http://www.punchng.com/faleke-lacks-legal-right-file-petition-bello%e2%80%8e-tribunal/ Ade Adesomoju, Abuja The Kogi State Governorship Election Petition Tribunal sitting in Abuja ruled on Monday that the deputy governorship candidate of the All Progressives Congress in the November 21, 2015 governorship election in the state, James Falake, lacked locus standi to file petition challenging the election of the incumbent Governor Yahaya Bello. Faleke was the running mate to the APC’s original governorship candidate, the late Abubakar Audu, who was coasting to victory but died after the November 21, 2015 election was declared inconclusive by the Independent National Electoral Commission. Faleke had therefore filed his petition asking the tribunal to declare the substitution of Bello as the governorship candidate following Audu’s death in the December 6, 2015, was unlawful. He urged the tribunal to declare that the election was already conducted and concluded on November 21 before Audu’s death, and that he had already emerged as the deputy governor-elect. He therefore asked the tribunal to declare him as the valid substitute for the late Audu and should be returned as the governor-elect. But delivering its judgment on Faleke’s petition, the Justice Halima Mohammed-led three-man panel held that Faleke lacked legal right to file the petition after upholding Bello’s preliminary objection against it. The tribunal upheld the objection but decided to still go ahead to decide the petition on merit. It upheld Bello’s objection to the effect that Faleke lacked locus standi to file the petition having not been the governorship candidate upon the conclusion of the election on December 6, 2015. It held that it was clear that Faleke was not nominated by its party, the APC, but instead the party nominated Bello as Audu’s replacement. The tribunal said it lacked the jurisdiction to question internal process of the party leading to the nomination for Audu’s replacement. It held that contrary to Faleke’s contention, the election had the November 21 poll had not been concluded and thus the right to challenge the outcome of the poll had not accrued to him going by the provisions of the Electoral Act. Meanwhile, the tribunal is still considering the merit of the entire petition. |
http://thenationonlineng.net/bianca-kicks-ojukwus-second-child-applies-join-property-battle/ The widow of the late Ikemba of Nnewi, Chukwuemeka Odumegwu Ojukwu, Bianca, has opposed an application by her husband’s son, seeking to be joined as a defendant in a suit she filed against the family over property. Emeka Odumegwu Ojukwu Jr., Ojukwu’s second child, filed the application dated May 24, before Justice Abdulfattah Lawal of the Lagos State High Court, Igbosere, seeking to be joined alongside Ojukwu Transport Limited (OTL) and seven others. Bianca had on behalf of her two under-aged children, Afamefuna and Nwachukwu (claimants), sued Ojukwu Transport Limited (OTL) and seven others over an alleged threat by the family to eject them from the company’s properties in Lagos. OTL was established by the late Biafran leader’s father, Sir Louis Ojukwu. In his application, Ojukwu Jr. prayed the court to join him on the grounds that he is a director in OTL and by virtue of his position has responsibility to look after the interest of the other children of his late father. He averred that the claimants in the suit are the last two of the eight children of his late father and they are represented by their mother who was the last of the six wives of his late father. The son of the late Biafran warlord prayed the court to join him as defendant in the “best interest of justice.” He added that any decision in respect of the claims of Bianca’s two children in the suit so far as it relates to his father’s interest in OTL “will affect me as the current head of the late Dim Chukwuemeka Ojukwu’s family.” However, in a 12-paragraph counter affidavit, Bianca’s children opposed their elder brother’s application. They averred that they have no claim or relief whatsoever against him in the suit and that that the suit can be duly and properly determined without their elder brother as a defendant. The claimant said the application was only a ploy to delay and scuttle the hearing and determination of the suit. Other defendants in the suit are Prof. Joseph Ojukwu, Emmanuel Ojukwu, Lotanna Putalora Ojukwu, Dr. Patrick Ojukwu, Edward Ojukwu, Lota Akajiora Ojukwu and Mrs. Massey Udegbe (doing business under Massey Udegbe & Company). In their statement of claim, Bianca, and her two children are praying the court to declare that the alleged threat of forcible ejection