CeaserB: Maybe in your own terms all deaths must be suspicious then? A cardiac arrest is not an uncommon death, even if is, an autopsy should be carried out before pointing accusing fingers at a man simply because he was away when his wife died.
For your own sake, please learn to read before responding to posts - I have zero tolerance for dullards. I suppose you were taught in school that "I find it interesting" = pointing an accusing finger. Go and find fellow dummies to respond to, I'm done with you.

I find your interesting comment so amusing I'm forced to think you must either be a babysitter or a jobless man. undecided
Stop being unnecessarily emotional like a sex starved effeminate. In civilized societies, all unusual deaths are investigated and in cases such as this one, family members are automatic suspects, or shall we say, persons of interest. If you were to die mysteriously, lets hope your cause of death is revealed and if foul play was involved, lets hope the culprits would pay for the crime. mumu

I really do not believe that our President wants to resolve this BH issue. All hands are not on deck and that condition seems OK by the President.

May her soul RIP.

I add that this kind of death is not consistent with what is expected to happen to any family member of a man of God, but I suppose God knows best.

I'd recommend that an autopsy be performed to determine the real cause of death. If it is cardiac arrest, since this woman did not show any prior sign of illness and her family is informed enough to have been having periodic medical checkups, the real cause of the cardiac arrest should be determined. Without suggesting anything, I find it interesting that the husband was conveniently out of the country when the tragedy took place.
Politics › Re: GEJ To Sue House Of Reps Over Summon by nduchucks: 2:26pm On Jul 06, 2012
bayooooooo: 1. Notwithstanding the wordings of section 88, the summon is not applicable to the office of the president until a competent law of jurisdiction rule otherwise. In law, any doubt at all put an irremovable question mark on the whole stuff. Let's take for example a similar imbroglio between Obasanjo and Atiku when Atiku declared for Advanced Congress of Democrats and later emerged as the presidential candidate of Action Congress. Based on the wordings of constitution, Obasanjo as the leader of PDP declared his seat Vacant. The rest as they say is now history.

2. "Risk of impeachment" got me laughing. My brother, impeachment is more political than legal if the procedure in the constitution is anything to follow. You don't have to run foul of constitution to be impeached. Reference the impeachments of Peter Obi, Ladoja and Joshua Dariye that were upturned by Supreme Court. Their impeachments were ruled illegal and unconstitutional. Not to talk of Ayo Fayose who was practically bundled out of office. Bottom line, impeachment does not have to be legal to sail through. It's politics and if well played, the logical conclusion would be achieved.
Now using a portion of Constitution that's is to be tabled before the supreme court to interpret as the sole excuse to commence impeachment proceedings is not only laughable but a hard politics to play. The impeachment option is not viable as the house will be the one running foul of the law in this case.

3. Obasanjo attended Oputa panel because he had no choice other than to do it (The panel was set up by OBJ not NASS). He used it to mount pressure and sway public opinion against IBB et al who refused to show up. There was no part of constitution that made it mandatory for him to attend. Neither were there sanctions in the event that he failed to turn up. What has happened to Buhari, IBB, Abubakar etc that did not appear before the panel? Nothing! In a presidential system of government, I stand to be corrected, there is no place in the world where the parliament issue summons on the President. If you have instances, please quote them for the benefit of all to learn. When the house issued the summons on GEJ, why didn't they put a specific deadline on it? What if GEJ happens not to be ready till the end of his term since there is no urgency of flouting a deadline? What's the essence of a summon that the fellow being summoned would pick a convenient date for himself? How would one establish that such a summon has not been honored ? How would that now constitute a basis for impeachment? It does not have a logical flow sequence.

The powers of NASS to issue summons on anyone as presently itemized in 1999 constitution (as amended) do not apply to Mr.President. It's unconstitutional and amounts to legislative rascality that must be stopped by all legal means necessarily hence the rightful step of approaching the judiciary to give true meaning to that section. Until supreme court rules, the summons is as unconstitutional as illegal and thus null, void and of no material effect.
Let me first state that there is nothing wrong with inviting the President, but to do so with a tone of arrogance or disrespect to the office of the President or his person, would be outright wrong and ill advised.

The way and manner the leadership of House of Reps went about the summon was not proper, in my view, and smacks of arrogance - the kind of arrogance exhibited by thieves wey don belle full and have lost their minds.

