I disagree with you, he should pay the 70k fine, next time when he thinks about the 70k he won't repeat what he did. In civilized countries only the cameras on the roads will flash you and your car number will be recorded. You must pay your fine, no two ways about it. Speed limit will be 100km/ph, Just drive a little above that speed limit and the camera360 that will flash you eh, nobody will tell you to reduce your speed and drive the speed limit you see on the roads. Obey the rules so that the people you call Agberos won't create an avenue to exploit your pocket.
You are not entirely correct on that.

You are allowed a 10% over the stated limit ....otherwise everyone will have their face glued to the Speedometer..... instead of driving sensibly!
grin grin undecided

If its 100 Km/h, you are still safe as long as you dont go beyond 110 km/h
If its is 60 Km/h... then just hover between 60 and 66Km/h .... but if you exceed that by even 1km, you are done for it.

Having said that, the issue is not whether he should be fined or not. He SHOULD be fined.

The issue is the AMOUNT.... relative to his income.... which also determines his "ability to pay".

Fining someone an amount YOU KNOW they cannot pay.... is tantamount to imposing a "mandatory jail term", ... for a "non-jailable" offence!

100 Dollars = 25,000 Naira..

Minimum Wage in some States are as low as 5 Dollars a day. AN HOUR. undecided

Do you know how many days you would have to work to make a hundred dollars.

#PrayForNigeria
I dont think you are getting the point being made by the poster.

Fines are paid from the offender's finances/income.

Income is a function of the country and the "standard" of living.
In some countries, that $5 is a monthly income, while in some, it is an income for "One Hour" low-paid job!
In Nigeria, some TEACHERS earn less than that in A MONTH. Yes, l know this for a fact.

Thus, l have not seen where a Traffic offender is asked to pay say "THREE TIMES THEIR MONTHLY INCOME", (without them killing somebody! or being a repeat offender, in which case, the fine becomes a "deliberately PUNITIVE fine", imposed by the Judge).

Let us take over-speeding as an example.
In most Western Countries, the fine is around 60GBP, 90Euros, $100... with between 2 and 3 penalty points.
That amount is what most people (averagely poor people) earn in ONE DAY.

In Nigeria, by our low level of income/standard of living, that should equate to about #1,000 (One thousand Naira) going by an "average" Monthly Income of say #25,000.

Now, to fine someone in Nigeria, #75,000 for a traffic violation, will translate to fining the same person, if in the Western Clime (USA, U.K, Canada, Europe, et.c.) about $60,000, 50GBP or 45,000 Euros!

That you will agree is IMPOSSIBLE..... for minor traffic infractions like over-speeding or even Jumping a red Light.

I have done it before and l have paid that fine (with the Penalty Points to boot) so l am talking from personal experience.... and not just mouthing it. undecided

Thus, Traffice offence FINES need to be REASONABLE and in tandem with average INCOMES of the particular clime.

That is what the poster was inferring.
I know, you know but you are just being provocative.

Mind you, l am not endorsing "bad road behaviour" as it is a danger to everyone but l am also not endorsing "killing a fly with a sledge-hammer".

Thanks.

If he broke any traffic rules then he should be fined accordingly.
TCD:
this is what happens when you put illiterate touts in offices of responsibility. They have no slightest idea of rule of law, conduct and human rights.
I think we need to put things in perspective here:
We need to strike a balance between criminality, enforcement of the law and human rights.

While the video did not proffer "incontrovertible reason" for this arrest ....and hence we cant state categorically whether the driver was guilty or not, we can at least "jaw-jaw" on what we saw in the video.

1.) We never heard the LASTMA staff say "You did x, y, z offence"..... all we saw was them trying to hijack the vehicle by force

2.) If it is true that he had a flat tire, did he push the vehicle off the road or was he as usual with these danfo drivers, trying to change tires right in the middle of the road and thereby causing "obstruction of traffic"?

3.) Did the LASTMA staff assists or even attempt to assist him push the vehicle off the road or were they just interested in "arrest and fine" .... hopefully a compromise of "Egunje" will be offered? These guys need to understand that there primary responsibility is to assist in the free-flow of traffic! Arresting and fine are secondary matters.

4.) Are there (and are drivers aware) of stipulated amounts to pay as fine, for specific traffic offences or is it up to the LASTMA official to just "make-up" some amount and impose same on the drivers?

In a country where average basic income is less than #15,000, how can you impose a fine of #70,000 on someone, for a traffic offence?

Is that "amount reasonable" and expected to be payable or are we forcing people to become "desperate and aggressive" ...towards a law that is supposed to be "corrective"?

I know these "commercial drivers" are a "nightmare" but we need to develop robust ways to deal with them.

