Thanks for the feedback guys. However, what he is doing is a renewal, not a first time application. He does not need police clearance from Nigeria even if he stayed there for the past 1 year, as long as he is renewing his existing visa. If it is a fresh application, then it is a different matter. Like Lukgaf said, you can do your medical in any hospital. The Radiological will have to be done in a hospital with X-Ray capabilities. You can try any Netcare hospitals or Lister building (downtown). The Netcare hospitals should accept your Momentum medical aid.

Secondly, if you are renewing, you don't need Nigerian Police Clearance. Your SA Police Clearance will also be done at VFS at the point of renewing your visa, so no need to get any Police Clearance.

By counting of Sultan, today is 29th of DhulHijjah, 1440AH. By implication, we start new Islamic calendar tomorrow (Saturday) or next (Sunday). The thread seeks to treat the permissibility of congratulating one another at the beginning of the new Islamic year calendar?
Shaykh Muhammad ibn Saalih al-‘Uthaymeen (may Allaah have mercy on him) was asked: What is the ruling on congratulating people on the occasion of the Hijri new year, and how should one reply to a person who offers congratulations?

He replied:

If someone offers you congratulations, then respond to him, but do not initiate such greetings. This is the correct view concerning this matter. So if a person says to you, for example, “Happy New Year”, then you can say, “May Allaah make it a good and blessed year for you.” But you should not initiate such a greeting, because I do not know of any report that the salaf [early generations of Islam] congratulated one another on the occasion of the new year, rather the salaf did not regard the first of Muharram as the first day of the new year until the caliphate of ‘Umar ibn al-Khattaab (may Allaah be pleased with him.

Shaykh ‘Abd al-Kareem al-Khudayr said concerning offering congratulations on the occasion of the hijri new year:

Praying for another Muslim in general terms, in phrases that are not meant as a kind of ritual on special occasions such as Eid, is acceptable, especially if what is meant by this greeting is friendship and to show a friendly face to one’s fellow Muslim. Imaam Ahmad (may Allaah have mercy on him) said: “I do not initiate the greeting but if someone greets me I return the greeting, because responding to the greeting is obligatory. But being the first to offer congratulations is neither Sunnah nor forbidden.

Islam is a beautiful religion for it touches all aspect of human lives. It is normal as human to experience pain in some part or all over the body. The Prophet (May peace of Allah be upon him, his households and companions) teaches us what to say in this regard.

Usman ibn Abil Aas As-Saqafi (R) complained to Nabi (Sallallahu Alaihi Wasallam) of a pain that he felt in his body. Thereupon Nabi r said: “Place your right hand at the place where you feel pain in your body and say (7 times):

أَعُوْذُ بِعِزَّةِ اللهِ وَقُدْرَتِهٖ مِنْ شَرِّ مَا أَجِدُ وَأُحَاذِرُ
Bismillaah). ('A'oothu billaahi wa qudratihi min sharri maa 'ajidu wa 'uhaathiru).

I seek refuge with Allah and with His Power from the evil that I find and fear. (Ibn Majah/Muslim)

Conclusion:

In this hadith, there are two virtuous scenarios:

The scenario of supplication and asking of Allah, and beseeching Him, even if that is outside of prayer, whether it is done before praying or after finishing one’s regular acts of worship at night, or even without praying at all; a person may wake up, call upon Allah (du‘aa’), remember Him (dhikr) and ask Him for forgiveness, then go back to sleep.

The more virtuous scenario is to combine all of that by praying as much as Allah wills of tahajjud prayer at night, when people are sleeping, asking his Lord for forgiveness in his tahajjud, and calling upon Him, asking Him for whatever he wants of the goodness of this world and the hereafter.

Hence the salaf (early generations) used to prefer to pray at this time, as az-Zuhri said.

It was narrated from Ibn Shihaab az-Zuhri, from al-Agharr and Abu Salamah ibn ‘Abd ar-Rahmaan,

That Abu Hurayrah said: The Messenger of Allah (blessings and peace of Allah be upon him) said: “Our Lord, may His name be blessed, descends every night, when the last third of the night remains, to the lowest heaven and says: ‘Who will call upon Me so that I may answer him? Who will ask of Me so that I may give him? Who will seek My forgiveness so that I may forgive him?’ until dawn breaks. Hence they used to prefer to pray at the end of the night rather than at the beginning thereof.”

Narrated by Imam Ahmad in al-Musnad (13/35); classed as saheeh by al-Albaani in Irwaa’ al-Ghaleel (2/196).

Imam Muhammad ibn Nasr al-Mirwazi (may Allah have mercy on him) said:

Chapter on seeking forgiveness before dawn, and praying at that time.

Allah, may He be exalted, says (interpretation of the meaning):

“And in the hours before dawn they would ask forgiveness”

[adh-Dhaariyaat 51:18]

“and those who seek forgiveness before dawn”

[Aal ‘Imraan 3:17].

It was narrated from Naafi‘ that Ibn ‘Umar used to pray at night, then he would say: O Naafi‘, has dawn broken yet? And I would say no, so he would pray again, then when I said yes [dawn had broken], he would sit and ask Allah for forgiveness and offer supplication until the time for Fajr prayer.

