Honestly, with the incessant refusal of study permit applications since the beginning of this year, i'm beginning to feel it is deliberate. There have been good applications refused for erroneous reasons even after meeting all requirements of a study permit. I have seen GCMS file contradicting the generic reasons on the refusal letter. At this rate, one begins to wonder if they truly and carefully review applications based on it's merit or based on the general situation of Nigerian applicants. I have lived and studied outside Nigeria and likewise applied for visas outside Nigeria and saw how the process was expedient and smooth even for me a Nigerian coming from a 'High risk' country. The case was not the same when i applied for my study permit from Nigeria. It is becoming tougher as the day goes by. While it's really unfortunate this development has seen untold emotional trauma both from the long processing time and the refusal in itself, I want to encourage those of us who have seen their application refused for one reason to the other to stay strong, keep pushing, do NOT show desperation in any form in your application, re-strategize, be consistent in your information and documents and simply trust God in this process. It's mentally derailing and can make one make a decision that he/she may not be proud of in the long run. If your desire is to truly study and better your life in Canada, stay the course, do not be discouraged. One thing i have learnt from challenging times is that it makes you stronger, more patient with yourself, the process and equip you to even face the other challenges that will present themselves when we eventually get the study permit and strive in our endeavours in Canada. bronze25:I'm not a boss o. No, it will not raise a red flag. Once the funds is in your name, no worries. It shows you have access to the available funds which is the main thing. Also, you may wish to use a letter of explanation to state that so so amount of money was given to you by a family member in support of your education. The person doesn't need to be a co-sponsor as long as the main sponsor can stand in well in financial strength even beyond the first year. You can just add evidence in the transfer reciept. |

Cdynmar:Anybody can sponsor you. They only simply need to state why they decided to do so and show a convincing commitment to their claims. Affidavit of support, etc and since your application was refused for insufficient funds, it will be advisable you pay your full tuition. The co-sponsor(uncle) should state how much he is/will be willing to support you with. It should be a reasonable and realistic amount considering his other obligation and family responsibilities. Like i initially mentioned, the whole point is to ensure the applicant will have the required funds for study. The burden now will be on the applicant/sponsor to outrightly show this. In a recent case i know, an applicant transfered his entire funds(tuition+living expenses) to his student account after his previous application was refused for all 3 reasons. His reapplication was eventually approved. However, doing this is always at the applicant's risk. |

Cdynmar:Yea true. The first box is not related to funds sufficiency. Your best chance will be to have your mum pay your full tuition and either transfer funds for your living expenses for the first year to you or leave it in her account. Sometimes, the issue of insufficient funds cut across different factors. 1. Insufficient proof of relationship to sponsor. 2. Lump sum deposit of funds were seen in the account that was unexplained or did not show average income of sponsor. 3. Source of income/funds was not evidenced. Using your mum as a sponsor puts you in pretty much good chance as to credibility to funds availability during your study. However, this does not entirely mean that if any trace of uncleared funds is seen in the account statement or financial document submitted it will be overlooked. A Visa officer main prerogative is to make sure fund is accessible by the applicant irrespective of who the sponsor is. The more you show you have direct access to funds, the better chance you have. Notwithstanding, ensure you order for your immigration file AKA GCMS file note. It will help you know the exact reason inferred by the visa Officer. |

You can either reapply or seek a judicial review in the federal court(which is highly unlikely you will win unless your case has merits and saw errors from the VO). ceceliaa34:@mcobex has simplified everything with your case. To the bold, Your living expenses fund of a minimum of 10,000CAD MUST be in the account before you apply. This is the requirement. Secondly, if your sponsor will be using a business account, he/she will have to have to explain why funds to run a business will be used for your education. Even if he is the sole signatory, he/she still have to show how the business will run when these funds will be removed from the business account. Best way to go around this is in addition to your paid tuition, funds for living expenses should be transferred to you or if possible, the entire funds for your study. 2 Likes |

