AllTheWayUp: Buhari is indeed a curse to Nigeria. These terrorists have been well armed to the teeth and given the free license to invade rural communities and sack the natives from the homelands. In terms of security, this is the worst dispensation we've ever had. 5 Likes |

BluntBoy: You are the one displaying acute ignorance of the Law, not me. How did you arrive at the conclusion that libel is less of a "crime" than defamation ![]() Always making baseless assertions and still has the guts to call another ignorant, lol ![]() And I really wonder who you think you are to decide for someone how he or she should bring his matter to Court. Listen again dullard, Pst Ibiyeomie has EVERY RIGHT to sue Kemi for whichever offence he chose (whether libel, slander or defamation) so long the said offence is provided for by a law in force and he can prove his case against her. Whether it seems laughable to you is very irrelevant; because you too are irrelevant to the matter. 1 Like |

BluntBoy: Kindly face the SARS on behalf of your fellow countrymen O ye Master Braveheart! ![]() With your supposed bluntness, you are really wasting away here on nairaland where the Country's important Polithiefcians never visit; rather than taking the message straight to them in Abuja, since by your analysis, you seem to be the only courageous & upright Nigerian at present. ![]() First you wrongly asserted (with utmost confidence) that the case of defamation against Kemi was civil; hence she is being unjustifiably held behind bars. And I showed to you (with a link & a copy of the charge sheet) that the case against her again. civil, but criminal. Then, you chose to shift the goal post instead of humbly admitting to your mistake, by wrongly asserting again that the Police kidnapped her, suspicious bench warrant was issued against her & the Pastor is behind her re-arrest. I believe Kemi is more learned than you, hence, if she had thought any of your baseless assumptions above was the case, she would have done the needful; by counter suing the Police for infringing on her fundamental rights (which is a Court remedy that is always being sought by mostly defendants in the High Courts & is made available to them). She can also petition against the Presiding Magistrate that the case be transferred to another Court as she strongly believes she will not get justice there (i.e if she feels the magistrate is doing the bidding of the Pastor). That is why I'll keep saying that she is the root cause of her problems, because she knows what to do but refuses to do the right thing just to garner the sympathy of ignorant folks around. Let her get a good lawyer as well as ensure she never misses her Court proceedings (without the authority of the Court), and she won't have to worry about being detained again. Trust me, the Nigerian might not be perfect, but it's still better than taking laws into one's own hands. Imagine how terrible the Society will be without the Courts. I hope I've touched on all the issues you raised tho? ![]() |

BluntBoy: In as much as I didn't make these laws, there is no clear cut difference between the two offences except that the propounders of these laws deemed it fit to provide aggrieved persons with two different alternatives in seeking legal relief for the offence of defamation; considering the gravity of the offence. Just because you don't regard your reputation as something worth protecting does not means others should do same. A good name is generally seen as worth more than gold in every Society. Like one of the best quotes in William Shakespeare's 'Othello' states thus: "Good name in man & woman, dear my lord, is the immediate jewel of their souls; who steals my purse steals trash; 'tis something, nothing: It was mine, it's now his & has been slave to thousands. But he that steals from me my good name robs me of that, which tho not enriches him, makes me poor indeed" The same you will not hesitate to come online and accuse the Govt of being lawless, yet you still complain when they apply the laws strictly. Kemi jumped bail, that was why a bench warrant was issued against her (which is the standard procedure). And at the time, she accepted it was the undoing of her lawyer who failed to inform her properly about the proceedings in due time. So how's that the fault of the Court or the Pastor ![]() Please when you don't know something, just politely ask and you shall be enlightened. No one is witch hunting Kemi. The Court won't change it's procedure because of her. The same way she feels it's her right to tarnish someone's reputation online is the same way the Pastor also has the right to sue anyone who has offended him either civilly or via criminal action. It's now left for her to put up a strong defence at the trial, after which the Magistrate shall give its judgement. So far, Kemi has not even accused the Court of doing anything wrong. So why are you wailing more than the bereaved? |