from 29, Oyinkan Abayomi Street, Ikoyi, by the defendants as illegal. They are asking the court for a declaration that her children are entitled to possess the following property: No. 13 Hawksworth Road, Ikoyi (now known as No. 13 Ojora Road; No. 32A Commercial Avenue, Yaba, Lagos; No. 30 Gerard Road, Ikoyi, Lagos and No. 30 McPherson Avenue, Ikoyi. According to them, the properties were under the possession of the late Chukwuemeka Odimegwu Ojukwu, the father of the claimants, from the time the properties were released from government acquisition till date. The claimants stated that throughout the period their father was fought to retrieve the properties from the government, the second to seventh defendants “never played any role in the struggle nor contributed financially or otherwise to the realisation of the struggle.” Justice Lawal will hear the argument for the application on September 14. |

http://www.dailytrust.com.ng/news/general/efcc-will-soon-move-to-petroleum-industry-magu/132815.html The ongoing fight against corruption by the Economic and Financial Crimes Commission (EFCC) will soon move into the petroleum industry as all preliminary investigations have been concluded, acting chairman of the commission, Ibrahim Magu said yesterday. He said towards strengthening the crusade, the anti-graft agency planned to recruit additional 750 different cadre of staff this year that will add to the core work of the commission. The EFCC boss revealed this when he appeared before the House of Representatives financial crimes committee to defend the 2016 budget proposal. Magu was reacting when asked by Rep Razak Atunwa (APC, Kwara) if the agency would l go after the former minister of Petroleum Resources, Diezani Allison-Madueke, Kola Aluko, former Finance Minister Dr. Ngozi Okonjo-Iweala; and some oil companies in its ongoing fight. But he wasn’t specific in his response, as he only replied that “very soon, we will go into the petroleum industry.” On the EFCC’s 2016 budget, Magu bemoaned that a slash to the commission’s allocation of N1.60 billion may undermine the ongoing operations. He said the ministry of Budget and National Planning had reduced the agency’s overhead cost for 2016 from the proposed N2,999 billion to N1,389 billion which could affect corruption crusade. EFCC, according to him, currently faces space constraints due to the inability to complete its permanent headquarters, which results to payment of high rent rate, dearth of adequate manpower and operational vehicles. Members of the committee however assured the EFCC boss of their readiness to support the agency in its fight against corruption and vote enough funds for the completion of its permanent office. |
http://thenationonlineng.net/dangote-slashes-cement-price/ As a result of its economy of scale occasioned by the recent introduction of new production lines in Okpella Edo State and Itori in Ogun State worth nine million metric tonnes, Dangote cement has slashed the price of its cement varieties. In a statement, the firm stated that the price cut from N1800 to N1300 was to ensure the product is affordable to all segment of users. Speaking in Umahia, the Abia State capital during a national meeting of the National Association of Block Moulders of Nigeria (NABMON), Regional Sales Director, Dangote Cement, Johnson Olaniyi, stated that Dangote Cement considered incessant building collapse as an indictment on all sector operators hence his company’s resolve to continue the collaboration with all so as to tackle the menace. While assuring that Dangote Cement would continue to ensure that block moulders have access to its quality cement as part of its contribution to the war against building collapse, the Sales Director further stated that the company reduced the price of its cement from N1800- N1300 to enable Nigerians have unhindered access to the product. |

http://thenationonlineng.net/supreme-court-judgement-stop-deceiving-nigerians-chris-uba-tells-brother/ The controversy generated by last Friday’s judgement of the Supreme Court recognizing the Ejike Oguebego faction of the Peoples Democratic Party in Anambra State and sacking Senators Andy Uba and Stella Oduah from the senate is taking a new dimension as Chris Uba has asked his brother and others to stop deceiving Nigerians and vacate their seats in the National Assembly honorably. Chris Uba also declared himself as the Senator representing Anambra South in the Senate, pointing out that he will be leading other beneficiaries of the judgement to INEC on Monday to demand their certificate of return. Uba who was the candidate of the PDP for the election was replaced by