A Nigerian community from the oil-rich Niger Delta has filed a lawsuit in the United States seeking $1 billion in compensation from Anglo-Dutch oil major Shell for decades of pollution caused by oil spills.

Last week the U.S. Supreme Court agreed to decide if companies can be held liable in the United States for international human rights law violations.

The decision was related to a case involving allegations that Shell helped Nigeria violently suppress oil exploration protests in the 1990s.

The $1 billion compensation case was filed at a court in Detroit last week, citing the U.S. Alien Tort Statue law, which dates back from 1789. It has been used in the past to charge companies in the United States for breaches of international law.

The suit was brought on behalf of the people of Ogale in the Eleme local government area, where a United Nations environmental report earlier this year found people drinking water contaminated with carcinogens at 900 times the World Health Organization's safety limit.

"(Shell operates) well below internationally recognized standards to prevent and control pipeline oil spills , (the company) has not employed the best available technology and practices that they use elsewhere in the world," the case against the oil major said.

Shell declined to comment. It has said in the past that the majority of oil spills in the Niger Delta are caused by oil theft and sabotage to its facilities but it clears up spills whatever the cause as quickly as possible.

The U.N. report recommended that Ogoniland, one section of the oil-rich Niger Delta wetlands region, required the world's largest ever oil spill clean-up. It said it would cost an initial $1 billion and could take up to 30 years.

The U.N. paper was critical of both Shell and the state-owned oil firm NNPC for not cleaning up oil spills and for not operating their own best practises while working in the winding creeks and waterways of the delta.

Shell has been reducing its focus on onshore Nigeria in recent years, selling fields, following difficulties in the delta.

ADO-EKITI—Hausa community in Ekiti State has appealed Governor Kayode Fayemi to consider members for appointment in his cabinet to make the group have a sense of belonging in the state.

Operating under the umbrella of Arewa Community in Ekiti State, the group argued that most of its members were born in the state, while others have been resident for between 30 and 40 years.

Speaking in Ado-Ekiti, the leader of Hausa Community in Ekiti, Alhaji Adamu Lima, urged Fayemi to emulate his colleague in Lagos State, Mr Babatunde Raji Fasola who appointed non indigenes into his cabinet.

He condemned the level of carnage being perpetrated by members of the Boko Haram sect and called on the group to shield their swords in the interest of peace.

The community reminded the governor of the promise he made in 2007 during his electioneering campaign that he would consider members for political appointment if he became the governor.

The group recounted of members positive contribution to the development of the state, saying a political appointment would further cement the already cordial relationship existing between them and the state government

Ekiti State Government has ejected over 30 physically challenged Deltans in their various special educational institutions, it was learnt yesterday in Asaba, Delta State capital. The government, it was said, took the decision due to the huge fund being spent on their welfare which it claimed was eating deep into the state lean resources.

Besides, the governments of Edo, Lagos and Kwara states were said to be warming up to emulate the action of Ekiti State as physically challenged were said to have taken special education institutions in these states.
National President of the Nigeria Association of Special Education Teachers (NASET), Dr. Joseph Okuoyibo stated this in Asaba at a press briefing ahead of the 23rd Annual Conference and Workshop of the association which starts today.
Dr. Okuoyibo also decried the attitude of some state governments for not implementing the 30% special allowance approved by the Federal Government for the special teachers, adding that the teachers were also being deprived of other incentives for motivation.

Delta State chairman of NASET, Dr. (Mrs.) Catherine Onwubolu, attributed the migration of physically challenged Deltans to other states for education due to the dilapidated nature of infrastructures at special education institutions across the state and called on the government to pay adequate attention to the sector.

She emphasized that the environments of such institutions were not friendly to those who expected to make use of the decrepit infrastructures, adding that the state only recently implemented the payment of 15% special allowance for the secondary school special teachers only.

“I wept for Delta State when I moved round all the schools for the physically challenged. Like in the state capital, Asaba, Agbor, Ughelli and other areas, the state could not boast of good infrastructures for the learning of these children what a shame,” she lamented.
Ekiti State chairman of NASET, Alhaji Lawal Ganiyu, bemoaned the inability of Delta State Government to take responsibilities of its physically challenged persons whom he said were scattered all over the country and were being catered for by other states government.

Commissioner for Education and Human Capital Development in Kwara State, Mallam Raji Mohammed, has said 13,000 students in Senior Secondary School (SSS) 2 will not be promoted to the next class, because they did not qualify for promotion.

The commissioner, in a release issued on Monday and made available to journalists in Ilorin, said the affected students could not pass English and Mathematics, adding that they were also unable to make other requirements.

Mallam Mohammed also said the state government would pay the National Examinations Council (NECO) fees for 7,000 candidates with five credit passes and above, including in English and Mathematics.

The commissioner, who said that 42 per cent of the 31,590 candidates who sat for this year’s promotion examinations in SS2 were expected to repeat the class, added that the state government was determined to improve the quality of education.

He charged teachers to work towards increasing the number of students with five credits, including English and Mathematics, in both West African School Certificate (WASC) and NECO examinations.