BluntBoy: Now this is getting really funny ![]() As the Kemi's sweetheart that you are, why don't you get your ass off & go challenge the Court that has been keeping her behind bars if you really do care? ![]() You will just sit in the comfort of your dirty room & start spewing trash on what you know nothing of. All these your baby trantrums won't help her case, so better do the needful! |

Vacora: You guys are getting several issues wrong out of ignorance of our Nigerian laws. You are free as air to criticize these laws because they ain't perfect, but I want you to know that in as much as they are still in force, the Courts MUST apply them. Stop being sentimental about it or better still, persuade your Reps at the National Assembly to amend the laws. Secondly, I know that our Judicial system isn't as good as it should be. And several voices have canvassed for better reforms, but only God knows what the Govt is doing about the problem. Thirdly, atimes it's not always the fault of the Laws or the Courts, but also the fault of the Litigants/Parties & the Counsels representing them. They sometimes don't take their cases serious or even fail to meet up with Court Orders. In all, it's best to stay out of trouble if one knows he/she cannot cope with the stress of litigation because the reality is, it involves tedious procedure (when one isn't used to the trial system). |

BluntBoy: Why are you still confusing yourself mister? Kemi is neither being sued for libel/slander or any civil offence as you initially postulated in your earlier posts. Rather, she was charged for committing criminal offences as can be seen in the charge sheet attached below. Hence it is a criminal case and that is why she has been in & out of detention. Please kindly carefully read the charge sheet for proper understanding that it is not a civil libel or slander suit, OK ![]() When it comes to the offence of defamation, an aggrieved person has the option to either institute criminal complaint against the accused or a civil suit of libel/slander in Court. However, the said Pastor chose to institute a criminal action against her, hence, hers is a criminal case. |
![]() |
BluntBoy: She was charged for an offence provided under the 'CYBER-CRIMES ACT' (a Federal Law) & the 'CRIMINAL CODE' (applicable in the Southern region of Nigeria). Why then would you refer to it as a 'civil' offence ![]() https://www.google.com/amp/s/ynaija.com/explainer-kemi-olunloyos-arrest-makes-perfect-sense/amp/ 2 Likes

Oxster: Well, it's left for the Police there to determine whether the actual cause of her death was snake bite or not. I can't rightly assume anything since I'm not a direct witness to the tragic event. However, it is not a must that a snake has to desert the scene of its attack. BTW the story states that it was found under her mattress, possibly hiding from what it perceives as any further 'intrusion'. Who knows? ![]() |
![]() |
Oxster: The "deadly" in the narration meant "dangerous", and not that the snake was also found dead. From the story, the villagers were the ones that later killed the snake after it was discovered. 5 Likes |

aribisala0: And you had to resort to using insultive words to show how smart you are? ![]() BTW the Op did not ask whether or not his mother can inherit his deceased dad's property. Rather, the question is on what steps the OP's family should take to prevent the uncle from depriving him & his siblings of their due inheritance. Hence, your posts aren't even relevant in this matter. |

aribisala0: The person you quoted is right Sir. Customary Law is enforceable in Court ONLY if it satisfies the following 3 tests of validity: 1. It must not be repugnant to the rules of natural justice, equity & good conscience. E.g Customs that encourage slavery, or killing of twins e.t.c. 2. It must not contradict or conflict with any statutory law in force. [Note that the Yoruba custom you stated goes against this 2nd test of validity. This is because it contravenes the provision of the supreme law of Nig., that is the Constitution, which prohibits discrimination based on gender] There are a numb. of Supreme Court case laws in support of that position of the law Sir. 3. It must not be contrary to public policy e.g Customs that encourage vices which are abhorred by the majority in the Society.. Thus legally, @Op has a good case against his uncle. All he needs is a good lawyer with a wealth of experience in Family law & Succession matters. |

