ACE comedian, Babatunde Omidina, a.k.a Baba Suwe, on Monday, asked a Federal High Court in Lagos, presided over by Justice Okechukwu Okeke, to vacate an order he gave last Friday, which empowered the National Drug Law Enforcement Agency (NDLEA) to detain him for additional 15 days.

The request formed part of a motion on notice he brought, pursuant to Order 26 Rule 11 of the Federal High Court (Civil Procedure) Rules, 2009.

The artiste, while asking for an order of the court discharging or vacating the order issued by Justice Okeke, argued that the application for the order obtained by the NDLEA was grossly irregular and constituted an abuse of the processes of the court.

In the motion filed by his counsel, Bamidele Aturu, Baba Suwe also argued that the application for the order obtained by the respondent was contrary to public policy and constituted a wanton violation of his fundamental rights.

The motion is expected to be heard tomorrow.

The NDLEA, it will be recalled, had arrested the comedian on October 12, while trying to board an Air France plane to Paris, after the scanning machine at the Murtala Muhammed International Airport had allegedly indicated that he had ingested substances suspected to be hard drugs.

Meanwhile, the NDLEA, on Monday, denied the rumour that Baba Suwe excreted wraps of cocaine or any other hard drugs.

Its spokesman, Mitchell Ofoyeju, in a telephone interview with the Nigerian Tribune, described as untrue, the rumour doing the rounds on Monday that the actor had started excreting drugs.

The rumour that Baba Suwe had excreted 16 pellets of cocaine led the Nigerian Tribune to call the NDLEA officials for confirmation, which they denied.

According to Ofoyeju, “the story is untrue, there is nothing new, he is still under observation.”

The question to the poster, how many lives have you touched, affected positively from your salary, if you are able to pick someone on the street and help the person without bias or return of favour, then God in heaven will reward you. sir i beg to disagree.the poster is not a man of GOD. the poster has not been entrusted with billions of naira by his congregation and the poster does not ride in fleets of 4x4s,private jets while his congregation trek to and from church.there is nowhere in the bible GOD said we should see things like this and keep quiet,remember the paul that you mentioned was criticised so many times by the first christians?
the same paul and peter fought and argued so much that paul said at a point that he will not concern himself with anything else,other than christ and the gospel it is all there in the bible and we know where it is.the bible also said my people perish for lack of knowledge the lord has opened our eyes to what some of the MOGs are doing which is running contrary to the will of GOD and if we don't talk then we will perish with the knowledge.
if you go to any church in nigeria,you will find out that some families mostly poor are the ones vested with the dirty odd jobs,cleaning,heavy lifting e.t.c while some posh families do the easy nice bits and it will even continue to the next generation is that right?

The church give aides to widows and orphan, am also aware of scholarship program for Intelligent less privilege children into their N640,000.00 school. If they at least give scholarship to 10 students, that will be N6.4 million/year and since the scholarship program runs every year, it will turn out to be 6.4 million multiple by 4 for a four years program and by 5 for a five years program; that will be 25.6 million/annum or 32 million/annum every year for 40/50 students.
dont do your calculations that way,its like the governor of a state who is being accused of embezzlement saying that he spent 500 million,it might sound like a lot of money until you do it by the ratio of money realised and divide by the number of the poor and needy i the church.then you will realise its like a drop in the ocean
we are not asking MOGS to donate to the anglican church,or to islam or the babalawo religion,we are asking them to take care of their own congregation who donate the tithes and offerings.as far as i am concerned before my pastor or general overseer will think of buying a private jet the poorest the congregation should be riding a small 1.3 litre engine toyota on hire purchase or even a motorcycle.
i am not asking my pastor to pack the children of the poor into the university but to give them like a 60/70% discount towards tuition fees and books or subsidise them its called means tested benefits meaning they will check your finances,investigate before subsidising even if the church now decides that you have to be a member for so number of years i don't even mind.if you check how much private universities like covenant,redeemers e.t.c charges what a single student pays is enough to take care of at least 3 more students who are from poor backgrounds

sir,the lives of the poor and vulnerable amongst the congregation is not changed by how many churches are planted.the only people who gains by a new church being planted are the new pastor and his mummy pastor,the pastor's children and the deacons it doesn't change anything amongst the congregation.
like i have written above let us not talk about the government because we are not asking the MOGS to take care of nigerians as a whole or those of other religions,we are asking them to emulate jesus christ and take care of their own congregation simple.

