Simply made a point (that peeps actually make that claim) and even added proof. Whether he acknowledges the validity of my point or chooses to attack the claim itself, is quite inconsequential.

The burden of proof lies with he who makes the claim, and not with he who refutes or denies that claim.

Depending on the nature of an argument, 'he who makes the claim' could be defendant or plaintiff.

Lets say the plaintiff charges the defendant to court for murder. It is a claim not hinged on any previous claim. The burden of proof in this case lies with the plaintiff.

But in a case where a claim is challenged, the burden of proof lies on he who makes the claim who happens to be the defendant.
The Airhiavbere vs Oshiomhole case falls into this category.