9jakohai: And how are you sure she hasn't repented already to God of the sin she committed ![]() Why discuss or pick on the sin of another when you know very well that you ain't without sin yourself? Judge ye not that you might be judged not, says the scriptures. My God is a God of mercy & grace. Let's not dwell on the sin of others and ignore the one positive thing that came out of it i.e the beautiful kids. Remember the story of King David and baby Solomon. Peace! |

PrecisionFx: From the story, the accused is arguing self defence. Definitely at the hearing, whatever evidence she provides to support her self defence argument, it's left for the Judge to decide her guilt. But under the Criminal Code Law which operates in the South, a self defence plea that succeeds in court attracts an outright acquittal in favour of the accused; not manslaughter charge. Manslaughter only comes up where an accused raises the defences of provocation or mistake. |
![]() |
PrecisionFx: There's nothing like manslaughter. If her self defence plea scales thru in Court, she walks free; as it leads to an acquittal. |
![]() |
chigoizie7: If only she gets a good lawyer, she may most likely walk free. Self defence is a good defence for murder in the Criminal Code. And her lawyer can argue that she panicked at the time, which made her take the drastic decision of leaving the scene abruptly instead of alerting the police. Note that in criminal cases like this, the burden of proof rest on the prosecution, and the law requires that the prosecution proves its case against the accused beyond reasonable doubt. Which is not an easy thing to do in the absence of forensics & other advanced technologies to assist the Police in properly ascertaining her guilt. |

Nasiruddeen: From the original writer's name, I can deduce that he is Shiite (I may be wrong though). ![]() Well because of the exceeding length of this your baseless writeup, I'm compelled to make a concise response to it: Firstly, the bulk of your writeup is on the issue of the "Trinity", that is, Jesus Christ being same as, or, a part of God. Briefly, the biblical doctrine of the Trinity consists of the following belief: 1. That there is One Living and True God who is the Creator of heaven and earth; who is eternal, almighty, unchangeable, infinitely powerful, wise, just and holy. ![]() And several Bible verses attest to that (e.g Mark 12 v 29 : The Lord our God is only one God) 2. That the one God eternally exists in three entities: the Father, the Son, and the Holy Spirit; and that these 3 entities are the One True God. Note: a) God the Father = The fiercely powerful Creator of all things & the Supreme Judge of mankind in all His glory. b) God the Son = The powerful Message/Word of God (which comes forth out of God the Father) made into flesh, to interact with mortal man. And several Bible verses have attested to this (e.g John 1:14 The Word became flesh and made his dwelling among us. We have seen his glory, the glory of the one and only Son, who came from the Father, full of grace and truth.) c) God the Holy Spirit = The all Powerful Spirit of God that dwells within true believers to maintain our righteousness before God & guard our spiritman/decisions from sin. Several Bible verses attest to this as well. (e.g Micah 3:8 But as for me, the Lord fills me with His Spirit and power, and gives me a sense of justice and the courage to tell the people of Is real what their sins are). Thus, the Son + the Father + the Holy Spirit = One same God. So let me leave you with these few Bible verses for knowledge sake:- John 1:1 In the beginning was the Word. And the Word was with God, and the Word was God. John 4:24 God is spirit, and his worshipers must worship in the Spirit and in truth. Genesis 1:26 Then God said, "Let us make mankind in our image, in our likeness, so that they may rule over the fish in the sea and the birds in the sky, over the livestock and all the wild animals, and over all the creatures that move along the ground. (Note that here, God says, "Let Us" and not "Let me". And we are told man was made in God's image. So how can God refer to Himself as "Us" and not "me" ![]() Genesis 5:1-2 This is the book of the generations of Adam. In the day when God created man, He made him in the likeness of God. He created them male and female, and He blessed them and named them Man in the day when they were created. ![]() On a lighter note however, Nasirudeen = 1 person To his children, he is "Nasirudeen the FATHER To his parents, he is "Nasirudeen the SON and And in him is his Spirit; thus in the spiritual, he is Nasirudeen the Spirit. That said, Nasirdeen as the Son + the Father + his Spirit is still = the same one Nasirudeen. ![]() |