Frankrobbn1:Most people have spoken well in your case and i just want to add one or two things. Undergraduate sponsorship would usually require very high financial commitment and the onus is always on the applicant to ensure this is translated well to the VO. 1. Like others have mentioned, sponsor will have to commit financially atleast for your first year expenses and tuition. 2. 3rd party sponsorship will show that aside you, other financial needs will be met(family). 3. Explain convincingly why he/she is sponsoring you and why he/she decided to expend such funds for a 4 year program plus the ESL program in Canada and not Nigeria since it will be cheaper and economical for a 3rd party who didn't bare you. So aside all the financial strength displayed, the sponsor and you must show that all the financial obligation will be met with ease and without strain to other obligation of sponsor. OmalichaUC:Any officer can review a reapplication including the visa officer who initially denied previous application. Actually, in a reapplication, it is usually must likely the reviewing officer would first see the conclusion of the previous application through the GCMS/CAIP database to ascertain if the reapplication have addressed the concerns as well as meeting the requirement of a study permit. So even if a different officer reviews a reapplication, he/she will still see the conclusion of the previous officer which will in turn inform areas to look out while carefully reviewing the reapplication. |

Well, on the contrary, the federal court in Canada have on cases successfully ruled that a refused application be re-opened and a different visa officer reviews the application. This most times happen when there was an error in fact(s) and judgement, the visa officer overlooked certain documents presented at the time of application or a wrong application of the provisions of the IRCC act in reaching the final decision. Visa officers DO NOT completely review application on discretions. They are guided by the law and the provisions of the act. Since they are humans, they may make errors which may result in a refusal. The judicial process in federal court in Canada often times address these errors but only on merit of the application. So in most cases, it is very difficult to overturn a visa officer's decision in Federal Court with the judicial review process, mainly because this process is a 'judicial review' process, and not an 'appeal'. Even if the judge disagrees with the decision of the visa officer, that is not enough to overturn the decision. There needs to be more than disagreeing with the outcome based on the merits. Based on what I have read about the federal court cases, there have to be more than disagreeing with the outcome based on the merits and some cases are reopened and reviewed by a different officer but the risk is that the new officer can refuse same application for an entirely different reason. Conclusively, officers don't apply total discretion in their review. The requirements of a temporary resident visa provides that certain things be established and home ties is one of such. Discretion may apply in what holds strong in the applicant's profile in this regard. 2 Likes |

jnyuwa02:I quite agree with you largely on your points, this issue of hometie is HIGHLY discretionary. I always encourage people to work around what the have at the time of application. There is no rule of thumb to home-ties. Officers deduce these things from an overview of the applicant's case, situation and circumstance. Get documents and evidence to show you are established at home. Establishing that one has close home ties for the duration of any category of temporary resident visa which includes the study permit can be from a variety of thing.(social, family, assets, employment, etc). It is just standard for the VO to make sure it is evidenced in one way or the other before a study permit is approved because it is part of the provisions of their requirements for a temporary resident visa. More and more perfectly good visa applications run into difficulties due to a failure to outline strong enough home ties. Therefore, each individual should make every effort to submit as much information as possible to establish that you do indeed have these ties. Add documents in simplicity that will firstly portray you as a genuine study(Purpose of visit) which to me is the MOST important thing, established your financial capability and show you are established at home in any of the form highlighted above. |

BRANDYAK:I'm no way near a guru but i will try to answer your question. IRCC requirement is that applicants have their tuition + a minimum of 10,000 for living expenses for a year. This evidence can be in a one time fund availability. i.e Loan proof, funds in convertible currency, scholarships, grant etc. Showing 6 months bank statement should be dependent on what your claim and if you intend to prove that you can generate funds for subsequent year(s) of program. If you already showed that you have funds for your entire program in other form, then the 6 months statement may not be necessary except you just want to show you earn money. 1 Like |

khasm:Na wa o bros, this your analysis though! Well, Purpose of visit is exactly what it is 'your purpose of going to Canada and Circumstance(s) surrounding that singular definition and intention'. As you may also know, the refusal letter has other reasons of not satisfying an officer and each will serve the purpose it was ticked(although, IRCC have been ticking anyhow these days) So to a very large extent, purpose of visit always surrounds intended program, prior event leading to that choice, the advantages of it, how it will highlight convincingly a claim of studying and returning back home, the viability of the propose program as well as the surrounding circumstances to ensure that primary intent of study will be met. More of why you are going to Canada and events that will surround your study in Canada. Officer's note regarding a refusal on purpose of visit will most likely have lines of " not a genuine student who intend to complete study and depart, proposed program not logical with previous education or employment etc" So the points you raised will largely fall under 'home ties' 'personal asset' and financial situations. They are provisions to raise concerns in these light. Like most people have already mentioned, the GCMS note will throw more light to the refusal. My only concern is that some GCMS file i have seen lately have been erroneous and also misleading. I just hope in this case, it highlight the exact reasons for the refusal. 4 Likes |
