I just got my Canadian student visa, and intend to attend my would be fiancée's graduation next year. I intend applying when I'm in Canada, I'll leave for Canada next month. May I know the procedure for this?
When you get to Canada ask the US embassy there for the procedure and apply from there like you plan.

I want to move to a country that will offer me a high quality of life, a stable employment (job), descent wage (compensation), relatively safe environment, a good work life balance(very important), friendly to immigrants and a good place where an IT guy(like my self) can work in with no hassle.

I was approved today at the US consulate. First time I've heard congratulations after many trials. It was the easiest interview ever and God made it so. Prayers, hard work, preparing with interview questions and frontloading cleared the way for me.

After waiting for almost 4hrs, my number was called up by the white lady at window 17. As I approached her, I was already beaming with smiles and she smiled back. Swore the oath and began my interview.

Who is calling you?
How did you meet?
What course was she studying?
Did you guys date in Uni?
How did and do you communicate?
I see you have been to Dubai and UK together?
What is her profession?
Where does she live?

Congratulations, I will be approving your visa. Then she brought out the white paper and told me to follow the instructions to pick up my passport. Any questions? I said No, thanked her and walked away smiling and thanking God in my heart.

It was like a conversation or call/response. Within 3mins we were done. She didn't ask to check pictures, chats/calls, employment letter in fact I didn't show anything for the interview only pre interview. I wasn't even asked about my previous denials (b1/b2 four in number since 2015). It was stress-free and it was God at work.

Advice: Pray for confidence and calmness. Know your fiancé/husband very well. A lot of people fumbled today and we're asked to come back, some others fumbled and were still given visas, just be over prepared. Don't listen to touts outside

As long as you don't have any immigration issues and you are telling the truth, they won't waste your time. Somebody was banned from entering the US today, so be careful.

Smile, relax and go through the questions on Visa journey if you can and ask questions as well. All the best to those awaiting their approval (speak in faith) . I'm more than elated ���

Not true. You do not need to know your fiancé for 2 years.

A short period of knowing each other MAY be a red flag but it is not a requirement to know each other for any specified number of years.

How I wish I had seen this earlier. You don't need to inform the US consulate to book your interview in Nigeria. Once you get your NVC number you book appointment.
So no need waiting for the consulate. That's a good one.

Meanwhile, how does one know the steps to take if the consulate does not send the instructions?

Was finally able to change my DS-160 number to reflect what's on my confirmation page.

Did it after sending a mail to ustraveldocs support email. They effected the change within seconds!

Thanks. Was able to schedule finally. However, I have a major challenge. I noticed the DS-160 form number on the scheduled interview page is the one I used for my B1/B2 Visa application. I looked for how to change the DS-160 form number to the current one I'm using for the K1 Visa. I even had to cancel my appointment and reschedule but still didn't succeed. Please what do I do?

I have been contacted by the embassy concerning my K1 Visa application and was told to make payments, fill My DS-160 form and then schedule my interview date.

I have done all except scheduling interview date. Every time I go the ustraveldoc site to schedule an interview, it tells me there is no available appointment date. What could be the problem? Should I still wait or did I do something wrong?
Congratulations on getting to this stage.

From what I read, I think they upload avaible times every month and the days are filled up in days.

So i suggest you keep checking everyday until you get an available date.

The singular reason I support going to the interview armed with your bank statement, proof of work, etc is because the VO didn't return my bank statements and my printed whatsapp communication in my stack of evidence. He returned every other document to me. I remember some of the questions went like "what do you do... where do you work..."

My assumption was that he needed my bank statements as some sort of back office justification for my approval, based on the questions he asked. Again, that's just an assumption, I may be wrong.

NB: My reference all the while has been to consular processing (the interview stage) and NOT the initial K1 application

I don't think it is. This is because it's not spelt out in Black and White. For instance, I could provide a few example to justify that meeting is difficult due to extreme hardship. I could say:
1. Medical Condition of Petitioner
2. Financial Condition of Petitioner
3. Medical Condition of Beneficiary
4. Financial Condition of Beneficiary
5. War Torn Area of Beneficiary
6. Difficulty in getting Visit Visa by Beneficiary
7. etc cheesy
All these stories won't cut it except for number 5.

