NARD didnt call a strike.NMA did! so in effect ,jonathan and his minister should be sued for wrongful termination.

TUC urges FG to settle rift with NMA

The Trade Union Congress has called on the Federal Government and the leadership of the Nigeria Medical Association to resolve the lingering industrial action embarked upon by doctors in the country.

President and Secretary General of the TUC, Messrs Bala Kaigama and Musa Lawal, in a statement in Abuja on Sunday, also urged the Federal Government to reverse the sacking of striking resident doctors.

The duo said that it was dangerous for the Federal Government to take the decision to sack the resident doctors, especially at a time the country was battling with the challenge of the deadly Ebola virus disease.

The TUC leaders, who called on the Federal Government to commence talks with the doctors, also advised the NMA to suspend the strike because of the Ebola threat in the country.

Kaigama and Lawal said that even enemies would unite for a solution when confronted with a common deadlier threat.

The statement reads in part, “In relation to this issue, we implore the Federal Government to reverse its decision of sacking the striking doctors and call them back to the negotiation table.

“The nation cannot afford any calamity such as the sack move might cause. While we understand the plight of the Government in having to simultaneously contain both the threat of Boko Haram to national security and the challenge of the Ebola disease, we consider it very precarious for it to insist on sacking the doctors at this time.

“On the other hand, we charge all the doctors to listen to the voice of reason and the cries of Nigerians and end (or at least suspend) the strike and return to work, if only to resolve the Ebola mystery on our hands. Even enemies strike a truce and unite when faced by a more dangerous mutual adversary.”

Health › Go To Court, Lawyers Tell Sacked Doctors by phantom(op): 3:09pm On Aug 18, 2014
The law firm of the late human rights activist, Mr. Bamidele Aturu, and a Senior Advocate of Nigeria, Mr. Sebastine Hon, on Monday urged the about 16,000 resident doctors sacked by the Federal Government to challenge their dismissal in court.

In separate statements, the deceased activist’s law firm and Hon, condemned the sacking, describing it as irresponsible, “unlawful and unconstitutional”.

Aturu, who died at 49 on July 9, was the lawyer who sued Lagos State Government when it sacked 788 striking doctors in May 2012.

The Lagos State Government had sacked the doctors for participating in a three-day warning strike between April 11 and 13, 2012.

A statement by the Deputy Head of Chambers, Bamidele Aturu & Co Chambers, Mrs. Chisa Anyanwu, said the doctors sacked by the Federal Government on Thursday should seek to reverse their dismissal in court.

“The sacked resident doctors can easily challenge the unsympathetic act of the Federal Government in the appropriate court and have the decision of the Federal Government reversed,” the statement read in part.

The firm added that it was ironical that the FG sacked the doctors at a time it declared National Public Health Emergency on the Ebola Virus Disease outbreak.

“It is ironical to think that the Federal Government could have declared a National Public Health Emergency on the Ebola Virus Disease outbreak on one hand, and then turn around to sack the Resident Doctors who are the Primary Health Givers on the other hand,” it said.

On his part, Hon asked the affected doctors to disregard the purported termination of their appointments and urged them to go to court if their salaries and other entitlements are withheld by government.

He gave the doctors 100 per cent victory assurance if they dared to challenge their dismissal in court.

He argued that the sacking of the doctors on the grounds of the ongoing strike embarked upon by the Nigerian Medical Association was illegal, as the right to go on strike was recognised in Nigerian laws.

He also corroborated his stance by citing a the case of Union Bank of Nigeria Ltd. vs. Edet (1993) 4 NWLR (Pt. 287) 288 in which he said the Court of Appeal had “held that embarking on a strike action is acceptable in law.”

He added that even though the Trade Disputes (Essential Services) Act, Cap. T9, Laws of the Federation of Nigeria, 2004, prohibits strike action by persons rendering essential services, including members of NMA, “this legislation has not imbued the President with any modicum of power to sack any person who has acted in breach of the Act”.

Hon said, “I make it bold, therefore, to submit that the pronouncement by the Presidency sacking those medical doctors is unconstitutional, null and void. And the law is well settled that any act or action that is null and void is deemed not to have existed at all; hence should be ignored.

“NMA members can, therefore, ignore such purported mass sack; and if their salaries and emoluments are withheld or if they are denied ingress into and egress out of their respective hospitals, they can enforce those rights in court with 100 per cent probability of success.”

According to him, the sacking was also in breach of provisions of section 40 of the Constitution, which guaranteed the right to assembly and associate freely.

He added that the Federal Government’s pronouncement also violated the provisions of the University Teaching Hospitals (Reconstitution of Boards, etc) Act, Cap. U15, Laws of the Federation of Nigeria, 2004, which regulate and protect the employment of the sacked doctors.

But he also appealed to the NMA “to accede to reasonable offers from the Government and end the strike action soonest, for humane reasons”.

Health › Ebola: Nano Silver Fails Health Requirements— Health Minister by phantom(op): 2:33pm On Aug 18, 2014
The Minister of Health, Prof. Onyebuchi Chukwu, on Monday said that the Federal government was withholding its approval for the Anti-Ebola drug Nano-Silver produced by a Nigerian scientist in the diaspora.

