The Association of Nigerian Electricity Distributors (ANED) on Thursday said that it has appealed against the judgment of a Lagos Federal High Court annulling the 45 per cent electricity tariff hike.

Mr Sunday Oduntan, the Executive Director of ANED, announced the decision in a telephone interview with the News Agency of Nigeria (NAN) in Lagos. ANED is the association of the 11 Electricity Distribution Companies (DISCOs) operating in Nigeria.

NAN reports that on July 13, a Federal High Court in Lagos annulled the recent increase in electricity tariff announced by the Nigerian Electricity Regulatory Commission (NERC). Justice Mohammed Idris made the pronouncement while delivering judgment in a suit filed by a human rights lawyer, Mr Toluwani Adebiyi, challenging the increment.

The judge described NERC’s action as being ultra vires, irrational, irregular and illegal. Oduntan said the association had appealed against the ruling and would pursue the judgment to the Supreme Court for justice to be done. “We have appealed against the ruling and asked for a stay of execution now. “I can assure you that as a legal luminary, we will not stop until we get justice. “If the Appeal Court judgment is not favourable, we will pursue the case to the Supreme Court which is the highest court in the land, so there is no cause for alarm,’’ he said.

On Dec. 15, 2015, NERC announced a new electricity tariffs for all class of consumers, which became effective on Feb.1, 2016. The directive also abolished the contentious fixed charges for all electricity consumers nationwide.

A Federal High Court in Lagos on Wednesday entered judgment against the National Electricity Regulation Commission and electricity distribution companies in a suit opposing the Federal Government’s bid to increase electricity tariff.

Justice Mohammed Idris declared as null and void any hike in electricity tariff that did not comply with the provisions of the Electricity Power Sector Reform Act 2004.

The judge declared the decision of the defendants to embark on electricity tariff hike as hasty and ordered immediate reversal to the status quo.

He also awarded a cost of N50,000 against the respondents in favour of the plaintiff in the suit.

The suit was filed last year May by a Lagos-based lawyer, Toluwani Adebiyi, following announcement of proposed electricity tariff hike by the then Chairman of NERC, Dr. Sam Amadi.

Adebiyi had urged the court to stop any hike in electricity tariff until there had been a meaningful and significant improvement in power supply to at least 18 hours in a day in most Nigerian communities.

Justice Idris had since May 28, 2015 restrained NERC from giving effect to the proposed hike pending the determination of the suit.

In his final judgment in the suit on Wednesday, the judge berated the commission for embarking on the proposed tariff hike despite the court order.

“The upward increment in tariff was hasty and procedurally ultra vires. The review was done in a breach of existing order. This again was hasty, reckless and irresponsible. The court has the inherent jurisdiction to undo what has been done by a party in self-help.

“The increment in tariff by the 1st defendant, while parties were before the court and there was a subsisting order for status quo, is hereby declared illegal.

“The 1st defendant is hereby directed to reverse to status quo. The 1st defendant is further restrained from increasing the electricity tariff except in strict compliance of the provisions EPSRA and the procedures stipulated in section 76 of the EPSRA.

“N50,000 cost is awarded against the defendants in favour of the plaintiff. That is the judgment of the court,” the judge held.

He declared the electricity tariff hike and procedural and rebuked NERC for he declared as executive recklessness, which he said could only breed lawlessness.

Attorney General Malami “defends” forgery suit against Saraki, Ekweremadu


The Attorney-General of the Federation, Abubakar Malami, on Wednesday, appeared before the Senate Committee on Judiciary, Human Rights and Legal Matters, to defend the government’s forgery charges against the senate president, Bukola Saraki, and deputy, Ike Ekweremadu.
Mr. Malami was summoned by the Senate on June 21, to “explain and justify with evidence” the basis for the charges against Messrs. Saraki and Ekweremadu. The two lawmakers are accused of conspiring with two National Assembly to forge the Senate’s rules.

Mr. Malami appeared after repeatedly failing to honour the senate’s summons.

At the hearing, the chairman of the Senate committee, David Umaru, and other members, asked Mr. Malami if he acted in the public interest and without abuse of his office.

A member of the committee, Joshua Lidani, said there was an issue of conflict of interest as Mr. Malami was the lawyer representing senators who were aggrieved with Mr. Saraki’s election. Those senators filed the complaint accusing Mr. Saraki and his deputy of falsifying the senate rule.

Mr. Malami denied bias, and said the case predated his appointment as minister on November 12, 2015.
The minister said the investigation was concluded four months before his appointment, and that he was duty bound to continue with the matter.
“I only inherited a concluded investigative report,” said Mr. Malami.

