A case was raised by the Oyo PDP and has been dismissed as incompetent by the tribunal as there are already decided cases by superior courts on this issue as far back as 2004. The Constitution only barred citizens by registration/naturalization from holding any other citizenship except that of their country of birth.A natural-born Nigerian citizen can hold as many citizenship as he likes and still be eligible to contest whatever political post he desires. You only need to have one Nigerian parent or be born in Nigeria and have one Nigerian grandparent to qualify as a citizen by birth.Read section 25(1a,b,c).Also read sections 28 & 29 on qualification for political post and citizenship renounciation by naturalized/registered citizens. |

ocelot2006: The Sahara Reporter post is a BLOODY LIE and BS. First of all, the Special Forces is NOT part of the US Marine Corps. Rather the SF (or Green Berets/Operational Detachment Alpha-ODA) is an army unit. Second, the SF is based in Fort Bragg, not Carson or whatever. But if any unit of the ODA is going to be used, they'll deploy from Germany. Finally, being an idea counter-insurgency (COIN) unit, the US may offer the services of the SF/green berets to the FG as they've done in the past, but they will never be directly employed to engage BH directly. Rather, they'll offer training and serve as advisors.

IVY-Nerd: Much ado about nothing, the case of dual citizenship and right to run for an office is a forgone conclusion in Nigeria, yet we're beating a dead horse. The appellate court has ruled on this matter, setting a legal precedent that is unlikely to be changed by the Supreme Court except if there is ambiguity in the interpretation. I know some of us are not lawyers, thus, I don't expect us to know the modus operandi of the court. However, we can at least do some research using google or lexisnexis to search for cases relating to the issue in contention. For the record, I don't see Akala or PDP pursuing the case against Ajimobi to the supreme court because it is a loosing proposition. I don't even see Supreme Court taking up the case since the Appeal Court's and Federal Court ruling in 2004 and 2007 was congruent.
For the record, the Court of Appeal decision in the case of "Ogbeide vs. Osula {2004} 12 NWLR PART 886" as pronounced by Justice Adamu, reading the lead judgment, states that:
“WHEREAS a person who is a citizen of Nigeria by birth cannot have such citizenship forfeited or become ineligible to contest such elections under any circumstances even where Section 65(1) is read with Section 137. A person who is not a citizen of Nigeria can be so registered, but where he is not a citizen of that other country by birth, his registration will be conditioned on the renunciation of his citizenship of that other country. In other words, renunciation of citizenship does not apply to a citizen of this country by birth.
What one can make of that section read with Sections 25, 26 and 27 of the Constitution is that a citizen of this country by birth never loses his citizenship even where he holds dual citizenship of another country and cannot be disqualified from contesting elections into the House of Representatives for reasons only that he holds such dual citizenship.”
As such, the Court’s pronouncement and reasoning is clear and logical and cannot be controverted. This Court of Appeal’s decision has been followed by a Federal High Court sitting in Abuja in the case of "Professor Odidi & Akeem Bello vs. INEC (Suit FHC/ABJ/CS/28/07)." T[b]he applicants, in this case, had challenged the validity of the Independent National Electoral Commission, INEC, to disqualify the first two applicants, who were respectively the presidential and vice presidential candidates of the New Democrats Party, from contesting the 2007 presidential elections on the basis that both of them held citizenship of Canada and America (respectively). They stood disqualified from contesting the country’s presidency by virtue of the provision of Section 137(1) (a), of the Constitution. The presiding judge, Justice A.I Chikere quoted with approval the dictum of His Lordship, Adeniji JCA, in the Ogbeide case {supra} that “A person who is a citizen of Nigeria by birth cannot have such citizenship forfeited or become ineligible to contest election under any circumstances even where section 65(1) in the present case is read together with Section 137 of the 1999 Constitution.”[/b]
The judge then directed INEC to register the two applicants to contest the 2007 election. Again, there is no where in the record that says INEC challenge the verdict in Appeal or Supreme Court because its lawyer know better. Hopefully Akala and PDP's lawyer will come to their senses soon. Except the aforementioned parties have too much money to spend on legal fees.
The jurisprudence in other countries and in international courts also follows this line of reasoning. The most recent decision on the matter seems to be the decision of European Court of Human Rights in the case of Tanase and Chirtoaca vs. Moldova, which the court delivered on the April 27, 2010. In that case, the applicants, both Moldovan nationals had challenged a 2008 amendment to the Moldovan Constitution which barred Moldovans who held dual nationality from contesting for parliamentary positions. The Grand Chamber of the Court held that the 2008 amendments were unlawful and disproportionate to any concern of loyalty the country may have. The court ruled that:
“…in a democracy, loyalty to a state did not necessarily mean loyalty to the actual government of that State or to a particular political party. There were other methods available to the Moldovan Government to ensure loyalty of MPs to the nation, such as requiring them to take an oath. Such measures had been adopted by other European countries.”
I don't intend to comment on this issue any longer because it is an effort in futility. I would rather stick with court's interpretation of Nigeria constitution as opposed to listening to "non-learned" opinions, which often the case is prevalent in our society. layifioren: Ofcourse I knew that but I still had to do it to show that I've done what I needed to do to "renounce" my Nigerian citizenship. Technically that's the process but you and I know there's no process when it comes to Naija. Atleast they sent me a letter back so they used 42 cents out of the 50 bucks  Renouncing Nigerian citizenship is a near-impossible thing to do.I believe it was deliberately made so by the framers of the constitution to frustrate would-be seccesionists. Just continue doing what u are doing now,i don't think there's a downside to your attempt to renounce. Where u are through there,your Nigerian citizenship awaits u this side of the pond. |