Chukwu made this known when he received the U.S Ambassador to Nigeria, Mr James Entwistle, in his office in Abuja.

He said that the Nano Silver drug, which was made available to the Emergency Operations Centre in Lagos on Aug. 14, did not meet basic research requirements.

“The experimental drug, Nano Silver did not meet the requirements of the National Health Research Ethics Code.

“Accordingly, the approval was withheld by the National Health Research Ethics Committee,” Chukwu said.

He said the ambassador’s visit was an opportunity to share ideas and information on Ebola virus.

“He is the spokesperson for the United States’ government here in Nigeria, and so he came to me as the Chief Public Health Officer of the country to exchange views with me,’’ he said.

The minister said Entwistle also visited to know if there was any new development that recently cropped up on the Ebola virus.

Entwistle had commended the efforts of the Federal Government in curbing the spread of the Ebola virus in the country.

He said the aim of the visit was to discuss further on the anti-Ebola cooperation between the U.S government and the Nigerian government.

The ambassador also praised the work done at the emergency operation centre and the isolation centre, saying he understood that they were working hard.

“You have all seen the headlines over the weekend, this is an issue that we have to keep working hard on, it may be with us for a while but there are some encouraging signs.

“Your government is doing a good job on contact tracing; I noticed when I flew back here on Thursday night into the country, before I left the plane I filed in the questionnaire.

“I was very impressed because I had to put in my seat number which is a very good idea, so that if you have to trace the guy who was seating next to me you will know where I am.

“I have been very impressed by this thing so I encourage the government of Nigeria to keep at it, which I know they will,’’ he said.

Entwistle said the two countries had a broad partnership to keep collaborating, cooperating and working hard to make the world a better place.

He said he could not think of a more important example of cooperation than the Ebola cooperation.

On the U.S experimental drug on Ebola, Entwistle said there were no sufficient quantity for now to be given to Nigeria, therefore, the focus should be on isolation, screening and prevention.

FMC Owerri, I can assure u wld b the last centre to 'fall hand' on aluta matters. Solidarity was born there. Despite the fact that its residents have not be officially 'sacked' (since they r the only ones yet to receive july salary - which by the way, the disoriented FMOH says is the 1month pay in lieu of notice of sack) they, via the state NMA have also decreed that any '(un)professional locum MO' who as much as attempts to take up that demonic locum appointment would never have his licence renewed thru' the state NMA portal. And u can trust fmc owerri residents to enforce that. Health › Govt To Restart Residency Training After Overhaul-chukwu by phantom(op): 10:05am On Aug 18, 2014
-Suspension will worsen health indices, says Commonwealth Medical Association

-Lagos NMA insists on reinstatement of sacked doctors

- Centre condemns sack, Dabiri-Erewa calls for dialogue

IN reaction to criticisms against the suspension of residency training programme in federal hospitals and the purported sack of 16,000 resident doctors, the Federal Government has disclosed plans to restart the programme after an overhaul of the system.

Minister of Health, Prof. Onyebuchi Chukwu, said the closure was in response to complaints on how the programme is being run, with the motive of improving how doctors are trained during residency.

But Vice President, Commonwealth Medical Association (CMA) and immediate Past President, Nigeria Medical Association (NMA), Dr. Osahon Enabulele, yesterday said the decision of the President Goodluck Ebele Jonathan-led Federal Government to suspend Residency Training Programme (RTP) in Nigeria and sack of over 16, 000 resident doctors and would be specialist medical doctors and dentists is a most unstatesmanly, unsustainable and ill-advised approach towards the resolution of the challenges in the health sector.

Enabulele in a statement said it is undoubtedly an unproductive decision capable of further worsening the crisis and the challenges in the health sector.

He said this latest action of the Federal Government clearly indicates that most of our political office holders hardly learn lessons from history, or else why would a government in this 21st century apply a most draconian option that never succeeded even under the military regime of Gen. Muhammadu Buhari in 1985 or the infamous authoritarian dismissal of 774 doctors by the Babatunde Raji Fashola-led Lagos State government in 2012.

However, the NMA has told its members in Lagos State not to “connive” with state government, urging them to reject sack letters, applying or taking up any locum appointment in respect of the Federal Government’s sack of residency programme.

The NMA, Lagos branch, has also advised the Lagos State government to “toe the part of true democracy as it preaches” and henceforth stop the employment of doctors as casual workers, adding that all doctors currently on such engagement should be converted to regular employment status.

According to Chukwu: “Practically, the programme has been suspended in the last two months because no one is training. We are just taking a look at the situation and after that, we will restart the engine.

“As of today, no doctor has been stopped from working. And don’t forget that residency programme has only been stopped in federal institutions. They are still on in state-owned teaching hospitals. If any doctor even wants to volunteer in addressing Ebola disease, such person is welcome and will be appreciated greatly.”

Apparently unconvinced by government’s explanation, the Lagos NMA reiterated that the doctors remain resolute in their strike demands and would not be deterred by the mass sack, adding that all negotiations between the NMA and Federal Government are suspended until the sacked doctors are reinstated.