Quoting the Senate Order, Mr. Malami reminded the Senators that a matter in court should not be entertained by the legislative body.
Asked why Messrs. Saraki and Ekweremadu were not questioned during investigations before the matter went to court, and why the two senators were charged when their names were not mentioned in the proof of evidence, the attorney general said he could not comment as he was a party in a case.

The Senators said the Constitution empowers the Senate to regulate its internal affairs, including the matters arising from the controversial Senate Rules.

Defending the “amendment” of the 2015 Rules, a committee member, Chukwuma Utazi, said “I wish to refer the AGF to Section 64 (1)”which dissolves the Parliament after 4 years”.

He said Rules stood invalid at the end of the session and the Senate could amend the document handed to them by the bureaucracy.
But Mr. Malami said the alteration of Senate Rules, 2015 did not conform to valid procedures, insisting and that an offence was committed in the process.

In the police report exclusively published by PREMIUM TIMES, the Criminal Intelligence and Investigation Department, found that the Senate Rules used to inaugurate the Senate did follow the procedures stipulated in the Section 110 of the 2011 Rules, “the extant Standing Rules”.
Without direct reference to the CIID report, Mr. Malami told the Senators the “amendment” of the 2015 Senate Order did not follow the legally valid procedure.

The minister of Justice said that “a Standing Rule that has not been deliberated and voted on by the Senate, cannot be the Standing Rule”.
He said the criminal case was filed to curb “abuse institutional governing documents”.

Drawing from antecedents, he noted that when there was a need to amend the Senate Rules in May 2011, there was a process of deliberation that followed the stipulated procedure.

Babajide Omoworare (APC-Osun) made comment that caused division at the hearing.

“This session is an entire waste of our time,” Mr. Omoworare said, opposing his colleagues’ emphasis on the forgery suit against Messrs Saraki and Ekweremadu. “I am not bothered about the matter in court.”

He said the law should take its course.

However, like Ovie Omo-Agege (LP-Delta), Mr. Omoworare said the Senate expected apology from Mr. Malami for shunning the Senate’s summon earlier.

The minister refused to apologize.

He however said he had regard for the senate and he was known for honouring institutional invitations.
Earlier in his remark, Mr. Umaru said the hearing was convened not because of the matter in court but to ensure there was no abuse of office.
“We are only concerned with how the AGF exercises his powers,” he said. “Did he take into account public interest?”

No plan to increase electricity tariff, says NERC

The Nigerian Electricity Regulatory Commission (NERC) on Tuesday denied reports that there were plans to increase power tariffs across the country.

Six months ago, NERC increased electricity tariffs for different categories of consumers by over 45 per cent, but it denied doing so this time around because of the prevailing economic situation in the country.

It also stated that none of the operators in the industry was pressing for an increase in tariffs, adding that it had not received any application to that effect.



This is coming as the Nigerian National Petroleum Corporation assured operators in the power sector that by September this year, it would have completed the repair of vandalised pipelines supplying gas to the power plants.

Reacting to a media report (not The PUNCH) that the power firms had made a request for 100 per cent increase in tariffs, NERC said in a statement issued in Abuja on Tuesday, “The Nigerian electricity supply industry is not contemplating any tariff increase as none of the industry operators is pressing for 100 per cent increase in electricity tariff. This clarification is coming on the heels of a speculative media report that created the impression that NERC is considering applications from electricity distribution companies for 100 per cent increase in electricity tariff.

“Contrary to this report, NERC has not received any request for 100 per cent increase in tariff from any electricity industry operator as most of them are at this moment preoccupied with the challenges of improvement in service delivery imposed on them by the existing tariff regime.

“The commission as well as the industry is responsible enough to appreciate the state of the economy, level of power generation, how Nigerians are coping and would, therefore, not make any decision that could further aggravate the challenges faced by the power sector and the economy.”

On the completion of gas pipelines, the Federal Ministry of Power, Works and Housing, in a communique issued on Tuesday after the seventh monthly meeting of the minister with operators in the power sector, stated that the national oil firm assured stakeholders that it would support the industry by making gas readily available once the infrastructure was fixed.

It stated, “The NNPC acknowledged the current gas constraints to the power sector and assured consumers of steps to improve gas supply to power plants, which include restoring previous supply levels by completing repairs to vandalised pipelines by September 2016.

“The NNPC also discussed new supply additions from alternative sources as well as improving the readiness of power plants to receive gas, which should improve power supply in the country.”

