That is the main (if not the only obstacle) that one may encounter when travelling with expired passport; airline staff not letting you get a boarding pass: immigration officers do not have any problem with that

None of your given circumstances meet the requirement for a tourist/visit visa; your salary is barely £200 in a whole month, and your savings are not satisfying: how much would be left after paying the visa application and other associating costs, and also after paying for flight tickets? Besides, there is the money lodgement?

She is not even required to provide her bank statement, all she needs is a legal proof that she is your legal spouse: her birth certificate or age declaration document; marriage certificate and her post-marital passport. NOTHING more is required of her

If so, your wife does not need anything from her side, she is elligibly covered under your full sponsorship even if she doesn't have a job of her own: i gave that advice based on my assumption that you intend to use your wife's job as a proof of home time or obligation

My wife got the offer TODAY and had to turn in her resignation same day! Meanwhile, we have been planning for the trip since december last year. I do not see anything wrong in seeking opinion on how best to go about the situation. I have already told my wife that we may have to differ the trip till december this year, but i was just asking if there are any other LEGITIMATE way(s) of dealing with the issue especially because I am the sole sponsor for the trip and as such my wife's resignation should not put our plan to a halt. "Manipulating or maneuvering" does not necessarily imply illegality, it simply means to manage or handle with skills or smart arts.
Please, kindly look that up in the dictionary and understand that i wasn't intending to slander your person.

Note: I did carefully read your explanation and i considered your wife's circumstances before commenting, and i was honest enough to tell you my mind based on what i know is the rule. Be advised that for a job to be used as a tie or an obligation, you have to be in the same employment for more than 12 calender months because, such is the window period to be legally secured in a job: you can not use such job (in which you are under probation) as a proof of obligation or home tie

Please, I have a situation at hand and require some assistance sirs and mas.
I am planning a vacation in UK with my wife and two kids in two months time, however my wife just got a new job today! Though I will be the sponsor for the family, I initially planned that my wife will attach documents (payslips, letter of introduction, leave approval, etc) from her employer in order to proof that she works and to boost the success of the application. I wouldn't know if this can still be done now, knowing fully well that she has now officialy resigned. Meanwhile, presenting documents form her new employer may not be a good move as she resumes on April 9th. Please, advise us on how best to go about this issue. We intend to submit our aplications on April 24th. God bless you all...
This is the kind of mindset that gets people into trouble or into undesired and unfavourable situations.
You know fully well that your wife's circumstances are not appropriate for your desired travel intention, and instead of letting it go and doing it at the right time, you are seeking ways on how to manipulate the situation and maneuvre your ways. Things are easier when done orderly.

But my major concern is that my company doesn't pay our salary directly to our account, is being paid at the company by the accountant even my allowances, so I have been depositing to the account as self.

It is not unusual for visa officer to see cases of cash-to-hand method of payment in Nigeria, this system is considered as corruption. Now, the big question is: do you get pay slips for those salaries/wages, if not, how are you going to prove to the visa officer that your income is as claimed, and how do you pay taxes off unverified incomes?
You can see that there is no paper work regarding your income, so, i like to discourage you from applying for the visa until you sort this out

You've just answered your own question, "using company's statement of account is usually not good".
Be advised that even if you have the complete money, the visa officer will not consider you (couple) as deserving to be issued the visa for fear of financial difficulties that may compel you to resort into a desperate battle for sustainability and survival once in the country

If the lump sum is over 6 months time, then it would not have negative effect on your application since you're going to print an account statement that won't show it.

koolmd: Hello Vicjustice and others in the house...I applied for a TRV to canada for 8 day vacation but was refused today. The only reason ticked by the Visa officer is ..PURPOSE of my intended stay. I attached my intended itenerary and every other documentation. I think i have a good travel history as well as my last vacation in Nov. 2012 was spent in The Netherlands and France. What can i do now as i genuinely wanted to go on the vacation and am dissapointed that my visa application was refused.
I don't think your Temporary Resident Visa (TRV) application was refused because the visa officer thought you do not have a good travel history, but because the officer is not satisfied that your given purpose of visit holds enough water.
Perhaps you meet every other requirement, but if the purpose of your intended visit does not seem to be a valid reason to apply for the TRV, you may still be refused.
Knowing that applying for a visa is not just for anyone who will or anyone who desires but for those who have valid reasons to travel, i recommend that you make a good travel plan by studying the areas that you wish to give as places of your interest and make reasonable arrangements of how you intend to spend your time and the activities that you will be engaged in during your stay: if you can explain these to the visa officer, you would be approved.