The other reasons (1, 2, 3, 4) will mean that the petitioner may not be able to support the beneficiary so the beneficiary can become a public charge.

Number 4 is not an excuse at all. There are lots of visa free countries where they can meet.

He overstayed. Fell in "love" with another American. Got married. Brought her to Nigeria for a traditional wedding. They lived in Naija for a while, about 18 months. He re-applied via the spouse route and was approved.

He had to prove that his previous petitioner put him through "hardship" after their relationship didn't work and that was the reason for his overstaying that visa.

Dude was lucky!
Wow. That was some real luck. The overstay would have been used against him.

A K1 is still a non-immigrant visa even though technically it eventually leads to the beneficiary becoming an immigrant. However, this doesn't happen in all cases.Therefore, you need to satisfy all the requirements for a non-immigrant visa before you'll be issued one. I know a friend who went through the K1 process like I did and the petitioner eventually did not marry him when he got to the US. He ran out of Status when his marriage window lapsed. At that level, his stay became illegal.

The whole idea of being 'eligible" for a "visa" is to ensure you have enough motivation to return back to your home country when things go wrong. A job, property, etc., serve as some kind of proof that you'll return to your country if your fiancee doesn't marry you. That's why they typically ask you to provide "evidences that'll support your case"- they're not just limited to what they ask for.

To add to what you just said. Even though it's not explicitly stated that you submit evidence of ties to Nigeria, it's advisable you present such if you have any. It's not a crime to provide more evidence than required.

There are many cases of a beneficiary who is not working and has no financial records but was granted the K1 Visa. However there have been cases of refusal or administrative processing due to that. Imagine a scenario where the VO has little doubts of the petitioner being financially buoyant enough and also have little doubts about their true love for each other. Don't you think having strong ties to Nigeria will convince the VO that the beneficiary truly loves the petitioner and is willing to leave his country where he is doing well to be with his fiancee? Don't you also think that that strong tie is a form of assurance for the VO that the beneficiary would return back to Nigeria in case he breaks up with his fiancee before the 90days?

In summary, it's not a must the beneficiary must be working or must have a bank account for him to be granted a K1 Visa. It's not also a compulsory requirement to submit any documents proving such. But if one has a bank account with lots of transactions in it (even if the account is in the red) or is working, I advice he comes with evidence proving such. After all he submitted a DS-160 Non-immigration Form during his application for K1 Visa and in the form he provided info on his place of work and how much he earns on a monthly basis. It's not a crime if he goes with those documents as evidence to backup what he filled in on that non-immigrant form.

Beneficiaries can add whatever they think will boost their case and improve their chances. Information can not be too much with these people, they will simply ignore what they don't need.....

but i really don't think it is important to include the beneficiary's account statement unless it is specifically asked for.

Who May File Form I-129F?

You may file this petition if you are a U.S. citizen and:

1. You and your fiancé(e):

A. Are legally free to marry and intend to marry within 90 days of your fiancé(e)’s admission to the United States;
and

B. Have met each other in person within the two years immediately before you filed this petition, unless you establish
that either:

(1) The requirement to meet your fiancé(e) in person would violate strict and long-established customs of your
fiancé(e)’s foreign culture or social practice, and that any and all aspects of the traditional arrangements have
been or will be met in accordance with the custom or practice; or

(2) The requirement to meet your fiancé(e) in person would result in extreme hardship to you;


For a beneficiary from Nigeria..... Number (1) won't work.

So....what extreme hardship will prevent the US petitioner from meeting the beneficiary at least once in 2 years?

From reviews, the consulate hardly approves a visa if requirement B is not met.

Just know that the US Consulate in Lagos is unlikely to approve a K1 Visa if the condition of meeting in person in the past 2 years is not met.

