Britain has hit its cap on visas for skilled non-European workers for an unprecedented third month in a row, deepening the staffing crisis facing the NHS and other key employers.
When the monthly quota was reached in December and January for the first time in seven years immigration lawyers had expected it would prove to be a blip, but they now fear it is turning into a long-term problem.
More than a third of the tier-2 work visas issued by the Home Office go to medical and other staff recruited to work in the NHS. Migration experts expect that among the first group to be turned away will be doctors and other healthcare staff, software developers and scientists.
The next set of quarterly immigration figures will be published on Thursday. They are expected to show increasing evidence of a “Brexodus” over the past year, with an accelerating decline in the numbers of EU nationals coming to work in Britain while increasing numbers return home.
The Home Office sent out hundreds of emails to UK employers and businesses last week telling them that their applications for the certificates of sponsorship required to recruit mostly highly skilled workers from outside the EU had been refused because they did not meet the minimum points score set for the February quota.
The cap on skilled worker numbers operates on an annual quota of 20,700 with a fixed number of spaces available each month. Until last December the monthly quota had only been exceeded in one month since the cap was introduced by Theresa May as home secretary in 2011.
The Home Office confirmed that the minimum salary for a job to qualify for a skilled work visa was normally £30,000, or £20,800 for a graduate recruit. However, in December it was set at £55,000 and in January tier-2 visa applications for jobs paying less than £46,000 a year were refused unless they were PhD-level roles or were for jobs on the official shortage occupation lists.
The points-based immigration system prioritises applicants according to their advertised salary, with the minimum annual pay changing according to the number of applicants above the quota and their points rating. This hits the NHS particularly hard.
Nichola Carter, an immigration specialist at Carter Thomas solicitors, said: “From the information I’m receiving it is starting to look like the threshold for rejection in February could be around the £50k mark. Initially it was thought that December and January were just blips. Now it’s starting to feel like this could be a long-term issue.”
She said employers were increasingly seeking to sponsor skilled workers because they needed certainty in their recruitment plans.
“The government has to step in now and either change the points or the criteria or create exemptions. Calls for NHS workers to be removed have already been made.”
Carter added that she had seen two applications refused for clients last week: a software developer and a designer for a bespoke luxury goods manufacturer.
All jobs offered to skilled workers from outside the EU that are not on the official shortage occupation lists have to be advertised in Britain first for a set period unless the salary will be at least £159,600.
“I know of employers who are now willing to pay £65,000 for a job they were previously offering a salary of £35,000 for just to make sure they get a visa in the next round of allocations,” Carter added.
The immigration law firm Fragomen confirmed that the cap had been reached for the third time. “Since the quota has been exceeded three times consecutively it is highly likely to be exceeded again next month due to the volume of reapplications. Applicants can reapply next month provided the job advertisement is still valid. There is no right of appeal following refusal.”
Danny Mortimer, the chief executive of NHS Employers, has pressed the Home Office to exempt medical staff from the quota, saying NHS organisations were “increasingly concerned at their inability to obtain permits for essential medical colleagues”.
More than a third of tier-2 work visas issued by the Home Office go to medical and other staff recruited by the NHS. A Home Office spokesperson said: “It is important that our immigration system works in the national interest, ensuring that employers look first to the UK resident labour market before recruiting from overseas.
“The tier 2 visa route is intended to fill gaps in the labour market. When demand exceeds the month’s allocation of tier 2 (general) visas, priority is given to applicants filling a shortage or PhD-level occupations.
“The published shortage lists include a range of medical professionals, including consultants specialising in clinical radiology and emergency medicine, and we estimate that around a third of all tier 2 places go to the NHS.