Having said the above, under the powers of NASS to appropriate money, the lawmakers have the constitutional right and indeed duty to summon anybody to come before it for explanation. In this regard, since the House of Reps has the powers to appropriate money for security, it follows that it has the powers to call on Mr. President to explain certain issues that have to do with lives and security of the people of Nigeria, under section 88 and 89.

Additionally, the three arms of government are equal and under the principle of checks and balances in the constitution, the House is empowered to summon the president in time of national crisis as we have found ourselves with the current security situation.

In my humble opinion, this is not the time for the executive arm to be fighting the legislative arm in court over petty issues such as this. We are at war by all standards, and every arm of the government must join hands and fight this war together if we want to win.

Bayooooooo, you state that notwithstanding the wordings of section 88, the summon is not applicable to the office of the President. It appears as if the President and the AG do not believe as you do. If they did, they would simply ignored the summon. I submit to you that the President is going to court to claim that this particular summon is invalid but not that the President is exempted from summons by the House of Rep. In due time, we'll find out the real deal. This is my last post on this issue.

ezicat: Wow, such repetitive arguments

- According to prevailing statistics, agriculture contributes more to the economy of Nigeria than oil. For those who disagree POST YOUR SOURCES, because you haven't yet.

However,

- Oil contributes more to development since it is the major source of resource for the government (see the CIA factbook). Yes, even the miniscule development we get from our corrupt, incompetent government. So YOU ARE ALL essentially correct. We do depend on oil, as well as agriculture and retail. If the latter two were to disappear tomorrow, we would be in trouble as well. Oil won't be coming to our rescue. But, why are we arguing over the improbable? None of these commodities are going to disappear suddenly - except if there is a nuclear holocaust or something - but then, we would be screwed anyway.

So stop with the circular arguments. Let me summarize both sides in one cohesive statement "oil, though less than 20 %? of the GDP is important because it's essentially the major source of income for our lazy-ass government officials." And government, no matter how inept, is essential to any country in this day and age. In other words, if the government, by some miracle, gets it's corrupt head out of its corrupt *ss, and manages to diversify, oil will become less relevant.

Ok?

Politics › House Subsidy Probe: FG Won't Prosecute Or Charge Those Indicted - Adoke by nduchucks(op): 4:18am On Jul 05, 2012
I knew they'd keep this important news away from major Nigerian news outlets.

The Goodluck Ebele Jonathan administration will not “prosecute or take legal action against person or persons indicted by the report” of the House of Representatives Committee that investigated government’s fraud-marred subsidy scheme where over N400 billion was stolen by thieves posing as fuel contractors.

The federal government’s position was contained in a counter affidavit deposed on behalf of the Attorney General of the Federation (AGF), Mohammed Bello Adoke (SAN) by Mr. Ayotunde Ogunleye, a counsel in the Chambers of Chief Adegboyega Awomolo (SAN), who alongside Mr. Damien Dodo (SAN) are representing the AGF and the federal government of Nigeria in a suit instituted by Integrated Oil and Gas Limited against government seeking to stop it from implementing the recommendations contained in the report of the Farouk Lawan led House of Representatives Ad Hoc Committee on fuel subsidy.

“The report of the committee which is a fact finding committee will be studied and given to relevant agencies of government but it will not prosecute or take legal action against the person or persons indicted by the report,” shocked the AGF wrote in its counter affidavit.

Recall that President Jonathan had in a statement on July 01, 2012, described as false comments and insinuations coming particularly from the opposition and many Nigerians both home and in diaspora that his administration has been soft in its fight against corruption.

Addressing fears that the House report would be swept under the carpet, President Jonathan in the statement by his spokesman, Dr. Reuben Abati reaffirmed that, “there will be no sacred cows in the matter and that any organisation or individual found guilty of fraud or corruption will ultimately face the full weight of sanctions prescribed by the extant laws of the country.”

Who do we now believe? The President or the chief custodian of the law?

The committee in its report had indicted Integrated Oil and Gas and asked it to refund N13.2 billion naira to the federal government.

Several other companies were indicted by the report though its suspended chairman, Honourable Farouk Lawan is presently battling allegations of bribery.

However Justice Gladys Olotu of the Federal High Court today restrained the federal government from implementing the recommendations of the House report pending the determination of the suit.

The court order was based on a deal reached by all the parties that no action would be taken against the firm until the court delivers its judgement.