The job of the USCIS is to approve petitions. Approving petition is not the same as granting visa. Many people with approved petitions have been denied visas.

The job of the consulate is to GRANT the visa. The Consulate in Lagos is unlikely to (and i am trying to avoid using WILL NOT) grant a visa if the couples have not met physically at least once in the past 2 years.

As a matter of fact, the more the physical meetings, the better the chances of being issued to K1 visa.

The end game is to get the K1 visa and not just to have the petition approved. An approved petition is actually worthless if the visa is not granted because the decision of the VO can't be appealed.

I assume this is to provide help specifically for Nigerians in Nigeria.

Any visa application from Nigeria is unlikely to be be granted if the condition of physical meeting is not met. So, best is to meet that requirement rather than hoping for a miracle that will not happen.

You're right. You technically still have to demonstrate you qualify for the K1 "non-immigrant visa" irrespective of your petitioner meeting the sponsorship requirement. Meeting the requirement to be a sponsor only goes as far as getting your petition approved. The onus is still on you to prove you meet the requirements for a K1 visa during your interview.
However, you don't need to pad up your account to prove anything. Having a good job with stable income should suffice.
You don't need a job to qualify for a K1 visa.

The US Consulate does not ask for the beneficiary's bank statement.

The list below is specific requirements by the US Consulate in Lagos:

'INSTRUCTIONS AND REQUIREMENTS FOR FIANCÉ (E) VISA APPLICANTS

Dear Applicant,
The U.S. Consulate General, Lagos is ready to proceed with your fiancé (e) visa application. After you have paid your fee and scheduled your appointment you will come for your interview. Please review the following information carefully as you prepare for your interview.

The following are required for the visa interview.

1. Form DS-160: Fill out the online DS-160 visa application.

2. Visa Fee:

3. Schedule the interview: You must schedule your visa interview appointment. You will need your payment receipt number to schedule the interview.

4. International Passport: Your passport must be valid for at least 6 months past your interview date.

5. Affidavit of Support (including tax returns): All applicants are required to have an Affidavit of Support (Form I-134 and an IRS Tax Return). It is required for ALL applicants to demonstrate that the immigrant is not likely to become a public charge while in the United States. If the petitioner makes LESS than the minimum for their Household size, they MUST get a joint sponsor to also submit an Affidavit of Support along with their most recent tax return.

6. Medical Exam: Arrange for a medical examination by one of the physicians listed. You are responsible for paying for the medical exam. The medical exam is only valid for six (6) months and must be valid in order for you to travel to the U.S. It is recommended that you get the medical exam 2 weeks before your interview date. A medical exam is required for all applicants, regardless of age.

7. Police Certificate: Applicants age 16 or older must submit a police certificate for ALL countries in which they have resided for more than one year after reaching age 16 (If you have ever lived or studied in another country for more than one year, you MUST get a police report from that country). The police certificate must have been issued less than 1 year ago.

Photographs, Chat logs from social media, Phone records showing both phone numbers and duration of call, Email correspondence

11. Court and Immigration Records: If you have been convicted of a crime or other offense, in the United States or elsewhere, obtain a certified court record covering each offense. If you previously resided in the U.S., you are encouraged to bring evidence of your immigration status during your stay, and records of any previous U.S. visa extensions and deportations that would be relevant for review.'


Those are what is needed for the interview.

When a case reaches the embassy / consulate, the required information will be sent to the beneficiary as a guide.

It’s not a must to meet your fiancé. There are waivers for that. Very hard to qualify but some have done it.
Theoretically there are waivers BUT it's hard and almost impossible to get the visa from Nigeria if you have not met in person as Nigeria is regarded as a high fraud area.

Culturally or even based on religion, nothing stops the couple from meeting physically in our environment.

Talking about scheduling of interview dates, I hear the closest date is around March (for Visit Visa). So after one month wait, one still have to add additional four months for the interview? Or is the dates for K1 Visa different from that of B1/B2 Visas?
I think the dates for the K1 visa interview are different from those for the B1/B2 visa.
