For starters the President is the appointing authority of all executive powers in accordance with chapter 6CFRN 1999 (as amended). S.147 (1) says there shall be offices of Ministers as MAY be established by the president. (2) says any APPOINTMENT to the office of Minister needs senate confirmation. the word "may" here simply means the president has discretion as to the specific ministerial office to create. The president is not making any APPOINTMENT to the office of petroleum he is simply retaining the powers which he has constitutional discretion but no legal obligation to assign to a minister. S. 148 Says the president may in his DISCRETION assign any business of govt to the VP or ministers. for avoidance of doubt S.10 of the interpretation act says when a law imposes a duty on a person the law also vests the person with the power to carry out the duty. Bottom line it will be a cold day in hell before you see a commander-in-chief go for Senate screening over discharge of powers and prerogatives already vested in him by the supreme law! |

"due process" is a fantastic judicial concept for isolated cases of criminal prosecution. But when the "due process of justice" faces overwhelming break down of law and order, you need to scape goat or hunt down the most notorious suspects. It just like a teacher entering a noisy class and grabbing a truant red handed. others will fall in line and you can initiate the process of punishing others with the "nicety of due process" If you are familiar with criminal justice that is what the court do to suspects of notorious crimes such as rape, armed robbery and drug trafficking. Corruptiob is now on the "notorious crime" list. Admittedly, govt must attend to the bleeding citizenry with what is available. This will be done. Yet crimes cannot be captured and criminals tracked. Some people see nothing wrong in this criminal negligence and would rather blame other people when the seeds of their perfidy beging to yield. Satanism could be a Pschogenic condition such that the sufferers are just helplessly rebelling against progress and hoplessly at peace with industrial malevolence - so far they are the dominant merchants of that evil industry. Even though there is ethnicity, experice under each republic since 1960, clearly suggest that common sense and honour prevalis. 1st Republic- the north won with SE alliance. 2nd Republic- -the north won with SE alliance 3rd Republic -the SW won with North Alliance 4th Republic (a)- the SW won with North Alliance " (b) - the North won with SS Alliance " (c) - SS won with North Alliance. " (d)- North won with SW alliance whatever we feel about this scenario, let us discuss it as if we are Russian politicians (no attachment to anyone that is) the north will do eight years through the alliance of (d) above. Whether both alliance will produce Yoruba and Hausa as President VP respectively depends on many factors because it has never happened before. The closest scenario was VP GEJ who got the sympathy of all Nigerians excluding core north. But GEJ won in a divided north. This is due to honour and commonsense in 2011. Just as PDP honourably gave ticket to GEJ both in 2011 and 2015. APC will give the ticket to South in 2023. we have no exception to this rule yet ( in successive democratic regimes). SE can be like SW of 1999 who produced the Presidential candidates for both parties. SW spoke with one voice to achieve this and spoke with best intentions for the country. They spoke with concern for Muslims and Christians alike and never felt that any group of people were inherently bad. in return the whole country voted for their candidates without fear of retribution. Obsasanjo reciprocated by uniting the country. The question is: how does SE hope to get into presidency that it truly deserves? Hating the incumbent without any history of support for him is a curious strategy. Presidency have never been won only for the reason that North is on top of the ticket. if it is rigging, you cannot out-rig the incumbent unless you are massively popular and you most likely could have won a free and fair election. If it is by popularity, you have to appeal to popular issues. war against corruption, job creation and social justice. You can then do your political permutationon these issues. I may be wrong but protesting against corruption war , insulting other ethnic groups, declaring war on the Nation and hate speeches are not exactly a strategy for popular mobilization. Without exception anywhere in the modern world, you can only win peoples heart through promise of redemption and salvation from their conditions never because it is your right or that you must get it by superficial intrigues of zoning. |

chukwudi44:Pls CJN does not assign cases at lower courts. in FHC, it is the job of the Chief Judge. FHC was the hope of Saraki to challenge jurisdiction. Court of Appeal has already ruled that it does not interfere with the work of lower courts at this stage. in fact it ruled that standing trial is "not a death sentence" . legally, CCT will conclude the matter before court of appeal steps in to set aside or affirm the decisions reached on Saraki. unless there is anything amusing about this obvious "narrowing of chances" , it is time to keep a low profile. of course this is a game for many people, "law is balderdash!" |
