garfield1: Inec inability to follow its guidelines is not a violation of the electoral act.nowhere in the electoral act is it stated that the guidelines must be followed. Again, inec explained that the non transmission was as a result of a glitch and network errors and out of its hands. It's part of the electoral act oga.

garfield1: He cannot bring witnesses from Amazon or cloud, they cannot help him.they deal with servers,Internet, connection and has no part to play here.obu needs forensic analysts, mathematicians, polling unit agents, statisticians, voters etc not IT specialists that will deal with results physically and materially and show the court that votes were rigged or belongs to him....
Irev is not the primary backup but results or copies held by lp agents.they must have their copies first before comparing it with irev.obi agents have collated and analysed the irev severally and it shows that tinubu won based on irev therefore irev chapter is closed, obi needs to look for another means of proving his case either by vote recount, forensic analysis, tendering of copies of results by his agents etc Obi accusing or blaming inec is a waste of time.inec is dutybound to defend the results it declared and stand with the winners.even if pdp or lp won, inec will still stand with them. Your points are clear and your opinions are noted. Except that people from Amazon cloud can testify if the server was attacked. Why did you say they can't testify? The point is to show that INEC deliberately sabotaged the elections to allow for manipulations. Those manipulations are everywhere even on the IREV. |

garfield1: Oga,the supreme court right from 2015 has exhausted the difference between electoral act and guidelines.the apex court clearly stated that violation of inec guidelines is not fatal and cannot be a ground to disqualify elections while violation of the electoral act is fatal.see wike vs dakuku supra, see udom vs apc supra..moreover,inec itself stated that electronic transmission just like server in 2019 is not mandatory You agree that INEC failed to follow its guidelines? Let's start from there. So that the issue is now if the failure of observe election guidelines by INEC violates the Electoral Act. |

garfield1: You still dont get it.they won't just add votes to obi except he shows that those votes belong to him beyond doubt not just based on irev.he must bring prove beyond what is on irev.how will he do that? It is easier for obi to show that votes were invalid or illegitimate rather than it belong to him .based on what has been displayed so far is inadequate for the court to even rule in obi favour Ok I get your point especially the bolded which is true. However, PO said he can prove especially with witness from Amazon Cloud or so, so let's wait and see. Also results on the the IREV are meant to serve as backup to the form EC8A. If INEC cannot justify the IREV then it is clear that they are complicit in election rigging. I saw part of PO's response to the rebuttal by INEC where he accused them of favouring and working for one party while also being an umpire. Something the Appeal Court has frowned upon several times on previous occasions. |

garfield1: Yes that is what I am saying.for there to be a rerun, peter must prove that up to 2.8 million votes were invalid or illegitimate which is the margin between him and tinubu.based on these thread, total votes affected is not up to based on the irev calculations.atiku too in his own case must also prove that votes affected are over 1.8 million. The court can only order a rerun in those affected places which will obviously be places where apc dominates and with tinubu in power,he will still win.therefore,it is academic and needless It does not have to be 2.8m and 1.8m respectively. What will be considered is the algebraic sum. That is addition and subtraction. So any number of votes accrued to Peter Obi is lost by Tinubu and same with Atiku. So we are actually looking at less than 1m votes. |
Politics › Re: Peter Obi Won:2416 Polling Units Result Altered In Gombe And 1568 In Kaduna by Spy360(m): 4:13pm On Apr 26, 2023 |
garfield1: Inec guidelines are mere guidelines and not mandatory, the court has ruled severally that in conduct of election, the electoral act and constitution are to be followed.again, the complaints raised by pdp and lp should have been raised at the ward or lga collation not at the national collation level.
Secondly, what is substantial in electoral law? The courts have stated severally that substantial compliance means being enough to affect the final outcome, that is the margin is enough to make obi or atiku winner. this I not true as all recalculations from the irev including adding rivers and benue to obi still puts tinubu as winner.obi actually lost At the bolded, what's substantial can also be enough reason to call for a rerun not necessarily awarding another winner. Tinubu won less than 40% of the entire votes. If the objections comes close to that, it gets lower and then it's substantial enough. This is unlike previous years when the winner and runner up gets over 40% each. |

Jodera: The thing Is that even if today Is the final day and we draw, we won't still be crowned champions until Man city plays their two outstanding . So what does that suggests? It means that, it isn't a fact that we're champions (or 5pts ahead) until Man city plays their game. It also means the league isn't in our advantage but Man city's advantage.
As for your 2nd paragraph, we only need to win. If we draw/lose and and Man city just win one of their outstanding, then Goal difference will come into play and we know how vastly inferior we are to that.
Well, I don't want us to go round and round into this sha. If you think Man city will lose their two outstanding at Etihad and only needs a win against us, then good for you and I pray it happens.
At least, let it happen that way(even though I know the chance is of that happening 0.000001%) Man City doesn't just have to play but to win their outstanding matches. Secondly, the league is in our advantage because we are five points clear. Man City has to win to take over the advantage. I believe if given a choice they would prefer our position than theirs. I am not going to put my neck on the line that Man City will lose any game. I am just stating what facts are currently on ground. |

Jodera: You are bringing in conditions yet you're still claiming it's a fact? Why not wait let Man city Lose their two Matches against Everton and Brighton (both at Etihad to be precise) before you label the 5 points as facts.
No wonder you still think they need to win us for them to have an advantage when in actual fact they don't need to lose.
Well, e be like say na season of play we dey so make everybody dey play There must always be conditions attached to facts. If you look at the PL table right now, it states the facts. Any other possibility can take either way. We are five points ahead and will remain so if City does not win the games in hand. You are wrong about City not having to win against us. If we beat them on today or draw, they will still have point gaps to cover against us. |

Theflint1: APC has redefined what it means to be a public official and that's because at the core they have little understanding of the responsibilities of public servants...most of their members that are active on social media, all they care about is being banger boys, serving it hot to people and giving clap backs; zero comportment and zero professionalism. The attitude that brought them into power, they've failed to realize isn't one to carry into governance. What Nigerians are not getting is the philosophy behind the Tinubu presidential bid. The Emi lokan' philosophy is one of my turn to chop. So all the people lined up behind him are seeing it that way. Hence their readiness to refute any opposition and by any means available. Tinubu is also a smart criminal, he knows how propaganda rules the minds of people and spends heavily on it. In fact most of his key men are the ones controlling public space. You wonder why he invested in media, and tries to recruit people who can dominate the media space especially social media. What he didn't get is that most people who follow politics on SM are Obidients and so the battle of control became harder and thus vawulent. |

garfield1: The law recognises that every election will have flaws hence substantial compliance.the question is are those flaws enough to affect the final outcome of the elections? A big no.so you never learnt anything on all these law electoral cases here? What a pity The first question is if the INEC guidelines for the process for transmitting results were followed. The failure of comparing IREV with paper EC8A during collation violates this guideline. This led to the protest by PDP and LP agent. This issue was not addressed before calling the winner even though the INEC chairman promised to do so. The second question is if all the results displayed on the IREV tally with the EC8A CTCs and if the disparities are substantial. It is clear that substantially the results do not tally. These grounds are enough to cancel the elections and order a rerun. The only other possibility is to do a recount. |

Obi was very smart while filing the petition, he put his name first before labour party. That means labour party can't withdraw the case.
Where are those who were arguing that apapa is not an arm and tool for Tinubu and APC? Most SW regional LP leaders before 2022 were loyalists to APC/Tinubu. They never envisaged that they will be pitching tents against him. Hence most of them endorsed Tinubu during the campaign or collapsed their structures. Now Tinubu wants to use them as moles.