5.) Going by my own experience, l can say "some" of these LASTMA staff are worse than "Street urchins" (Agbero!)!
They are just after enriching their own pockets.... at all cost, no matter how devilish they act in the course of that!
Like someone said "Criminals in uniform", ...........is not restricted to the Police alone.

They lack any form of human-management skills, yet they are expected to work with the public.
In that video, would it not have been better to "calm down" that driver, make some assurances to him that he will be treated fairly, and then explain what he has done wrong to him and how he has broken the law.... and the penalties for same?

Rather, the LASTMA man was busy wresting the Key away and trying to start the vehicle so he can impound it!
How professional is that?
What if the vehicle is started inadvertently in the process and crushes one or more people during the struggle?
How about just calling-in the Police to arrest the driver, assuming he has really committed and offence and is resisting the law?

More importantly is that "No one should be able to use the "wearing of Uniform" to abuse, intimidate and harass Nigerians.

Nobody, whether Uniformed or not, is above the law of the land.
Every humanbieng deserves some level of dignity and respect...... Danfo drivers included.

LASTMA staff need to be properly trained and the use of Agencies like that, to "settle" (employ) "Political Thugs" is very undesirable.
Same goes for TOUTS of Ministries like regional and Urban Planning, Environment, Local Governments, e.t.c

On the flip side, Govt must continue to educate these Commercial drivers (Enlightenment Campaigns should be taken to their Parks on P.A Systems) and be told clearly on what and what constitutes infringement of the traffic law as most of them are not trained drivers nor educated!
When this is done regularly, offenders should be dealt with accordingly.... but in a civilized manner.

Yes, Impound the vehicle for "deliberate infractions" like driving against traffic or dropping/picking passengers at wrong spots, dangerous driving, jumping traffic lights, e.t.c, for which they are notorious for ....( not like when one gets a flat tire, which can happen to anyone at anytime),....
.... and let them pay a reasonable amount to collect it back.

My Take.

...I am suspecting Buhari and Tinubu ownership.
You people should STOP being Stewpid!

It does not really matter who owns the company, whether it is Buhari, Tinubu, Rochas, Jonathan, Amaechi or Patience.
Any and every company is definitely owned by "someone" and when they do a job, they are entitled to collect some money for the job done.

What matters MOST are:

1.) WHO signed the agreement that System Specs should collect 1% of all remittance to that TSA Account?

2.) Did that person act in the interest of this country?

3.) Is it a question of "lack of foresight" (as in being an "extreme case of RETARDEEN"! ) ........or a question of "CULPABLE CONNIVANCE" as a result of "vested interest" (as in "back-to-sender" pay me back a certain percentage through the "back door"! ... since nothing goes for free, as far as these Govt officials and Politicians are concerned)

The "FACTS" BELOW, are there for all to see.

a.) This "looting agreement" was signed in 2011

b.) Good "Badluck" Jonathan was the President in 2011 ...up till May 2015. Jonathan isgned this agreement with System Specs and l dont see Jonathan trying this heard to "enrich the opposition", ..."IFF" the company actually belongs to Tinubu...and there is no kickback for him, from such agreement.

c.) System Specs has been collecting money on behalf of the Fed. Govt into this TSA Account since then (2011) and making this 1% deduction, i.e for the past FIVE YEARS!

d.) Jonathan, Fayose and their PDP Govt are aware of this deduction since 2011...and kept quiet for some "not-so-strange" reason

e.) Some states Governors (like Fayose) and Federal Parastatals (like NNPC) have been stealing Money accrue-able to the Fed Govt by hiding them in various "secret accounts", hence the need to ask everyone to pay into a single (TSA) account.
This is a right directive to block all those "leakages"

f.) On assumption of office, Buhari ordered "strict adherence" to the use of TSA as a Central depository for all Govt incomes

e.) With enforcement, the money going into that account increased astronomically .... and proportionally, the "VALUE OF THAT 1%" also increased geometrically!

g.) On noticing this, the CBN, under Buahri's direction, asked System Specs to Repay back ALL MONEY it has charged the Nigerian Govt for that project since inception in 2011

h.) System Specs complied and returned the money........ citing "GOODWILL" but we all know that there is nothing like that in its dictionary otherwise it should have notified the Govt that 1% is just too much, knowing that it will run into Billions of Naira (but hey, if you say "there is awoof money for a company and signed awoof contract", it is not the company's responsibility to refuse such money!)

These are the FACTS of the matter, irrespective of whether you are an AP-Cheat, PD-Pig or just a #WAILING WAILER devoid of any brain cell!

STOP Acting Stewpid in publicly.
FACTS ...are FACTS.

