metroatl: Sorry about this. I think you were denied due to your previous travels to the US. I see you’ve renewed your b1/b2 recently. And you once gave birth in the US. The red flag might be from these. Did the same person who traveled to the US with you back then your petitioner? You need to state the reason why you were denied, even if you’re going for CR1 route so people can help if at all. Don’t give up Previous travels or B1/B2 visa has zero impact a K1 petition. I had a valid b1/b2 visa and I had traveled to the US twice within the past 1.5 years as at the time I had my K1 interview. |

The thing with K1 is that you are at the mercy of the CO. Even if you have all your documents and evidence of a genuine relationship and the CO feels something is not right (even without evidence), the applicant can be denied and there's nothing anyone can do about it. The only option is to refile the K1 or get married and file a spousal. |

Coquinoqui: 16th march 2022 i Submitted Adjustments of status, Employment Authorization Card and advanced parole
16th march received USCIS Receipt notice.
25th march biometric appointment scheduled
22nd April I did my biometric and photo capture After the appointment I checked my case online it says actively been processed , checked again few hours later and it changed to “We have approved your Form I-765, Application for Employment Authorization, we will mail ur card to the address u gave us” Omo i surprise I got the approval same day I did the biometric. Just 1 month and 5days . Thank God for grace , can’t wait to enter the hustling field$$$$$$$$$. Great. Congratulations. Biden's administration is trying to speed up work authorizations and the process in general. |

ednut1: false, i was working in a big 4 accounting firm, if i had gone to the industry and not travelled I would have gotten more than he earns. I have ex colleagues who left audit to shell and other big oil companies, today they are in Canada, one of the oil company started paying salary once every two months. My guy just japa. Canada migration was designed to take only the highly skilled workers with 3 or more years experience. You cant even get into Canada as an hustler. Na usa and Europe dem dey hustle A lot of people talking here don't even understand the situation. They think people running from Nigeria are poor or struggling. I met someone in Houston that left Shell in Nigeria to relocate about 4 or 5 years ago. My last salary in Nigeria was over 10m per annum (which was/is small in my opinion) in 2018 and I still relocated in 2019. I was an accountant in Nigeria and I got a job in a mid-size public accounting firm the same month I got my work authorization. At exactly 2 years, I moved to a big4 firm. The same big4 in Nigeria refused to employ me because of age or class of degree. I am currently paying cash for a master's program that will end this year. My program cost over $27,000 but I am allowed to pay per semester based on the number of credits I register for. No way I would have been able to afford $27,000 for school fees if I remained in Nigeria. The value of my retirement savings account in one year alone is more than my over 10 years pension fund account in Nigeria. One of the companies I worked for still owes me over 1 million Naira pension deductions not remitted to my PFA. So many other things that have happened that I won't want to disclose here so as not to give away my identity. I will always advise anyone. LEAVE if you have the opportunity to relocate legally. Staying in Nigeria was a waste of time for me. If I had come earlier.....I can imagine what I would have achieved. |

drpossibilities: Many thanks for all your contributions. I am more inclined to stay back in Nigeria and I will. Starting life all over again in a new country is a turn off for me. For my profession I'll need to spend a year or two writing exams in any new country to get certified in that country before I will be able to get similar job and roles unless I want to switch careers. My job in Nigeria is secured. The Company is over 50 years old and even though it started as a one man business it's no longer so. After becoming a director within 3 to 5 years you become a shareholder. Shares are allotted to you as part of your employment benefits and the shares are often enough to make you part of the decision makers. I feel I have better prospects staying here and building my career than relocating to a new country and starting all over again. Good luck and wishing you the best in your decision. If there is a pathway for you to relocate LEGALLY, it won't hurt to explore it. Hopefully you won't wake up 5 years from now and wish you had taken a different decision. I am speaking from experience, I had the chance in my late 20s / early 30s but ignored the opportunities. Fortunately, another opportunity came again in my late 30s and I grabbed it. Best decision ever! |

