The summary of the learned silk case is that the suspects are those who reasonably knew that diversion of arms money would cause large scale suffering of the unprotected civilian populace. This foreknowledge comes under article 7 which defines crimes against humanity.

It will be recalled that whilst the arms money were being shared for Dr. Jonathan's reelection, over 200 girls were abducted, 2 million innocent citizens were displaced and nearly 20,000 more were killed.

The attitude of the leaders were not surprising given the fact that Dr Jonathan was seen dancing in broad day light within 48hours of bomb last in FCT which claimed nearly 100 innocent citizens.

To majority of the PDP supporters the bloody atrocities were worth the ambition of their leaders. this shall be demonstrated by the insane reactions that may be read below.

"man alleges" on a blog! For what it is worth, I don't like the idea of handcuffs on a person like Chief Metuh. Seeing him one on one at Wadata House and legacy house in those days makes it all the more sordid.

Be that as it may, Nigerian leaders know what to do to move this country forward. RESTITUTION. if they choose power play, then all kinds of wailing because of use of power becomes hollow and benighted.

As far as I am concerned, the masses are the real victims of circumstances. all others who ground stand purporting to have nothing to give back when interrogated are on their own.

Exactly what I expect someone to say. Photo Ops necessary as evidence. It serves a purpose, doesn't it? That is how war crime tribunals work. What is the motive for armed conflict. it is called casus belli.? Who declared him dead? Those who would like to use his picture or a medical practitioner. atrocities of war is a collective responsibility. no one can assume the position of permanent victim in trial. What did you do or failed to do?

OK lets put everything on the table! the right to go and the duty to ensure federal cohesion. How much blood should tilt the balance in favour of one against the other?

Pls take a look at the picture and ask yourself the following question.

Whose brother or sister or parents will stand to take picture of his Loved one lying in pool of his blood?
for how long was the corpse lying on the floor and his soul flowing away in blood with no one ready to help as it appears?
Are we waiting to blame someone for this or concerned about the life that was gushing away in crimson red?

indeed it is noble to lay down your life for the cause that you believe in but to do so in the context of "Comradeship" without Espirit De Corps is a grievous tragedy.

The posture of the youths standing over the corpse shows nothing but detached mockery of the departed - a lesson for the living.

I have nothing to say about the state agents involved in this saga. rather my query is to the State (which includes government and citizens) that posterity will hold us all accountable for all our acts and omissions that trigger humanitarian suffering.

As a quiet observer on these forums, I must say this thread is one of the very best I've read here.

I normally avoid posting on Nairaland as I see some posters running rampage, insulting all and sundry. I'm not for that so I stay mostly on offline read mode only.

But I've logged on today so I can post a well done to the OP (Kayfra), Super1star, TruthToPower and few more for addressing points with facts and not emotions.

This, IMO, is the type of thread to take to front page.
We try so hard to maintain silence but silence itself could be so deafening on issues of war and well-being of the country. thanks, ma for your appreciation. I guess some of us are aware of the Intelligence Gallery where people like you monitor events on the floor. cheers ma.

Yes we can ask for more and fairness in federal character. but to put people in harm's way or jeopardize the peace of a whole region because of Federal Character is the height of criminal irresponsibility. When the music is over, as usual, who will be without chairs?!

Bottomline: we all want fairness in the system but no one should be a 'jumping pad' or 'target practice' for anyone to enjoy fairness. that in itself is primitive wickedness to those who are too ignorant to discern that they are the pawns!

What happens to vital supplies of food and medicine in the event of sudden escalation of hostility. What will be the purchasing power of the average biafrans in sudden outbreak of war? This is not guerrilla warfare where rebels depend on the economy of the hostile state. Even fighting BH within north east is hell for civilians how much more fighting separatists in a compact region.

We call for peace not because of a particular indispensable value any region brings to the table but because the discomfort of separation through exuberant threats is unbearable and yields no advantage to anyone based on the morally bankrupt foundation of the architects thereof.

If you knew what happened in East Timor, South Sudan before UN came in, you would make them a role model for Biafra.