Mallam Mohammed said evidence of all the efforts of the state government to raise the quality of education would show in the significant improvement in the results of students in both internal and external examinations.

NIGERIA'S Powerlifter, Loveline Obiji has set a new world record in 82kg with the lift of 137kg in the female category of the event held in Morocco during the London 2012 Paralympics Games qualifiers.

Also,the athlete who picked the Paralympics ticket broke the existing junior world record of 120kg in 82kg with a lift of 136kg before she set the new record of 137kg in the same event.


Samuel Ekoma, technical director, Powerlifting Federation of Nigeria in a text message to Tribunesports informed that Precious Orji also qualified for the London 2012 Paralympics winning gold medal in 82kg during the qualifier.


Ekoma, stated further that the two gold medalists will join the earlier eight powerlifters that have picked the Paralympics tickets during the qualifier held in United Arab Emirates in February this year.


While speaking with Tribunesports on phone Monday, the national coach, Powerlifting Federation of Nigeria, Are Feyisetan expressed happiness with feat in Morocco assured that the country's team will excel at the games proper in London next year, adding that he is sure of winning as many medals as possibles for the country going by the determination of the lifters.


''We are happy with the feat becuase, the athlete did not only qualify for the Paralympics in London but broke an existing record and also set a new one, so with this we are optimistic of doing well at the games proper next year,'' he said.

SEVEN Nigerians and two Ghanaians were yesterday convicted and sentenced to 810 years







imprisonment by a Federal High Court sitting in Asaba, Delta State capital, over illegal dealing in petroleum products.

The nine, who were arraigned on a nine-count charge by the Economic and Financial Crimes Commission (EFCC), were arrested on Nigerian territorial waters on May 1, 2010, and arraigned on June 29 of the same year for conspiracy and illegal dealing in petroleum products.

According to EFCC's Spokesman, Femi Babafemi, the accused were sentenced to 10 years on each of the nine-count charges, making it 90 years for each person and 810 years altogether.

However, he informed that the terms would run concurrently. He added that the trial judge, Justice Ibrahim Buba, who sentenced each of the accused also ordered the forfeiture of their vessel, MT TROICA, which was used for the illegal business.

He gave the names of the two Ghanaians as Nelson Seanehia and Teko Peter while their Nigerian counterparts are Felix Ogogo, Augustine Elomofe, Yakubu Otun, Lucky Tonwei, Sunday Apoh, Segun Agbeyegbe and Felix Mogbeyiteren.

In a related development, an FCT High Court sitting in Abuja also convicted and sentenced one Emmanuel Monye to five years imprisonment on each of the three- count charge of forgery and conspiracy to steal brought against him by the EFCC.

The flood, which has submerged houses in coastal communities situated on Ikorodu Road, Lagos, has also made vehicular traffic on some portions of the ever-busy road a nightmare, reports TOLUWANI ENIOLA
RESIDENTS of riverine communities on Ikorodu road and commuters from that axis of Lagos yesterday spent several hours in traffic; no thanks to the floods from Ogun River that had almost cut them off.

Many, who could not endure the gridlock had to re-route their trips either through Ajah-Lekki or the Sagamu/Lagos-Ibadan Expressway.
The traffic elicited emotions from residents of the affected communities, which include: Owode-Onirin, Owode-Elede, Agiliti, Ajegunle, Isheri-North and other coastal communities at Mile 12.
The Nation learnt that residents of the affected communities had a sleepless night because of the fear of being wiped away by flood. Sources told this reporter that some residents in Ajegunle slept in abandoned vehicles on the roads to save their lives.
Some rose as early as 5 am to beat the anticipated traffic but were still trapped on the road.
Many commuters waded through the flooded road with trousers rolled up above their knees. The flood became a blessing for commercial motorcyclists, who got free water to wash their motorbikes.
Traffic was held up for several hours. Many could not make it to their offices as the long queues of vehicles stretched from Mile 12 to Zion Street in Ikorodu.
Officials of the Lagos State Traffic Management Agency (LASTMA) had a hectic time maintaining order as impatient drivers drove against traffic. Some vehicles parked indiscriminately on either side of the dual-carriage way were submerged in the flood.
A newspaper vendor, Mr Nurudeen Abdulsemiu, who witnessed the traffic snarl, described it as a terrible one. Abdulsemiu said: “It was very terrible. For like three hours, the roads were completely blocked. At the Odo-Ogun Bus stop, the flood took over the roads. Many motorists flouted traffic regulations. The LASTMA officials over-worked themselves to restore order.

UGHELLI—Delta State Government has awarded contracts for the renovation of 50 schools and the construction of 10 new primary schools across the three senatorial districts, as part of its effort to improve on the standard of education in the state.

State Commissioner, Directorate of Special Infrastructure, Mrs. Erezi Esievo, who spoke at a meeting with the contractors, charged them to desist from executing shoddy jobs.

She told the contractors to work according to the contract specifications, adding that government would not hesitate to sanction any contractor who defaults.

