A Federal High Court in Lagos has stripped the Federal Road Safety Corps of its power to impose fine on traffic offenders. Justice James Tsoho, in a judgement delivered on September 26 declared that the FRSC, not being a court of law, could not on its own, impose fine on offending motorists as punishment for traffic offences. The judge held that Section 28(2) of the FRSC Act, 2007, which empowers the corps to fine motorists, was in conflict with Section 6 of the Constitution and, as such, it could not stand. He said, “Basically, an unconstitutional legislation is null and void. That is, therefore, the effect of Section 28 (2) of the FRSC Act, 2007, which has purportedly conferred power on the second defendant (FRSC) to impose fine, which is a judicial function. Such power is unconstitutional and unenforceable. “The FRSC is not constitutionally vested with judicial powers and cannot and should not under any guise purport to function as a court with competence to impose fine on alleged offenders. “Much as the FRSC seems to have passionate zeal for traffic law enforcement, it cannot be allowed to do so in breach of constitutional provisions. “It is necessary to add that even in respect of strict liability offences, a court of law should appropriately declare the guilt of an alleged offender and then impose fine. “FRSC’s function should not go beyond issuance of mere notices of offence.” A lawyer, Mr. Tope Alabi, had sued the FRSC, asking for N10m as damages for impounding his car and imposing a fine of N3,000 on him. Also joined as defendants in the suit marked FHC/L/CS/1234/13 were the National Assembly and the Attorney-General of the Federation, Mohammed Adoke (SAN). The lawyer had prayed the court to declare that only a court of competent jurisdiction could pronounce a person guilty under Section 10 (4) and 28 (2) of the FRSC (Establishment Act), 2007 and Regulation 143 of the Nigerian Roads Traffic Regulation, 2011. Justice Tsoho, in his judgement, said FRSC resorted to “legislative absurdity” when it imposed a fine of 3,000 on Alabi rather than the N2,000 statutorily prescribed. “The point must be made that it is a cardinal principle of natural justice that no person be condemned without being heard. There was uproar on Monday, at Koko in Warri North Local Government Area of Delta State, when soldiers deployed to keep surveillance in the community clashed with masquerades, arresting four in the process. Nigerian Tribune gathered that troubled began Sunday afternoon, when a masquerade accosted a soldier, who was in mufti. The soldier, in anger, was said to have responded with a fight. It was, however, gathered that the masquerades had notified relevant security agencies before embarking on their ritual mission in the community. Fisticuffs allegedly ensued, when youths accompanying the masquerades, having seen the sacrilege meted out on their ancestral rituals, descended on the soldier, leading to a serious showdown. The soldier, embarrassed, was said to have escaped to their base, mobilised his colleagues and returned to pick up four of the marauding masquerades at different points in the community. The arrested masquerades, it was gathered, were forcefully dragged into a waiting Toyota Hilux van to the military base. Nigerian Tribune further gathered that a female soldier was said to have engaged interrogating the masquerades, who by tradition, should speak to no one until it returns to its shrine. This sacrilege, it was gathered, infuriated the whole community, who mobilised themselves and stormed the military base, demanded the release of their ancestral representatives. An appeasement process initiated on Sunday night was said to have been disrupted by the soldiers. The imbroglio continued on Monday, when the soldiers allegedly barricaded the only access road to the town, preventing all forms of movements in the community, which is the headquarters of the local government. A leader of Koko community, who declined mentioning his name for fear of arrest, said the soldier in mufti only came into the community to look for trouble. According to him, troubled ensued when the soldier in mufti refused to give way, like any other person in the community, and he met face to face with the masquerade. He added that what the soldiers did was sacrilegious and the town needed be cleansed. Another resident said the “police know the culture here and abide by it every year or time these masquerades are brought out for display by the entire Koko community.” Meanwhile, the Olu of Warri, Atuwatse II was said to have sent emissaries to the embattled community to mediate on the issue. The Divisional Police Officer (DPO) of Koko police station, however, declined to comment on the issue while the state police public relations officer, Celestina Kalu, did not pick her calls as she was reported to have travelled out of the country. A SECRET panel raised by the Federal Government has reportedly cleared the President of the Christian Association of Nigeria (CAN), Ayo Oritsejafor, and Alhaji Mujahideen Asari-Dokubo of involvement in the $9.3 million arms’ deal. The panel said it was statutory and legitimate for the Office of the National Security Adviser (ONSA) to issue end-user certificate for arms transactions. But the identities of members of the panel, mostly drawn from security agencies, were kept secret last night. But a lawyer, Ibrahim Ahmed, faulted such a secret clearance by the government. A