Re: the highlighted. I don't want to risk misreading what you said, but my comments are informed by the "you" in red quoted above.

You may not be wrong, but then I don't think money or financial contributions in churches should be controlled by one man or group of men - simply because they money does not belong to them but rather to the church/churches that made the contribution. The church in such a case is to decide what they would like the money to be used for, besides care for the poor, needy, vulnerable. If a church decides it wants to keep the money in the bank (which suggests that it accrues interests), then so be it. But such things would often open doors to those who write the cheques.


thanks brother,i understand what you are getting at but it was like a tongue in cheek comment if you look at most of the super churches and their congregations,if the MOGS really did spend the money they have saved in the bank on the needs and wants of their congregations lets be honest nothing will remain in the church coffers.you see the way i see it,one man controlling or a set of people controlling is not the real issue but using the money for its intended purpose is what is paramount.

for instance redeemed finances is not controlled by pastor adeboye,but being realistic he probably has a major say and the group of people in charge will not realistically go against his views at any given time.i met a white pastor in scotland doing charity stuffs and in the couple of times i have seen the man his clothes,shoes are tattered and for out so one day i asked him why he doesn't take a shoe and clothes from what people donate instead of wearing the tattered clothes but the man turned around and said if he did that then it was stealing.
he said those who donated those stuffs are donating it to charity,and not to him that unless they handed it to him,then he can't very well touch a single socks talk less of clothes.

when you raise these sort of issues people tend to try confusing you with scriptures or use the "touch not my anointed" bible verse to shut anyone up.this is why a lot of our MOG get away with a lot, they are men of GOD,they are not GODs

i have been reading some of your comments and i must say you are not being objective.there is something called moral responsibility and this is what the MOGS owe their adherents.besides your logic is flawed because you seem to be arguing that those who are criticising the mogs should desist from doing so simply because they have not done anything or as much as they have this is not the point the issues are clear and crystal.
1.if you are getting tithes and offerings from the congregation,they should not be kept in the account to gather interests because there is a ready need for it,follow what the lord said in the scriptures and what is in the acts of the apostles use the money to feed the widow,the poor,the vulnerable if after this you have money left then you can keep it in the bank.

2.a mog under no circumstance cannot justify the use of a single private jet talk less of 3 when the congregation are not afforded its use,and they are going hungry morally it is reprehensible. one of the central tenets of the scriptures is to love others and do unto others as you would yourself.so if you would not starve yourself or trek to and from church if the funds are available why will you as a man of GOD allow your congregation to do same?
if your children will attend foreign universities,why shouldn't the children of the poor in your congregation be afforded same opportunity especially since the church can afford it?

i am not against  the preaching of prosperity but it is not a one way street,the prosperity you as a moG IS PREACHING can only be seen to be manifesting on your and your family and close circle of friends it is not manifesting on the poor in the congregation yet you want me to hold on to hope and faith.their parents held on to faith till they grew old in the church and the children have taken over yet it has not changed their situation I'm sorry but that is not christianity.

If one looks at the history of the U.S, one can see that things were kept homogenous by determining who could and couldnt vote, white land owners over the age of 21. That was it. yes but would you agree with the methods being used by most of those empires?
this is why i gave the example of the old oyo empire,while we see it as a monarchy but they actually practised a democratic form of governance because the king does not hold absolute unchecked power.he could be deposed by being pressured/forced by the chiefs representing the people to commit suicide, the chiefs in turn are the first recipient to be shown the displeasure of the populace if the empire is not being run properly.
if you look at the south eastern part,and their republican ideals they even have a more stricter form of checks and balances on their successive igwes,

while i agree with the poster of this thread i totally disagree with this comment and i am posting a retort due to the fact that people from all over frequent this forum and it won't do for them to think most of us nigerians or africans have this view of our leaders.