It was narrated from Ibn ‘Umar and Mujaahid concerning the verse (interpretation of the meaning): “And in the hours before dawn they would ask forgiveness” [adh-Dhaariyaat 51:18], that they said: They would pray. It was narrated from ad-Dahhaak: And they would get up and pray.

It was narrated from Qataadah: They were people of prayer.

It was narrated from al-Hasan concerning the verse (interpretation of the meaning): “They used to sleep but little of the night” [adh-Dhaariyaat 51:17]: They would sleep little during the night, and “And in the hours before dawn they would ask forgiveness” [adh-Dhaariyaat 51:18]. He said: They would continue praying until the time before dawn, then they would offer supplication and beseech Allah. According to one report: They would pray during the night, and would seek forgiveness in the time before dawn, at the end of the night.

It was narrated that Zayd ibn Aslam said: Those who attended Fajr prayer.

It was narrated from Ibn ‘Abbaas that a caller calls from heaven every night during the time before dawn (saying): Who will ask so that he may be given? Who will call so that he may be answered? Who will seek forgiveness so that he may be forgiven? And everyone between heaven and earth hears it except jinn and humans. Do you not see how the rooster and other creatures like him call out at that time?

‘Abdullah ibn Mas‘ood used to slip out from his house and say: “O Allah, You called me and I am responding to You; You commanded me and I am obeying You. This is the time before dawn, so forgive me.” It was said to him: Why do you say, “This is the time before dawn, so forgive me”? He said: When Ya‘qoob (peace be upon him) he would pray for forgiveness for his sons, he deferred that until the time before dawn. It was narrated from Ibraaheem at-Taymi that he said, with regard to the words of Ya‘qoob, “I will ask forgiveness for you from my Lord” [Yoosuf 12:98]: He deferred it until the time before dawn…

Thirdly:

The term seeking forgiveness is used in a general sense in this hadith, and is not limited to a particular wording. Therefore anything that may be described as seeking forgiveness in Islamic terms is encouraged at this time, whether it is seeking forgiveness in general terms, or seeking forgiveness for a specific sin or shortcoming that the Muslim thinks of.

Question
With regard to the hadith, “Who will call upon Me so that I may answer him?”, is what is meant by calling upon Allah here the supplication (du‘aa’) that a person may offer as he wishes for the good of this world and the hereafter? With regard to the words “Who will ask of Me so that I may give him?”, does asking here mean the same as calling or supplication? Why is asking mentioned in particular in the second instance? What is the difference between them? What is the reason behind this variation, as the first phrase says “call upon Me” and the second phrase says “ask of Me”? Should the calling and asking mentioned in the hadith occur in the night prayer, or may they be offered at any time during the last third of the night? With regard to asking for forgiveness, can a person mention a specific shortcoming and include seeking for forgiveness for it among these other supplications?

Firstly:

It was narrated from Abu Hurayrah (may Allah be pleased with him) that the Messenger of Allah (blessings and peace of Allah be upon him) said: “Our Lord, may He be blessed and exalted, comes down to the lowest heaven every night when the last third of the night is left, and He says: ‘Who will call upon Me, that I may answer him? Who will ask of Me, that I may give him? Who will ask Me for forgiveness, that I may forgive him?’”

Narrated by al-Bukhaari (1145) and Muslim (758).

What is well established is that asking and seeking forgiveness are included in the general meaning of supplication (du‘aa’). Asking (su’aal) is a term that usually refers to seeking benefit, whether it is a spiritual or worldly benefit, and asking forgiveness (istighfaar) is a term that usually refers to seeking to ward off the harm and negative impacts of sin. Rather it is singled out for mention by way of asking for something specific after asking for good in general terms.

Shaykh al-Islam Ibn Taymiyah (may Allah have mercy on him) said:

First of all he mentioned supplication (du‘aa’), then he mentioned asking and seeking forgiveness. The one who seeks forgiveness is asking, just as the one who is asking is supplicating or calling upon Allah, but he mentioned the one who asks to ward off evil after mentioning the one who asks to seek good, and he mentioned both of them after mentioning the one who calls upon Allah in supplication, which includes both of the above, as well as other things. So this comes under the heading of asking for something specific after asking for good in general terms.

End quote from Majmoo‘ al-Fataawa (10/239).

Al-Badr al-‘Ayni (may Allah have mercy on him) said:

What is mentioned here is supplication, asking, and seeking forgiveness.

The difference between these three is:

What is sought is either to ward off something harmful, or to bring something good, and the latter may be either spiritual or worldly.

Seeking forgiveness refers to the first of these.

Asking refers to the second.

Supplication refers to the third.

End quote from ‘Umdat al-Qaari (7/201). See also: Fath al-Baari by Ibn Hajar (3/31).


Al-Karmaani said: If you say: What is the difference between supplication and asking?

I say: What is sought is either to ward off something undesirable or to bring something that is desirable, which may be either worldly or spiritual.

Seeking forgiveness is seeking concealment of sin, so it refers to the first.

Asking refers to the second.

Supplication refers to the third.

Or [it may be said that] supplication is that in which there is no request, such as when we say, “Yaa Allah, yaa Rahmaan (O Allah, O Most Gracious).”

And asking is requesting or seeking.

