just like that. What happens when you see a he goat? Because clearly, the law wasn't defined to that extent. The question should be, is the he goat a goat, if yes, run! A goat is a goat irrespective of sex.
Removal is removal irrespective of duration, except when that was clearly defined. In this case, it wasn't. Therefore, whatever applies to temporary removal, also applies to permanent removal, and vice versa In law, there is no assumption. That is the point. Suspension and removal can not be used in place of each other.... U cant argue with "some type of" in law. Lol Thats enough grounds to fight the case on technicality |
Politics › Re: Agbakoba Makes Revelation About Tanko Muhammed, Acting CJN Appointed By Buhari by koboko69: 4:46pm On Jan 28, 2019 |
Newboss: Expulsion is explicitly clear: permanent removal. It's also derived from removal, but this time the removal is permanent.
Suspension is temporary removal Lol... I have checked all dictionaries....u just dey do ur own definition here |
Politics › Re: Agbakoba Makes Revelation About Tanko Muhammed, Acting CJN Appointed By Buhari by koboko69: 4:36pm On Jan 28, 2019 |
Newboss: Suspension is temporary removal. So it's still removal. If you suspend someone, you've removed the person, though not permanently Oga....na ur own definition be that. Is like saying suspension is the same as expulsion. Lol. Too much sense will not kill me |
Politics › Re: Agbakoba Makes Revelation About Tanko Muhammed, Acting CJN Appointed By Buhari by koboko69: 4:34pm On Jan 28, 2019 |
Hearme: LOL, as someone humorously said yesterday, the Senate should suspend the president and his vice and swear in Saraki as Ag. President. Since there is no provision for suspension of the President in our constitution. What do you think about this? That was a dumb humorous statement. Is the CJN covered by immunity like a sitting president and his vice? Or u dont know what immunity is? |

Politics › Re: Onnoghen: We’ll Resist Any Attempt To Impeach Buhari – APC Senators by koboko69: 4:28pm On Jan 27, 2019 |
Built2last: There is another legal issue rearing its ugly head so soon: PMB swore-in an Acting CJN yesterday and Tanko Muhammad commenced work immediately.
The question is, has Tanko Muhammad J disposed to an affidavit at CCB between yesterday and today declaring his assets?.
Has ACJN complied with section 290 of the 1999 Constitution of the Federal Republic of Nigeria( as amended)?
For avoidance of doubt, section 290 provides thus:-
"290. (1) A person appointed to any judicial office shall not begin to perform the functions of that office until he has declared his assets and liabilities as prescribed under this Constitution and has subsequently taken and subscribed the Oath of Allegiance and the Judicial Oath prescribed in the seventh Schedule to this Constitution."
While Tanko has taken oath of office, he has not declared his assets as required by section 290 of the constitution, yet he has performed a function of the office he occupies. There is difference between acting and substantive. |
