I doubt that invitation card can be of any use to a visa application, I don't think you need such: the invitation letter is sufficient

justwise: I totally understand where you are coming from, not stating that she was married in her application was a serious mistake and the ECO banned her which is not out of place.

If she can prove the legitimate of her marriage, proof of communication between her and her husband, met the financial requirement and come clean about her previous immigration offense(s) then she has a good chance of getting a visa, even 'if' the ECO refused her because of the previous offense...she will get right of appeal and its a winnable case.
Appeal, that is the only avenue where she would be given the opportunity to plead her case

Yes, the child is a proof that there was intimacy involved in the relationship, but it doesn't represent a proof of credibility or sustainability: know that Visa Officers are aware of immigrants using pregnancy and kids as a device to obtain leave to remain (even if this may not be your case).
Like i said earlier, it is not impossible to get over this, but it is going to be an uphill and time-consuming battle to prove the credibility of your marriage, and it must be a spouse visa that might help you at the long run even as i maintain that i have not seen any one who got success after a ban

I share the same opinion with the lawyer, s/he is being honest.
Though, spouse visa is not in the category of PRIVILEGE, but in the category of RIGHTS, and the onus is on the applicant to satisfy the visa officer of the genuineness and the sustainability of his/her marriage, and the visa officer reserves every right to approve or deny anyone the eligibility on the ground of inconsistencies and suspicions.
What you have done is a serious offence (if not a crime) by applying for a visa using deception. Now, you previously denied your marriage in order to be granted a visa, and now, you want to apply for another visa by affirming the very marriage that you denied. This alone (according to the judgement of the Visa Officer) is a proof that even if you are legally married, your marriage is not one that is credible nor is it sustained: and i think the ban will not be lifted.

By the way, i am yet to see anyone who had been banned for using deception during a tourist visa application and eventually got a spouse visa after marriage, i am not saying it is impossible, but i am yet to see anyone with such success.

I'll give US a try, no need advising me. I'm going with 100% genuine documents. If they approve, fine, if not,business continues.

I have 5months left on my passport for it to expire, knowing fully well i can't apply with that, do i get another passport, or wait for it to expire in 5months time before i can apply for another. Please advise.
If you are applying for a short term (like 3 or 6 months) tourist/visit (single entry) visa, you can not apply for it with a passport that is that close to expiration, but if you are applying for a long term visa with multiple entry, there would be no problem if your passport is close to its expiry date: A valid visa in an expired passport is allowed to be used.
The reason is, with a short term visa on a passport that is expiring, (for example, a 6 months visa in a passport with 5 months left) there is a high suspicion that the applicant does not intend to return to Nigeria

"Your right of appeal is limited to the grounds referred to in section 84(i)(c) of the National Immigration and Asylum Act 2002"


It doesn't look to me as a ban. No doubt i have sinned, but now i am going pure.

Now, regarding the rights of appeal, you need to have the FULL RIGHTS in order to be eligible to appeal a decision, and such full rights come with an application for a visa under the categories of RIGHTS (such as family member visa), not an application of privilege (such as one for tourist visa).
My friend, you are under the ban, don't expect the visa officer to tell you so.

The EU treaty rights directive only applies to all Union citizens who move to or reside in a Member State other than that of which they are a national, and to their family members who accompany or join them

I will not withhold any information. The two applications were false representation of my true self. Occupation and salary account were forged. But i was lucky enough to escape 10years ban.

Eco's decision/reasons for refusal

(a)"Closing balance is equivalent to more than 7months income. Not satisfied that the statement is true reflection of your financial circumstances"

(b) "i am not satisfied that the cost of this trip commensurate with your economic circumstances"

Truth is that i have genuine accounts both current and dom with enough funds, but i was advised by this agent and for the fear of having lump sums deposited several times i went with the agent advice. I have been doing business since 2005 when i graduated from uni., i own a big studio which folded up due to poor management, since then i have diversify into communication business, i sell gsm mobile phone which i buy directly from dubai and usa, also i have incorporated my company but hitherto it has no bank account. Just 2months old.

I intend to reapply in few weeks with my original documents, bank statement et al. Problem is how to convince the Eco with my current and dom account which have lump sums. I have some invoice from the warehouses i do business with both on dubai and usa. I have my wedding certificate, kids birth certs,

In the previous applications i used my bank statement of account (original) and salary account (fake) Only the fake was made reference of.

Now i intend to use the same original bank statement and dom account statement, but will write a cover letter that i have resigned my appointment with the forged company i used in previous applications. LOL

What makes you think that you have not been banned, do you expect the visa officer to tell you your status?
Well, that is not how they work, visa officers do not advise applicant on their ban status unless they are asked.
The highlighted part is a clue that (at least, one of your fraud) was detected and therefore, there is no doubt about it that you are under the 10 years ban. Period

It seems your husband is a citizen of another EU state but resides in the UK, if so, you should be applying for the EU Treaty Rights, and this application is done free of charge.
But shouldn't it be expected that your husband has knowledge about this?

Not quite that, but it was actually explained in the original post, i don't think it makes much of a sense to specify how much one needs to have in an account hence i explained thus: " This is how it works; An acceptable bank statement must have up to six months transaction records demonstrating your income (from verifiable sources) and expenditures, and it must have good enough fund to sustain your trip and intentions, and also; it must have enough balance to keep you going after the trip: preferably, a Savings account, Salary account or Wages account..."