@manny4life There no other qualification except the age,educational &political affiliation qualifications.Of course,u are also required not to have been convicted within 10yrs prior to the period u wish to contest a political position nor be an undischarged bankrupt. Another serious factor to consider is the indegeneship thing.If u have all these covered,then u are good to go. |

layifioren: I didn't even see that part until I was reading pokur's response. Alright to enlighten you this was what I did. I called the Nigeria Embassy here in the US and after several trials I got the chance to talk to a rude lady on a phone line that wasn't even clear (went on a tangent just to show you how useless they are). She then told me what I need to do is mail my passport with $50 and a letter renouncing my Nigerian citizenship. I did that and boom I got a confirmation letter back from them. Are you satisfied or do you have more questions amigo? @layifioren Did u get mailed a letter by the President,FRN accepting your renounciation and a copy of the official Gazzette wherein it was published?.If u didn't get any of those,then i have to inform u that u are still a Nigerian citizen a lá section 29(2) CFRN The president have to accept your renounciation in writing and have it published in the official Gazzette before it becomes fact/legal,he is even mandated to reject outright any renounciation of citizenship if Nigeria were engaged in any conflict or natural disaster. Then again,the combined effects of section 28 & 29(1) makes it clear that renounciation is only applicable to naturalized citizens or citizens by registration.If u don't belong to either category,dude u are still a Nigerian. |

ndu_chucks: Lete just wait for the supreme court to rule on the issue, hopefully, through Akala's case. It seems to me as if if you go in front of a judge and declare under oath, and in the presence of a judge, that you renounce and abjure all allegiance and fidelity to Nigeria, you don't deserve to hold any elective office in Nigeria ( but its only an opinion).

Is there any way you can prove that you renounced your Nigerian citizenship as stated above? @ndu_chuks The process for renounciation of Nigerian citizenship is clearly stated in section 29 CFRN,and as enunciated by Justice Adeniji in his ruling,it only applies to naturalized citizens or citizens by registration.A natural born Nigerian citizen can never lose nor forfeit his citizenship of Nigeria by just simply swearing allegiance to another state or potentate. As an aside,citizenship by birth is also extended to all those born in Nigeria who have only one grandparent who is a Nigerian.That is contained in the grandparent clause of section 25(1b). So,Akala or the PDP in Oyo are wasting their time and resources trying to unseat Ajimobi on such grounds. @manny4life A Nigerian citizen by birth,either through the parent or grandparent clause(section 25/1a-c),can contest for any elective position in the country provided he or she have met the other qualifications required for such posts. |

The man suspected to be behind last Christmas Eve bombings in Jos, the Plateau State capital, has been arrested by operatives of the Department of State Security Service (SSS), Sunday Vanguard can reveal.
He was arrested in Jos on Wednesday.
Coincidentally, Wednesday, September 7, 2011, marked the tenth year anniversary of the commencement of hostilities in Jos, a development that has become the negative hallmark of the once peaceful town.
The hostilities have claimed hundreds of lives, the latest being the two attacks allegedly carried out by Fulani herdsmen on two Christian communities in the state last Sunday and Thursday respectively which left more than 20 dead.
The suspected bomber’s arrest, it was learnt, came following what competent security sources in the Federal Capital Territory, FCT, Abuja, and Jos, described as “some very useful information”.
According to the security sources, “whereas the intelligence community had been getting signals about the whereabouts of the mastermind of the Christmas Eve bombings in Jos, he kept eluding the operatives.
“Fortunately, a big break came last Tuesday after the arrest of some Boko Haram suspects in Suleija. The arrested suspects provided useful information which led to the arrest of the alleged mastermind of the Christmas Eve bombings in Jos”.
Attempts to get the name of the suspect proved abortive as the sources maintained that investigations were still on-going.
Sunday Vanguard was nonetheless told that “the suspect is already providing useful information that would assist in the investigations of some other dastardly acts”.
Once the investigations are completed, the security sources stated, “the bombing mastermind would be arraigned along with his collaborators in the aw court”.
Seven explosives 32 people were confirmed dead and 74 hospitalized in the blasts which rocked two parts of Jos, last Christmas Eve. Giving details of the bombings, Plateau State commissioner of police, Mr. Abdulrahman Akano, said a total of seven explosives were planted in the two parts of the state capital.
According to him, five of the explosives went off at the Kabong area while two were detonated at the Angwan Rukuba area. One of the bombs was planted in a busy market at Kabong where people were making last-minute purchases for Christmas while another was planted at a relaxation spot in Angwan Rukuba.
He said dynamites and about 100 match boxes were recovered from one of the places combed by men of the bomb unit of the police and were being analyzed.
Akano described the incident as more political than religious or ethnic, saying, “Honestly, my own estimation of this is that it is political. Explosives have been introduced for the first time. When you understand that the problem on the Plateau is more political than religious, when the dust settles, people will know that this is not religious.”

