The Supreme Court of Nigeria has ruled that Section 46 of the Economic and Financial Crimes Commission Act should be construed within the narrow confines of the United Nations Convention Against Corruption, the precursor to the establishment of the EFCC - to prevent illicit financial outflow from Nigeria. EFCC is not supposed to arrest anybody unless the allegation is about "illicit financial outflow from Nigeria". There was a thread (from 29 December 2021) which discussed the Supreme Court ruling, but this has been removed from Nairaland. I wonder why. |
This is a very dangerous bill. It should be rejected from start to finish. Any bill that gives absolute and unrestrained powers to a government agency, to demand private information without a court order, should be thrown out. |

Well, this is just a theory: In early 1998, it had been determined that for Nigeria to move on, two persons had to be put aside. Abacha died on 8 June 1998. There was a soft spot for Abiola. It would have been convenient for Abiola to be out of the way; that is, for him to drop any claims on becoming president. When Abdulsalami Abubakar became Head of State, he initially declared 7 days mourning; the next day, it was increased to 30 days. The extension to 30 days was to give time for Abiola to make a decision. The Commonwealth Secretary-General Emeka Anyaoku and the United Nations Secretary-General Kofi Annan both (probably at different times) paid a visit to Abiola. The purpose of each visit was to convince Abiola to drop his claims. On 6 July 1998, Abiola (still in detention) was asked about his stand on his claim to become president. He sought advice from his closest (political) associates. Abiola did not relinquish his claim. He died the next day (7 July 1998), which happened to be the last day of the 30-day mourning period.