I have been sorely depressed since I found out but am even thankful that I can still hustle the money for re application.
There is apparently even expedited which takes 5 days. Costs 180 pounds though per applicant. And we are 3.. Not a lot but considering how much that has already been wasted... Wish you the best of luck. |

Why they didn't let me know early enough baffles me...it's almost like they waited for the 3 months to elapse before informing me...makes no sense... Yeah I remember you, you had a work trip and was asking how you’d get your passport back. Take heart iye, you and Lola have gone through a lot, I would have been crying by now. On the brighter side, you guys just have to wait 15days then join hubby and then you would work 2-3 months and get the wasted money back. Sorry o! It is not easy at all. |

Guys, I need your help. I have been a bit worried about my trip date.
So I started filling my form in Oct 2017 where I picked my trip date as Feb 12 2018, but some work trip made me submit in Dec 5 2017 and I totally forgot to change that trip date to accommodate 3 months (I have a refused visa from another country so I didn’t apply for priority).
Now today is 12 Feb; Will this cause any problem for me? |

As per your first question, You will get a mail of how to arrange your documents when you submit your application but this is how I arranged mine. 1. Basic Information a) cover letter and applicant’s cover letter b) Visa Application form & copy of applicant’s passport c) Appendix 2 d) Applicant’s English language evidence (Master’s degree from UK university) e) Sponsor’s British passport (copy) f) Applicant’s birth certificate/declaration of age g) Applicant’s first degree certificate and Business Analysis Certification h) Applicant’s IHS payment confirmation i) Tuberculosis Test Certificate 2. Proof of Relationship a) Registrar Marriage Certificate b) Copy of Newspaper publication of Applicant’s change of Name c) Evidence of communication (Instagram, WhatsApp, Facebook, WhatsApp Calls) d) Photographs of Civil ceremony, pre-wedding and random photos e) Flight tickets to Nigeria. f) Hotel Booking in Hilton Manchester Deansgate Hotel 3. For your second question, pins are not allowed (I think), so I cut strips of papers and banded the documents for each alphabet, then I put all alphabets in their respective envelopes (i.e. a-i for number 1, were all put in an envelope marked 1). I have mild OCD, so you can just stack yours  For your last question, you don't need any copies (unless you want the original doument returned to you- so, only attach two copies of birth certs, marriage certs, and whatever else may be important to you). You also don't need to go with these docs to TLS, just go with your passport, appointment confirmation print out and your application form. All docs should be sent to your wife who will send to sheffield. |

Oh! i forgot to mention Council TAX Bill that alone drives me nut lol. But well we have to keep going. Its best you starting thinking of things you can on E-bay for extra income Or look round your community see what you do to make extra income that wont involve you going against the law that's if you have entrepreneurial spirit. Having multiple streams of income one is what fits uk life.That's what i did . I know about the council tax  I was lucky to have dodged it for a few months in the UK (as a student), its ridiculous but that's what they use to maintain the community so I don't complain much, besides Cheshire isn't so expensive. No I am not in the UK yet, I am hopeful that my spouse visa is a success cos we are planning the white wedding there, hence my needing my family over. But like you said, I have to lock up and save it  . As for handwork, my dear, God did not bless me like that o, my sister was applauding me the other day for sewing the strap of my singlet back  , but I will try my hands on the ebay stuff. Thank you |

sheke01: How long depends on your school and how seriously you follow them up. I started my WES evaluation last September. My school delayed and sent my transcript in October and WES sent it back to them for verification that same month. My school then went cold on the matter as Non academic staff went from one strike to another which is still ongoing. I had already given up on the whole stuff and applied to schools that did not request for WES evaluation only for WES to send me a mail yesterday that they have received the necessary documents needed and my evaluation would be completed by friday. I dull shai, so ur case could be a whole lot faster is you follow up your school bumper to bumper What Uni is this? I know that UniBen is on strike. I have been trying to get information on how to get a transcript from the dead school. So if UniBen is your school, please can you fill me in on how you got your transcript even though the strike is not over? |

UKmigrant: This is just a provisional licence. You do not need any driving test to get it. But you need this to start learning driving and to take the driving tests. If you're successful in the tests, you get a full licence. Alright, i get. thank you. |

I had to post my residence permit card to the driving licence authority to apply for it. Took about a week. 10 years! impressive! Did you have to go to driving school again, take the driving test or did you just show them your Nigerian driver's license? |