Or it may be said that what is meant [by these terms] is one thing, and the different phrases are by way of emphasis.

End quote from al-Kawaakib ad-Daraari by al-Karmaani (6/200).

Two other additions [to this hadith] were narrated:

Imam Ahmad narrated in al-Musnad (15/362): “… Is there anyone who will repent, so that I might accept his repentance?”

He also narrated in al-Musnad (12/478): “… Who is there that will ask Me for provision, so that I might grant him provision? Who is there that will ask Me to relieve harm, so that I might relieve him of it?”

The purpose of this elaboration, in which a specific meaning is mentioned after a general meaning, is to emphasize that which is singled out for mention, as well as to further encourage the listener to offer supplication. This is something that everyone who hears this hadith will experience, because when hearing the hadith in full, he will sense the importance and virtue of offering supplication (du‘aa’) at this particular time more than he would if he only hears part of the hadith.

Secondly:

The hadith mentions supplication at this time in general terms and does not restrict it to the prayer only. Therefore the basic principle is that supplication is encouraged and is good at this time in general terms, whether it is offered whilst praying or otherwise.

It was narrated from ‘Ubaadah ibn as-Saamit that the Prophet (saw) said: “Whoever turns over at night and says Laa ilaaha ill-Allaah wahdahu laa shareeka lah, lahu’l-mulk wa lahu’l-hamd wa huwa ‘ala kulli shay’in qadeer. Al-hamdu-lillaah wa subhaan-Allaah wa laa ilaaha ill-Allaah wa Allaahu akbar, wa laa hawla wa laa quwwata illa Billaah (There is no god but Allaah Alone, with no partner or associate. To Him belongs praise and His is the sovereignty, and He is Able to do all things. Praise be to Allaah, glory be to Allaah, there is no god but Allaah and Allaah is Most Great. There is no power and no strength except with Allaah), then he says, Allaahumma aghfir li (O Allaah, forgive me), or he offers supplication, his supplication will be answered. If he does wudoo’ and prays, his prayer (salaah) will be accepted.”

Narrated by al-Bukhaari (1154).

In this hadith, there is a differentiation between the status of the one who wakes up at night and remembers Allah, seeks His forgiveness and calls upon Him, and the status of the one who does more than that by getting up, and doing wudoo’ [and praying].

Allah, may He be glorified, has promised His bounty and grace to both of them.

It was narrated that Abu Umaamah al-Baahili (may Allah be pleased with him) said: I heard the Messenger of Allah (blessings and peace of Allah be upon him) say: “Whoever goes to his bed in a state of purity, and keeps remembering Allah until sleep overtakes him, then he will not turn over at any time in the night, asking Allah for something of goodness in this world and the hereafter, but He will grant it to him.”

Narrated by at-Tirmidhi (3562) and others. At-Tirmidhi said: This is a hasan ghareeb hadith.

DEMOLITION OF TRANS AMADI CENTRAL MOSQUE, PORTHARCOURT BY RIVERS STATE GOVERNMENT: GOVERNOR WIKE'S SYSTEMATIC RELIGIOUS CLEANSING, PERFECTION OF CHRISTIANIZATION AGENDA AND IMPUNITY TAKEN TOO FAR

The Muslim Ummah in Nigeria, especially those residents in Portharcourt, Rivers State, woke up on Tuesday, the 20th day of August, 2019 to witness surprisingly, illegal demolition of an ultra modern Trans Amadi Central Mosque, Port Harcourt by the Rivers State government led by Mr. Nyesom Wike.

It needs to be stated clearly that the land upon which the mosque was built is not in any dispute while its Survey Plan No. AI/RV2009/D13 and Building Plan No. RTP/09/617 were duly approved by the same Rivers State Government.

One then wonders why a religious place of worship accomodating more than ten thousand worshippers should be demolished without any understandable cause.

But then we recall that the Rivers State Governor, Mr Wike on some occasions in the recent past boasted that Rivers State is hundred percent Christian despite the presence of a good percentage of Muslims who are not only residents but indigenes of the State. Could this wanton destruction be an attempt to fulfil Gov Wike's stated interests in making Rivers a 100% Christian state? What might follow? Killing of Muslims? How far can Gov Wike go?

Will we wake up one day to see a government orchestrated mass killing of Muslims in Rivers State? Indigenous Muslims and non-indigenes alike? Has Governor Wike started a journey into mass murder of Muslims or is he just playing high level politics with people's lives and properties?

We really don't know how far Gov Wike is willing to go in pursuance of whatever is driving him but we call on all well meaning Nigerians, Muslims and non Muslims alike to call him to order. An attempt to lean on dangerous religious sentiments to gain some political popularity is a very low level that all men of decency should avoid.

We deem it important to note that we have read in the newspapers that Governor Wike claimed he did not demolish a mosque but agreed that he demolished a structure purportedly without a government approval. This is a clear lie, again a low level that a governor should not be descending to. The property is duly approved by the Rivers State Government with Building Plan No RTP/09/617.

Conclusively, we the Muslim Students' Society of Nigeria (MSSN) B-Zone condemn in the strongest term the illegal demolition of the central mosque. It is insensitive, unwarranted and uncalled for. It is a flagrant disregard to the right of Muslims in Rivers State to freedom of religion as well as right to own immovable property.