East Timor was annexed by Indonesia in 1976. by 1999 before they. Nigeria did not annex Biafrans. Biafrans have been voting to affirn Nigeria constitution since 1940s. South Sudan has been a parallel entity in Sudan . The war in South Sudan is ongoing. Over 10000 deaths and over 1million displaced as refugees. Sudan has been a text book case of war for over 30 years before UN intervened. Not a good example for Biafra and Nigeria.

Eriteria war of independence 1961 to 1991. claimed over 200,000 lives before UN felt urgent need to speed up separation.

No territory has ever been granted independence through UN just for asking. there are over 1000 requests for such. all of them equally sympathetic. But the objective of UN is not liqudation of member states. it is about giving them opportunity to grow in peace for as LONG as it takes.

It is easier to negotiate independence with parent nation than with UN. USSR, N. Ireland.

United Nations by its charter of 1945 IS NOT a supranational government. The Corfu Channel case, 1949; Nicaragua case of 1986. laid to rest the principle of non-interference and territorial sovereignty. This principle itself became part of customary law of nations (jus cogens) as far back as 1648 under the Treaty of Peace (Westphalia).

Territorial Sovereignty being part of just cogens is also regarded as a pre-emptory norm that cannot be modified except by another norm of similar character. The famous exceptions are under humanitarian laws. for you to invoke IHL, there must be armed conflict to such an extent that shocks the conscience of humanity. Think of Libya Syria, Sudan, Rwanda and Somalia. this will bring about the principle of Responsiblity to Protect or Uniting for Peace.

Remember that UN was already in existence prior to the civil war of 1967. the humanitarian conditions then only attracted sympathy of the international community. Nigeria has assumed greater status in the UN now. Keep the Palestine struggle in mind.

From the above the rule is clear: no interference. successes in separations such as USSR was internally achieved by relevant parties.

Will Biafra be an exception to the UN rule? who knows. but you cannot invoke UN without the abhorrent levels of humanitarian conditions as we have in every other place where UN intervened. At that, Only South Sudan after 30 years of civil war could lay claim to success.

Is there a way to Biafra. Yes. Dialogue! The alternative under UN HAS BEEN war - WITHOUT A SINGLE EXCEPTION.

Keep in mind that Diplomacy is the language of UN not threat or insults of whatever kind. UN has never considered threats and insults as a legitimate mode of communication in any of its august meetings. cheers!

It was the military ruling class, who were mainly from the north, that concocted that constitution and even had the audacity to say WE THE PEOPLE....

What it means is that ICJ can make a ruling that invalidates the contents of Nigerian 1999 constitution based on the fact that is was not really adopted by all the peoples the constitution was meant to hold together. Legal agreements e.g a constitution must be adopted by all parties whose interest the constitution is meant to protect.

You can even argue that at no point did Nigerian agree to invalidate the 1979 constitution which Buhari and his fellow coupists destroyed. I'm sure the 1979 constitution has provisions for those that commit treason, which of course includes Buhari. This can even be roled back to the 1963 repiblican constitution e.t.c

Bottomline is that once UN gets involved, there is nothing, ABSOLUTELY NOTHING that the Nigerian government can do to stop self determination, if the se and much of ss opt to go that way

of course no state should hold a suspect without trial. that is rule of law. no suspect should hold the state in contempt without penalty. that also is rule of law. so it is a balancing of conflicting laws. What you choose to uphold depends on what you choose to sacrifice.

Interestingly the law does not say "Don't commit a crime" rather it says "if you commit a crime you shall be punished" it gives you the opportunity to make your choice and face the consequence.

I wish there are more peaceful ways of achieving our goals. but if the hard way seems to be the only way, then it is pointless complaining about hardship going forward. cheers.

Try using 10 billion Naira to fly private jets
Try spending 80% of budget on 0.05% of the citizenry
Try diverting defence budget
Try flying to south Africa with millions of dollars
Try paying conference attendees 12million naira each.
Try hiding from exradition through PDP sponsorship

Because you can't try any of these things that fetched your principals billions which trickled down to you, I expect you to wail.
