Nigeria's Senate has voted to amend the constitution, setting a time limit for presidents to formally announce their inability to carry out their role. If passed, the head of state would have 14 days to declare their absence in writing - then MPs would vote for the deputy to become acting president. The move came after President Umaru Yar'Adua returned home after spending three months in a Saudi hospital. His return has sparked a row over the vice-president's official role. The amendment will need the approval of the legislatures in two-thirds of Nigeria's 36 states before becoming law. On Mr Yar'Adua's return, the presidency said Goodluck Jonathan would continue to run state affairs while the president recuperated. But Mr Jonathan's appointment by parliament as acting president during Mr Yar'Adua's absence was controversial and enters unchartered territory. Then a group claiming to speak for Mr Jonathan hit back with a statement calling him "acting president" three times. The BBC's Caroline Duffield in the capital, Abuja, says Nigerian politics is always murky - but that difference in title clearly matters. And there are now few rules to guide what happens next, she says. Mr Yar'Adua's condition is unknown and he has not been seen in public since 23 November. "We do not think he has the capacity today. We are appealing to him, and his handlers, that he should honourably resign his appointment," Osita Okechukwu of the Conference of Nigeria Political Parties, a group representing opposition parties, told the BBC. But our reporter says the president's tight-knit circle have bought him home for a reason. Analysts say that the struggle for the leadership is really about money. I don't have an ounce of doubt your folks can do worst than that to disrepute Muslims on this board, especially the likes of davidylan that couldn't feel, even a little, for those Boko-Haram defenseless people murdered extra-judiciously after the crises. Constable to pay N10m damages for shooting bus driver By Kazeem Ibrahym, Published: Friday, 19 Feb 2010 Justice Olubunmi Oyewole of an Ikeja High Court on Thursday, ordered a police constable, Alibor Narman to pay N10m damages for shooting a commercial bus driver, Mr. Sunday Awoyera. Awoyera had sued Narman for shooting him at a Police checkpoint in Igando, a suburb area of the state, while in company of his wife and children on August 2, 2008. He also demanded N10m damages from Narman “for the infringement of his right to life and dignity of human person.” In his judgment, Justice Oyewole held that with the medical report of the victim, “there was severe tissue loss and deep laceration of the mandible of the bones. “I declare that the action of the police officer is unconstitutional, as it violates the applicant’s right to life. “The dignity of the applicant has been significantly impaired upon, his person was trampled upon and he will live with the nightmarish incident. “I hereby award the full sum of N10m jointly and severally against the respondent”. The commercial bus driver told the court that the police officer placed the gun at his neck and pulled the trigger in the presence of his wife and children. But Narman had through his lawyer, Chief S. W. Baidi, urged the court to dismiss the application of the commercial bus driver since his client name was not mentioned in the reliefs sought by Awoyera. Awoyera had, however, through his lawyer, Mr. Simeon Oyeniyi, insisted that the erring police officer was guilty of the offence as charged. PUNCH |