Section 38 of the Constitution of the Federal Republic of Nigeria 1999 (as amended) gave right to freedom of religion and it stated thus:
"Every person shall be entitled to freedom of thought, conscience and religion, including freedom to change his religion or belief and freedom (either alone or in community with others, and in public or in private) to manifest and propagate his religion or belief in worship, teaching, practice and observance"

In a similar vein, Section 44(1) of the constitution gives freedom to own property whether moveable or immovable anywhere in Nigeria to all Nigerians irrespective of their tribe, ethnicity or religion. The said Section 44(1) stated thus:
"No moveable property or any interest in an immoveable property shall be taken possession of compulsorily and no right over or interest in any such property shall be acquired compulsorily in any part of Nigeria except in the manner and for the purposes prescribed by a law"

We therefore call on the government of Rivers State, to as a matter of serious urgency, apologize to Nigerian Muslims for subjecting their brothers and sisters in Rivers State to this psychological torture and agony by demolishing an ultra modern mosque worthy of several millions of Naira.

We also demand for immidiate payment of enough compensation to the authority of Trans Amadi mosque for reconstruction of the mosque on the same land.

We use this medium to also call on the President of the Federal Republic of Nigeria, President Muhammadu Buhari, Vice President Prof. Yemi Osinbajo, leadership and entire members of the National Assembly, Religious leaders, Traditional rulers, religious groups, human right groups, media houses to condemn this act of impunity and call Governor Wike to order and not put Nigeria into another avoidable crisis.

Long live Rivers State, Long live the Federal Republic of Nigeria.

Question

I have muscular atrophy and suffer from spasms and extreme pain in my muscles; even barbiturates do not help with this pain. Hence the doctor has advised me to use marijuana, because it is very helpful for patients in cases like mine. There is also a pharmaceutical medicine that can be used instead of marijuana, but it has bad side effects. What is the Islamic viewpoint? Is it permissible to use marijuana in this case?

Praise be to Allah.

Firstly:

We ask Allah, may He be exalted, to grant you healing and well-being, and we ask Him to grant you both reward and a speedy recovery. We advise you to be patient and seek reward with Allah, for the believer is patient at times of hardship and grateful at times of ease. No doubt you know that Allah, may He be exalted, is most Wise in what He decrees for His creation of tests and trials, so seek the help of Allah your Lord, may He be exalted, to relieve you of hardship, and ask Him to make you patient and help you to obey Him and worship Him properly.

Secondly:

Marijuana is a drug that is derived from the cannabis plant. It is also sometimes called hashish or grass. With regard to the difference between these words, hashish refers to the sticky substance or resin, which is obtained from the tops of the cannabis plants.

Regarding the effects of this drug, it says in al-Mawsoo‘ah al-‘Arabiyyah al-‘Aalamiyyah: Marijuana contains more than four hundred chemical substances, and when it is smoked it produces more than two thousand chemical substances which enter the body through the lungs. These chemical substances have a number of immediate, short-term effects, in addition to the fact that regular use is connected to a number of long-term effects. End quote.

On our website we have previously stated that it is haraam to use this drug, and we have explained its harmful effects in the answer to question no. 66227.

Thirdly:

With regard to the ruling on using marijuana or other drugs to relieve pain, this is permissible subject to certain conditions:

That the patient’s need for this drug has reached the level of necessity.
That a trustworthy doctor testifies that the drug will be beneficial and helpful for the patient.
That use of the drug is limited to the level dictated by necessity.
That use of this drug is indicated in the sense that there is no other permissible or less-prohibited medicine that could be used instead.
That this drug will not cause the patient any harm that is greater than or equal to the harm for which it is being used; one of the greatest harms to the patient is addiction to using the drug.

What is the ruling on using pethidine or morphine, which are medicines that have an intoxicant effect, in cases of necessity or need?

They replied: If no other, permissible substances are known that could reduce the patient’s pain apart from these two substances, then it is permissible to use either of them to ease pain in cases of necessity, so long as using them will not result in any greater or equal harm, such as addiction to their use.

Numerous citizens especially those that reside outside Abuja spend days to get these documents certified. Among the beauties of Islam is the fact that in this religion there are no intermediaries in the relationship between a person and his Lord. Entering this religion does not involve any special ceremonies or procedures that need to be done in front of any other person, nor does it require the consent of any specific people. Becoming Muslim is very easy and anyone can do it even if he is all alone in the desert or in a locked room.

All it takes is to say two beautiful sentences which sum up the meaning of Islam and which include the statement that a person is the slave of his Lord and that he submits himself to Him and recognizes that He is his God and Helper and Protector Who decrees for him whatever He wills; and that Muhammad is the slave and Messenger of Allaah whom he must follow with regard to what was revealed to him from Allaah, for obeying the Messenger is part of obeying Allaah. Whoever utters these twin statements of faith, with conviction and believing in them, becomes a Muslim, sharing all the rights and duties that other Muslims have. After that he can start straight away to do the things that Allaah has made obligatory, such as the five daily prayers at the right times, fasting during the month of Ramadaan, and so on.