The Minister of Power, Works and Housing, Babatunde Fashola, according to the communique, revealed some developments towards achieving incremental power for the country during the meeting.

Some of these include the recent Power Purchase Agreements that were signed to provide solar power from 12 companies, which should add almost 1,000 megawatts of electricity after implementation in coming years.

He also noted that the Azura power plant construction was on schedule and when completed, it would add 450MW of electricity to the national grid.

Nice! Lots of illiterates on this forum. I can remember vividly when PMB stated that NCC was one of the revenue generating agencies in Nigeria.

The IPOB has also failed to inform Igbos about the sort of government and constitution that the proposed state of Biafra will operate. How will the leaders of the proposed state be chosen? Will it run as a monarchy, a parliamentary system or a presidential executive? Where will its capital be located and will it be a secular state? The association has also failed to tell Ndị Igbo how the economy of the new state will be sustained…


The United Nations, under its declaration of rights of indigenous people, provides citizens of member states with the right to self-determination. This right empowers every citizen to agitate for the separation of his or her region from a recognised or sovereign nation that it belongs to but which is hindering its well-being, due to political and other considerations. However, that right is not absolute as it comes with some conditions. One of those conditions is that any region that wants to enforce the provisions of the declaration must be able to prove that it is a victim of continuous persecution and established discrimination by the present state it is in. Whether the Igbo has experienced such will be a topic for another day.

Before I proceed, I want to make it clear that I am fully in support of the declaration of the rights of indigenous people but I will never encourage or support anybody or group of persons to twist the provisions of the UN declaration in order to satisfy their selfish interests.

Nnamdi Kanu, a London based dual citizen of the United Kingdom and Nigeria formed an association that addresses itself as the Indigenous People of Biafra (IPOB). This operated a faulty set of assumptions from the outset, and if I may ask: Who are the Indigenous People that Kanu claims to be leading? Who did he consult before establishing such association and who elected its executives to speak for the proposed state of Biafra? From facts available, IPOB was formed by Kanu and some other Igbos residing in London. The group also went ahead and established an underground radio station which ended up as a tool for spreading hate, falsehoods and unnecessary propaganda. I earlier wrote about the evil acts of the pirate radio, wherein I raised an alarm over the rate at which the IPOB had been using the pirate radio to poison the minds of misinformed Igbos and inciting hatred against people of other nationalities, while broadcasting falsehoods. But it was unfortunate that the government failed to promptly and effectively take action by jamming the radio’s signal on Nigerian airwaves, leading to the pollution of minds that became ready to commit suicide in the streets in the name of agitations for Biafra. I have written extensively on the acts of the pirate radio station and will now focus on the funny and deceitful acts of IPOB.

For any act of self-determination to be successful, intelligent diplomacy must be employed. However, instead of trying this out, IPOB sought to adopt the strategy of utilising touts and hoodlums. The IPOB leadership should have known that today’s United Nations would not be ready to listen to any group that refuses to employ dialogue or diplomacy in its activities. Any separatist group should know that its agenda will not be achieved without the peaceful cooperation of its present state or government. Even though there is no relationship between the controversial Brexit and the secessionist motive of IPOB, that should have taught the group that dialogue and diplomacy are key tools for achieving any separation agenda.



Instead of conducting an opinion poll in the Niger Delta region to ascertain their stand on Biafra, IPOB delights in claiming that Ijaws are their brothers and that there is nothing like Niger Delta… Yet, the militants either address themselves as Niger Delta Peoples Volunteer Force, Niger Delta Avengers, Movement for the Emancipation of the Niger Delta, etc. without any of the groups attaching ‘Biafra’ to its name.



Rather than employing the required diplomatic techniques, IPOB delights in insulting persons and institutions that are supposed to be its best friends. This association insults Igbo elders, Igbo traditional rulers, South-East governors, and South-East Senators and the region’s representatives at the federal House of Representatives. It insults the Nigerian government and addresses Nigeria as a zoo, insults an elected president and addresses him as a pedophile, insults America, the United Kingdom, other world powers and even the United Nations and addresses them as enemies of Biafra. If you insult the whole world, who do you think that will push for a referendum for you? According to IPOB, Biafra will be the last miracle to happen on earth and that the miracle will be achieved without the support of the world. What a ridiculous assertion!