democracy has never been practised in its real sense of "GOVERNMENT FOR THE PEOPLE AND BY THE PEOPLE" what has been practised all over the so called democratised countries have been a corrupt form of democracy.in fact africans have been the fore runner of real unadulterated democracy before the westerners introduced their versions to us
an example of a real democracy is the old oyo empire, the alaafin of oyo was chosen by those who represent the empire i.e the oho mess (the chiefs who represent e.g the hunters/bodyguards(security),the head of the ogboni(trad worshippers,the version of religion) the iyaloja representing the women/traders,the otun representing the commercial aspect /traders similar to the iyalode's role e.t.c

they will short list the names of the contenders and then by lots chose who they reckon will be the best candidate,even though the king seems to be the over lord,there are a system of checks and balances and if they have to depose the king there is a system whereby he has to open the lid of a calabash and dies instantly.
this is just a shortened version but the point of my pre amble is that true democracy involves the will of the people and their representatives working on consonance and if for any reason they want another leader a system is in place to depose/remove such leaders to pave way for another one also there are checks and balances.

ghadaffi even though he had some sterling qualities,made the same mistake sadam hussein made by pushing his luck too far and not quitting while the ovation was loudest,times have changed and he should have realised that rather than holding on to a system of governance that has been phased out a long time ago

dude,nacho and faan are both situated in a very popular and central area,there is no way someone of baba suwe's status will be detained for even a couple of hours and the news will not be all over the town talk less of days.you keep saying you know he is a drug peddler yet you have not offered a single objective and proper evidence other than conjectures,rumours and hear say.
even if he eats once a week,the fact of the matter is that it is not possible to have cocaine in his system till this very moment since the time he has been detained under observation, coupled with that is the fact that they have been giving him laxatives to force him to excrete which they have been monitoring.
the only face saving measure or what they call evidence since the almost 2 weeks he has been in detention is the controversial ct scan done yesterday which newspapers have faulted now due to the questionable background of the indian doctor.

if anyone needs to do a brain check i ll suggest you need it more than anyone because there are numerous issues of a psychological nature suggesting you are a sandwich short of a picnic.when 2/3 or more people are saying the same thing or have same view of a single individual then that individual needs to properly check himself.

while we are doing the fluid count,you should get your brain to the nearest brain surgeon for a comprehensive and thorough rain scan to help you detect and suck out the dead brain matter floating around in order for you to think clearly and rationally

The National Drug Law Enforcement Agency, NDLEA, may have started singing a new song on why they have detained ace comedian, Baba Suwe, for nine days now, according to an online report published early today.
[b][b][b][b] The National Drugs Law Enforcement Agency (NDLEA) has denied ever accusing Nollywood actor, Alhaji Babatunde Omidina, aka, Baba Suwe of ingesting drugs in his body. Rather, the agency is blaming the media for over blowing the story and putting the agency in a precarious position all in a bid to gather scoops for themselves.
the Public Relations Officer of the agency, Mitchel Ofoyeju, described Baba Suwe as a complete gentleman who is doing everything with- in his purview to assist NDLEAs investigation into whether he ingested drugs while attempting to travel out of Nigeria last week.

[b]Ofoyeju said the comedian had been cooperating with the agency[/b] and was in good and healthy condition while the agency continued to detain him pending the final investi- gations into the case. The agency spokesman, who declined to comment on whether the suspect had excreted three times as being speculated in the Nigerian media, said that the actor remained innocent until proved otherwise. We have never told anybody that he carried drugs in his body.
Baba Suwe is under observation just like it has been the case with every other sus- pected Nigerian passenger, the law is no respecter of anybody, we dont want to speculate about anything and we will make a comprehensive press conference on the case after we conclude our investigation. We are still investigating the case, well address the press as soon as we conclude our investigation on the matter, and we are not going to say anything until we conclude our investigations.

totally agree with this comment,after the whole euphoria has died down i honestly and earnestly believe it will dawn on the libyans that in a quest to wrest power from one dictator they have unknowingly foisted not one but a group of imperialists on their country.people paint the man as a corrupt dictator but from what i have heard from people who have been to the country he made sure he fed,clothed every single libyan apart from this the average libyan could choose not to work and be given welfare benefits by the government.