In 2011 i applied for a tourist visa but i was refused the first time then i reapplied immediately and got 6 months.I was 27 then single and self employed business man with a monthly income of 250k as i stated in my application form.I went to UK and spent 2 months although i stated in my application form that i was going to spend 7 days vacation but i returned to Nija after 2 months but something happened at the airport i got arrested for handling stolen goods these were 17 blackberry phones that a few friends gave me to help them delver in Nija but unfortunately i was stopped at the departure by a custom officer and started questioning me about the phones in my luggage i didnt have receipts because there were UK used before i knew what was happening 2 police officers arrived and started running running a check on each phones but unfortunately one of them has been reported stolen i was taken to police station from there but later released on bail and was told to come back after 1 month but i didnt stay back in UK as i returned to nija after a week the incident happened.

After a week i returned to nija i email the police station and i got a reply saying my bail has been canceled and NO further actions will be taken against me and also i didnt need to answer the bail anymore and concerning the mobiles phones they are free to be collected by me or anyone who can prove ownership or else the phones will be destroyed in next 6 months if unclaimed. I returned to UK and got the phones except the only one that was reported stolen i returned to Nija after one week because i only had 1 month left on my visa then.

My issue now is i have been finding it difficult to to renew my visa as i have been refused 4 times since my visa expire. The first time the ECO was right he refused my application because i failed to explained the reason i stayed in UK for 2 months after i stated in application form that i wanted to stayed 7 days the second reason was there was an adverse notice to the home office during my first visit and i didn't explained what happened then after 6 months i reapplied and addressed the two reasons with the help of my lawyer and i also submitted evidence to support my claim such as the email i got from the police station but the application was refused again for second time because there was lump sum of money into my account 5 days before the application was submitted but there has always been huge some of money in and out of my accounts prior to that but i replied immediately for the the third time providing the evidence of the origin of the funds i.e invoice and the receipts of the goods sold the day the lumps some of money were deposited into my account explaining to the ECO that they were deposited by my customers but to my surprise again the ECO refused my application again given the same reason as the one i was given the first time i went for renewal i.e (i didnt explain why i stayed in UK for over 2 months and how i manage my business while away for so long) but this reason has already been addressed before and they never express satisfactions so i asked for Admin Review calling the BHC attention to the ECO's mistake but they wont change the decision and was asked to reapply.

After 4 months i reapply for the 4th time with the help of my lawyer i submitted a copy of the notes that was used to addressed the refusal notice earlier before another Eco repeated it but again my application was refused despite the mistake by the previous ECO this time the ECO said i claimed i make 250k monthly and he acknowledge the income may depends on the financial performance of the business and that the documentary evidence of my pay may not exist but he needs more evidence to make his assessment that shows i make 250k per month such as company audited account that will allow him to know the financial position of the business so he refused my application.

Now i have the audited account for year 2012 signed and sealed by an auditor but i am little concerns because i dont know what else they will say is wrong this time around because i am tired of been refused too many times i am a genuine visitor just going on vacation and nothing more, some friends advised me to use a family visitor so when they refuse me i ll be able to appeal the decision and there is a high possibility i ll win the appeal but i dont have any family in UK but hes saying it doesn't mean once the person sent me IV and necessary documents it will work despite i never stated in my application form that i have a family in UK.

Your subsequent (four) applications had been refused due to that first reason? Well, this is more or less a sign that a regulation had been placed on you.
I will not be surprised if you have been banned in silence as it is their preferred custom to ban unsuspecting people without notice: But why isn't your "solicitor" concerned about this possibility?

By the way, it is not altogether illegal to stay in the UK for longer than "two months", but unexplainable lengthy periods spent on a single trip as a tourist visitor may cause immigration or visa officers to doubt your purposes. Be aware that it is not only those who used false or fake documents that are banned from the UK: if you gave misinformation about your intentions or you breach the conditions attached to your entry to the UK, you may face the dreaded 10 years ban as well. Bear in mind that you might have been issued the visa due to your declaration to stay 7 days, which means that your application might not have been successful had you declared your true intended period of stay.

Suggestion: As the application fee does not seem to be a problem to you, i advice you to resolve the money-lodgement issues with valid proof of income and then, you may want to apply again one more time, and if unsuccessful, then demand to know your status with them (you can't normally inquire to know your status if you are not making fresh application or if you are not collecting your application result)

The baffling thing about this refusal is that this fellow in question has at different occasions been granted a 6 months, 2&5 years atisfied that you can before now. Been to the UK over 8 times and has never overstayed and also visited the US and currently has a visitors visa to Canada which he has not used and his current US visa will expire next year. See below the refusal notice;
I acknowledge dat u hv previously been issued with entry clearance.however,each time yu apply for entry clearance,yu hv to demonstrate dat yu qualify and therefore yu are required to submit sufficient evidence with each application.
You have applied for entry clearance as a visitor and stated you hv 2 paternal cousins in the UK , yu are married with 3 kids and intend to travel alone to the UK. Also UKBA records shows that your UK sponsor has sponsored 35 other visa applications. I am therefore satisfied that he is aware of the kind of documents that should be submitted with an application. I note that you only have a copy of his passport and a council tax bill from march 2012, 11 months ago. I have therefore seen no recent and up to date evidence of his accommodation and that he lives at this address in London. Such that I am satisfied that. this accommodation is secure and available to you. I further note that your bank statement show several purchases made by you in Bromley,Lewisham and streatham during your last trip to the UK in August 2012, a fact that further causes me to doubt you intend to stay in north London as stated.