The most funny part is that since it’s formation, IPOB has never organised a general conference in the South-East region to discuss its objectives and plans that it has put in place to successfully manage the proposed state of Biafra but rather, it keeps insulting everybody and threatening the sovereignty of the Federal Republic of Nigeria. Someone should please tell the IPOB that the United Nations does not joke with the territorial integrity and sovereignty of member nations. Also, IPOB is yet to tell Igbos living in other parts of Nigeria the plan it has to ensure that their investments outside Igboland will be protected if the proposed state of Biafra is achieved but instead of doing so, it uses its pirate radio station to insult them by addressing them as fools, baboons and monkeys that deserve to die because they failed to live in Igboland. Rather interestingly, the pirate radio station was not even established in Igboland but in far away London and non of the people operating it are living in Igboland. IPOB should better know that the world is a global village and no nation will ever prefer to live alone.

The IPOB has also failed to inform Igbos about the sort of government and constitution that the proposed state of Biafra will operate. How will the leaders of the proposed state be chosen? Will it run as a monarchy, a parliamentary system or a presidential executive? Where will its capital be located and will it be a secular state? The association has also failed to tell Ndị Igbo how the economy of the new state will be sustained, and till now it is not even clear if the Niger-Delta region will be part of the proposed state because the region may not afford to be a slave in their land anymore, as it experienced during the Nigerian civil war when Dim Chukwuemeka Odumegwu Ojukwu forced the Niger Delta region into the Biafran state, with that forced marriage being one of the major reasons why the Biafran cause under Ojukwu was sabotaged. Instead of conducting an opinion poll in the Niger Delta region to ascertain their stand on Biafra, IPOB delights in claiming that Ijaws are their brothers and that there is nothing like Niger Delta, while commending all the criminal acts perpetrated in the region by militants. Yet, the militants either address themselves as Niger Delta Peoples Volunteer Force, Niger Delta Avengers, Movement for the Emancipation of the Niger Delta, etc. without any of the groups attaching ‘Biafra’ to its name.



If one had followed Nnamdi Kanu closely before he was arrested, one would think that he chats with Obama every other hour, yet his arrest and events after this have showed that him as merely seeking to cash in on the sentiments of his Igbo brothers over the loss of former President Jonathan at the poll in order to cause confusion and threaten the peace of the land, with the hope of getting some payment from government.





Moreover, the IPOB fails to understand that this ought to be a period for it for grassroots campaigns and professional lobbying at both the National Assembly and the United Nations, but rather than lobbying relevant stakeholders and authorities to push for a referendum, IPOB is insulting everyone and deceiving misinformed youths into committing suicide in the streets with the hope that the world is watching and will always protect, as its pirate radio usually lies to the people. For Goodness’ sake, why would a person stay away in London and instruct his brothers and sisters to celebrate the independence of a non-existing state inside the territory of a sovereign state? Not only that the IPOB leadership gave such deceitful order, it also encouraged youths to fight back the security forces if they try to stop them, and such evil and illegal instruction led to the throwing of two policemen inside the River Niger by some IPOB protesters, consequently leading to the unfortunate deaths of some protesters on May 30, 2016. The blood of the misinformed youths that died in Onitsha and Nkpor on that day will continue to be on the heads of IPOB executives, namely Uche Mefor, Emma Mmezu and Mr. Iroanya who stayed far away and ordered young bloods through radio Biafra to go and commit suicide in the name of a Biafran independence day celebration.

Also, before he was arrested, Nnamdi Kanu, not only claimed that he had the support and backing of 88 countries through the Radio Biafra, but also that the zoo would fall if he is arrested, but where is him today? IPOB has been releasing a lot of lies to misinformed Igbos and have been deceiving them through its pirate radio to believe that they are employing professionals around the world that will ensure the speedy achievement of the Biafran state. This is why many Igbos are paying monthly dues to the ridiculous association and thereby enriching Nnamdi Kanu and other IPOB executives. What a fraud! No wonder why many address them as Biafrauds. If one had followed Nnamdi Kanu closely before he was arrested, one would think that he chats with Obama every other hour, yet his arrest and events after this have showed that him as merely seeking to cash in on the sentiments of his Igbo brothers over the loss of former President Jonathan at the poll in order to cause confusion and threaten the peace of the land, with the hope of getting some payment from government.

Igbos should know that IPOB is the greatest enemy of Biafra and people should see the association as a group of fraudsters and upcoming terrorists, which is why the world refuses to act on their claims and will never discuss the Biafran referendum as long as the association is concerned. If the dead and buried Biafra should be resurrected, it will certainly not be under Nnamdi Kanu or the unstructured and fraudulent IPOB. Rather, a disciplined and well structured group should take charge.