1. Directors earn not less than N2,200,000.00 monthly and salaries are reviewed upwards in the company annually.
2. You and the company both contribute to a pension fund with a reputable pension fund administrator monthly and your pension fund account balance in just 6 years of working with the company is over 8 million naira.
3. The company caters for the health needs of you, your spouse and 5 children at no cost to you under HMO.
4. You enjoy performance bonuses annually.
5. Your next promotion is to Assistant General Manager where you will begin to earn about US$6,000 per annum as foreign trips allowances.
6. You are married with 5 children.
7. You are 35 years old. I will relocate to the US or Canada if I am in the situation above. That 2.2million you hope to earn monthly is not even up to $4,000/month at the current exchange rate. If the naira continues to depreciate, it will be a lot less in 8 years. $4,000 per month is $48,000 per annum. If you are a legal immigrant and you are educated, you can easily earn a lot more than that in the US. Then consider you will have to pay school fees for your kids, provide your own power, water. You can't escape bad roads, police checkpoints, generator noise, etc. I won't even think about it, I will leave if I have the opportunity. Actually, I left already and it is one of the best decision i have taken in my entire life. I only regret not exploring the opportunities available and leaving earlier. |

I came across this case and thought it would be good to share. I have attached a pdf copy of the case.
It's a relatively long read, but it is helpful. This is a warning against lying on any immigration or visa form. Whatever benefit derived, including citizenship, can be rescinded if they find out.
Summary:
In 2008, an applicant from Ethiopia applied for a K-1 visa as the fiance of a U.S. citizen. He did not disclose he had two children with a woman who was not his fiance in his application. The children were conceived when he was reportedly in a relationship with his fiance. His K1 visa was approved. In 2008, he entered the United States soon after and married his fiance within 90 days based on the terms of the K1 visa. In 2009, he adjusted his status to that of a conditional lawful permanent resident by filing a Form 1-485 and eventually removed those conditions in 2011 by filing a Form I-751, Petition to Remove Conditions on Residence. He did not disclose these children on either of these forms.
In 2012, the Applicant divorced his K-1 visa petitioner. Approximately one month later, he married the mother of his two children, filing a Form 1-130 to bring her and his children to the United States. In November 2013, the USCIS interviewed the Applicant in connection with this Form 1-130. During this interview, USCIS discovered he did not disclose his children on his prior immigration applications. As a result, in 2014, USCIS issued a notice of intent to rescind permanent residence, and in response, the Applicant requested a hearing before an immigration judge. In June 2016, the immigration judge rescinded his lawful permanent residence.
In trying to remedy the situation, the Applicant and the mother of his children divorced the same year. One month later, the Applicant married the mother of his third child, she filed a Form 1-130, Petition for Alien Relative on his behalf, and he filed a Form 1-485 to adjust his status based on this relationship.
Of course, the new petition was not approved, and he lost all his appeals in court.

rentAcock: You hustled in Nigeria and succeeded. You are on an exponential trajectory in Nigeria as it is, whatever you do, do no relocate to the U.S.
You will be miserable there. You may end up working at Mcdonald serving food or end up as a security guard or at the very best a taxi driver. Your U.S based wife may talk down on you because she feels like she brought you to the U.S and also because she will likely be the bread winner of the house. Nigerians in the U.S especially in Houston, have the highest divorce rate and domestic homicide rate than anyone else. And that's because a a majority of the U.S based Nigerian women are nurses making good money while their husbands are minimum wage earners doing menial jobs. They feel like they can talk to their husbands anyhow and one day the husband reacts and kills the woman.
IF you are into IT, you can work remotely right here in Nigeria. I know a couple friends working for Amazon Web Services from Nigeria, they get paid in dollars and they earn nothing less than $300,000 annually by working for different companies. I wish you all the best, but don't say you weren't warned. This has got to be the dumbest take I have seen on this travel section this year. |