From this it should be clear to you that you can become a Muslim straight away, so get up, have a shower and say: “Ash-hadu an laa ilaaha ill-Allaah wa ash-hadu anna Muhammadan ‘abduhu wa rasooluhu (I bear witness that there is no god except Allaah and I bear witness that Muhammad is His slave and Messenger).”

May Allaah help you to do all that is good and guide your steps aright. May He decree for you happiness in this world and the next. Peace be upon those who follow true guidance.

What is the meaning of the hadith, “The people of Paradise will see the people of the chambers above them as they see a brilliant star far away on the horizon in the east or in the west, because of the difference in status between them.” They said: O Messenger of Allah, will those be the chambers of the Prophets that will be attained by no one else? He said: “No, by the One in Whose hand is my soul; they will be men who believed in Allah and believed in the Messengers.”? Does that mean that it is possible to attain

Firstly:

Paradise has various levels, and its people’s levels will vary according to their status and deeds. The Prophets will occupy the highest level of the people of Paradise, and no one will ever attain that level.

This has been explained previously in the answer to question no. 260581.

Secondly:

With regard to your question about attaining the level of the Prophets as mentioned in the hadith quoted, there are two scholarly views concerning that, which were mentioned by the commentators on the hadith.

Badr ad-Deen ad-Damaameeni (may Allah have mercy on him) said in Masaabeeh al-Jaami‘ (7/69): “No [Balaa], by the One in Whose hand is my soul; they will be men who believed in Allah and believed in the Messengers .” It was said that what is meant is that they will attain the level of the Prophets, and it was said that they will attain the dwellings (chambers) described here, but the dwellings of the Prophets will be above that. End quote.

Ibn Hajar (may Allah have mercy on him) said in Fath al-Baari (6/328):

The word Balaa may mean “yes”, these are the dwellings of the Prophets as Allah, may He be exalted, has affirmed that for them, but Allah, may He be exalted, may bless others by causing them to reach those dwellings. End quote.

Reaching the dwellings of the Prophets does not mean that one will be equal to them in terms of status and virtue.

Allah, may He be exalted, says (interpretation of the meaning):

“And whoever obeys Allah and the Messenger - those will be with the ones upon whom Allah has bestowed favor of the prophets, the steadfast affirmers of truth, the martyrs and the righteous. And excellent are those as companions”

[an-Nisaa’ 4:69].

Imam al-Baghawi (may Allah have mercy on him) said:

“those will be with the ones upon whom Allah has bestowed favor of the prophets” that is, they will not miss out on seeing the Prophets and sitting with them; it does not mean that they will be raised to the same level as the Prophets.

End quote from Tafseer al-Baghawi (2/247).

Imam Ibn ‘Atiyyah (may Allah have mercy on him) said:

What is meant by their being with them is that they will be in the same abode, and will share the same sense of joy and bliss, in which everyone who is there will be granted contentment with his lot, and he will not believe that he is less favoured than others, even though we know from the teachings of Islam that the people of Paradise will vary in status, commensurate with their good deeds, and commensurate with the grace that Allah bestows upon whomever He wills.

End quote from al-Muharrar al-Wajeez (2/76).

Az-Raazi (may Allah have mercy on him) said in Mafaateeh al-Ghayb (10/133):

The idea that the one who obeys Allah and obeys the Messenger will be with the Prophets and siddeeqeen does not mean that they will all be on the same level, because that would imply that they are all equal in status, and that is not possible.

Rather what is meant is that they will all be in Paradise in such a way that each of them will be able to see the other, despite the distance between them, because when the screen is removed, they will see one another, and if they want to visit and meet one another, they will be able to do that. That is what is meant by being with them in this case. End quote.

Imam Abu’l-‘Abbaas al-Qurtubi (may Allah have mercy on him) said in al-Mufhim:

This being with them means that they will be like them in being saved from the Fire and in attaining Paradise; otherwise, the people of Paradise will be in different levels and statuses according to their deeds and condition. This is indicated by the religious texts, as the Prophet (blessings and peace of Allah be upon him) said: “A man will be with those whom he loves and will have what he has earned.” End quote.

The hadith mentioned, “… and he will have what he has earned” was narrated by at-Tirmidhi (2386) from Anas ibn Maalik, and was classed as saheeh by al-Albaani.

Part of the perfect blessings that Allah, may He be glorified and exalted, will bestow upon the people of Paradise is that He will not deprive them of meeting their loved ones there, even if they vary in levels.

Shaykh al-Islam Ibn Taymiyah (may Allah have mercy on him) said:

When Allah, may He be exalted, wills to bring together [two people in Paradise], He will bring the one from the higher level down to the lower level.

A man said to the Prophet (blessings and peace of Allah be upon him): I love you and cannot bear to be away from you, but you will be in the highest part of Paradise, so I will not see you. So Allah, may He be exalted, revealed the words (interpretation of the meaning):

“And whoever obeys Allah and the Messenger - those will be with the ones upon whom Allah has bestowed favor of the prophets, the steadfast affirmers of truth, the martyrs and the righteous. And excellent are those as companions”

[an-Nisaa’ 4:69].