Gaskia:
Meanwhile, System Specs, the company that owns Remita, the e-payment and e-collection software used by the Federal Government to implement payments into the Treasury Single Account (TSA), has written a letter to President Muhammadu Buhari on the controversy surrounding the 1% processing fee charged on inflow into the TSA.
The company in the letter dismissed allegations of wrongdoing, explaining that it was contracted by government in 2011, when President Goodluck Jonathan was still in office, whilst Emir Lamido Sanusi was Governor of the Central Bank of Nigeria (CBN).
The company further dismissed allegations made against it by Senator Dino Melaye (Kogi West) that the firm was making about N25 bn daily as commission, saying it made about N3 billion from the 1% processing fee as its share since the implementation of the project.
System Specs said it actually shared the processing fee with banks affected by the implementation of the TSA and the CBN in ratios of .5 %, .4% and .1%, respectively.

It is clear that during GEJ era he trusted Sanusi to enlist an ethical collection agent but Sanusi in his usual character enlisted one of their own, REMAITA.
GEJ was so prudent not to kick-start the TSA because of the N25B loss or leak implication per month.
Oduah was sacked for buying two bullet proof vehicles for N150M yet we are clapping for wiping of a whole N25B/ per month.
Currently, no bank is permitted to charge COT on govt. account so why collect charges on TSA, its against ethical standards.
The TSA is not expected only taxes and receivables, on the receivables like taxes and levies should be subjected to charges equivalent to the current COT regime of N 1/1000 (0.1%).
Alternatively, the commercial banks will be happy to manage the money / collection free just to enjoy the float. If the intention was to prevent losses then it has not solved the problem. Its a good intention but should be reviewed.
Just look at how purile you come across?

GEJ was "Prudent" not to implement a contract he signed?
A whole Commander-in-Chief is afraid to kick-start a contract he awarded?

If he thinks the contract is WRONG, a C-in-C with "balls" will simply cancel the contract or ask for ti to be reviewed downwards!

Now, you are trying to shift the blame to Buhari... who simply asked the States to direct all incomes into the TSA Account (which is a sound decision in itself).

The fact that the company (system Specs) has collected some income in the past (before Buhari became President) under President Jonathan, shows that Ebelete Badluck Jonathan is part of the SCAM and is probably using some cronies to front and collect his share of the money
.

But with Buhari in power, even the compnay itself has "jejely" refunded all the "excess money" it collected under Jonathan.
This goes to show (as against its claim of "goodwill"wink that the company knew what it was doing was "ethically wrong" but since it started under a "Jonathan Lootocracy".... System Specs knows and observes as well as comply, that a New Sheriff is in town.

I trust Buhari, he will quickly review the fee downwards, to a more sensible amount.

This is another example of how that "clueless thief" called Jona-Daft, has tried to destroy this country with its kleptomaniac band of Looters.

May God punish all those who try to ruin this country.

dammytosh:
REMITA is an ePayment and Collections system owned by system specs. REMITA is from REMITTANCE not from any REMI ati TAJU acronym pdp is spreading via their poor e-warriors.

Collecting 1% of transactions done on an electronic platform is the cheapest you can ever get and that should not make PDP run mad all of a sudden.

The problem with PDP is that they just don't know when to stop.

What f00lish question is Fayose asking from a company engaged by Jonathan and his team as far back as 2011.

PDP is obviously running out of dubious funds. all the REMI and TAJU acronymns are simply nonsense to derail what is going on.
When PDP was in Power, it was okay for Systems Spec to implement REMITA..... and okay by Fayose!
The dofus and Eediot called Fayose did not raise ANY ALARM since 2011, when Badluck Jonathan signed these silly agreement with System Specs!

Now that PDP has lost Power, Fayose has suddenly taken delivery of his "missing brain" and crying wolf! grin grin

Meanwhile, it was the humongous corruption of Ebelete Jonathan, that could sign such corrupt agreement where one company makes such Huge Income within so short a space of time.

Even Microsoft that produces the windows that Billion of people use, does no make money at that rate.
System Specs knows this and that is why it is "threading softly" less its Corporate Leaders end in JAIL and the company is completely proscribed.

Going forward, the company must agree to a specific amount, irrespective of how much passes through such its "software system".
System Spec cannot be the beneficiary of that TSM policy...... it is meant to save money for the benefit of Nigerians.

#500 Million "one-off" payment and that is it.

In addition, l think EFCC and DSS needs to focus on these Bank Executives who are aiding and abetting corruption.
They are beginning to behave like they are above the law.

As for Fayose, if he does not remit the money into the TSA as directed by the Federal Govt, the Government at the center should just withhold its Monthly allocation...... and let us see what he would do. he thinks Ekiti State is Lagos State (with big IGR)... or that he is Tinubu in terms of intellect!
Silly Cow
huh grin grin

Nuff said!