Guys, I know I can't help a lot of you from your conjectures, but a man is innocent if you hold no proof of guilt. Why do educated Nigerians still hang on to middle age attitudes of "crucify him since you suspect him"? If Mr. Suwe is connected enough to effect a plan B to escape a publicised arrest, wouldn't it be simpler to use same connections to pass himself through the airport in the 1st place? If, as some believe, he somehow made the illicit drug load disappear with the aid of "juju", does it make sense then to go through the rigour of ingesting the drugs in the 1st place? Their goof is not in using a malfunctioning machines or applying outmodeled investigative methods but in actually holding official press briefings on the case of a man who turns out to be innocent! On that note alone, Mr. Suwe and his camp should be suing for N10B for defamation of character and let the courts decide what amount to charge. Remember even the Nigerian Navy was fined N100M recently for the treatment their cadets metted out to a lady in Lagos.
you shouldn't be surprised by the conjectures,innuendos and the wolf pack lynching mentality of the middle ages being displayed by a lot of people concerning the man's case.if you check the handles of those making negative comments you will quickly realise that tribalism is a big factor driving the negative comments which is really sad when you discover a lot of them have at least a first degree.
the british who introduced us to the judicial system have always held sacrosanct the quote that "you are innocent until proven guilty" that is why a suspect will be released within 24 hrs unless something substantial is found on him/her.otherwise it becomes a case of false imprisonment.but as usual and like everything else once it gets to nigeria believe it will turn to rubbish in an international airport where officials will be eating and drinking while attending to you or asking you "wetin you bring come"there is bound to be this kind of errors i won't be surprised if the scanner operator was not paying attention or if the error was from them and they are trying to cover their incompetence.

anonymous tip implicates the man that he has swallowed cocaine,in their haste they arrest him and then make an official comment that he has ingested cocaine ,not having found anything they keep holding him due to the embarrassment.

in 2006 when i was coming out of the airport some ndlea officials in plain view,in front of everybody were literally begging me for pounds and i gave them some pound coins and naira that i had on me,some airport police in plain clothes with their guns will even approach you as you r getting in your car to beg for money.

if i was baba sure i will sue them for

1.false imprisonment which will pay him the bulk of his compensation in the british law courts false imprisonment is calculated hourly and its 500 pounds for the first24hrs and then the emotional,psychological trauma is calculated as well.
then his children and loved ones too can make a civil suit against ndlea because they were also affected psychologically and emotionally
a.n.t.p should sue them as well or be a part of baba suwe's suit to strengthen it as there name was mentioned in the said allegation.

2.after this another grounds to sue them is for defamation of character,which is totally different from false imprisonment,evidence of this is the official who read the statement mentioning drugs or cocaine they have to show the probable cause and the evidence of the traces of drugs in the stool sample.

3.another grounds is also the loss of earnings he will calculate the amount paid for the mc job,a reasonable amount he would have made if he was being sprayed money and use videos of his other jobs as evidence of this

[b][b][b][b][b]Report has it that Baba Suwe who is still in NDLEA custody since Wednesday October 12,2011 for alleged drug trafficking is yet to excrete the alleged drug after scanning machine had proved he has substance concealed in his stomach.[/b][/b][/b][/b][/b]

He was reportedly on his way to France- in the night- when the Anti- drug agency's scanner indicated that he was smuggling drug. He was promptly arrested and thrown into detention.

The comic act has excreted three times since his detention but no drug has so far been found on him.

We learnt the scanning machine employed by the NDLEA, is called Soter RS, which was donated by the United States government to the agency in June 2008.

The machine is believed to be one of the most sophisticated x-ray body scanning machines available for drug detection.

The SOTER RS Security Body Scanner can undertake a whole body, clothing or body search, detecting everything hidden in or outside the human body within just 10 seconds.

For seven days now, since the popular comedian was arrested and detained by NDLEA operatives, Nigerians have been waiting to know the outcome of the drug saga.

The arrest of Baba Suwe is generating a lot of interest in the Nigerian media and social network sites such as Facebook and Twitter.

His lawyer, Mohammed Bashir on Wednesday said that a fundamental rights enforcement suit would be filed on his behalf within the next five days and they planning a N1 billion suit against the National Drug Law Enforcement Agency (NDLEA) over his arrest and detention.

Bashir talking to NAN reporter, said: “We will be filing the suit before a Federal High Court in Lagos between now and Monday. “We will be asking for N1 billion as compensation for damages suffered by him due to his illegal arrest and detention, as well as the embarrassment and defamation done to his reputation as a result of the incident,” he said.

The lawyer further told NAN that NDLEA officials had prevented him from meeting physically with Baba Suwe since his arrest, almost a week ago.

“I have visited the place twice since he was detained but was turned back and prevented from seeing my client. This denial of access to my client is another violation of his fundamental human rights,” Bashir added.

It is however instructive to note that prior to his arrest- Babasuwe had been severally rumoured to be involved in the drug trade