I am mentioning you because you are someone I respect a lot on nairaland and I have seen your contribution. Yes, Twoods is rude, but No, he is rude for good reason. We lack research culture in Nigeria and its very bad. some people prefer to just ask questions and not make any move on their own to get information- its such a disgusting habit. During my master's, I helped a friend who was doing his master's in Nigeria out with some of his assignments until he asked me to do his dissertation- I ended the friendship there!
Now if you look and the pages between 89 and this one, you will see a set of humans posting their cgpas and asking if they can study in America, however, if only they can go a few pages backwards, they would see the answers they need. I was also a newbie on some pages but I never posted questions until i read from page 0 to the recent page so that I dont miss anything. It is easy to bash TWoods for being rude, but imagine answering the same questions over and over again, even you would snap or ignore (like I do).
Now, to prove the lack of research culture I talked about, someone came and posted a list of 10 schools they found and asked to know if they can get the following from the schools.. 1. Assistantship 2. Low Tuition fee 3. Normal living cost 4 Chances of admission
Neither you nor the people that have been bashing Twoods have responded to this person, because it is outrageous to ask us to do your own homework. I know that Twoods has asked people to mail the grad coordinators of their courses to get such info, some other people have also added that people don't know about funding in a school other than the grad coord, why then would someone expect me to sit by my PC and help them do this kind of work? I mean, how on earth do you want a master's degree in a developed country if you cannot find information yourself, or if you do not have the common sense and patience to read from the beginning of the thread, truly (like someone said) not everyone here is a graduate!
The end point of this is that even if Twoods or whoever is scolding newbies, since you have a big heart, answer the newbies. After three repeated responses, i'm sure you will give up! |

Provided you did not submit any fraudulent document to attract a ban, you can re-apply every month if you like, however, we advise that you address the reason you were refused (read back). Now this is not what you asked for but I’ll tell you anyway, if you intend to study in the UK because you truly want to study and then return to Nigeria to impact your community (by being jobless- just joking!), I wish you success in your application(s). If, however, you are doing so as a means to migrate, my dear, better look for another country because no matter how good you are, it’s easier to find a needle in an ocean that to find a company to sponsor and retain you in the UK. Pick another country. The US, Canada, Ireland, France.. and if you’re an ace student Aus. Cheers |

Thanks When you book your appointment, you pick that you want a priority service. Also you will be asked to create a TLS account, When you do this, you can include priority service to your profile and pay for this at the TLS centre during your interview. You cannot have your visa within 10 days. Priority takes 6-10 weeks (this is me assuming that you are applying for a spouse visa). Include your child in your application. You will see the option on the homepage, after logging into visa4uk.fco.gov.uk look up and you will see “apply for myself”, “apply for someone else”, “view my applications”. Click on the second option. |

It’s the new year, hence I’m getting really close to applying again. So house I have a question as I keep gathering supporting documents. My question is, one month out of the past 6 months we want to use to apply for my application, my wife was sick and spent like 10 days in the hospital... as a result she wasn’t paid for those 10 days so her payslip for that particular month wasn’t the same as the rest of the months. For that particular month, she was short of a few 100 pounds... However, her annual salary still exceeds £18600 required. Please can someone tell me if this payslip can affect my application in any way because I understand that the HO wants to see that your monthly salary when calculated with their figures meets the required 18600. Please gurus in the house, over to you. Thanks I think if she makes 1550 per month she shouldn’t worry if she got paid 100 less what she normally collects unless what she made for last month was 1450- that is when there might be trouble. Alternatively if she is able to make 9300 in 6 months then that should be fine, regardless of what she got paid less of. Another thing to consider is what her company will agree to write in their letter as her annual salary. If they write they her annual salary is 18600, I am not sure it would matter what she gets paid per month. With what I know the payslips are for confirmation of her payments not just to check how much goes into her account. The gurus will give a more definite answer. |

Unless the person is meeting you at the waiting lounge in the airport, you cannot leave the airport (well no country will allow you to with your Nigerian passport). Apply for an Ethiopian visa. Your inviter will need to speak to the ministry of defence to get you a visa permit which you will take to the embassy in Nigeria alongside your passport for your passport to get stamped. That’s the much I know sha. |
