kunlelikeme:You can still be granted Visa but your chances are very low. The onus is on you to prove to them you have no immigration intent. And that will be very difficult to prove since you have commenced K1 visa which shows immigration intent. |

djfrancis:My dear each State has different rules and requirements. Mine is Texas, yours is New York right? I tried to argue that I'm married and also showed my NOA1 for the AOS but she said they can only use K1 until it expires then I come back for renewal. I just hope my EAD will be ready by then. If not, I'll go back there again with my NOA1. So you got a validity of 4 years! Thats great. Well done. |

LegitBachelor:I've commenced the process for obtaining Drivers License. Went to the DPS with my international passport, social security card and proof of residence. The queue was quite long. Waited for close to 4 hours before it got to my turn! Aside the documentations, I did the vision test and the Drivers written exam test which I passed. I also had to go do the driving practise test which I passed. However I was given a license with a validity of a month! This is because they said my K1 visa is valid for only a month ![]() Well, I guess I'll just manage it till it expires then I can go and renew. I advice you go get your Drivers License after getting your social security number. Note however that each State within the US has different requirements for obtaining Drivers License. |

OOT1:Co-sponsor will fill I-134 as well. Read the instruction document for I-134 for further guidance. |
blazerichy:In addition to what Drenimarcus said, I will advice that you wait until you have scheduled an interview appointment date before you go for medicals. Your medicals should be done at least 3 weeks before the interview date. This because medical reports is valid for only 6 months and the validity on the K1 Visa will depend on it. Police Report is valid for 1 year thus you can afford to get it anytime. folarinstr:This is what I think: If the traditional wedding was done without going to the Registry (be it Federal, State or LGA) or Customary Courts to register it officially then the proper way of divorce is to return the brideprice to the bride's parents in the presence of witnesses. Also divorce papers is then gotten from the Customary Courts. If the traditional wedding is registered at the Registry then I think the High Courts should come into play here....I'm not too sure. I recommend a special thread be created where this question is asked. The thread should be created in the Romance section and the moderators and supermoderators can help in pushing it to the frontpage. The question in the thread should be well structured so the mods will see it as FrontPage worthy. I believe we will get good answers there as there are some sound lawyers here om nairaland. You should provide details such as you and your fiance email, case number, date of birth, passport number, phone number, etc. They will reply on a weeks time with this generic mail below: Thank you for your inquiry.The above mail comes with the K1 Packet along with other documents. The mail has no significance in itself. It however confirms that the US Embassy has your casefile and is ready to interview you. |
@OOT1, 1. I dont recommend scheduling an interview until contacted by the Embassy. Its a risk many people take but could backfire if the risk fails. What I would rather advice is to continue tracking the casefile until its confirmed to be in the Embassy. Also an email should be sent to the Embassy by the couples confirming this by providing their full details (full names, dates of birth, emails, case number, receipt number, passport number, etc), they will respond within a week. If they say they can go ahead and schedule, then they can. 2. I recommend he renew his passport asap. It won't take long, 2 weeks at most. I think he will be denied if he uses a different passport during the visa interview. I also think a passport should have a 6 months validity at the time of the interview. |

innken:My humble advice is that you guys meet at least twice within two years. The rule says at least once but its safer to do twice. This is because of the thorough scrutiny embassies in places like Nigeria and other high fraud countries give to K1 Visa applications. |

The request to expedite the process should be based on at least one of the following: a) Severe financial loss to person b) Emergency situation c) Humanitarian reasons d) USCIS error or e) Compelling interest of USCIS. Note however that they hardly grant expedition request 3.i saw a thing about some people who had traditional marriage been refused,in my own case,we just had a traditional engagement and she even put evidences of payment to the vendors for the engagement in the petition.does this mean that it may not be approved or even if it’s approved,can it jeopardize my chances of getting a visa?If brideprice was paid then it's considered marriage. Based on the rule of reciprocity, whatever is considered marriage here in Nigeria is considered as marriage by the US. The USCIS guys might approve it because they don't know our customs but the US Embassy guys might have issues with it and might recommend spousal visa. So if the traditional engagement is not actually considered as marriage by your customs and traditions then be prepared to prove it during the interview. Best of luck. |

innken:Its not compulsory but highly recommended. Getting a K1 visa with only one visit is very difficult as the Consular Office will need lots of substantial evidence to prove you guys truly love each other.....and that evidence is hard to get. Many people have been denied K1 Visa because the CO wasn't convinced but several have also been approved with only one visit. The choice is yours. I met my fiancee twice within 2 years. She filed for me after my first trip but we met again before my interview date. It cost me close to a 1000 dollars for the second trip. But I had to do it to prevent the possibility of being denied....which will lead to wasted time and money. |
Drenimarcus:I'm sure the CO did and she told the CO that she don't have it. Even if she now go and get the divorce papers, it will not be accepted as the date on the divorce paper will be that of today and not the day before her fiancee filed for her. One of the eligibility requirement for K1 Visa is that both intending couple must not be married as at the time of filing the i129F petition. And since she didnt get the divorce document when her fiancee was filing for her, it means technically she was still married at the time. That being said, I believe the CO was being too thorough. Some COs might not have noticed the error and would have approved her visa. Even me myself didn't know that a divorce document from the place where wedding was conducted is not enough unless a document from a competent High Court is gotten. But its well, God knows the reason for this delay. She will eventually be with her Love at God's own time which will be soon enough. |
@Sisiorente, I'm so sorry for the delay. Perhaps you would have scaled through if it were another consular officer that isn't very thorough. But God knows best. Maybe this happened to prevent you from encountering something dangerous. What I dont understand however is why the consular officer said your only option is through Spousal Visa. Based on what you just said, you can still apply using either Fiancee or Spousal Visa after obtaining the divorce document from the court. After all, you are not yet married to your man. But if you guys are married OR plan to marry outside the United States (bride price payment and/or traditional wedding), then your only option is Spousal Visa. However the final decision is yours and your fiancee to make. Both Spousal and Fiancee visa has its pros and cons. I wish you the very best. This is not a denial but a delay. Gods Grace. |

Although I must add that a Visit Visa is not the route to use if you have immigration intent. This thread is for those who already have a US Citizen fiancee and want to commence the K1 Visa Process. |
Drenimarcus:Go with at least 2 passport photos, international passport, appointment confirmation printout, DS-160 printout, GTBank Payment Receipt, Birth Certificate, Police Clearance Certificate, Medical Report (sealed), filled Affidavit of Support form along with its supporting documents (fiance's birth certificate, international passport, tax returns, bank statement, employment letter, etc), copy of documents your fiance submitted to USCIS when she petitioned for you (i129F along with supporting documents), proof of relationship (WhatsApp Chats, Call Logs, Pictures of you both together, copy of Flight Boarding Pass used to visit fiance, money transfers, etc) and other documents that supports what you filled in the DS-160 thats not listed here. Success bro. |