She said: “Government has issued letters of award to 23 firms with 25 per cent mobilisation funds given to 15 contractors. More will be awarded and mobilised.

“Phase one of the construction and renovation has 60 schools spread across the three senatorial districts in the state.”

Esievo said her office would monitor the level of work in each of the project sites through regular site inspection to ensure compliance with specifications. She urged the contractors to move to site without delay.

She warned that government would revoke the contract of any contractor found wanting.

The poor performance of the local government in Lagos State in the last three years may have affected Saturday’s poll as voters refused to turn out at the various polling booths monitored by Sunday Tribune.

Electorate at Surulere Local Government Area of the state attributed the low turn out to poor performance of the successive local government administrations, adding that there was no need to vote for them anymore.

According to one of the voters, Mr. Aruna Saheed, those who turned up at the polling booths had done so to show support for the state governor, Mr. Babatunde Fashola, SAN, and not the ruling Action Congress of Nigeria (ACN) or any of its chairmanship candidates.

At the polling booth, located inside the State Junior Secondary School, Eric Moore Ward, Itolo Street in Surulere where the governor cast his ballot, just a little above 40 people turned up to vote between 8.00 a.m. and 12.00 p.m., out of the 870 registered voters.

Politicians at the community were seen moving from one house to another to convince residents to come out for the exercise.

One of the politicians, who refused to mention her name, was seen ringing a bell to create awareness for residents about the ongoing election.

A resident, Mr. Kolapo Rasaki, told Sunday Tribune that he refused to vote because he did not know any of the chairmanship candidates.

Rasaki, who was playing football when our correspondent met him, said he did not know any of the candidates for the elective posts.

“I don’t know these people. We only know Fashola. The governor is the only one that is working in this state. I don’t know the incumbent chairman. I don’t know the new candidate. So, why should I vote for someone that I don’t know?”

It was observed that the major streets in Lagos were turned to football pitches as residents spent the free period to engage themselves in sporting activities.

Reacting to questions, shortly after he cast his ballot, the state governor, Fashola, described the exercise as peaceful, based on the feelers he received from other quarters. He said the state would not hesitate to punish anybody arrested for electoral offences, irrespective of their party.

“We have planned for the worst; we are looking for the best. We will prosecute electoral offenders to make a statement that elections such as this are important to us.

“So far, from the reports that we have, the election has been peaceful. We expected it. We planned for it,” he said.

Despite the low turnout, the governor said the poll was given high attention, adding that “I was not surprised at the high level of attention the election had attracted. Lagos is a global city. The attention is expected because Lagos is the heartbeat of Nigeria. This election is a small election of Nigeria.”

Meanwhile, Former Lagos State governor, Senator Bola Tinubu, caused a drama at yesterday's local government election when he arrived at his polling area in Ikeja without a voter card.

Tinubu, who arrived the venue of the polling centre in the morning, caused a stir when he bluntly told electoral officers conducting the exercise that he was not with his voter card and that the officials should allow him to vote.

“Well, my people, I have forgotten my voter card at home, hope you can recognise me. I am Ashiwaju Ahmed Bola Tinubu, the national leader of the Action Congress of Nigeria (ACN),” he said.

OWERRI – A 57-year-old man, Mr. Richard Nsofor, from Abba autonomous community, Nwangele local government area of Imo State, has been arrested for allegedly defiling a four-year-old girl.

Confirming the incident to journalists, the girl’s father, Mr. Chinedu Anele, gave a graphic account of how his daughter reported the “sharp pain in her private part”, adding that he quickly took her to a hospital where the doctor confirmed the rape.

The town union Chairman, Mr. Ifeanyi Ebosie, equally confirmed the incident, adding that the girl’s father produced a medical report to buttress the case of rape against Nsofor, who heads the vigilante group in the community.

He said: “We had no other option, especially when the accused person could not prove his innocence, than to quickly report the matter to the traditional ruler.”

It was also gathered that when the matter was reported to the traditional ruler, Justice G.G.I. Orjiako (rtd), he advised the villagers to handover Mr. Nsofor to the police for proper investigation.

Meanwhile, Vanguard gathered that the accused person was taken to the magistrate court at Abba but the case could not go on because of the absence of the magistrate.

LAGOS — Desperate Libyan dictator Muammar Gaddafi begged for his life by offering gold and money before he was killed, a witness has revealed.

Hammad Mufti Ali, 28, has told how the former leader frantically offered his captors riches beyond their wildest dreams after he was dragged from his sewer hideaway.

The details emerged as mystery still surrounded the final moments of Col. Gaddafi’s life and as his body remained unburied amid calls for an investigation into his death.

Ali, the commander of a brigade in Sirte, told Italian newspaper Corriere Della Sera: “He was pulled from the drain and he was pushed around.

“He said he was willing to offer anything in exchange for his life – he said he had money and gold for us if we spared his life.

“He was losing a lot of blood – he was 69 years old and his body could not take it. He was in a bad way. He had had wounds everywhere from shrapnel and from being beaten.”