Mr. Tayo Oyetibo (SAN) represented Integrated Oil and Gas Limited.

Politics › Re: GEJ To Sue House Of Reps Over Summon by nduchucks: 12:56am On Jul 05, 2012
bayooooooo: The question we are trying to answer is not whether the House has powers to summon or not. NASS has powers to summon as it affects business of governance. The question is, can the president be summoned? If summoned and he refused, can such summons be enforced? And finally, do that provisions of the constitution really affect the office of Mr President?

1.It's obvious and self explanatory that a summon issued to the President, Commander in Chief of Armed Forces can not be enforced. How are they going to compel him to appear before the committee either of the whole or designated ad hoc one? Means of enforcement does not exist. A threat that can not be carried out is called empty threat, null, void and of no use.

2.There is nothing in section 88 that either invalidates or confers additional powers on section 89 with respect to summons. If anything, section 88 actually restricted or limited powers of the NASS as it is obvious you can not be summoned on your private business. It does not strengthen section 89 to the extent of applying it to the office of President.

You rightly believe that the Supreme Court will likely rule in favor of Mr President, there are several reasons that can be advanced, not just a simple one as postulated in my post above. In coming days, if time permits, I can open a thread on a strictly legal perspective on why the pendulum of justice will swing victory to the President side in this case.
In the exercise of its oversight functions the House of Representatives or the Senate is empowered by sections 88 and 89 of the Constitution to summon “any person, authority, ministry or government department charged with the authority for executing laws and …disbursing or administering money appropriated or to be appropriated by the National Assembly”.

I agree with Delafruita that the word “any person” or “authority” includes the President. You stated that since no means of enforcement exists, such a summon amounts to an empty threat, null, void and of no use. I completely disagree with this postulation. The President stands the risk of impeachment if summons are ignored depending on the gavity of the "crime" being investigated.

No doubt, the President is vested with enormous powers by the Constitution. But he is not an absolute ruler. Do not forget that President Obasanjo appeared twice to answer the summons issued on him by the Oputa Panel on human rights violations. That the President cannot be summoned is not an issue, but a moot point, in my mind.

As I stated earlier, GEJ can argue that this particular summon is invalid because of section 88 and he may win this particular case.

bayooooooo: The above quote is where the NASS derives the power to summon "any person", let's look at "any person":

What happens if "any person" in this above quote for House of Representative is the Senate President or vice versa? Can Tambuwal(House of Reps) order David Mark to appear before him? Is it enforceable? That "any person" even when interpreted loosely is still not applicable to everyone in Nigeria. The supreme court will have to interpret if that "any person" can be applied to the office of president.

It's my opinion that GEJ is not duty bound to appear and can not be compelled to appear before NASS. NASS also does not have the means of enforcing such a resolution. Can they also order CJN to appear? Shunning such an invitation more so when it does not have any precedent can not amount to impeachable offence. SO on technicality of law, GEJ is not duty bound to appear.

I made the above contribution in a similar thread. The only addition I have now is to appreciate the fact that GEJ is taking the right step. Civil litigation in a democracy especially in a renascent one as ours can only help give true meaning to the boundary or limits of powers of each arm of government. There is a reason why we have Supreme Court and is in part to adjudicate on matters of this nature. Let supreme court decides if any person, in this case, is truly the same as everyone.
There is a strong probability that the courts will rule in favour of The President but not because of the reasons you stated above. We can always find impractical exceptions to this "any person" you talked about above. We can carry the definition of "any person" to ridiculous levels which I do not care to do here.

It suffices to say that even the constitution clearly defines the conditions under which "any person" can be summoned. This summon would be valid if it is for the purposes of any investigation under section 88. If so, I submit that even the President can be summoned.

section 88

(2) The powers conferred on the National Assembly under the provisions of this section are exercisable only for the purpose of enabling it to -

(a) make laws with respect to any matter within its legislative competence and correct any defects in existing laws; and

(b) expose corruption, inefficiency or waste in the execution or administration of laws within its legislative competence and in the disbursement or administration of funds appropriated by it.
I admit however, that it would be quite easy to show any court that the summons issued to the President would not be exercisable based on section 88 above.
Politics › Re: GEJ To Sue House Of Reps Over Summon by nduchucks: 8:06pm On Jul 04, 2012
When a country is at war with "terrorists", as is the case in Nigeria, one would expect the President to bring in all parties, including respected leaders from the affected region, NASS subcommittee on National Security and Foreign Affairs, and others to discuss how to solve the resulting security issues. It seems obvious that GEJ and his team did not keep NASS in the loop while the security situation continues to deteriorate, prompting the summons.

