Education / Court Dismisses Case As JSS1 Student Sues Teachers & Ekiti Govt N15 Million by Sigggy: 1:17pm On Dec 16, 2021
Update from SIGGY .ng

Read Previous Thread : https://www.nairaland.com/6700615/jss1-student-drags-ekiti-state#104750657

The Ado Ekiti Division of the State High Court on Wednesday dismissed a suit instituted by a nine-year-old Junior Secondary School 1 student of Mary Immaculate Girls Grammar School, Ado Ekiti, filed by her mother.

Recall that Siggy had reported on the 3rd of August that a JSS 1 student named Gift Agenoisa sued the Ekiti state government for N15million for alleged "breach of fundamental human rights".

Respondents in the suit are the School Principal, Oluwasanmi Funmilayo, Ekiti Commissioner of Education, Ekiti Teaching Service Commission, and the Government.

Delivering judgement, Justice Lekan Ogunmoye, held that the applicant did not place before the court credible and sufficient evidence to convince it to grant her prayers.

“It is also trite, that applications for the enforcement of fundamental rights are granted once the rights of the applicants are shown to have been breached or threatened.

“This was not done in the instant case.

“The sole issue for determination is hereby resolved against the claimants, the reliefs sought are hereby dismissed,’’ he said.

Counsel to the applicant, Timileyin Omotoso among other reliefs sought a declaration that the physical, mental, violence, abuse, negligent treatment of the nine-year-old JSS 1 student was illegal and unconstitutional.

He said it was a violation of his client’s fundamental right to the dignity of her person as guaranteed under section 34(1)(a) of the Constitution of Nigeria as amended and Article 5, of the African Charter accordingly.

He also sought for an order directing the respondents to immediately lift the suspension placed on the applicant on May 19 in the school and reabsorb her to continue her education and learning forthwith”.

Furthermore, he sought for an order directing the respondents to pay N15 million as general damages for the violation of her fundamental rights to education, dignity, fair hearing and the protection of the Child Right.

Counsel for the respondents, S.B.J. Bamise, in his counter affidavit, described all averments in the Originating Summons, as not only untrue but total falsehood.

According to one of the respondents, Funmilayo Oluwasanmi, the girl on May 19, went to the school with a weird, indecent and unapproved hairdo, in an attempt to correct and scold her, she shouted at her teacher, that it was her mother who made the hair for her birthday.

Mrs Oluwasanmi said following her unruly behaviour, she was punished and given two strokes of cane and warned not to come to school with such hairdo again.

He said during a meeting with the girl and her mother, she called her husband, Moses Igenoisa, a Police Officer, who stormed the school with five fully armed Policemen.

“On their arrival, they beat up and harassed some school teachers.

“They forced open the school gate and in the process, wounded the gateman,” he said

The government of Ogun State has rewarded the two best graduating students of the Ogun State Institute of Technology (OGITECH), with immediate employment.

The students, Lawal David and Emmanuel Ogunleye, both emerged as the best overall graduating students both being the first graduating students in the history of the institute to emerge with distinctions in their respective courses.

Prince Dapo Abiodun, the Ogun State governor disclosed this during the 4th convocation ceremony and conferment of the institute’s Fellowship Award programme of the school for the 2019/2020 academic session held at Igbesa.

This is really a kind gesture from the Governor and this will go a long way in encouraging other students and disabusing their minds from the fact that education and students are not considered or taken greatly.

The Governor who was represented by the Commissioner for Education, Science and Technology, Professor Abayomi Arigbagbu, pledged his administration’s commitment to educational development through the provision of conducive environment, adequate facilities and funds for teaching and learning to thrive.

He urged the graduates to think out of the box and not add to the growing rate of unemployment in the country and had thus enjoined them to see the academic awards as a starting point.

He charged the graduates to be creative and think of whatever they could do to be employers of labour.

The Governor speaking further, acknowledged the steady growth and development of the Institute as he pointed out that the school has grown to define the state’s renowned academic excellence, integrity and honour.

He applauded the school for being economical with its internally-generated revenue. He thereby promised that the state government would continue to support the institution for the greater growth of all the stakeholders and promote excellence among the students.

The rector of the institute, Dr Olufunke Akinkurolere in her address mentioned that the programme and courses available in the school were designed in such a way that industries around them could provide employment opportunities for the graduates.

Kidnappers are reportedly demanding N5million for the release of four students of Delta State University (DELSU), Abraka, alongside five other travellers who were abducted.

The students were reportedly abducted along Abraka-Eku road, Ethiope East Local Government Area of the state on Saturday.

The names of the students kidnapped were given as Arogbo Harriet Seyifunmi, Azunobi Prosper, Miracle Etavbwobor Robert (all 500 level students of the Department of SLT Chemistry) as well as Adegor Aghogho Happiness, a 500 level student of Electrical Engineering.

Meanwhile, executive members of the Students Union Government (SUG) led by the president, Comrade Solomon Mukoro, have condemned the abduction.

In a statement on Tuesday, the students described the abduction as shameful.

“The alarming abduction of students is very shameful to the state government and security agencies; that they have done nothing to stop the recent attacks on students and citizens after reports and official complains have been made about the Eku-Abraka expressway,” the statement read.

The students called on the Delta State government “to wake up, develop and deploy new strategies to deal with insecurity and kidnapping in the state, especially the recent kidnappings along Abraka-Eku expressway.”

They lamented that the lives of students of the institution are in grave danger.

The students’ leaders, however, urged all DELSUITES to “remain calm and not endanger the lives of the kidnapped persons, as we are doing all we can to rescue the abducted students.

“We are in constant communication with the Police department and state DSS, and we are working together with them to save the abducted students in the shortest time possible,” the statement added.

Police Public Relations Officer (PPRO), DSP Bright Edafe, when contacted, said he was not aware of the abduction.

Update from SIGGY

Mother of Nigerian artist Simisola Ogunleye a.k.a Simi, has asked Nigerians to quit being cruel to their employees in order for their children not to pick up negative habits.

Read her tweet below;

“Too many sad stories of children maltreated by teachers & fellow students. Why are people so wicked to children? Some adults are still doing same to their housemaids & staff. Please, change your ways & stop being wicked. Those of you who did it in the past should ask for mercy.

Some students learn wickedness from home from the way their parents treat their domestic staff. They see their parents treat their staff less than human & these kids took this mentality to school to deal with those younger or weaker than them. Parents, please show good example.

Parents, have a good relationship with your children so they can quickly speak up when they are being molested by a teacher or fellow students. Find time to ask them questions that will make them open up. Attend their Parents/Teachers meeting and be observant.

When your child complains please listen. I removed my daughter from FGGC & she became a day student when I realised she didn’t like it. What works for one child might not work for another. Stop using other people’s children to determine what is okay for your own children. Listen.

Parents, pls don’t stop going to your children’s schools when they enter university. Our kids now go to Uni at a young age so we still need to be up & doing. Check on them, encourage them & advice them & check out their friends. Trust them into the hands of God but do your part.”