There are six conditions for the udhiyah:

It should be one of the an’aam class of animals, which are: camels, cattle, sheep and goats, because Allaah says (interpretation of the meaning):

“And for every nation We have appointed religious ceremonies, that they may mention the Name of Allaah over the beast of cattle that He has given them for food”

[al-Hajj 22:34]

Baheemat al-an’aam (translated here as “beast of cattle”) includes camels, cattle and sheep. This is what is well known among the Arabs, and this was the view of al-Hasan, Qataadah and others.

It should have reached the age stipulated in sharee’ah, which is six months for a sheep and the age at which the animal is considered to be an adult for any other animal, because the Prophet (peace and blessings of Allaah be upon him) said: “Do not sacrifice anything but an adult animal, unless it is difficult for you, in which case you may slaughter a six-month old lamb (jadh’ah).” Narrated by Muslim.

A mature animal means one that is considered to be an adult.

In the case of camels it means one that is five years old.

For cattle, it means one that is two years old.

For sheep it means one that is a year old.

The jadh’ah is that which is half a year old. So it is not correct to sacrifice a camel, cow or goat that has not yet reached maturity, or a sheep that is less than six months old.

It should be free of any faults that would render it unsuitable for sacrifice, of which there are four:

1 – An obvious defect in one eye, such as when the eye is sunken in its socket, or when it sticks out like a button, or is white and obviously defective.

2 – Obvious sickness, whose symptoms are clearly apparent in the animal, such as fever that prevents it from grazing and causes loss of appetite; mange that obviously affects its flesh or its health; deep wounds that affect its health, and so on.

3 – Obvious lameness, which prevents the animal from walking normally.

4 – Emaciation that leaves no marrow in the bones, when the Prophet (peace and blessings of Allaah be upon him) was asked about what should be avoided in udhiyah, he gestured with his hand and said: “Four: a lame animal which is obviously lame, a one-eyed animal whose defect is obvious, a sick animal whose sickness is obvious, and an emaciated animal that no one would choose.” Narrated by Maalik in al-Muwatta’ from the hadeeth of al-Bara’ ibn ‘Aazib. According to a hadeeth narrated from him in al-Sunan, he said: “The Messenger of Allaah (peace and blessings of Allaah be upon him) stood up among us and said: ‘There are four which are not permissible for sacrifice,’” and he mentioned something similar. Classed as saheeh by al-Albaani in Irwa’ al-Ghaleel, 1148.

These four faults render an animal unsuitable for sacrifice, and they include similar faults or more severe faults. So the following animals are also unsuitable for sacrifice:

1- One that is blind in both eyes.

2- One that has eaten more than it can stand, until the danger has passed.

3- One that has encountered difficulty in giving birth, until all danger has passed.

4- One that has suffered something that could kill it, such as strangulation or a fall from a high place, until the danger has passed.

5- One that is unable to walk because of a defect.

6- One that has had one of its forelegs or hind legs cut off.

If these are added to the four defects mentioned in the text, the number of those that cannot be offered as sacrifices reaches ten – these six and the four mentioned above.

The animal should belong to the person who is offering the sacrifice, or he should have permission for that either on the grounds of sharee’ah or from the owner. The sacrifice is not valid if the animal slaughtered does not belong to the person who is sacrificing it, such as one that has been taken by force, stolen, or taken on the basis of a false claim, etc, because it is not permissible to draw closer to Allaah by means of sin. A sacrifice offered by the guardian of an orphan from the orphan’s property is valid if that is customary and if he feels sad about not offering a sacrifice.

A sacrifice offered by a guardian from the property of the person under his care is valid, if done with permission.

No one else should have any rights to the sacrificial animal; the sacrifice of an animal that is held in pledge is not valid.

It should be slaughtered at the time specified in sharee’ah, which is from after the Eid prayer on the Day of Sacrifice until sunset on the last of the days of al-Tashreeq, which is the 13th of Dhu’l-Hijjah. So the days when the sacrificed may be offered are four: the day of Eid after the prayer, and the three days after that. Whoever slaughters it before the Eid prayer is over, or after sun sets on the 13th of Dhu’l-Hijjah, his sacrifice is not valid, because of the hadeeth narrated by al-Bukhaari from al-Bara’ ibn ‘Aazib (may Allaah be pleased with him), according to which the Prophet (peace and blessings of Allaah be upon him) said: “Whoever slaughters (his sacrifice) before the prayer, it is meat that he has brought to his family, but that is not the sacrifice.” And he narrated that Jundub ibn Sufyaan al-Bajali (may Allaah be pleased with him) said: “I heard the Messenger of Allaah (peace and blessings of Allaah be upon him) saying, ‘Whoever slaughters the sacrifice before he prays, let him replace it with another.’” And it was narrated that Nubayshah al-Hadhali (may Allaah be pleased with him) said: “The Messenger of Allaah (peace and blessings of Allaah be upon him) said: ‘The days of al-Tashreeq are the days of eating, drinking and remembering Allaah.’” Narrated by Muslim.

But if he has an excuse for delaying it beyond the days of Tashreeq, such as if the animal ran away, without there being any negligence on his part, and he could not find it until after the time was over, or he appointed someone else to slaughter it and that person forgot until the time was over, then there is nothing wrong with slaughtering it after the appointed time. This is by analogy with the one who sleeps and misses a prayer, or forgets it – he should pray it as soon as he wakes up or remember it.