This shows that our President is surrounded by incompetent and ill-advised operatives. This is a time when the executive and legislative branch should be cooperating and be working together towards finding a solution. Valuable time will now be wasted on a foolist lawsuit which can be avoided altogether. SMH

valacious: i find flaws in your theory sir. Why should otedola suddenly turn around and re-label his offering to bribe farouk as a sting operation? Why would he go that path. I agree with your theory that otedola reached out to bribe lawan, but i disagree that it hasnt been a set-up from the onset. I say, it's been a sting operation from the very onset with just d sole aim of discrediting the subsidy report. I forsee the story ending this way- many drama and inricacies are introduced, and both parties are let go, and d subsidy report thrown to d trash bin-the exact motive from d word go!
There may be flaws in my theory - remember its only a theory. This was not a sting operation orchestrated by SSS from the onset to catch a criminal in the act. If it had been such a sting operation with the aim of arresting criminals, the people who collected the money should have been arrested on the spot with the evidence protected and intact.

This is probably nothing but a failed conspiracy by Otedola and some paid SSS oficials to discredit the report as you stated. Otedola has no credibility left. Both Otedola, his SSS accomplices, and Farouk need to be visited by the usual suspects and made to pay. lipsrsealed

9 questions Farouk Lawan has for Otedola

•Why is this audio recording being played in bits and pieces, rather than enbloc and wholly?

•How come that an audio recording which ought to be played on Radio for a listening public is being aired on television for a viewing public, when no visual is involved how so ever?

•Where is the visual recording of the alleged bribe?

•How come a supposed part of the same conversation portray Lawan as a talkative, belligerent and unyielding character who barely allowed Mr Otedola to utter one word, while the first part supposedly shows him as a sluggish, tentative, stammering, and measured speaker, speaking only when prompted on by the same Otedola?

•If Lawan says it was left for the Committee to know what to do to help out, why will Otedola pay bribe to influence an issue Lawan had already concluded that his committee would know what to do about?

•If Lawan did actually warn Otedola not to tell other Oil Marketers so that the impression is not given that his Committee has been compromised as the audio tend to show, does this not in fact show, assuming the story were correct, that Lawan was actually saying to Otedola, “you know we have not been compromised”?

•Why has it taken Mr Otedola this long to make public his so, called “sting operation” well over two months after Lawan had notified the Police when he interacted with them in May, 2012?

•How come that neither Mr Lawan nor Mr Emenalo was arrested or swooped upon in a so called “sting operation” where money allegedly changed hands on four different occasions?

•What is the source of this audio tape that is being played installmentally and which ought ordinarily to emanate from Security Agencies, if indeed it was a “sting operation” by the SSS?

•Who is fooling whom?

bayooooooo: Lawan will not be sentenced on the pages of Newspaper. All the pieces of evidence available at the public domain so far can not be used to even convict a world renown devil. They are too weak to even warrant prosecution as a mere no case submission will get those charges dropped.

The purported audio can even be discredited on sole account of incompleteness. If it's incomplete, then it must have been edited and if edited, it's not far fetched to emboss the notorious word "doctored" on the brea$t plate of the evidence and get it inadmissible in the court of law. Leaking this type of evidence does a great disservice to the case. It's even worse if the leakage is not emanating from the Police which as investigators are the rightful custodians of evidence.

I am of the opinion that the whole hullabaloo is to discredit the subsidy report and renders it infertile, worthless and non implementable. The powers that be are not interested in unearthing the truth not to even talk of meting out deserved punishment else the house would not call Otedola for a patently laughable in door session and the SSS that purportedly led the sting operation allowed the evidence to be discredited even before prosecution.

PDP is a party of kleptomaniacal thieves, wicked killers, recidivist liars, unpardonable villains and it will stop at nothing to see the destruction of Nigeria. The earlier we voted the thieves in power out the better for this country.