Hotel Reservation for the 2 of them
From Her:
Her Business name registration documents (Officially registered in February 2013, but has been in existence as a sole trader since 2012)
Her Saving account, with constant flow of funds since Jan 2012 (she has been using it for her business) of about 300K to 500K Naira turn over. Sometimes 800K balance sometime 250K
Company account (I have advised her to open one in her business name, and proceed with business transactions on that account from tomorrow till June when she shall do the application, this will mean she will have 2 to 3 months company account NOT 6 months)
Maybe Tax Documents if she can pay her taxes and obtain one *
Receipts and Invoice of ordered Goods since 2012 till date.
My Brothers Passport and his birth certificate (he is a minor so no other paper work for him, just birth certificate to prove it is his mom)

But on the other note, i am thinking of plan B (A bit complicated):

"If applicable" (that is usually for travellers who intend to make a transit or a stop-over in the country, it is not applicable to those whose destination is the country).
Outbound, onward and Return tickets are three different things

No, your invitation letter does not need a stamp, you only have to include a copy of the bio-data page of your passport

Send her a letter of invitation stating her name, her date of birth, her residence address. Also, state how long you intend to host her in Nigeria.
She doesn't need much from her side, just her evidence of a job and her bank account (even if it has only $1.000). Yet, even without a job, she can still get the visa, let her say she is a cleaner, Nigerian embassies never verify anything

I have no idea about "Wakanow", i don't even know what they do or how they function, i have never had anything with them, so i can't say anything about them.

Firstly, my husband is a businessman mostly overseas and all supporting documents I can obtain from him will be foreign, hence I decide to sponsor myself using my personal account in a bid not to attract questions on who will take care of my son when I am away for 2weeks since he will be home when I make the trip. Your advice and take on this.

Also, is there any negative impact in filling 4.14 of VAF1A that my spouse lives with us in the same address and not providing any supporting document from him for the application?

Secondly, I will like to discuss my personal bank statement. I am an event person, and started the business February 2012 after a two year postgraduate studies outside the country. I had a smooth start with a 1.8m turnover for the year 2012. I got my personal tax clearance with respect to this in January 2013. The issue with my account statement is that most clients prefer to pay cash for my services but I insisted that any payment above 200k should be to my personal savings account.

Due to this, if I am going to produce a 6 month statement starting from Oct 2012 to March 2013, the balance brought forward was 7.3m (pls note this). I withdrew 4.5m (early Oct) to purchase a van in the US and other party rental materials I bought to boost my event services ( I have the van's bill of laden which I later cleared in Nov 2012, with van pic and pic of the rental equipment too). My balance went to 2.7m which was followed by consistent ATM withdrawals for over a month.

Early Nov, I got a deposit of 3.5m for an event job out of which I had to withdraw 2.3m to execute the job leaving my bank balance to be 3.4m. After this, I had a consistent ATM withdrawal till the beginning of January 2013 with just a couple of bulk withdrawal for tithes and pledges. from Jan to march, had just a couple of deposits for jobs (520k & 200k), and after consistent ATM and cash withdrawals for maintenance of business outfit which prepares me for rest of the year, I am left with a balance of 1.4m. Do I have a suitable account statement to apply for a UK tourist visa? Your candid advice is needed.

How do I also calculate my monthly income after tax in this situation where income is not constant? Or will it be logical to use my income on my personal Income Tax clearance for 2012 to give an average? Using the average of the total income after tax for 2012 as stated in my tax clearance, my monthly income will be 134k, is it suitable?

I look forward to your critical assessment of my situation.

As an adult responsible for your own travel, you do not need your husband consent nor do you need any supporting document from your husband as long as he is not the one to sponsor your travel and as long as you are not travelling under his own rights; ie the rights which he is entitled to in the country that you are travelling to: but you would need your marriage certificate as a proof of your marital status and for future reference. This cleared your first and second question.

Your financial standings are good, you won't have any problem with the transactions that ensued (the withdrawal of funds and purchasing of the van): there is nothing bad with all that you did. just avoid money lodgement and you are good to go.

To answer your fourth question: there would be nothing wrong with such cash lodgement since the deposited sum does not represent the main fund that you intend to use for the visa application, the Visa Officer would see that your bank account is good for the application even without the lodgement: but you might need to provide proof of the source to avoid suspicion of corruption or such.
NOTE: If you can't provide proof of the fund origin, i like to recommend that you print a post-deposit bank statement, it is ok to present 5 months statement: even a 3 months statement would do if the displayed transactions are transparent enough and are credibly impressive

Finally, i recommend that you go to your area revenue office and explain your situation and get their tax clearance: as a self employed business owner, it will be impossible for you to get a visa if the visa officer considers you a tax cheat

Finally, i recommend that you go to your area revenue office and explain your situation and get their tax clearance: as a self employed business owner, it will be impossible for you to get a visa if the visa officer considers you a tax cheat

It is not compulsory for the embassy to contact the bank especially if they have nothing to worry about, but be warned that it won't look good for you if they observed or suspect that you are trying to obtain the visa by means of deception.
If I were you, I'd withdraw the application to avoid getting the 10 years ban for fraud.