You guys need to chill and give the President a chance. Stop this unnecessary suspicion. If the news had been, that the airforce is building a permanent base in Kano, I can imagine what people like u will say.

I can imagine the abuses and sarcasms you will utter. Now that the case is that it is being constructed in Enugu, you are still insinuating and making unfavourable conjectures. You guys are unbelievable!

Of course I have seen the map of the proposed railway. If you are looking at it superficially, and from a layman's perspective, you'll conclude that it is not supposed to pass through Aba and Onitsha.

But the railway is not a decoration. It is to transport goods and persons and foster economic growth.

On this basis therefore, it makes so much sense to ensure it passes through the highly economic cities of Aba and Onitsha. And the proponents of the project has confirmed to us that the route will include these two cities. I don't really know why you have an issue with that.

If they didn't make those cities to be part of the train route, you'll have a conspiracy theory to Web on divide and rule through the instrumentality of the SS states, now that it is clearly stated that the cities are part of the route, you still have something to say. undecided undecided

How will a permanent air base contribute to the economy of South East?

Why not enugu/Onitsha expressway, and that of enugu/porthacourt, why not the coal fired power plant he promised during the campaign, why not the expansion of owerri cargo airport why not the inland port at Onitsha and aba. Etc

All the projects you mentioned are worthy and viable projects which the Fg has considered. But you must be highly shortsighted to think they can all be done at once.

The road projects were covered in this year's budget including the 2nd Niger bridge.

You seem to deliberately claim ignorance of the rail project which will transverse notables SS states including Aba & Onitsha.

God will definitely keep PMB alive to see the success of all Nigerian ethnic groups including the Igbos.

NAF begins construction of permanent base in Enugu


The Nigerian Air Force (NAF) on Saturday said work has commenced on the construction of a permanent base for officers and men in Emene near Enugu metropolis.

The Commander, NAF Base Services Group, Enugu, Air Commodore Ebenezer Alade, told the News Agency of Nigeria (NAN) in Enugu that the move would further boost the morale of officers in Enugu.

Alade commended President Muhammadu Buhari and the Chief of Air Staff (CAS), Air Marshal Sadique Abubakar, for the special attention given to NAF officers and men in Enugu.

“The vision of the Chief of the Air Staff, Air Marshal Sadique Abubakar, is being felt in all units and formations of the NAF, and for us in Enugu, we bear testimony of that vision.

“We are all excited about the construction of our permanent base in Emene near Enugu.

“We are also happy that Enugu has become a re-occurring decimal in the agenda of the Chief of the Air Staff,” the NAF commander told NAN.

Alade, who, however, did not mention the cost of the ongoing project, said a team of officers from NAF headquarters recently inspected sports facilities in Enugu toward the conduct of NAF Games later in the year.

“All these are pointers to the strategic importance of Enugu to the NAF family,” he added.

How I wish Ajaokuta steel and Delta steel can actually be brought to life. We've heard too many back and forth stories over these projects, it becomes difficult to be hopefull about them these days.

Without recourse to the earlier agreements?

1. That will dent our image in the international business community.

2. The parties will go to court. Naija court will order maintenance of status quo until determination of the substantive issue. The court case will then linger for years until everyone gets weary. And the place definitely will lie idle during the years of legal battle.

That is exactlyctly what is happening now. Everybody is tired and the govt of the day is seeking a out of court settlement.

Read the news again. We are trying to take the company back from them. The company has already been concessioned to them since. Taking it back from them has been entrenched in a myriad of knotty legal issues.

That is the problem of Nigeria, we just go into agreements without proper scrutiny, only to realize later that the agreement was not profitable to the country.

Withdrawal from those agreements usually cost the country a lot financially, time-wise, business goodwill, reputation and cost of legal battles.

And one thing people always fail to detect in these failed endeavors are usually those that sell us out due to selfish vested interests. There are usually sell-outs who cash in on the complexities to selfishly make something for themselves and their families at the expense of the country. Until we follow the Chinese way of dealing with these economic saboteurs, our journey will be long.

Back to the matter, Nigeria is looking at the most cost effective way of taking th company back from the Indians. And from the above, I think the plan is to allow them have the ore processing unit instead of leaving them with empty hands.

We can't just leave them with empty hands, there will be consequences. We had our eyes opened when we earlier got ourselves into the mess.

But I just hope with the ore producing unit firmly in their hands, they won't blackmail the steel plant later in the future by starving them of raw materials.
