Working with the president..expressing his willingness to work with the presidency or whatever you are saying...have nothing to do with the National Assembly being the rubberstamp of the executives...you cannot in a sane and civilize institution and threaten a whole independent body like the National Assembly to vote for a particular candidate because of party affiliation...The Senator after elected represents the interest of his/her state and try as much as possible to align those interest with the objectives of his party but whenever there is conflict between the two...the interest of the state is supreme....So Tinubu and oshiomhole coming out with a threat to a senator of the federal republic of Nigeria is absurd and total disregard of the functionality and the integrity of both the Senator and what his office stand for...if APC should continue like this...they are a venom and will degenerate the entire polity.

What some people are failing to understand is that everyone whether APC or PDP wants to get favoured by the Presidency, which is why most of them will vote for the Candidature of Lawan, so as to be in the good books and hold a bargain chip. The Newly elected governor of Zamfara choose to recognise with the President first before even the National leadership of his party. He can't just leave the State House without having been adviced by the President Aides to ensure his Senators vote for the party's candidates in the National Assembly. I am from Benue, and all 3 Senators are from PDP, but I can tell you that all 3 senators will vote for Lawan. After the General Elections, one of the Senators openly expressed his willingness of working with the President, people where hoping he will start condemning the President, the guy simply said he likes the man, and his constituency comprises of both PDP and APC so he has to careful in handling certain matters, and he is the influential amongst them. With the Backing of the President and APC NWC, I say Lawan still holds the Ace.

The reason why I respect Tinubu, the Man knows when to sacrifice his ambition and ego for the greater good. some of the candidates that won elections in the South Western states where not people he himself preferred, but still rather than allow his party lose because of his own desires, he simply let things be. That's no victory, sit and watch how event unfold. trial will be on facts of the case.

Case closed, PDP should find another excuse. She even recused herself voluntarily, the other judges on the panel dismissed the petition. If she had any hidden agenda, she would have stayed on the trial since the petition was dismissed. PDP are just holding on to straws.

PDP keep on showing their ignorance and desperation day in day out. The Appeal Court panel comprises of 5 justices, including the President of the Court of Appeal. She might not even get to deliver her own judgement in the case. once a majority verdict has been made, her influence is no longer there. only when there is a tie, that is when her judgement will be heard, a possibility that is Highly unusual.

EXCLUSIVE: NJC Recommends Onnoghen For Retirement

The National Judicial Commission (NJC) has recommended Walter Onnoghen, chief justice of Nigeria (CJN), for compulsory retirement, TheCable understands.

After deliberating on the petition filed against him by the Economic and Financial Crimes Commission (EFCC) on Wednesday, members of the NJC unanimously agreed that Onnoghen has lost the moral authority to continue as CJN with the litany of allegations bordering on misconduct.

The NJC — which handles disciplinary issues of judicial officers — sat under the interim leadership of Umaru Abdullahi, former president of the court of appeal, who had to act because Onnoghen was already under suspension.

The council also concluded that Tanko Muhammad did not commit any offence by making himself available to be sworn in as acting CJN without the recommendation of the NJC.

These recommendations have been passed to President Muhammadu Buhari for approval, Soji Oye, the council’s director of information, informed the media on Wednesday, although he did not make the details public.

WHAT NEXT NOW?

TheCable can report, however, that the president still has to seek the approval of the senate for Onnoghen to be retired if he wants to follow the CJN route.

This will require two-thirds majority of the upper legislative chamber.

Section 292 (1) of the 1999 constitution says a “judicial officer shall not be removed from his office or appointment before his age of retirement except in the following circumstances – (a) in the case of – (i) Chief Justice of Nigeria… by the President acting on an address supported by two-thirds majority of the Senate.”

Onnoghen is also undergoing trial at the Code of Conduct Tribunal (CCT) over allegations of false asset declaration — and if found guilty, he could be removed.

ROAD TO RETIREMENT

Buhari suspended Onnoghen on January 25, 2019 following an order made by the CCT.

TheCable had reported how the Anti-Corruption and Research Based Data Initiative (ARDI), a civil society group, launched the legal move to remove Onnoghen.

The group had filed a petition against him at the Code of Conduct Bureau (CCB) over alleged false declaration of assets.

The CCB is empowered by the constitution to investigate public officers, after which it would forward its findings to the appropriate body for trial if the allegations are confirmed.

It had listed a number of allegations against Onnoghen — notably false declaration of assets.

The President does not need the Approval of the Senate to remove Him if the recommendation is from the NJC. He only needs it when he is doing so without any Approval from the NJC. read section 292(1)(b)

The difference in terms of numbers between APC nd PDP in the Senate this time around is wideder. Mr Goje who PDP were creaming his name has already declared his support for Lawan, Same as APC cocus in the current 8th senate.
