don't sound like you know more than the national assembly members. they have done their hearing and investigations, lets wait for the report.

it could be adverse or favorable to her but one thing is clear to me, those cars have not been received or used by the ministry, the national assembly if truly they know their job and want to do it will order the cancellation of that transaction. All that will be lots is the management fee and processing fee for the facility.

How does underdeclaring your import fall into avoidance?

There are clearly breaches in the whole transaction and anyone exonerating the Minister is either naive ....being paid or doing the support on base primordial ethnic sentiments...

But where I underdeclare what I have received, it is clearly evasion.

Maduka got waivers to import ordinary cars. He then applied same waivers to specialised vehicles which are 10 times above the price of the cars which the waivers apply to. That is criminal and a theft from the treasury.

Prof Corruption: "Do the needful" is the funniest phrase ever deployed to defend Madam Oduah!

1. Would NCAA have gone ahead with the deal with only "Do the needful" on the memo? What was needed to execute the deal was an approval by the Minister. Stella Oduah gave that approval. This is not a case of NCAA executing a deal without getting an approval from the Minister. Stella has exonerated the DG of NCAA from any wrong doing, at least up to this point. "Not approved" is clearly different from "approved, do the needful".

2. Does she have powers to give that approval considering the amount involved? Minister's approval limit is N100 million, anything more than that requires approval by the Federal Executive Council. But Stella gave an approval for a deal amounting to N255 million without FEC approval. Obviously, NCAA does not have means or powers to table anything before FEC without going through the Minister of Aviation. So, Stella is still responsible for the approval she gave to NCAA.

3.It beggars belief that a Minister would approve such an amount of money without prior discussions about the deal or without an elaborate briefings on methodology of execution. You can't just approve what has not been examined to your satisfaction. You read, schedule an appointment with subordinates, ask questions (if you are not clear about anything), then approve. If you have doubts about anything, you demand such is fixed before approving the deal. But once you approved, it means you are happy with everything.

So key questions answered.
1.Stella Oduah approved the deal
2.The approval was beyond her stipulated limit.
That's clearly an abuse of office.

This investigation has also exposed Maduka as a shady business man. He lied to both Ministry of Finance and NSA on a matter that ordinarily should be straight forward. Lagos did not order armored vehicles, Ministry of Finance did not and could not approve waiver for NCAA because it did not even submit any application to that effect. Ditto for NSA. But here we are NCAA have armored cars with fraudulent NSA clearance, all thanks to Crook-Mas Maduka. That's not all. The cars supplied have different chassis number to ones quoted on invoices, which speaks volume of the extent of desperation to cover up the obvious. Hear Okonjo Iweala here:

So, if NASS did not approve the purchase, what do we call it? Extra-budgetary spending!

****. Stella approved an extra budgetary spending to the tune of N255 million which is clearly above her legal approval limit. If that's not an abuse of office, I don't know what it is.

I expect a report from NASS that indicts Stella Oduah and Maduka.


At the beginning of this controversy, people like you took a lot of pain to explain and prove that NCAA was an Agency independent of the Minister, and as such the minister must not dictate to them. Especially since the DG is appointed by the President.

Your Question 1, 2 and 3 are premised on your forgetting this fact. The Minister of Aviation has administrative authority over the NCAA, but she is not responsible for managing nor keeping the budget of NCAA. I believe the Aviation Ministry has its own Budget and keeps it, why is it not the subject of this controversy?

The minister has the duty of approving the purchase of cars as a necessity to the unit, whether it is within or outside the budget of NCAA. What she approved is the administrative decision to buy the cars. The procedure for their procurement is the responsibility of the DG of NCAA. Means the DG of NCAA has the responsibility of complying with his own budget or the requirements of his tenders board, or any other procedure for extra budgetary appropriation.

Last we checked, the cars are not registered under Oduah or the Ministry of Aviation. Their is absolutely no case against the Aviation Minister.

As for your grouse with Mr Maduka. He is a business man. He will not throw away post supplied waivers for cars he has already delivered. He will recover the tax he paid by using the waivers for other vehicle imports.
There is no law that says you cannot sell a car you imported to another person because you paid the import duty in your name.
Rather the question is that NCAA needed to apply to NSA for approval to own armoured vehicles.

hahahaha ha you are still here? Ok let me school you a lil. Coscharis did not under declare his import rather he used a tax wiever regime that is running to import the BMW. That said he can only get cautioned and ask to pay the import duty if the wiever cannot be swapped.

I was mocking you guys all along not that I like the purchase of the BMW but the one sided system you guys chose to fight corruption in your country. Partial justice is no justice. You can't find somebody guilty when he/ she is yet to face trial.

Waiver to pay duty given by the Fed Ministry of Finance exempts coy from paying duties on imported goods that already have a tariff bar.

It's been bastardized in Nigeria because of its indiscriminate use for political patronage...