I have therefore refused your application because I am not satisfied on the balance of probabilities that you meet all of the requirements of the relevant paragraph of the UK immigration rules.

Family Visit Visa is not categorised for those travelling with family, but for those travelling to visit their family (members) already in the country: but the persons that you intend to visit is your "friend", so you are not qualified for that category.

Are you saying this out of assumption or presumption?
Well, although marriage does not necessarily mean a change of surname, but in the event that you signed a declaration effecting the change of surname, then every applicable credential needs to be updated, and that includes your passport: You are required to update your passport to bear your current surname and not your maiden family name: therefore, in the presence of such surname declaration, her current passport (bearing her maiden family name) is invalid even if it has not yet expired

amykelly: Hi All I need to get some advice for an ex colleague of mine. She got married in Dec, 2011 to a British Citizen but did not apply for a spouse visa immediately because she got pregnant and had not written the TOEFL. I advised her to apply immediately and use her Bachelors degree as proof of English but i didnt see her for a while and the next time i saw her she was heavily pregnant. Last year she went to renew her UK visa and filled single out of negligence and because she thought she had to change her name to fill married so her visa was revewed for 2 years. Just last month she tried applying for her daughter and this time filled in married and attached her marriage certificate but the embassy picked on the change of status immediately and called her for an interview. they asked her why she filled single when she was renewing and she told the truth that her marriage certificate wasnt close to her thats why she negligently filled single but she travelled to get her marriage certificate thats why she had filled in the correct status. The lady didnt believe her and cancelled her visa and also gave her a 10 years ban.
Now she wants to apply for a settlement visa but her husband doesnt even earn up to 22400 which is the financial requirment for her and her baby.
This is what i advised her to do:
First of all, you need to meet the financial requirement. It is an essential requirment for you to meet the minimum requirement. The only other way for you to beat the requirement is for you or your Hubby to have a savings of £16,000 savings. If you apply without meeting the minimum threshold, you will be rejected. The minimum threshold was put in place to reduce the ammount of immigrants coming to the UK and to prevent people from eventually seeking their stupid benefit. If your husband can't meet the minimum threshold, I suggest that you get the 16k from family. You shouldn't pay all the money in at once as that will flag that you sourced the money. A ban doesnt affect you cos it is settlement visa however, they can frustrate you and if you are not careful they can frustrate you for years and it can turn it into a legal battle. The best way to handle it is to make your application air tight. Make sure you have the test of english or that you have your certificate. Make sure you have 16k if your husband doesnt earn up to 22,400 because if you dont, they will take your application fees money and still reject you because you didnt meet the essential requirement.
Once you are sure that you have met all the essential requirement, then the next thing to do is draft a very very good letter explaining what happened. Be as sincere as possible, that you thought you had to change your name first before you could apply for a renewal. Make it heart felt that its putting an emotional strain on your marriage as you and your husband are not together and that you have a baby involved. They will be baised because of the ban but you can show how sincere you are by explaining and backing it up with proof. Add job adverts and show case that you are employable that you will get a job to support your husband. Add pictures of your wedding, baby, birth certificate of baby, time spent together(dont add a big album cos they will not collect it at vfs if it is big), emails, invitation card to your wedding, letters from family, friends attesting that your relationship with your husband is genuine.
Remember DO NOT APPLY if you dont meet the essential financial requirements because if you do you will waste 200+ on the application and even if you apeal which can take between 6-12 months, you will loose just because of the financial cash requirement problem.
Another way that you can beat the system is if your husband comes to apply for the baby so that he can get a british passport for your baby. They will do a DNA to make sure the baby is his.(He will be the one to pay for it sha) After the baby gets his passport then you can apply. That way he will only have to meet the minimum threshold of 18,600 because the baby will be exempt from immigration control being a citizen.

It will be difficult to "correct the mess" since your financial circumstances are not such that meet a visa requirement.

Given your financial circumstance, I don't see how it is possible to obtain a UK visa

Though the question might come up out of curiosity or for credibility purpose, but changing a job is a personal matter, it is not a requirement to provide reasons for leaving a previous job, so, it is none of the embassy's business

johnkent: If he's transiting through another country, he might not be allowed to board a plane. An expired passport is just as good as no passport. Just like u can't drive on an expired drivers license, u sure cant fly on a expired passport either.
Even if he is transiting through another country, he can't be stopped, no immigration authority has the legal rights to stop him from returning to his own country with expired passport.

What immigration law forbids a person from returning to his own country if he is able to prove that he is a citizen of the country?
Whether expired or not expired passport, he is entitled to return home with it;and even without a passport, it is the duty and the responsibility of Immigration officers to receive a citizen who is able to prove his/her citizenship: and expired passport is a valid proof that one is a citizen.