It is permissible to slaughter the udhiyah at any time, night or day, but it is better to slaughter it during the day, and it is better to slaughter on the day of Eid after the two khutbahs. Each day is better than the day that follows it, because that means that one is hastening to do good.

The day of Arafah falls on every 9th day of DhulHijjah of Islamic calendar (equivalently, Saturday, 10th of August, 2019 this year). It is recommended that Muslim Fast and makeup some righteous deeds on this Day because of the virtues embedded on the day.
Below, we list some virtues of the day excerpted from IslamQA
1. It is the day on which the religion was perfected and Allaah’s Favour was completed.

In Al-Saheehayn it was reported from ‘Umar ibn al-Khattaab (may Allaah be pleased with him) that a Jewish man said to him, “O Ameer al-Mu’mineen, there is an aayah in your Book which you recite; if it had come to us Jews, we would have taken that day as an ‘Eid (festival).” ‘Umar said, “Which aayah?” He said: “This day I have perfected your religion for you, completed My favour upon you, and have chosen for you Islam as your religion.” [al-Maa’idah 5:3 – interpretation of the meaning]. ‘Umar said, “We know on which day and in which place that was revealed to the Prophet (peace and blessings of Allaah be upon him). It was when he was standing in ‘Arafaah on a Friday.”

2. It is a day of Eid for the people who are in that place.

The Prophet (peace and blessings of Allaah be upon him) said: “Yawm ‘Arafaah (the day of ‘Arafaah), Yawm al-Nahr (the Day of Sacrifice) and Ayyaam al-Tashreeq (the 3 days following Yawm al-Nahr) are Eid (festival) for us, the people of Islam. These are days of eating and drinking.” This was narrated by the authors of al-Sunan. It was reported that ‘Umar ibn al-Khattaab said: “It – i.e., the aayah ‘This day I have perfected…’ was revealed on a Friday, the Day of ‘Arafaah, both of which – praise be to Allaah – are Eids for us.”

3. It is a day by which Allaah swore an oath.

The Almighty cannot swear by anything except that which is mighty. Yawm ‘Arafaah is the “witnessed day” mentioned in the aayah (interpretation of the meaning):

“By the witnessing day [Friday] and by the witnessed day [the Day of ‘Arafaah].” [al-Burooj 85:3].

It was reported from Abu Hurayrah (may Allaah be pleased with him) that the Prophet (peace and blessings of Allaah be upon him) said: “The promised day is the Day of Resurrection, the witnessed day is the Day of ‘Arafaah, and the witnessing day is Friday.” Narrated by al-Tirmidhi and classed as saheeh by al-Albaani.

It is the “odd” [i.e., odd-numbered, Witr] by which Allaah swore in the aayah (interpretation of the meaning):

“And by the even and the odd” [al-Fajr 89:3]. Ibn ‘Abbaas said: “The even is the Day of al-Adhaa [i.e., 10th Dhoo’l-Hijjah] and the odd is the Day of ‘Arafaah [i.e., 9th Dhoo’l-Hijjah] This is also the view of ‘Ikrimah and al-Dahhaak.

4. Fasting on this day is an expiation for two years.

It was reported from Abu Qutaadah (may Allaah be pleased with him) that the Messenger of Allaah (peace and blessings of Allaah be upon him) was asked about fasting on the Day of ‘Arafaah. He said, “It expiates for the sins of the previous year and of the coming year.” Narrated by Muslim.

This (fasting) is mustahabb for those who are not on Hajj. In the case of the one who is on Hajj, it is not Sunnah for him to fast on the Day of ‘Arafaah, because the Prophet (peace and blessings of Allaah be upon him) did not fast on this day in ‘Arafaah. It was narrated that he forbade fasting on the Day of ‘Arafaah in ‘Arafaah.

5. It is the day on which Allaah took the covenant from the progeny of Adam.

It was reported that Ibn ‘Abbaas (may Allaah be pleased with him) said: the Messenger of Allaah (peace and blessings of Allaah be upon him) said: “Allaah took the covenant from the loins of Adam in Na’maan, i.e., ‘Arafaah. He brought forth from his loins all his offspring and spread them before Him, then He addressed them, and said: ‘Am I not your Lord? They said, ‘Yes, we testify,’ let you should say on the Day of Resurrection: ‘Verily, we have been unaware of this.’ Or lest you should say: ‘It was only our fathers aforetime who took others as partners in worship along with Allaah, and we were (merely their) descendents after them; will You then destroy us because of the deeds of men who practised Al-Baatil (i.e., ploytheism and committing crimes and sins, invoking and worshipping others besides Allaah)?’ [al-A’raaf 7:172-173 – interpretation of the meaning].” Narrated by Ahmad and classed as saheeh by al-Albaani. And there is no greater day than this and no greater covenant than this.

6. It is the day of forgiveness of sins, freedom from the Fire and pride in the people who are there:

In Saheeh Muslim it was narrated from ‘Aa’ishah (may Allaah be pleased with her) that the Prophet (peace and blessings of Allaah be upon him) said: “There is no day on which Allaah frees more people from the Fire than the Day of ‘Arafaah. It was reported from Ibn ‘Umar that the Prophet (peace and blessings of Allaah be upon him) said: “Allaah expresses His pride to His angels at the time of ‘Ishaa’ on the Day of ‘Arafaah, about the people of ‘Arafaah. He says, ‘Look at My slaves who have come unkempt and dusty.’” Narrated by Ahmad and classed as saheeh by al-Albaani.