You people are still missing the forest for the trees. The SSS got the intelligence on the 18th,arrested the suspects on the 21st,yet the bombing was still carried out on the 26th costing 23 precious lives. The question we should be asking the administration is this: -Why were no advisories issued to residents or people working in high risk areas/targets?. -Why was security not beefed up around these intended targets?. -What measures were put in place to ensure the bombing did not occur at all?. -The President receives security/intelligence briefing from the office of the NSA every morn,what did he know about this actionable intelligence and when did he know it?. If nobody in the GEJ administration could provide reasonable answers to these posers,then it might be right to conclude that there is more to these bombings than we are being led to believe.It might not be Boko Haram's handiwork afterall. |

Jonathan contested on the platform of the Peoples Democratic Party (PDP) while Major Gen Muhammadu Buhari (RTD) was the candidate of the CPC.
The CPC which is asking the tribunal to cancel the results of the election in 20 states want the tribunal to hold that Jonathan and his running mate, Namadi Sambo were not duly elected by majority of lawful votes.
The opposition party is alleging substantial non-compliance with the Electoral Act and irregularities in Lagos, Bayelsa, Kaduna, Sokoto, Nasarawa, Kwara, Adamawa, Abia, Akwa-Ibom, Enugu and Cross River.
Others are Rivers, Ebonyi, Bayelsa, Delta, Imo Anambra, Benue, Plateau states and the FCT.
In a motion on notice filed yesterday, the party accused the Independent National Electoral Commission (INEC) of colluding with Jonathan to frustrate its efforts at regaining the allegedly stolen mandate.
The party said all efforts made to assess the sensitive materials which the tribunal had ordered the commission to allow it access to met a brick wall.
The INEC, having violated the order of the tribunal, CPC wants the panel chaired by the President of the Court of Appeal, Justice Isa Ayo Salami to enter judgment in its favour.
The motion was brought pursuant to paragraphs 18(11) of the first schedule of the Electoral Act 2010 as amended, Section 149 (d) of the Evidence Act and under the inherent powers of the tribunal.
The petitioner is seeking the following reliefs:
•An order of this Honourable Court entering Judgment in favor of the Petitioner in Petition No. CA/A/EPT/PRES/1/2011 under Paragraph 18(11) of the 1st Schedule to the Electoral Act, 2010 as amended and Section 149 of the Evidence Act on the ground that the order for inspection granted by this Honourable Court on the 24th day of May, 2011 is refusal or failure or neglect of the Respondent s to comply with the terms contained in the said order,
• And for such further or other orders as this Honourable Tribunal may deem fit to make in the circumstances.
The application is predicated on the following grounds:
•That the Petitioner was one of the registered political parties that contested the Presidential Election held on the 16th day of April, 2011 and had in consequence thereof demanded for election materials from the 1st Respondent vide series of letters written to that effect before, during and at the conclusion of the election.
•That 1st (INEC) and 2nd (Prof. Attahiru Jega) Respondents denied the Petitioner’s request by failing to make copies of the requested election materials available to the Applicant and the Applicant was as a result forced to file an application dated the 15th May, 2011 for an order directing the 1st and 2nd Respondents to produce for the inspection of the Applicants and permitting it to take copies of the election material used in the conduct of the election. This prick is definitely insane. |

OP Are you obtuse or what?.Apapa-Oshodi expressway n the Lagos-Badagry expressway are two different roads built at two different times.Their only link is the Mile 2 flyover. By the way,the Lagos-Badagry expressway,though an international thoroughfare,was built by the Mobolaji Johnson administration,so its a Lagos road,not a federal road. |

Guys,i don't know where some of u get your facts,but Obi is not leaving next year.His tenure ends March 17 2014,get that straight. @topic A 260mw power plant is a good start for my state,but i would advise the state govt. to source for more investors as the proposed 260mw will not be enough for Onitsha alone when it comes onstream,talkless of the whole state. |

This is a case of attempted assasination,it's obvious that the Norwegian PM is the primary target of these attacks.First,bombs going off close to the PM's office,then a youth camp he was supposed to attend being attacked. The so-called islamic group claiming the attack is a ruse to cast suspiscion elsewhere. |
