Nice Topic.

Way back in the day I had to travel by road from Jos to Lagos as all flights were cancelled due to harmattan.
I travelled with a guy I'd met at the taxi park in Jos and whom I did not know from Adam. On getting to Benin
dusk was closing in and there was no way I'd get to Lagos before nightfall. The guy who lived in Benin offered me
a bed for the night in his house. Given we'd only met that day I was really touched and grateful. We continued to stay
in touch for several years, Usman thanks a lot.

If the guy applied for asylum then he would definitely have been fingerprinted. Anyone applying for asylum in Western Europe is routinely fingerprinted and the information is shared amongst all European countries. This is done primarily to stop people shopping around for the best "asylum deal" in different identities.

If he returns to Nigeria on his own passport why would he have problems from Nigerian immigration on arrival? It wouldn't be written on his forehead that he had problems in Ireland, and I'm sure he would have more sense than to tell them of his problems.

Marrying someone just so they can have immigration status is risky, supposing the marriage doesn't work out.

Naa this was definitely an EU travel document because it was what she arrived on.
At the bureau de change they asked for her passport which she didn't have so
she gave them her ID that they accepted. It was blue in colour.

I'd hardly call this an apology, it sounds more like an explanation as to what happened.
No where do they accept they were to blame for the incident.In addition their "explantion"
states that 64 of the passengers originally off-loaded later re-boarded. I was made to believe
that this wasn't the case.

Who is telling the truth?

The person will probably have to make a SAB (subject access bureau) check with the Home Office.

I remember in 1998 me and some of my  Naija guys, about seven of us(all of us held british passports) went to France via Dover to watch the Eagles play Bulgaria, that was when the eagles were truly a force. All the oyinbo wey de motor
before us and after just flashed and went. When it came to our turn them ask us to park, come down from the motor and then proceeded to check our passports one by one.

So you see it is not all good.

You say I am too bookish, well I just like to back up any disputed contention with the relevant facts where possible.

Immigration Officers make the decisions to refuse entry (its their remit based on the Immigration & Nationality Act), the Chief Immigration Officer only rubber stamps the decision made. If an IO decided to grant entry to a passenger the CIO can not reverse the decision. The CIO listens to the IO's submission and asks "what are your recommendations?" and the IO tells him "Its a refusal, because of xxxxxxx", then the CIO only says "I agree with you". This is mainly with non-visa nationals. For a visa-national to have his visa cancelled due to a change of purpose where the passenger will have no right of appeal-the IO and CIO must get an approval from the Inspector (or HMI-Her Majesty's Inspector) in principle -but they are merely rubber-stamped.

If a passenger is an elderly Grandmum or student-it is not wrong for the person to sumbit a sponsors financial details to back his application. If the applicant is working and earns an income in Nigeria, it would be seen strange for the person to submit a sponsors financial details to back his application (except he has a good explanation).

The UK law states that the Immigration Officer must be SATISFIED that the passenger is coming to the UK as a GENUINE VISITOR.If the IO is not satisfied there is nothing the CIO can do about it. The terms SATISFIED and GENUINE VISITOR are relative and depends on the person making the decision. I may be a Moderate interpreter of the law whereas another IO may be a Liberal or a Core Ultra Fundamentalist defender of the law.

With all due respect I beg to differ.

Yes the decision is made by the IO, I have not said it isn't.
However, I still believe an IO cannot refuse a passenger without
AUTHORISATION of a CIO. Call it rubber stamping if you want.
If a CIO disagrees with the decision of the IO then surely no authority will
be given.

It is all part of the checks and balances of the  decision making process
which MAY end up in the appeal process.

An Immigration officer CANNOT refuse entry to a passenger without authorisation of the Chief immigration officer.
I am sure London cool will bear me out here.

If a passenger is stopped for further investigation and a notice to that effect is served on him/her then the chief
immigration officer will again have to give authorisation before that passenger is granted entry at the end of the investigation.

Passengers not subject to further investigation, the vast majority, will be granted entry by an immigration officer
without the need of further authorisation.

All the above is fact.

I didn't say they didn't have the right. The point I was making was that the grounds for cancellation in that particular case appeared weak.
Also an Immigration officer cannot cancel or refuse a passenger without authorisation from a higher officer.Fact. wink

I'm sure it was real, however if an Immigration officer is going to cancel a visa he has to justify it in writing
and I can't see how such a officer would have justified a cancellation by saying something like;

"in your visa application form you claimed to be a housewife, however you are now claiming to be a physiotherapist, I therefore cancel your visa."

Naaa check it out Ako, there will be more to it I am certain.

I might be wrong, but surely the legal action has to be instituted in the UK, which is where the alleged wrong took place.
I can't see how a Lagos High court would have jurisdiction over an event which did not take place within its jurisdiction.
If for example a similar set of circumstances had taken place in eg Oyo state then it would be to Oyo and not Lagos the NBA would bring any action.

Anyway, I am sure the best legal minds in Nigeria are on the case so I shall observe with interest.

An interesting thread, however in the example you have given I doubt any reasonable Immigration officer
would cancel a visa for that SOLE reason. I strongly suspect that there were other issues that arose which
resulted in the cancellation.

1) Maggie was not born British. At the point of birth she's a carrier of her Mum's status. The Mum is a visa national so is Little Maggie. Maggie became a British citizen the moment Seun married SisiFunky.

2) Sisifunke is not entitled to NHS free health services. She has to pay and she did pay over £1,000. The downside was if she didnt pay BHC is likely to refuse her future visa.

3) There is a big contradiction on that day maggie's passport is to be personally collceted at passport office in St James Park.

Numbers 1 and 2 in the above statement clearly implies that people born before the 1981 act enacted in 1983 and people born post 01/07/06 are UK citizen/Uk natioanals, what is the status accorded to someone born between this period which is between 1983 and 2006?

If Maggie had the same automatic right as number 1 and 2 in your quote above, why did the law bother to change again in 2006? Why fix something that ain't broke?

She is a British citizen at birth because one of her parents is British, not solely because she was born in the UK.

2. You are correct, but in my previous post I did state I was only dealing with the scenario on the basis of how
the law currently stands. Ako did not at first even give dates for his scenario.

3. Btw 01/01/83 and 30/06/06 anyone born in the UK would only be a citizen if one of the parents was a citizen
or settled.
The law changed in July 2006 because before then if your father was a UK national but not married to your mother who was not, you would not be able to claim UK nationality.
