On the issue of contracts and terms and conditions, their terms and conditions are illegal ab initio and as such they cannot argue on the basis of it.

It's like saying because a borrower signs a contract that you can take his kidney if he fails to pay, that you can go ahead to take it. Organ harvesting is illegal and as such, that contract is illegal and unenforceable.

Loan sharks share personal information with third parties, infringe on the privacy of people who didn't take loans (this is an offence under the cybercrime act and under NITDA regulations), and shame and threaten people (also an offence under defamation laws in the criminal code). That they claim they informed customers in their terms and conditions is immaterial as those terms and conditions are illegal.