My Theory:

(1)Odetola reached out to Farouk and offered to bribe him.
(2)Farouk collected the $620,000 bribe
(3)After collecting the bribe, Farouk implemented his portion of the "quo" in the "quid pro quo" by removing names of Odetola's companies from the subsidy report.
(4)Odetola tried to pull a fast one on Farouk by possibly bribing SSS officials into supporting his claim that the whole thing was a sting operation and make Farouk the sole criminal.
(5)Odetola was naive enough to think he can buy anyone including SSS member's who are more loyal to their political interests than Odetola or his money.
(6)The bribed SSS members refused to back Odetola up, and in desperation, Odetola started releasing purportedly doctored audio tapes which are inadmissible in a court of law.

Unfortunately, what we have so far, is nothing but hearsay. A second year law student should be able to successfully defend Farouk and I predict that Farouk will not serve a single day in jail. There is however, stonger evidence against Odetota and if he is not convicted for bribery, he should be convicted for claiming that this was a SSS sting operation. This saga is not good for the SSS as an institution and I predict that SSS will distance itself from Odetola's claims, publicly, soon enough.

Ho I wish GEJ's advisers can see that the President's association with Odetola does not serve GEJ and the country well, and advise that Odetola is removed from GEJ's team of economic advisers. Odetola has lost all credibility he has left. It may be time for Odetola to start planning his exile. As for Farouk, stoning awaits him in Kano. Barawo.

These people are taking Nigerians as fools. It is obvious that Odetola is releasing portions of the audio recording which favour his position. We must not rush to judgement until we've seen the complete unedited video and heard the complete audio recording. Even the complete video will be unreliable since Odetola seems to be its recorder and guardian.

No sane court of law would admit the video as evidence if the SSS cannot document its custody from the time it was recorded to the time it will be presented in court, if it ever gets presented. By leaking the audio tape, they have essentially exonerated Farouk. The evidence has been tainted and will be inadmissible. This is equivalent to a crime lab mishandling blood stains and then presenting lad reports after glaring evidence of screwed up custody of the said sample. Such action would typically render the said lab report rightfully inadmissible.

GEJ needs to dissociate himself from Odetola until Odetola clears him name. Odetola does not belong in GEJ's economic team at this point in time.

The same Russians have been developing Ajaokuta since the early 70s and we all know that the project has become a boondoggle.

Locate the plant in the North and it becomes the greatest gift to BH terrorists, locate it in the SE and haters may use it to finally put a nail in the Biafran coffin, locate it in the SS and a crazy MEND terrorists can put it to very "good" use. An accident in such a plant located in the SW could wipe out thousands of good people of the SW.

GEJ might as well go ahead and drop bombs in "choice" locations across Nigeria so that we can go to reconstruction mode now, instead of postponing such to a few years after the first accident in a nuclear built 5 years from now. SMH

@Jakumo, bayoooooo, and others are very much on point.

Beaf: That is false. El Rufai's sentence was totally unambiguous in whipping Pat Utomi, Reno Omokri, Naijapundit and Nairaland as PDP tools and agents.
professional bigots and pretenders like Pat Utomi, Reno Omokri, and their tools like Naijapundit and Nairaland falsely attribute to me

-El Rufai
Read your statement above, and read your El Rufai post above, while paying attention to the texts in red, and you'll quickly discover the futility of your stance. You fool only the gullible ones.

In case you are stoopid, which I doubt, all El Rufai stated was the obvious i.e. professional bigots and pretenders (I'll add other folks including you and several other forumites), use NL as a tool to further their various interests. Shi kena. Again you and others are included in my "other" category, just in case you attempt to accuse me of calling you a professional bigot,

Carry on with your campaign.

FACE: Considering that Lagos is a very small state in area; where then is "Fashola working" this "work" that we keep hearing if people are saying that roads in all LGAs are bad ?
I wonder o. Sadly, the costs to the state, of 3 of these flooding episodes, are enough to get 50-60% of Lagos roads in a good shape.
Politics › Re: Breaking Down The Constitution . . . .a Section At A Time! by nduchucks: 12:48pm On Jul 01, 2012
bayooooooo: That's the portion that nullifies the whole constitution. As FRA Williams put it "A false document that tells lies about itself"
That portion nullifies nothing. Have you ever encountered an agreement or resolution which did not have parties who opposed its contents as originally crafted? Stop misquoting Rotimi Williams. I suspected that you are a closet separatist and secessionist who shares the same goal as _Negro. You people will be smoked out, one unpatriotic separatist at time.