My elder sis and I. My elder sis is a nurse in Austria (3 years now), she's married with a kid in Austria. My big sister send money home once in 3 months, and I have been the one receiving the money. I share the money exactly as instructed by my big sis. I have never cheated anyone, Infact my Dad and Big sis communicate very well. My Dad trust me so much.
My younger brother is always angry, He said he feel cheated all the time. He shouts and talks to me anyhow like I'm his mate. Honestly speaking, I gave my younger brother more love and respect that he could ever imagine. When he was serving, he would call telling me he need 10k urgently, sometimes 20k, that he will pay back. Immediately I will send it to him and he would never pay back. Same thing he does to my father. If we ask him what's he using his allawee for?? He would angrily say so is becus we're sending him "chicken change" that's why we're asking jamb questions.
He said we don't regard him, he called my Dad a SIMP, he said my Dad listen more to my big sis and I....but he don't listen to any of his suggestions.
My brother is a 2:1 (second class upper) graduate in economics from UNIBEN. After his Nysc all he does is to sleep and eat. My Dad's good friend told my brother to come to Lagos and resume work with him. He refused. My Dad ask him if he wants to further his education (masters or professional courses)he said no....Okay follow my Dad to his cement shop and help him (my dad even promised to pay him salary) he refused....I overheard him on a call with a friend and i suspect he's now into yahoo yahoo.
Look at what happened. My big sis sent us money yesterday to celebrate this festive period. She said I should give my brother 50k, I should take 80k and give my father the rest (abt 250k). My Dad is always aware of everything. I even added 20k out of my money and I transferred 70k to my brother, I was left with 60k (becus she also sent me hair and I plan to sell it becus I already had enough). You can imagine this ungrateful idiot started insulting me, that I cheated him. the fool angrily withdrawn the money from his account and SET IT ON FIRE (70k). He called my elder sister and started warning her saying "if he can't receive the money henceforth, she should stop sending him money again that he's the man of the house". My Dad gave him a resetting, resounding, hot and dirty slaps. He pulled out a knife, deflated my Dad's car tyres and ran away from the house.
Everyone is not happy. I don't want my brother to live a wayward life. He's 24 years old. Please nairalanders Help! Leave him! There is nothing you guys can say to him that will make him change, he has to learn by himself. He is old enough to make his choices and bear the consequences. Your father should not worry about him and he should leave the house permanently to fend for himself. When/If he realizes his stupidity, he will come back home. He should only be allowed back in the house omly if he us truly remorseful. |

Skybridge33: A friend of mine called me last week, she resigned from a high paying job working for a Telecom company in Nigeria to move to America with her two kids. Before she left she was doing okay, her salary was over a million, her kids went to the best schools in Lagos and she bought a plot of land in lekki. She sha want to leave Nigeria and japa even though she was in her mid forties and can't hustle like before. She got a tourist visa and left with her kids. Now she's complaining even after advising her not to leave as she was average rich here before she left . Now she lives in a one bedroom apartment in a ghetto area of Houston. She works 20 hrs a day doing two jobs and she still doesn't make enough money to pay her rent, the landlord will chase her out anytime. Now she's complaining that things are hard and she wants to come back to Nigeria. What should I tell her, everybody wants to japa thinking life is better there. Eventually when they get there, instant regret it's cold, the people are unfriendly and even the blacks there are racist to Africans. The issue here is that she is an illegal immigrant and that's her fault. If she was legal, her story would have been different. |

Get a death certificate from the Nigerian Population Commission. The same place you obtain birth certificates from. The death certificate will likely be sufficient as proof that you are free to marry your fiance at the filing stage, but be prepared to show more evidence at the interview stage. At the interview, in addition to the death certificate, you should have other secondary evidence like social media posts (from you, friends, etc) showing her death when she passed, copy of the obituary, burial ceremony program, condolence letters, pictures of grave with gravestone showing name, dates, etc. Anything that will confirm death aside the death certificate. |