his elder brother following a decision by the Court of Appeal which set aside the decision of the lower court. Speaking with newsmen in Abuja, Chief Uba warned his brother, Senator Andy Uba, Ms. Stella Oduah and others to stop parading themselves as representatives of the people of Anambra state in the National Assembly. He said that last Friday’s judgment by the Supreme Court which affirmed an earlier High Court verdict recognising the Oguebego executive as the state’s authentic leadership, advised the affected ‘former’ senators and House Representatives members to accept their fate and honourably step down. He said he would be leading other members of the party who emerged as candidates under the Oguebego monitored primaries to the office of the Independent National Electoral Commission on Monday to demand for their certificates of return. Andy Uba and Oduah had faulted the assumptions that the Supreme Court judgment effectively removed them from office, arguing that they were not party in the suit which basically had to deal with issues of leadership crisis in Anambra PDP. Chris, who described himself as “Senator representing Anambra South” said he was shocked that those who should be conversant with the laws of the land could be deceiving the public regarding their true status after the Supreme Court failed to recognise the dubious way through which they got to the Senate. He said: “The time for substitution had passed and we were busy doing our campaigns when, one week to the election, the Andy Uba faction went to the Court of Appeal and set aside the judgement of the High Court. “Based on that, they took the judgement to INEC and their names were used to substitute our own. We cried foul then, insisting we were not party to the suit but INEC insisted that our names were initially published based on an earlier court order and that we should go on appeal. “We appealed to the Supreme Court and the verdict on Friday clearly vindicated our position as the Supreme Court set aside that judgement of the Court of Appeal, agreed with the judgement of the High Court and even granted all our five prayers. “Now, they (Chris Uba and Oduah) went on air and issued press statements to deceive the public that the order from the Supreme Court did not affect them because they were not a party to the suit. The question is: when our names were removed by INEC and replaced with theirs, were we party to the suit? “Now they are shouting and trying to misinterpret a clear judgment that has removed them and given us victory. They are just deceiving the public. We will demand for our certificates of return from INEC on Monday because the judgement is clear. We do not need to seek for any further clarifications.” Uba said further: “When the whole exercise wanted to start, INEC wrote a letter to the PDP headquarters to avoid confusion, telling the PDP that the Ejike Oguebego exco was the one that it would recognise based on court order of a Federal High Court in Abuja. “Unfortunately, the PDP ignored that letter and, instead, set up a two-man caretaker committee to come to Anambra State to conduct primaries. Of course, there was no room for that caretaker committee to operate in the state because the key to conducting the primaries is the 3-man delegates from the 326 wards in the state. “It was obvious that without the state exco, the caretaker committee cannot be functional because the people who are supposed to organise the state congress were expected to liaise with the state chairman. From there, they would set up a committee to go to all the wards where the delegates would emerge from for electing candidates into the National and state assemblies. “So when they set up this caretaker, the Ejike Oguebego exco went to court and got a judgement recognising it as the right exco therefore making null and void the caretaker committee. “The judgment also instructed INEC and the PDP to conduct all the electioneering exercise under the Ejike Oguebego exco including all the candidates who were participating. So, we obeyed the court order and did our primaries as instructed. The exercise was duly monitored by INEC and all the relevant papers were signed.” He said it would amount to injustice if the court had ruled in favour of the other group comprising Andy Uba, Stella Oduah and others who allegedly did not undergo any primaries nor visited Anambra. “They just sat in their houses in Abuja. INEC and the PDP got copies of the results of our primaries and even sent our names to INEC and that was why the list containing our names was published as candidates before they went through the backdoor to remove it,” he stated. |