In conclusion, many scholars are of the opinion that there is nothing wrong in fasting Arafah if it falls on Saturday since you want to observe Arafah and not Saturday.

Without doubt, the Day of Arafah for this year falls on Saturday. Since it is rewardable to fast the day of Arafah coupled with the impermissibility to fast on Saturday as instructed by our Prophet (May the peace of Allah be upon him); this thread seeks to answer question on whether or not it is permissible to fast on the day of Arafah because it falls on Saturday
Praise be to Allaah.
It is makrooh to single out Saturday for fasting, because of the report narrated by al-Tirmidhi (744), Abu Dawood (2421) and Ibn Maajah (1726) from ‘Abd-Allaah ibn Busr, from his sister, that the Messenger of Allaah (peace and blessings of Allaah be upon him) said: “Do not fast on Saturdays apart from days when you are obliged to fast. If any one of you cannot find anything other than grape stalks or the twigs of a tree, let him chew it (to make sure that he is not fasting).”Classed as saheeh by al-Albaani in al-Irwa’ (960). Abu ‘Eesa al-Tirmidhi said: This is a hasan hadeeth. What is makrooh in this case is for a man to single out Saturday for fasting, because the Jews venerate Saturday. End quote.

Ibn Qudaamah (may Allaah have mercy on him) said in al-Mughni (3/52): Our companions said: It is makrooh to single out Saturday for fasting … what is makrooh is singling out that day. If he fasts another day along with it, then it is not makrooh, because of the hadeeth of Abu Hurayrah and Juwayriyah. If it coincides with a day that a person regularly fasts, it is not makrooh.

What is meant by the hadeeth of Abu Hurayrah is the report narrated by al-Bukhaari (1985) and Muslim (1144) from Abu Hurayrah (may Allaah be pleased with him) who said: I heard the Prophet (peace and blessings of Allaah be upon him) say: “No one of you should fast on Friday, unless he fasts (a day) before it or after it.”

The hadeeth of Juwayriyah was narrated by al-Bukhaari (1986) from Juwayriyah bint al-Haarith (may Allaah be pleased with her), that the Prophet (peace and blessings of Allaah be upon him) entered upon her on a Friday and she was fasting. He said; “Did you fast yesterday?” She said, “No.” He said: “Do you intend to fast tomorrow?” She said: “No.” He said: “Then break your fast.”

This hadeeth and the one before it clearly indicate that it is permissible to fast on a Saturday at times other than Ramadaan, for the one who fasts the Friday before.

It is proven in al-Saheehayn that the Prophet (peace and blessings of Allaah be upon him) said: “The most beloved of fasting to Allaah is the fast of Dawood; he used to fast one day and not the next.”

In this case it is bound to happen that he will sometimes fast on a Saturday on its own. So it may be understood from this that if Saturday coincides with a day that he habitually fasts, such as ‘Arafah or ‘Ashoora’, there is nothing wrong with fasting on that day, even if it is on its own.

Al-Haafiz stated in al-Fath that an exception to the prohibition on fasting on Friday is made if a person habitually fasts on a certain day, such as ‘Arafah, and it coincides with Friday.

The same applies to Saturday. We have quoted the words of Ibn Qudaamah concerning that above.

Shaykh Ibn ‘Uthaymeen (may Allaah have mercy on him) said:

It should be noted that different scenarios may apply with regard to fasting on a Saturday.

1 – It may be obligatory, such as observing a Ramadaan fast during Ramadaan or making it up later on, or observing a fast as expiation (kafaarah), or instead of offering a sacrifice when performing Hajj tamattu’, and so on. There is nothing wrong with that so long as he does not single it out deliberately thinking that there is some virtue in that.

2 – If he fasts on the Friday before, there is nothing wrong with it, because the Prophet (peace and blessings of Allaah be upon him) said to one of the Mothers of the Believers who was fasting on a Friday: “Did you fast yesterday?” She said: “No.” He said: “Are you going to fast tomorrow?” She said, “No.” He said: “Then break your fast.” The words, “Are you going to fast tomorrow?” indicate that it is permissible to fast Saturday along with Friday.

3 – If it happens to be one of the days when it is prescribed to fast, such as Ayyaam al-Beed (the 13th, 14th and 15th of each hijri month), ‘Arafah, ‘Ashoora’, six days of Shawwaal for one who has fasted Ramadaan, and the ninth of Dhu’l-Hijjah. There is nothing wrong with that, because he is not fasting because it is Saturday, rather it is because it is one of the days when it is prescribed to fast.

4 – When it happens to be a day when he habitually fasts, such as a person whose habit is to fast alternate days, and the day that he fasts happens to be a Saturday, then there is nothing wrong with it, as the Prophet (peace and blessings of Allaah be upon him) said when he forbade fasting one or two days before Ramadaan begins: “except a man who (habitually) observes a fast, in which case let him fast.” This is similar.

5 – If he singles it out to observe a voluntary fast for one day only. This is what is forbidden, if the hadeeth forbidding it is proven to be saheeh.
