Most of Calabar metropolice runs on public water supply. Some areas of LAgos state still run solely on public water supply. I lost control of my vehicle on a Sunday morning years ago when a speeding vehicle came from behind and cut in front of me so hard that I swerved and braked so such that my car went into a spin out... Luckily, it was a sunday and the road wasnt as busy.. Had it been otherwise, I would be dead or I would have killed someone.. Blaming the driver for loss of control of a Vehicle due to a pothole on a 'HIGHWAY' is like blaming the Pilot of an Aircraft for Turbulence as a result of a strong air pocket.. The loss of control is only important here for one reason:: The Cause of that Loss of control. What caused this loss of Control?! Driver Error Like sleeping on the steering, over-speeding, bad over-taking, reckless driving, e.t.c?! NO!! The driver as far as I know was driving as he should on a highway. (Because the so called eye witness in a court of law will not be able to prove beyond reasonable doubt that the bus was over-speeding.. Except he|she had a speed gun or a speed camera.. Now any loss of control due to; 1. Mechanical Failure (Not borne out of negligence) 2. Unforseen conditions (Like Weather, ditches, sizures and co ) 4. An act of God.. Cannot be blamed on the driver. Again, If the speed limit on a road says 100 Km/hr and a driver doing that exact speed suddenly comes upon a pothole that he isnt aware of on that road, would you say the accident was caused by OVER SPEEDING on the part of the driver or would you blame it on the Unforseen pothole that appeared out of no where with no warning sign?! If a child gets killed crossing THIRD MAINLAND BRIDGE for example, what kind of case would you bring against the driver?! MURDER?! [/b] |

Its another thing for a Driver to lose control due to a bad patch on the road, causing him to 'ACCIDENTALLY' crush a Soldier on a bike that shouldnt have been there in the first place.. Secondly.. How did you come to the conclusion that he plies that route daily?! Why couldnt he have just started work on that day?! Or he just got assigned a new route that day?! Reptyle: He was wrong to be riding a bike on a road upon which bikes are banned. The bus driver was however at fault according to eyewitnesses, for not been more careful thus leading to the loss of a life.Well Said... However, the matter of the Driver being at fault remains a matter of Jurisprudence. Lets assume that the allowed speed limit on that road was 90Km/hr and the Bus driver hit that pothole at that exact speed; 1. Would we blame the driver for hitting a pothole that shouldnt have been there in the first place?! 2. Do we blame the driver for losing control of his vehicle as a result of an 'Anormaly' in the road?! 3. Do we blame the driver for killing a Pedestrian or Motor cyclist that shouldnt have been on that road at all as a result of point number 2 above?!?! 4. How do we say the driver was reckless?! What if he lost control as a result of a burst tyre?! Would we still balme him for killing a motorcyclist as a result of something beyond his control?! What if it was a vehicle that lost its tyre rod Like most Hondas, Do we blame the driver as well?! Finally:: It will biol down to a matter of he said|she said.. The driver can maintain that he wasnt speeding.. And any judge will agree. Its like a case of knocking down a pesdestrian crossing the express road in Nigeria.. The matter is simply ajudged 'manslaughter' and its normally settled with the Police asking you to please assist in the burial of the deceased. |
Xano: you are not a lawyer. You don't know how many count charge the driver will be charged with. Murder(manslaughter),attempted murder, bodily harm, reckless driving, damage to property,etc1. Murder?! - I think not.. This case lacks the Mens Rea & Actus Rea for it to be murder. For murder to occur, These two elements must be there. 2. Manslaughter - Thats all that this is.. And not all manslaughter cases carry jail time. 3. Attempted Murder - Of who?! The passenger I guess?! Well.. That charge wouldnt stick. You have to prove that the Drivers intent was to kill the passenger as well, and that would be an uphill task for any prosecutor to prove. 4. Bodily Harm:: Hmmm... Again, How do you prove this. He didnt go out of his way to harm them They just so happened to be riding ILLEGALLY on a road that they werent meant to be on, thus getting involved in an accident Assuming gthey were not even responsible for the driver hitting that pothole in the first place 5. Reckless Driving: I believe that this charge is for the Dead soldier and not the driver... 6. Damage to Property: Thats for the BRT|Lagos State government to bring against the dead soldier.. Just in case you are thinking of more chrages to bring against the Driver: 7. Hit and Run:: This one might stick.. But the driver would have a good defence if he turns himself into the police willfully.. FINALLY: The driver is inncent of all charges except 'Hit & run" as it is an offence to flee the scene of an accident in Nigeria.. Other than this, he is clean. The Soldier knew what the risks were for riding on a road illegally and paid the ultimate price. He would have been charged to court if he didnt die from the accident. The passenger should also give thanks go Olisa bi na igwe for her life.. And No. I'm not a lawyer.. Just an Aboki. |

sasview: The bridge is damn bad if not fix this may be a child play, had the driver not run probably he would have been a dead man now.Everyone in this order; Soldier: Commited suicide by delibrately putting himself in harms way. If it wasnt a bad bridge, it might as well have been a burst tyre or failed brakes, or even braking suddenly.. THE SOLDIER SHOULDNT HAVE BEEN ON THAT BRIDGE RIDING A BIKE DRIVER:: Has the least blame.. We dont know the speed he was doing for sure. If the road was bad, anybody could have fallen victim. He tried to control the vehicle and had the Bike not been riding on that bridge illegally, he would have brought his vehicle back under control after hitting that section on the bridge without any casualty.. GOVERNMENT:: Eko oni ba je o!! Fashola is truly working.. Working on killing as many Lagosians via road accidents as possible.. ![]() FINALLY:: Lets not attribute this to bad driving.. The Driver was not responsible for the pothole being there. Anybody could have hit that pothole. |

Ngwakwe: This is not the first and probably others (not cyclists) have been involved on the same bridgeWether the bridge is bad, good or whatever... Points to note; 1. The Bike shouldnt have been on that road. Maybe its because of such dangers that they would be exposed to that prompted such a law. 2. Even pedestrians have no business being on highways either. 3. Maybe if the Guy were in a car rather than a Bike, we would be talking about an accident and not a 'Fatality'. |