statement made in Abuja by PRNigeria claimed that the panel had submitted its report to the Presidency. PRNigeria is a media outfit close to security agencies, through which important information are released to the public. The statement said: “”A Special Team, comprising security agents, intelligence experts and officials of the Ministry of Foreign Affairs has investigated the $9.3m cash-for- arms deal and submitted its report to the Presidency. “The committee confirmed that the President of the Christian Association of Nigeria, Pastor Ayo Oritsejafor, had no connection with the transaction. “It was true that the CAN President’s jet was used, but we found out that it was without his knowledge. As at the time in question, the aircraft was on lease. And you may be aware that the lease trend is peculiar to private jet owners in the country. “It is the view of the committee that Oritsejafor cannot be held liable for any shuttle made by a lease firm. “As for the manifest of the plane, the committee also discovered that the Niger Delta activist, Mujaheedin Asari-Dokubo, was not among those on board the transaction aircraft. There was no mention of Dokubo in the manifest presented during the investigation.” The statement added: “The committee’s findings revealed that the Office of the National Security Adviser (ONSA) has the statutory and legitimate mandate to issue end-user certificate for such arms transactions. The imputations surrounding the role of the ONSA were unfounded, baseless and ill-motivated. “The decision of South Africa to return $15million to Nigeria lent credence to the legality of the transaction. Certainly, Nigeria had no case to answer”. Ahmed faulted such a secret clearance by the government. He said: “It is within the ambit of the law for the Federal Government to set up a panel to look into the allegations surrounding the ill-fated transactions. “However, the fact that the public was left in the dark as to the members constituting the panel as well as the details of the proceedings surely has a roller coaster-effect on the credibility of the outcome of the panel’s findings.” A private aircraft belonging to Oritsejafor last month conveyed some unnamed persons and cash to South Africa, ostensibly to purchase arms from the black market to help bolster Nigeria’s fight against terrorists in parts of Borno, Yobe and Adamawa states. This led to widespread speculations in the media and sentiments expressed by politicians on the issue. Civil servants, under the aegis of Association of Senior Civil Servants of Nigeria, have protested against the planned deregulation of wages by the National Assembly. The workers submitted that the action would complicate the security challenges in the country, describing the move as a declaration of war against civil servants. The group said it would join other affiliates of the Trade Union Congress of Nigeria and Nigeria Labour Congress to commence an indefinite strike over the planned exercise. “This time around, it is not going to be business as usual. We will mobilise millions of Nigerian workers, including other oppressed citizens as well as the international community to resist this negative action of members of the National Assembly in Nigeria because this country belongs to all of us. “It is important to note that Nigeria does not belong to political office holders alone but to all Nigerians including workers,” the ASCSN threatened. According to ASCSN, the decision of the National Assembly to remove wage and other labour issues from the exclusive list to the concurrent list will amount to impoverishment of Nigerian workers. A statement on Wednesday in Abuja by the National President of ASCSN, Mr. Bobboi Kaigama, and Secretary-General, Mr. Alade Lawal, called for “a total resistance of the move by the National Assembly to further impoverish Nigerian workers by outlawing the meagre national minimum wage through the backdoor.” The association said, “We urge the trade union movement, the civil society groups, religious leaders, royal fathers, and other well-meaning Nigerians to prevail on the National Assembly to reverse its decision to deregulate wages in the interest of peace in the country. “It is surprising that the National Assembly wants to complicate the security challenges in the country by inviting millions of Nigerian workers to take to the streets by its insensitive decision to deregulate wage. “The monthly take home pay of each member of the National Assembly is about N30m. Half of such girls arent brilliant in every meaningful sphere, so how can they recognise a potential "already made guy"? Talk politics...they go mute. Talk history...they become a newborn baby. But talk about shopping, clubbing, frivolities etc, then you become their REAL MAN. All they want and think about is money. Have we ever been appreciative of our heroes in every aspect of our existence. Amodu qualified us after the Almighty Bonfrere Joe absconded in Sierra Leone, we sacked him and put another coach, played 3matches at the World Cup and won none. Then same Amodu played 12 matches at the qualifiers, won ten drew one and lost one qualifying us again, we only sacked him and replaced him with laggerback who could not qualify Sweden, result was play 3, and won none. The best any foreign coach did was win Nation's cup and get to second round of World Cup this was equalled by Keshi, wetin dey worry us sef. Now that we have sacked Keshi,we would see what happens.