Chairman of the Lagos NMA, Dr. Tope Ojo, told The Guardian yesterday that the sack action by the Federal Government of President Goodluck Jonathan was act of tyranny.

Ojo said: “In the last six years, there has been consistent pressure from some allied health workers’ union for government to stop the training of specialists in Nigeria, but it is most unfortunate that the Federal Government got entangled in this unholy conspiracy against the Nigerian people by heeding this retrogressive call.”

In another development, as the Justice Research Centre (JRC) yesterday condemned the sack of 16,000 resident doctors by the Federal Government, Chairman, House of Representatives Committee on Nigerians in Diaspora, Abike Dabiri-Erewa, has called on President Goodluck Jonathan to rescind the decision of suspending the resident doctors in the country.

While appealing to the entire NMA to be reasonable in their demands and opt for dialogue to make peace in the interest of the nation, she described the sack as “highly questionable” considering the present outbreak of the Ebola virus plaguing our nation.

Dabiri-Erewa told The Guardian yesterday that although it is understandable that the Federal Government may have disagreements with the striking doctors but opting to sack all resident doctors given the present predicament is “unjustifiable, insensitive and inconsiderate.”

A statement by the Director of the Centre, Donald Inwalomhe in Benin City yesterday, said the move was “unwise, illegal, unconstitutional, and can only best be described as a travesty of justice. It is reminiscence of the draconian and dark days of military juntas when the Abacha military dictatorship sacked striking lecturers; an action, which no other government, be it military or civilian, had resorted to until now.

Besides, Secretary of the Lagos NMA, Dr. Babajide Saheed, reiterated the position of the national body, saying that the current industrial action continues. He said that the only condition to resume talks with the government is for it to reverse the sack of 16,000 resident doctors nationwide unconditionally and with immediate effect.

Enabulele said he is most appalled by the use of an extreme, unwarranted and retrogressive measure by the present Federal Government, saying: “With this action of government, there is bound to be worsening of the braindrain phenomenon with increased migration of doctors and specialist medical/dental practitioners abroad. This will certainly worsen the health human resource crisis in Nigeria. Surely, it will deprive Nigeria of the required skilled medical/dental manpower needed to handle the increasingly complex medical/dental conditions of the 21st century.”

He said there is still room for constructive dialogue and amicable resolution of the current dispute between the Federal Government and Nigerian doctors.

Kcinho: How many of the other medical bodies have a post graduate school? The students in school of nursing (not bsc) in UNTH get #10000 monthly and no medical school in Nigeria pays undergraduate medical students.
you beat me to it.

how many of our pharmacists are interested in their west African college? they prefer to open a pharmacy when they leave school or rent their licenses out.

undergraduate nurses are paid monthly. i bet. Nigerians don't know that.

ozodigboo: Nigeria health system is finished.
Because even if the doctor goes back to work, after witnessing all these bashings. . . . .
They will now operate and carry out their work, in a cold calculating way without feelings and emotions - possibly with a tinge of bitterness.
This is not going to look good.
its sad honestly. nigerians say we have lost their sympathy BUT they have equally lost ours.

if by now they havent realised that it is a SECURITY RISK being attended to by a terribly depressed and unhappy doctor, then i dont know what else to say.

for me,i cant imagine myself under a doctor who while operating on me,cuts one of my ureters because hes thinking of his daughters school fees.. grin grin

ozodigboo: Some pple don't understand d issues.
Sacking resident docs, is like sacking every doctor.
All doctors are bound by the Hippocratic oath_ nobody will dare apply for any new job opening.
Fashola was used . . . he employed locum docs..... what happened later ?
He recalled d sacked docs, but the new locum docs, refused to be disengaged. . . . meaning more docs on state employment.
If Fashola dared sack d locum guys, when next there will be strike & u call for locum, nobody will listen to u. . . they will say u wanna use and dump.
GEJ has started what he can't finish.
Consultants and medical officers will NOT start work, and they can't be sacked by fiat becos they are PERMANENT CIVIL SERVICE STAFF.

And. . . . what are we even saying ?
Assuming some young, inexperienced docs go n apply, no matter how few. . . do u want to entrust ur LIFE onto them ?
And assuming d experienced docs, resident docs etc are frustrated to return to work against their will..........will u entrust ur LIFE on a group of embittered docs who are so angry with d nigerian populace who didn't back them ?

plz go back and read my opening sentence again.
nigerians dont even know who reisdent doctors are..

your pregnant wife goes into a very difficult labour and needs a C/S by 3am,you drive to the TH or FMC,you meet a resident doctor

you go to OBGYN....those doctors that run your antenatals and clinics are resident doctors
you go to paediatrics....those doctors you see at the clinics, wards are resident doctors
your baby is in special care baby unit, that person that gives your baby drugs by 2am while you are still sleeping is a resident
you need surgery, that doctor that assists the main surgeon is a resident
you go to radiology department, that doctor you see scanning, reading your xrays/CTs or perfoming an HSG,MCUG is a resident
you go to ophthalmology department, the doctors who check your eyes are residents.

if the hospitals are vehicles, residents are the engine!
